Robert Blake Goes Back to Court Today

LEON HARRIS, CNN ANCHOR: Actor Robert Blake goes back to court today, trying to get released on bail. He's been in jail nearly six months now. He's accused of killing his wife, as you probably know by now. The bail hearing was set for today, after his lawyer took the matter all the way to the California Supreme Court.
CNN's Charles Feldman checks in from Van Nuys, California. He's got a preview of the day's activities ahead.

Good morning, Charles.

CHARLES FELDMAN, CNN CORRESPONDENT: Good morning, Leon.

Now, you know, Robert Blake's favorite -- not attorney, his favorite restaurant is in studio city. It's an Italian place. He used to eat there three or four times a week. His attorney, if he has his way at this bail hearing, if he gets his way in this bail hearing, which gets under way in about 25 minutes, if he has his way, Blake will be able to go back to the restaurant as early as tonight and dine on some nice pasta, maybe some thin sliced veal or a glass of wine.

But prosecutors, on the other hand, they think the food at the men's detention center is good enough for Robert Blake, and they think he should silt right where he is until the trial, and the trial is not going to happen until sometime in the summer of 2003.

Now as you pointed out, Leon, this issue about whether he should or shouldn't get bail has been going on for quite some time now. It all hinges on a technicality, if you will, on California law. He was charged with murder with special circumstances. It's very technical, but because of that, the district attorney says he does not qualify for bail.

Well, his defense attorney says that's not true, that he's not a flight risk, that there's no reason why he can't be out. His co- defendant, after all, in this case, has been out on bail, bail, by the way, posted to the tune of a million bucks by Robert Blake, so he's making the argument that there's no reason why until that trial Robert Blake can't be a free man.

But I should point out prosecutors have said in court that there's some evidence that at one point in time, Blake was thinking about going over to Mexico and maybe thinking about not coming back from Mexico, so they think that he is very much a flight risk, and they do not want him out -- Leon.
