CAROL COSTELLO, CNN ANCHOR: OK, let's keep the Potter buzz going and head to the Nasdaq market site in New York and Carrie Lee. She has details about a lawsuit filed by Harry Potter's author against a New York City newspaper.
Which one -- Carrie?

CARRIE LEE, CNN FINANCIAL NEWS CORRESPONDENT: The "New York Daily News," Carol, a very big lawsuit, by the way. J.K. Rowling, as well as publisher Scholastic, are suing the "Daily News" for tens of millions of dollars for publishing an excerpt of this fifth novel installment ahead of the official sale date.

Now the book officially goes on sale at 12:01 on Saturday. The plot obviously wrapped in secrecy. A lot of people talking about it, but this reporter wrote an excerpt yesterday. They did kind of give people a warning, though, the article was written from a copy of the book that was being sold. And they did say that they warned readers not to -- not to read further if they wanted to have the plot revealed to them. But still, obviously, Ms. Rowling and her publisher very upset about this, Carol, and so they are suing for tens of millions of dollars.

Now the "Daily News" says that they are convinced they didn't do anything wrong journalistically or legally, that they're going to defend their actions. We'll see what happens, but tens of millions of dollars that is the level of this lawsuit.

COSTELLO: It'll be interesting to see the outcome, and of course we'll have that later whenever an outcome is decided.

Carrie Lee, thanks, you'll give us the futures in the next half hour of DAYBREAK.
