Malvo Preliminary Hearing

DARYN KAGAN, CNN ANCHOR: We move on to Virginia, where a hearing begins today that could determine whether sniper suspect John Lee Malvo will be tried as an adult. That would make him eligible for the death penalty if he's convicted.
Patty Davis is in Fairfax, Virginia, with a preview of the hearing.

Good morning.

PATTY DAVIS, CNN CORRESPONDENT: Good morning. It was exactly three months ago today that FBI analyst Linda Franklin was gunned down inside a Home Depot in Falls Church, Virginia.

Now, prosecutors today and tomorrow will be presenting evidence and putting on some 20 witnesses. They are trying to convince a judge here in Fairfax County, Virginia that there is probable cause that 17- year-old John Lee Malvo indeed is the one who murdered Linda Franklin. The judge also expected today or tomorrow to decide whether or not Malvo should be tried as an adult.

As you said, he does face the death penalty if convicted of these alleged crimes. Now, the preliminary hearing is scheduled for 1:30 this afternoon. If the judge does not find that there is probable cause, this prosecutor in Virginia can go directly to a grand jury and ask for an indictment -- Daryn.
