Kobe Bryant Back in Court Today

CAROL COSTELLO, CNN ANCHOR: Kobe Bryant is back in court today for closed door hearings. Bryant's attorneys have called into question his very first conversation with police and the accuser's conversations with her mother.
CNN's Gary Tuchman explains why the hearing will be closed to the news media.

(BEGIN VIDEOTAPE)

GARY TUCHMAN, CNN CORRESPONDENT (voice-over): Kobe Bryant talked to sheriff's deputies for 75 minutes after he was alleged to have raped a 19-year-old woman. He did not know his every word was being recorded on audiotape.

CRAIG SILVERMAN, COLORADO ATTORNEY: The mind runs wild about what possibly Kobe Bryant said. After all, his attorneys are saying it would be very embarrassing if it was revealed to the public and it's of a highly personal nature.

TUCHMAN: As of now, what Bryant said about the events at the Lodge and Spa at Cordillera has not been disclosed and that's just the way Bryant's attorneys want it to stay.

UNIDENTIFIED MALE: Kobe Bryant, he's...

TUCHMAN: The Lakers star apparently wasn't read his rights because he hadn't yet been arrested. But under the law, there is more to it.

LARRY POZNER, COLORADO ATTORNEY: The defense will be saying to the judge that the circumstances surrounding it were illegal and unconstitutional, perhaps saying he was effectively in custody.

TUCHMAN: So this week, the judge will hear arguments about whether Bryant's statements should be allowed to be heard by a jury. Despite attempts by news media attorneys, the discussion will be held in a closed courtroom so reporters can't report what Bryant said.

Meanwhile, Judge Terry Ruckriegle hopes to complete another closed hearing about whether the alleged victim has waived her privacy rights about her medical history by talking about it with family and friends.

POZNER: I cannot imagine the judge would ever say a person telling their mother their history has waived it. But what if she's gone to a party and sat around the table with some people she knows and maybe some people she barely knows and has said, let me tell you what medications I'm on, let me tell you my diagnosis?

TUCHMAN (on camera): This hearing is scheduled to last for two days. There are two more motions hearings scheduled for next month. A trial is unlikely to start before the summer.
