Scott Peterson Preliminary Hearing Delayed

HEIDI COLLINS, CNN ANCHOR: A developing story that we are tracking now, some new information in the Laci Peterson case, that status hearing in Modesto, California, this morning.
CNN's Rusty Dornin joining us now to get us updated.

Hello to you, Rusty. What's happened?

RUSTY DORNIN, CNN CORRESPONDENT: Well, Heidi, as expected, there will be a delay in the Scott Peterson preliminary hearing. It's a delay until October 20.

This was really a case of, be careful what you wish for. The defense had been complaining for a long time that they just had not been getting enough of the discovery to go forward. But they presented in court that, on Friday, they got voluminous information, so many boxes, so many C.D.s that they couldn't possibly go through all this information in time.

Really, the deciding factor, however, was that Mark Geragos has another case of a deputy sheriff in Los Angeles, where the deputy sheriff has refused to waive time in his case. Apparently, that is going to start some time next week. And there's no way that he could appear for this preliminary hearing. And for that reason, the prosecution said, well, we can't really argue with that.

And the judge agreed to go ahead and delay until October 20. Now, as we said before, we have heard from sources that Scott Peterson is not happy about a delay in this preliminary hearing. He was asked directly by the judge and did agree to it. But, apparently, he was not happy about it. He had been urging his attorneys to go forward.

But, at this point, the preliminary hearing on October 20. There will be another status hearing like this one to make sure that both sides are ready on October 17.
