FREDRICKA WHITFIELD, CNN ANCHOR: Well time to check on business. Microsoft has won a fresh victory over Java.
Let's get the details on the latest in the tech titans' battle from Carrie Lee at the Nasdaq market.

Hi -- Carrie.

CARRIE LEE, CNN FINANCIAL NEWS CORRESPONDENT: Hi, Fredricka.

A long running battle, I might add, but now a major victory for Microsoft. A court has overturned a ruling that would have required Microsoft to carry its rival's programming language. These tech giants have been in a battle over a long time over Java, which is a software used to create Web site applications.

The court did uphold, however, an injunction which prevents Microsoft from offering its own version of Java programming language on Windows. That's Microsoft's operating system.

Also, the appeals court upheld a ruling that Microsoft violated its distribution deal with Sun a few years back, and Microsoft does have to abide by that deal.

So that's the latest on the Microsoft front, Fredricka, and that is a stock we'll be watching today.

WHITFIELD: All right, Carrie, well let's get our quick little peak at the futures, if we could.

LEE: Yes, things look pretty mixed right now. Technology looks good. Looks like we could see a higher start. Overall, though, the market looks flat to lower.

Tech, in fact, did hold the gains yesterday, the Nasdaq up about 2 percent, the Dow did add fractionally as well.

One stock to watch this morning is going to be Nike. It was moving lower last night. They reported profits a little light of the Wall Street expectation. Looks like U.S. sales going forward may be a little disappointing as well. But so far a mixed bag, Fredricka, this Friday morning.

WHITFIELD: All right. Thanks a lot, Carrie. Well have a great weekend.

LEE: Same to you, thanks. TO ORDER A VIDEO OF THIS TRANSCRIPT, PLEASE CALL 800-CNN-NEWS OR USE OUR SECURE ONLINE ORDER FORM LOCATED AT www.fdch.com
