Scott Peterson Double Murder Trial

CAROL COSTELLO, CNN ANCHOR: And today in Scott Peterson's double murder trial, the judge will hear arguments about the admissibility of some high tech evidence.
Our Rusty Dornin has more for you.

RUSTY DORNIN, CNN CORRESPONDENT (voice-over): When Scott Peterson drove around Modesto and made trips up to San Francisco Bay before his arrest last year, investigators were using satellite technology to track him. But his attorney says the GPS devices planted on Peterson's vehicle sometimes didn't work, were often inaccurate and should not be admitted as evidence. The judge will hear arguments Wednesday on whether the technology is an acceptable science. If the judge gives the thumbs up, San Francisco prosecutor Jim Hammer says it may not seem like much but...

JIM HAMMER, PROSECUTOR: I think it's one of the little pieces in a circumstantial evidence case where the D.A. is going to try to show that Scott Peterson was acting like a guilty man, like somebody who was afraid they were going to find Laci Peterson's body.

DORNIN: And remember all those interviews Scott Peterson did last year?

SCOTT PETERSON, DEFENDANT: People accuse me of some involvement and I had nothing to do with her disappearance.

DORNIN: Defense attorney Mark Geragos says that they are irrelevant and could mislead a jury. He filed a motion to exclude any statements Peterson made to the press.

This billboard on Highway 101 just south of San Francisco, says Peterson's defense, is a sign the new venue appears even more hostile than Modesto. Geragos used it to support his motion to sequester the jury for the four to six month trial.

Peterson's defense also wants two juries, one for the trial, and, if he's convicted, another for the penalty phase. Geragos claims statistics show people who qualify for a jury in a death penalty case often tilt in favor of the prosecution.

Jury selection is not expected to begin for at least another two weeks.
