D.C. Sniper To Appear In Court Today

CAROL COSTELLO, CNN ANCHOR: Later today, John Lee Malvo is set to appear at the Fairfax County, Virginia courthouse. Malvo was the 17-year-old suspect in last year's D.C. sniper case.
Our Patty Davis is in Fairfax for a preview of what we can expect.

And this will be the first time that prosecutors sort of show their hand.

PATTY DAVIS, CNN CORRESPONDENT: Absolutely. That hearing gets under way, his preliminary hearing, at about 1:30 this afternoon. And what prosecutors must show here to the judge is probable cause. Is there reason to believe that 17-year-old John Lee Malvo was involved in the killing of Linda Franklin? That was the FBI analyst who was slain three months ago today outside of this Home Depot in Falls Church, Virginia.

Now, Malvo is charged here in Fairfax County with Franklin's murder, and he could face the death penalty.

Here is what his court-appointed guardian had to say about Malvo's state of mind:

TODD PETIT, MALVO GUARDIAN: It's as good as you can expect. He knows that the attorney general of the United States, that the attorney general of Virginia and that all of the Commonwealth attorneys in this area brought him to Fairfax to try him and to try to execute him. So, I think we can all imagine what he must be feeling and how he must be feeling.

So, I'm not going to say he's in good spirits, but to say he's suicidal, I'm not going to comment on that either. But let's just say he knows what he's facing. He realizes the battle that's ahead of him, and he's feeling what I would deem appropriate.

DAVIS: The judge here today also will decide if John Lee Malvo should be tried as an adult.

Now, as you said, Carol, we expect the most evidence yet that prosecutors will be presenting in open court so far. They're expected to call some 20 witnesses, but they're putting it out there, as I said earlier, to try to get a judgment of probable cause and move this into adult court -- Carol.
