Peterson's Attorney Wants Prosecutors Removed

LEON HARRIS, CNN ANCHOR: Now stateside at 10 after the hour, hearings scheduled next hour in the Laci Peterson case, and much of the scrutiny will not be on husband, Scott. Rather, it's going to be on those building the murder cases against him. Now, among the variety of other issues in this court, the defense is asking that the prosecutors be thrown out of the case.
Our Elaine Quijano is standing by in Modesto, California.

Good morning -- Elaine. What's the latest with this?

ELAINE QUIJANO, CNN CORRESPONDENT: Good morning to you, Leon.

Well, we're expecting to hear about three things really this morning: wiretaps, autopsy results and a possible gag order.

Now first on those wiretaps, you remember those 69 intercepted phone calls between Scott Peterson and his defense team. Well, his lawyers are accusing the D.A.'s office of prosecutorial misconduct. They want those intercepts thrown out. They believe that some of those intercepts may have violated attorney/client privilege. And they also want the prosecutors and investigators involved to be removed from this case. Now, the D.A.'s office defends the use of those wiretaps. They say their agents acted properly and within the guidelines of the law.

Now also today, the judge will consider a prosecution motion requesting that all of the autopsy reports on both Laci Peterson and her unborn son, Connor, be made public. The prosecution essentially reversed its position late last week, when part of an autopsy report of the autopsy report on Connor Peterson was leaked to the media.

And finally, the judge will also look at whether or not to issue a gag order to all of the parties involved in this case. The judge very concerned about pretrial publicity possibly affecting Scott Peterson's ability to get a fair trial. Now, the prosecution supports a gag order, but both the defense and Amber Frey's attorney are opposed to that. Amber Frey, of course, the woman who said she had an affair with Scott Peterson. The defense says it wants a chance to correct misinformation out there. Amber Frey's attorney saying that she wants her client to have a chance to defend her reputation from attack.

All of this set to take place, this hearing scheduled to take place in about 90 minutes -- Leon.
