Malvo in Court Today

LEON HARRIS, CNN ANCHOR: Well, prosecutors in Virginia will present a glimpse of their case today against teen sniper suspect John Lee Malvo. The hearing will determine whether the 17-year-old can be tried as an adult for his alleged role in the multi-state killing spree a few months ago.
Our Patty Davis is covering the afternoon proceedings. She is now live with us -- hello, Patty.

PATTY DAVIS, CNN CORRESPONDENT: Hi, Leon. Well, as many as 20 prosecution witnesses and the most evidence that we have seen to date in this sniper case expected here today, in Fairfax County court today and tomorrow.

Now, prosecutors are expected to be pressing for probable cause. That is their goal. They want the judge to find that. They want that probable cause, that Malvo murdered Linda Franklin, the FBI analyst, at a Home Depot in Falls Church, Virginia, exactly three months ago today.

ROBERT HORAN JR., PROSECUTOR: Probable cause is a totally different standard than the standard of beyond a reasonable doubt. Probable cause means what it says. Is it probable a crime was committed? Is it probable, No. 2, the defendant committed it?

DAVIS: Sources tell CNN that Malvo told police here in Virginia that he did, indeed, pull the trigger. He murdered Linda Franklin, shooting her in the head, a single gunshot wound at that Home Depot in the parking lot as she loaded her bags into her car, October 14 in the evening.

Now, he also -- he also, our sources say, told police that he killed an elderly black man in Washington, D.C., and fired the shot that wounded a 13-year-old school kid in Bowie, Maryland.

Now, the judge also to decide today whether or not Malvo will be tried as an adult. Malvo turns 18 next month. He is expected here in court today wearing his green jumpsuit, his orange coat over that, and handcuffs and shackles. He's sitting most of the time next to his court-appointed guardian, talking. Sometimes his head in his hands, sometimes listening intently. But we've been impressed with the fact that he has lost a lot of weight from the beginning of these proceedings. Also, how very young he looks -- Leon. HARRIS: Yes, and that's the issue that may not work in his favor, though. Patty Davis reporting live for us this morning from Fairfax, Virginia.
