Martha Stewart's Attorneys to Cross-Examine Government Witness

CAROL COSTELLO, CNN ANCHOR: They will go after the man with a baby face. It's likely to be a brutal day in court for the star witness in the Martha Stewart trial. Allegations of drugs and hatred for Stewart will likely come into play.

(BEGIN VIDEOTAPE)

MARY SNOW, CNN FINANCIAL NEWS CORRESPONDENT (voice-over): The government's star witness, Doug Faneuil, will return to the stand; this time to be questioned by Martha Stewart's defense attorney. And the cross-examination is expected to be intense.

Stewart's attorney will try to poke holes in Doug Faneuil's credibility. He'll also pick up where other defense attorneys left off last week.

Last week, the defense for Peter Bacanovic, Stewart's co- defendant, tried to paint Doug Faneuil as having a grudge against Martha Stewart. They produced e-mails in which Faneuil complained of her rudeness, and even boasted that he got even with her.

Faneuil delivered damaging testimony to both Stewart and her co- defendant, Peter Bacanovic, by telling this court that he passed along a tip to Stewart that her friend, Sam Waksal, was trying to sell all of his ImClone shares on December 27, 2001. He testified that he was instructed to give her that tip by Peter Bacanovic.

Bacanovic and Stewart have maintained that they had a pre- existing agreement to sell shares of ImClone once they fell below a certain level.
