Martha Stewart Trial: Stewart's Attorney Says Martha Will Not Testify

CAROL COSTELLO, CNN ANCHOR: Time for a little "Business Buzz" now. Mum is the word for Martha Stewart.
Carrie Lee has more live from the Nasdaq market site.

So she won't be taking the stand after all?

CARRIE LEE, CNN FINANCIAL NEWS CORRESPONDENT: She will not, Carol, a lot of people wondering about this. Martha Stewart will not be taking the stand in her own defense at her trial. Her lead attorney says the defense also will call no more than two witnesses, including a former lawyer who attended an interview Stewart gave to investigators in 2002. That witness is expected to testify today. And if the judge allows it, a memory expert could be called.

Now lawyers for Stewart's former stockbroker Peter Bacanovic presented their last witness yesterday and they will rest their case. Stewart's team is also expected to rest today. Lawyers for both defendants remain confident, basically that the government hasn't proven its case and that they need to put on a minimal defense. So that is the latest on Martha Stewart and Peter Bacanovic. The case could go to the jury late this week or early next week.
