DARYN KAGAN, CNN ANCHOR: We want to bring you up to date on a development out of the Supreme Court: A defeat for Oklahoma City bombing conspirator Terry Nichols, the Supreme Court has turned down his appeal. He is arguing that these pending state murder charges against him in state of Oklahoma violate his right of being tried twice for the same crime.

Nichols has already been convicted under federal law, in 1997. He still faces 160 counts of first-degree murder in state of Oklahoma. Under the federal charges, he is serving a life sentence, but under the Oklahoma state charges, he could get the death penalty.

So it looks like that trial is going to go ahead in the state of Oklahoma.
