Court Decisions Pending on Evidence in Peterson Case

LEON HARRIS, ANCHOR: Moving on now, in California news organizations are in court this hour there and they're asking the judge to unseal search warrants in the Laci Peterson murder investigation.
And CNN's Elaine Quijano is headed into court herself. She joins us now from Modesto with the word from there. Hello, Elaine.

ELAINE QUIJANO, CNN CORRESPONDENT: Hello to you, Leon.

That hearing expected to take place in just about 20 minutes or so. The hearing itself is not expected to last very long. Now at issue here is whether or not to unseal eight search warrants that were obtained before Scott Peterson was arrested in April.

Now you'll recall that it was back in February when investigators searched the Peterson home, and they removed dozens of bags of evidence. Well, today the judge will decide whether or not those warrants involved then will be released to the public.

Another hearing, set for this Friday, will deal with a number of issues including intercepted phone conversations between Scott Peterson and one of his defense attorneys. The defense filing a motion yesterday, essentially say that it wants certain prosecutors and investigators to be removed from this case. This in response to 69 intercepted phone calls between Scott Peterson and members of his defense team.

The defense says that monitoring actually violated, in their opinion, attorney client privilege. They say the wiretaps constitute, quote, "grave prosecutorial misconduct."

Now the district attorney's office has maintained that only portions of two conversations were actually monitored. They say that this defense motion is not a surprise to them. They're expected to file their own response tomorrow.

Also expected on Friday the judge will take up the issue of whether or not to impose a gag order and whether or not to unseal the autopsy results on Laci Peterson and her unborn son, Connor.

Now as for today's hearing, neither relatives of Laci Peterson or Scott Peterson are expected in court. As I said, this is expected to be a very brief hearing. And Scott Peterson himself may not be even present in court today -- Leon.
