CAROL COSTELLO, CNN ANCHOR: It's still there. After 21 arrests, emotional protests and a court order, an Alabama judge is not obeying a federal judge's command: thou shalt remove thy monument.
To Montgomery, Alabama, now and Fredricka Whitfield.

(BEGIN VIDEOTAPE)

FREDRICKA WHITFIELD, CNN ANCHOR: Holding prayer and keeping vigil throughout the night: dozens of people in support of the granite Ten Commandments display inside this judicial building and in support of the man responsible for it, Alabama Supreme Court Chief Justice Roy Moore.

A federal court ordered the display be removed by midnight on the grounds that it's unconstitutional and a violation of the separation between church and state.

In a last-ditch effort, Justice Moore filed a request for a stay in the U.S. Supreme Court, but the higher court ruled it would not intervene for now.

Meantime, as long as Moore defies the court order, the plaintiffs in the civil lawsuit say they will file a contempt order, and a hearing would immediately follow.

Fredricka Whitfield, CNN, Montgomery, Alabama.
