Malvo Due in Court Today

CAROL LIN, CNN ANCHOR: Attorneys for the teenage sniper suspect, John Lee Malvo are headed to a Virginia courtroom in just a few hours. They're going to ask a judge for a copy of a seven-hour interrogation.
CNN's Patty Davis is in Fairfax County, Virginia always covering the case. Patty, what does this mean? What are they looking for?

PATTY DAVIS, CNN CORRESPONDENT: Well, if John Lee Malvo did, indeed, make statements here during this interrogation claiming credit, claiming that he pulled the trigger in some of these sniper murders -- in fact, defense attorneys say that they have not seen those statements, and they are going to ask a judge today to force the prosecution to turn any statements that Malvo may have made over to them so they can use them to help in the defense of Malvo.

Now CNN sources say that, indeed, Malvo claimed that he shot FBI analyst Linda Franklin outside of a Home Depot in Falls Church, Virginia on October 14. He is charged in Fairfax County with her killing. Now, Malvo also said that he pulled the trigger in some of the other shootings as well, particularly the elderly black man, Pascal Charlot in Washington, D.C.

Now, in Virginia, the defense is given a limited amount of information in its discovery process, and defense lawyers basically call it trial by ambush, and they say that they need access to that information to defend him. He, of course, here now faces the death penalty in the state of Virginia. A very important hearing now two weeks away for Malvo, as well a preliminary hearing. That is when a judge will decide whether or not Malvo will be tried as an adult. No trial date yet set for Malvo, but there is one set for his alleged accomplice, in the sniper shootings, and that is John Muhammad. His trial date set for October. That would be a year after the sniper killings, the sniper shootings here in the Washington, D.C. area terrorized most of the residents here -- Carol.
