ANDY SERWER, "FORTUNE" MAGAZINE: Dennis Kozlowski in the news again, the ex-CEO of Tyco. I just can't believe this story. I mean, this blows my mind, Paula.
Yesterday, a judge allowed this guy -- now let's remember, he's been charged with looting his company of hundreds of millions dollars.

PAULA ZAHN, CNN ANCHOR: Right.

SERWER: Yesterday, a judge said that he is allowed to go on vacation to a luxury resort in Colorado for almost a month. The Christmas holidays in Colorado for Dennis Kozlowski. Beaver Creek, outside of Vail, I think we have some pictures of this resort. There. Oh yes.

ZAHN: Nice.

SERWER: This is just about five miles from Vail. It's unbelievable. Listen to this, suppose that Andy Fastow and Sam Waksal want to go to the French Riviera, or what about Malvo and Muhammad want to go to Maui? I mean, what is this with letting people who are charged with crimes go on vacations like this?

ZAHN: How can he afford this vacation is the question I have.

SERWER: Well, that's another question, because he didn't have trouble getting bail, but we have a solution for him, Paula. We've discovered some coupons at Beaver Creek. We've got a two for one here. Let's see if we can pull it. We've got a two for one here at Coyote Cafe that Dennis might want to use, because of course he's so strapped for cash.

He can get a two-fer there, a lunch deal. I hear they got a nice little burrito special, probably, going down. But, you know, I really think that white collar criminals should not be treated any differently from any other kind of criminals. It's outrageous. .

ZAHN: And you were talking about all the problems in the SEC, and you just wonder what message it sends to the average investor out there.

SERWER: Not a good one.

ZAHN: All right, Andy. Thanks. Just ahead, in a lame duck session of Congress, Minnesota's Dean Barkley is the ugly duckling. Jonathan Karl follows the Senate short-timer's first day on the job. That's coming up right after the break. TO ORDER A VIDEO OF THIS TRANSCRIPT, PLEASE CALL 800-CNN-NEWS OR USE OUR SECURE ONLINE ORDER FORM LOCATED AT www.fdch.com
