DARYN KAGAN, CNN ANCHOR: In the Robert Blake case, apparently, the question is, to depose or not to depose the actor who remains behind bars.
Our Charles Feldman is standing by with more on that.

Good morning.

CHARLES FELDMAN, CNN CORRESPONDENT: Good morning.

To depose or not to depose, hey, well, that's the question, and it appears as if it may not happen.

I have with me here Eric Dubin, who is the attorney representing the children of Bonny Lee Bakley. Let me ask you something, Eric.

Today, you were planning, you said, to depose Robert Blake in your wrongful death civil suit. Late yesterday, attorneys representing Robert Blake said to the sheriff's department that you didn't follow proper procedure, that there wasn't arrangements made, and that it was not going to take place. This morning, they said they asked Mr. Blake and he doesn't want to take part in this today.

Who's playing games here?

ERIC DUBIN, ATTORNEY: I understand why Mr. Blake really doesn't want to take part. There's no really answers for my hard questions. Everything was set up through the sheriff's office. I have verbal and written confirmation through Blake's attorneys that he was showing up today.

FELDMAN: Will you provide that to us?

DUBIN: Absolutely, I'm surprised to hear this through the media that they're not coming. They had until last Friday to serve objections if they wanted to, they never did, and these depositions are all the Blake's team's ideas. They're taking depositions tomorrow on the case. I'm a little confused myself.

FELDMAN: If he comes and refused to talk, what happens, what do you do?

DUBIN: Well, I go to court immediately and tell the judge, he refused to show up, I'll take a certificate of nonappearance, and we'll be back in a few weeks.

FELDMAN: A lot of people have asked me, and I'll ask you, what is the point of having a deposition in a civil case, even before the criminal trial has taken place? Nobody knows if Mr. Blake is going to be found guilty or not by a jury. Why not wait until after that's all over.

DUBIN: Well, Charles, that's a great question, and we wanted to wait till it was all over. As far as the children that I represent, we wanted to let the criminal process play out, and then do the civil afterwards. It was his attorneys that demanded depositions go forward, such as tomorrow and Christian Brando (ph) for Thursday.

FELDMAN: All right, are you a betting man?

DUBIN: Yes, I am.

FELDMAN: All right, take a bet, is he going to show today, and is he going to sit for a deposition, yes or no?

DUBIN: From what you are telling me, no, but he has an obligation under the law and under the code to be here today. If he doesn't show up, he's in violation. Everything I've done, it's fully proper, there's been no objections to what I've done, and this is all media.

FELDMAN: Thank you very much, so we'll hang out here, and let you know what happens -- Daryn.
