Minding Your Business: Off Again, On Again Do Not Call List

SOLEDAD O'BRIEN, CNN ANCHOR: Don't mess with do not call. That is the latest judge's opinion at the very least.

Good morning,

ANDY SERWER, "FORTUNE" MAGAZINE: Good morning, Soledad. How are you doing?

O'BRIEN: I'm well. Thank you.

SERWER: Good. So are American consumers who are not getting bothered by telemarketers. It looks like this thing is wrapping up, Soledad, although it's still a little bit confusing here. Let me see if I can straighten this out a little bit.

Yesterday, a federal appeals court ruled that the FTC does have the right to enforce this do-not-call list that we've been waiting on and then delayed upon and everything else. And it's still mired a little bit, though. And I'll explain why. And that's because it basically just stayed the decision.

Remember, Judge Nottingham in Denver ruled that it was unconstitutional. Right now, this appeals court says go ahead and enforce the list, federal government, but we still need to appeal this thing. In other words, the direct marketers are going to appeal this in court, but it is being enforced. It was being enforced anyway voluntarily, but now they're going to go ahead and do it.

Two things: So, you've got the appeal is going to go on, and the list is not yet opened up. So, we're stuck at that 50 million level. Consumers can't sign up yet, but they probably will be able to do that pretty soon.

O'BRIEN: All right, so good news for the consumers, at least in the short term.

SERWER: Yes.

O'BRIEN: Good news for the consumers who don't like to be bothered at dinnertime.

SERWER: That's right.

O'BRIEN: Andy Serwer, thank you, as always.
