CAROL COSTELLO, CNN ANCHOR: More business buzz for you right now. Martha Stewart and her legal team are gearing up for her trial.
Let's go back to the Nasdaq market site and Carrie Lee.

Good morning -- Carrie.

CARRIE LEE, CNN FINANCIAL NEWS CORRESPONDENT: Good morning, Carol.

Now today's court date in the Stewart case is basically a pretrial status. This gives her legal team time to prepare for a trial. They're hoping for a trial date as early as later this year. Of course Ms. Stewart, along with her broker, have been charged to obstruct an FBI and an SEC investigation into her sudden sale of nearly 4,000 shares of ImClone stock in late 2001.

Now the "New York Post" is reporting that Ms. Stewart wants to get out of appearing in this pretrial meeting today because of her celebrity status. They don't want a big media frenzy. Well, the judge has denied that claim. So what they're doing instead, and this is taking place in Manhattan, they're going to erect some steel barricades to separate television crews from Ms. Stewart and her legal team. Also, dozens of U.S. marshals are expected to patrol the pavement. So nice to see those tax dollars at work in a way, but basically she was looking for a free pass to not have to show up. And the judge said you're just like everyone else, you have to show up just like everyone else in these matters. So that's the latest on this story.

COSTELLO: Yes, but she gets all that security around her protecting her from whatever.

LEE: That's right, so she'll have the media buzz, but she'll have the protection as well I guess is the upside.

COSTELLO: Yes. Quick look at the futures before you go.

LEE: Things are looking pretty good this morning. We do get a report on weekly jobless claims, new faces in the unemployment line, also an indication of regional manufacturing conditions so that should change things. But remember yesterday we had a mixed session, the Dow down a little bit on the Eastman Kodak warning for the second quarter, but the technology heavy Nasdaq held up OK. So looking so far slightly better this morning, we'll see.

COSTELLO: All right. Carrie Lee, many thanks, live from New York.
