Anna Nicole`s Baby Has DNA Taken; Britney Out of Rehab, But Maybe Too Soon

Aired March 21, 2007 - 23:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

A.J. HAMMER, SHOWBIZ TONIGHT ANCHOR: The first photos of Angelina Jolie`s new son with his new siblings. I`m A.J. Hammer in New York.
BROOKE ANDERSON, SHOWBIZ TONIGHT ANCHOR: And a celebrity couple gets his and her face lifts. They`re here on SHOWBIZ TONIGHT. I`m Brooke Anderson in Hollywood. TV`s most provocative entertainment news show starts right now.

HAMMER: On SHOWBIZ TONIGHT, are we finally going to find out who`s the father of Anna Nicole Smith`s baby? Tonight, a dramatic new development, as Howard K. Stern finally makes a decision in the battle to get a DNA test to settle this once and for all. SHOWBIZ TONIGHT takes you right to the drama in the Bahamas.

Britney Spears out of rehab after just 30 days, but has Britney left too soon and is she setting herself up for a relapse.

Plus, absolutely shocking words from Lindsay Lohan`s mom. With Lindsay out of rehab, why in the world is her mother posing for a magazine with champagne, and seeming to make excuses for her underage daughter? Tonight, only SHOWBIZ TONIGHT can set the rehab record straight.

Hello, I`m A.J. Hammer in New York.

ANDERSON: Hi there everyone. I`m Brooke Anderson in Hollywood. And you know, tonight we`ve just got to ask, has Britney Spears made a terrible mistake? Yes, she`s out of rehab again. But is it way too soon? Britney, out of rehab, straight ahead.

HAMMER: But first tonight, it`s the moment everybody`s been waiting for in the nasty and ugly battle over Anna Nicole Smith`s baby. And tonight, after a ridiculously long time and plenty of court hearings, it looks like we may finally be getting closer to knowing who is really the father of baby Dannielynn. Tonight Court TV is reporting that Howard K. Stern brought Dannielynn to a doctor`s office in the Bahamas today so a DNA sample could be taken to determine if Stern or Larry Birkhead is the father.

The samples will reportedly be sent to a lab in Columbus, Ohio and eventually back to the court in the Bahamas.

ANDERSON: And SHOWBIZ TONIGHT is heading right to the Bahamas to get the very latest. Joining me tonight from the Bahamas, Court TV correspondent Jean Casarez and from Los Angeles, investigative journalist Jane Velez-Mitchell, who is also the author of the soon to be released book, "Secrets Can Be Murder."

OK, Jean, I want to start right there in the Bahamas. This battle over the baby has been going on for months now, well before Anna Nicole Smith`s death. Reportedly, the DNA testing happened today after a judge yesterday told Stern to get it done. Is there a feeling, Jean, in the Bahamas that there might finally be some closure here?

JEAN CASAREZ, COURT TV CORRESPONDENT: That`s a good question. I think it`s a tough question because there`s possibly going to be an appeal. But you`re right, Court TV News has spoken with people close to the case, and they did say that that DNA testing went forward today, taking a buccal (ph) swab with a Q-Tip of tissue of little Dannielynn, most notably inside of the cheek.

All of the parties were present when it was done, and then the sample was bound for the U.S., the state of Ohio, where it will be analyzed. But it will be sealed, pending appeal, and also pending a court hearing on April 3rd. Now, we confirmed at the close of court today, Howard K. Stern had not filed an appeal with the court of appeals, but that option is still open to him at any time.

ANDERSON: OK, it all seems like a giant leap forward. Jane, we knew this was all going to happen eventually. And until now, Howard K. Stern has been a road block, really, the stubborn one in this whole mess. Wouldn`t he have looked a lot better if he had just done it in the first place, just gotten it over with? It was inevitable that he would have to do it.

JANE VELEZ-MITCHELL, INVESTIGATIVE JOURNALIST: Brooke, absolutely. If he had allowed the test in the first place, and it turned out, let`s say, that he wasn`t the father, he could have argued, hey, Anna Nicole and I were intimate. I thought I was the father. It was honest mistake. And think everybody would have given him the benefit of the doubt.

But with all this stone walling and maneuvering, there`s a lot of good will that is gone. And in its place is a lot of suspicion about his motives in general, vis-a-vis this entire family. And this comes at a very bad time for him, if in fact it`s proven that he`s not the father, because the formal inquest into Daniel`s death starts next week in the Bahamas. That`s a mini trial and according to TMZ.com, at least one of the estimated 40 witnesses is going to make some damaging claims against him.

So he needs all the credibility he can get. One last thing, if it turns out he is the father, it`s perfect timing for him.

ANDERSON: Yes, he does have that inquest coming up next week. Jean, there was a lot of confusion as to whether the Bohemian judge urged Howard K. Stern to submit the baby for a DNA test or actually ordered him to do it. Can you clarify for us? What happened? Was it an outright order?

CASAREZ: You know, with the gag order, I think that we cannot determine exactly what the judge said, but if we look at the law in the Bahamas, it says directs. It does not say an order. But I think the end- all of that could be something that is very similar, because if Howard K. Stern is thinking about an appeal, that would mean there was a type of order. But he did consent to the test today because it was done.

ANDERSON: Well, you know, under Bohemian law, paternity doesn`t necessarily determine custody. And Howard K. Stern, in fact, is listed on that birth certificate as the father. So, even if the DNA determines, Jean, that Larry Birkhead is the biological father, that doesn`t mean conclusively that Howard K. Stern has to turn the baby over, does it?

CASAREZ: I think it`s a separate issue. I agree with you. I think guardianship, custody is separate from paternity, even if he is determined to not be the father, he could mount a fight to still keep the child as the physical custodian at this point. And since the child has been born, that`s all that Dannielynn has known, is Howard K. Stern.

ANDERSON: Yes, and now that we wait for the DNA results to come back, what happens next? After the results -- After that happens, the testing, does it all go back to a court? Does the Bohemian court have to decide custody then? What`s the next step?

CASAREZ: Well, we`re going to wait to see if an appeal is filed, because I think that`s crucial. And I think if an appeal is accepted to go forward, that could stall all of this. But, in the meantime, once they get the results, it takes three to four days to do the testing. They`ll keep them sealed. April 3rd will be the next hearing. We can presume the results would be known at that point in time.

The judge would most likely determine who the child should be with, being the natural both father, one of the two of them. And then, beyond that, then we get into some gray area. Will custody then be fought, either between Howard K. Stern and Larry Birkhead, or between Virgie Arthur and the two?

ANDERSON: Yes, it`s very confusing. Only time will tell what happens. OK, very good information. Jean Casarez, thank you so much for your insight, we appreciate. And I want to mention, we did lose Jane Velez-Mitchell. Satellite and technical issues there. And we`re going to speak to her again later on in the show. Thanks to both of them for joining us.

And coming up at 31 past the hour, SHOWBIZ TONIGHT is asking, what about the baby? We want to know about the welfare of Dannielynn, whose life is ultimately impacted by what`s going on right now? And we do want to hear from you on this is. It`s our SHOWBIZ TONIGHT question of the day, Anna Nicole Smith`s baby battle, is Howard K. Stern hiding something?

HAMMER: Tonight, Lindsay Lohan`s mother speaks out like never before. Dina Lohan is catching grief over an interview and a racy photo shoot that she gave for the April issue of "Harper`s Bizarre Magazine." Dina does not hold back in the interview, opening up about her daughter`s hard partying and stint in rehab, also talking about whether or not she considers Lindsay to be an alcoholic.

And if what she says doesn`t shock you, what she`s wearing might.

(BEGIN VIDEOTAPE)

ROSIE O`DONNELL, THE VIEW: It looks like she`s trying to have a career on her daughter`s career, which is kind of interesting.

BARBARA WALTERS, THE VIEW: She likes to go out with Lindsay. She likes to wear Lindsay`s clothes. She can still wear them. She doesn`t tell everybody that she`s Lindsay`s mother. It`s what you were saying.

JOY BEHAR, THE VIEW: Why doesn`t she tell them that?

HAMMER: The ladies of "The View" aren`t the only ones all fired up over an interview in the April issue of "Harper`s Bazaar Magazine," with Lindsay Lohan`s mom, Dina Lohan. Red carpet ready and dressed to kill, Dina posed for several sexy photos. But SHOWBIZ TONIGHT can tell you that it`s this picture, showing Dina in the back of a limo, dressed to the nines, holding a glass of champagne, with a chilled bottle at her feet, that`s got everyone talking.

BEHAR: You wonder why the poor kid has issues herself.

HAMMER: Dina`s 20-year-old daughter Lindsay recently completed 30 days in out patient rehab and still attends AA meetings. "We`re not a bunch of screw-ups," is how Dina describes her famous family in Bazaar, insisting that Lindsay just had to tone down the partying, saying, "Lindsay had to fall and get up. I knew it was coming. I told her, but finally she was like, mommy, I had to do it myself."

Dina reveals she staged a couple of interventions, asking her hard partying daughter to go to treatment, but insists Lindsay is not an alcoholic, saying, "no, she is just a 20-year-old who had to real it in. And she`s from an addictive personality genetically."

Despite her daughter`s problems, 43-year-old Dina says she`s living the American dream. Check out this picture of her in Bazaar wearing a Dolce and Gibana (ph) next to nothing dress. Price tag, nearly 18,000 dollars. Dina says she sometimes wears Lindsay`s clothes and at times goes out with her to the clubs, but insists that that doesn`t make her a party mom. She just goes to keep an eye on Lindsay. "She trusts my judgment," says Dina. "She`s in such a whirlwind. She`s in a tornado."

The interview with Dina was done right after Lindsay checked into the Wonderland Treatment Facility. But after 30 days of rehab, the tornado that is Lindsay`s life still seems to be going at full speed.

DAVID CAPLAN, "STAR MAGAZINE": Lindsay, she`s been out of rehab for a little bit over a month and she was in New York for several days and she went out so many night clubs, and she was partying, having a great time.

HAMMER: Dina insists her daughter is like any other 20-year-old and is just misunderstood, saying some of these kids are just lost. You can`t blame parents for kids.

(END VIDEOTAPE)

HAMMER: Brooke, I spoke with Dina Lohan by phone earlier today. What`s really interesting about her, very nice woman, and really family- oriented. In addition to handling a lot of Lindsay`s business, she`s just a soccer mom, out on Long Island she was worrying about car pooling. But she wanted to make it clear that they are very misunderstood. She does not go out clubbing with her daughter, as we just pointed out. She`s just there to look after her daughter`s affairs and taking care of business.

ANDERSON: Well, that`s good to hear, A.J. Because I do think that boundaries need to be set. There needs to be some structure and some rules applied, because that can only help the kid in the long run. Although I know that it may not be the easiest thing for a parent to do in the short term.

HAMMER: Sure, it`s a lot of balancing.

ANDERSON: Absolutely. But another young star, fresh out of rehab, we`ve got Britney Spears. You know, after 30 days at a luxurious rehab center, Britney`s out, but did she stay long enough and what happens now? That`s next.

HAMMER: Also, Angelina`s new son. There are brand new pictures of Pax with his new siblings. I`ve got to tell you, they are oftly cute. So we are going to show you the entire family album. You won`t want to miss it, coming up. Also this.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: You have staples in your neck.

UNIDENTIFIED MALE: I have staples in the eyes.

(END VIDEO CLIP)

ANDERSON: That`s got to hurt. It`s Gene Simmons of Kiss like you`ve never seen him before. So why did he and his long-time love get his and hers face lifts? Yes, they`re here in the interview you`ll see only on SHOWBIZ TONIGHT.

(COMMERCIAL BREAK)

HAMMER: Welcome back to SHOWBIZ TONIGHT, TV`s most provocative entertainment news show. I`m A.J. Hammer in New York. Tonight it looks like the third time just might have been the charm for Britney Spears, or was it? Britney Spears checked out of rehab late last night after checking in 30 days ago, and two other short-lived stays in rehab. In a statement her manager tells SHOWBIZ TONIGHT, quote, "Britney Spears has been released by the Promises Malibu Treatment Center after successfully completing their program. We ask that the media respects her privacy, as well as those of her family and friends at this time."

Joining me tonight from Hollywood, Candy Finnigan, who`s an interventionist from A&E`s "Intervention," and also in Hollywood, investigative journalist Pat Lalama. Ladies, I appreciate you both being with us.

Candy, let me start with you, because, as I mentioned, it was just about 30 days that she spent in rehab. We never got an exact reason as to why she went in. We do know that her life was rather out of control before she entered rehab and this was the third time she was entering a treatment program. The other two didn`t stick. Can 30 days really be enough for someone who was seemingly in her situation?

CANDY FINNIGAN, INTERVENTIONIST: Well, the longer you stay in treatment, the better your recovery usually is. But I have to say, 30 days is better than nothing. But 90 days would have been wonderful.

HAMMER: That`s what a lot of people have been saying along the way. Because when you look at what was going on before she entered rehab, it was what seemed like months of out-of-control, very public partying. It finally ended with the head-shaving incident. Pat, do you believe that Britney is finally ready to turn her life around? We all hope so, but do you think it`s going to happen?

PAT LALAMA, INVESTIGATIVE JOURNALIST: You know, A.J., I have more hope for her than I do a lot of other people in Hollywood. But here`s my problem, it seems, in the last year or two, a lot of these celebrities, particularly young celebrities, have been using rehab as sort of the cool thing to do without any real sincere motivation behind it. Rehab if your a homophobe, rehab if you`re a racist, rehab if you drink. All these kinds of things.

I think that really undermines the program. I think it undermines what these kinds of programs can do for millions of people who are really sincere about it. The fact of the matter, A.J., is that she doesn`t have it up here, if she doesn`t know in her heart of hearts that she needs to fix things, 30 days is not going to make a bit of difference.

HAMMER: And I do want to believe, and I think -- and I`m just saying this without actual knowledge, but I believe that her motives were genuine here. So Candy, assuming that is true, assuming she went in for the right reasons, assuming that she spent a good month in the program, doing everything she needed to do, it`s still a very delicate and tenuous time for anyone when you get out of rehab. And you look at what she`s now facing.

She`s in the middle of a divorce. She`s trying to revive her career. She`s got other pressures, a custody battle for the kids. What could be the toughest part for her right now, now that she is out?

FINNIGAN: Well, balancing her life, you know, just trying to be a mother and trying to get her legal -- with her divorce and everything. She`s got to stay focused that all of this is going to fall apart again if recovery isn`t her primary purpose.

HAMMER: And, of course, Britney Spears, not the only one who`s been in and out of rehab, Pat, as you were just mentioning. Hopefully when Lindsay was in most recently it was for the right reasons. I`m wondering, Pat, if you think there can be a cautionary tale for Britney in Lindsay. She did 30 days, but Lindsay`s now back out, and everybody we talk to, when she got back out, said the last thing she should be doing is going to the clubs.

Now she`s going to the clubs. Nobody`s actually confirmed that she`s drinking, but everybody`s saying she shouldn`t be in that atmosphere. So we really can see some parallels between the two of them, can`t we?

LALAMA: A.J., the most glaring parallels for me, and I`ve seen this for all the years that I`ve covered this sort of thing, the parallels are that when young people achieve too much money and too much fame without the right core group of support behind them, then it`s just going to go to hell in a hand basket. And that`s the problem. I have more hope for Britney than I do for Lindsay.

I hope they both achieve success in this. I really do. I don`t want to see anybody go down, particularly this young. But the problem is that I`m hearing that Lindsay`s got a mom who likes to party. These people need strong people around them who say, wait a minute, I`m putting reigns on you. You`re not going to hang out in the clubs. You`re not going to go out without underwear. You`re not going to have a baseball bat and shave your head and do all this crazy stuff.

They need good support systems. It`s too much money, too much fame, too fast.

HAMMER: I want to talk about that core group of support you mentioned, Candy, because on "Intervention," on your show, big emphasis on the family`s role in helping people with the recovery. So, in Britney`s case, we`re talking about Kevin and her mom and the other members of her family. What do they need to do to help Britney recover?

FINNIGAN: This is a family disease. And we need to quit glamorizing addiction through celebrities. Everyone has got to participate in her recovery. She didn`t get there alone. And she needs to be a part of a family, whether she has to create her own support group or get her own intimate biological family involved in recovery, now, not tomorrow, now. It starts today. The work starts today.

HAMMER: It starts today and we just hope -- we really genuinely hope that everybody around her is doing the right thing. Addiction specialist Candy Finnigan, investigative journalist Pat Lalama, I thank you both.

Britney, of course, not the only member of the young Hollywood party set that has been having trouble recently. Well, tonight we have a possible answer to a question that`s been asked time and time again over the past couple of years: What the heck is wrong with Nicole Richie? Now, Nicole`s rep says she`s been diagnosed with Hypoglisemia. Essentially, that`s low blood sugar, and it`s something that can happen when you skip meals, if you don`t eat enough, and if you drink too much, or if you have liver illness.

Well, Nicole has never said that she has an eating disorder, but obviously it`s not secret that she has gotten shockingly thin. And she did seek treatment to find out exactly why she couldn`t seem to gain weight. The kicker in all this, as SHOWBIZ TONIGHT reported earlier this week, for the reality show "The Simple Life" Nicole and Paris Hilton are counselors at a health and fitness camp. People.com is reporting that Nicole`s own health on the set has been an issue, and she`s holed up in her trailer quite often because she feels faint.

Some good news today for Regis Philbin after his heart surgery. I`ve got to say, Kelly Ripa could not contain her happiness this morning on "Live." All that coming up next.

Also, a big day in the Anna Nicole Smith case. We`re asking, what about the baby? I mean, if you look at the situation, she still has no mother, no definite father at this point. How`s all of this going to be affecting Dannielynn down the road? That is coming up.

Also tonight, Angelina Jolie`s new son. You could just hear a chorus of "Aw" when we got these brand new pictures today, really cute, of Pax and his new siblings. We got the entire family album to show you. You will not want to miss it when SHOWBIZ TONIGHT returns.

(COMMERCIAL BREAK)

ANDERSON: Tonight, an update on how Regis Philbin is doing after his triple bypass heart surgery. Good news, he`s out of the hospital after just five days. Kelly Ripa made the announcement this morning on "Live With Regis and Kelly." Howie Mandel was filling in for Regis today. Take a look.

(BEGIN VIDEO CLIP)

KELLY RIPA, "LIVE WITH REGIS AND KELLY": We should say good morning to Regis, who is at home watching. He was released.

HOWIE MANDEL, ACTOR: At home, I didn`t know that? That`s amazing. That`s incredible.

RIPA: We miss you.

MANDEL: That`s incredible. How fast they get you up --

RIPA: He was home two days ago. He was home. We were sworn to secrecy. I don`t know why.

We are excited. We`re looking forward to -- is this true, Michael? I`m not sure if it is. Potentially Regis will be phoning into the show on Friday and we`ll all get to speak to Regis on Friday. So, very big for us around here.

(END VIDEO CLIP)

ANDERSON: And doctors say that Regis should be back to work in about five weeks.

HAMMER: Brooke, it`s been a big day in the Anna Nicole Smith case. Finally and thankfully, we`re one step closer to finding out who exactly the father is. But, of course, we want to know more. What about the baby? Here`s a little girl who has no mother, no definite father as of now? How is this all going to affect Dannielynn down the road? We`ll get into it at 31 past the hour.

ANDERSON: Also, A.J., Angelina Jolie`s new son, brand new pictures of Pax with his new siblings. Those pictures are adorable and we`ll show you the intimate family photo album straight ahead.

Also this --

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Give me your hand.

UNIDENTIFIED MALE: No, no, no.

UNIDENTIFIED MALE: Come on, one finger.

UNIDENTIFIED MALE: Oh, what did they do to you.

(END VIDEO CLIP)

HAMMER: It`s Gene Simmons of Kiss like you`ve never seen him before. Why did he and his long-time love get his and hers face lifts? They`re joining us in the interview you`ll see only on SHOWBIZ TONIGHT.

(NEWS BREAK)

(COMMERCIAL BREAK)

HAMMER: Welcome back to SHOWBIZ TONIGHT. It`s 30 minutes past the hour. I`m A.J. Hammer in New York.

ANDERSON: And I`m Brooke Anderson in Hollywood, and you are watching TV`s most provocative entertainment news show.

HAMMER: Brooke Anderson, you can`t hide from the truth. I know, in fact, you are a card-carrying member of the KISS Army, right?

ANDERSON: See, well, I`m - man.

HAMMER: Yes.

ANDERSON: I - I`m not in the KISS Army. It`s - nothing wrong with that if you are though. A.J.

HAMMER: You`ve worn kabuki makeup. You`ve been jamming out to "I Want To Rock and Roll All Night."

ANDERSON: Yes, that`s me. I admit it.

HAMMER: KISS - KISS bass player, Gene Simmons, not exactly a shy guy - in fact, you`ve probably seen his tongue in the course of your life. Well, he and his partner of more than 20 years, the lovely Shannon Tweed, just went in for his-and-her facelifts.

(BEGIN VIDEO CLIP)

GENE SIMMONS, KISS BASS PLAYER: Ah, you have staples in your neck. And now they have staples in the eyes.

(END VIDEO CLIP)

HAMMER: Staples in the eyes? Well, that`s no good. Those two are right here to explain exactly what in the world they were thinking. I can`t wait to hear.

ANDERSON: Ouch. And I`m not sure how to follow that one up, A.J.

But how about this: an exclusive interview with Angelina Jolie and pictures of her new adopted baby boy. Not bad for a follow-up, right?

HAMMER: (INAUDIBLE) your pictures than stapled eyelids.

ANDERSON: Yes.

Angelina Jolie heading back from Vietnam with her new 3-year-old named Pax Thien. And tonight, we`ve got the really sweet pictures of mom and son that you haven`t seen. And what may be next for her and Brad Pitt.

HAMMER: But first tonight, more of SHOWBIZ TONIGHT`s continuing coverage of the Anna Nicole Smith baby battle. Tonight, Court TV is reporting that at long last, daughter Dannielynn has finally undergone a DNA test in the Bahamas. Larry Birkhead, who insists that he`s the dad, also submitted his DNA.

But all of this fighting has SHOWBIZ TONIGHT asking, `What about the baby?`

Joining me tonight in New York, developmental psychologist Cooper Lawrence.

In Los Angeles, it`s investigate journalist Jane Velez-Mitchell, also the author of the soon-to-be-released, "Secrets: Can Be Murder," with foreword by Nancy Grace.

Good to see you both, ladies.

Finally, it looks like we`ve made some progress. I`ll believe it when we see the results.

Cooper, here we have a young girl. You know, she`s less than seven months old at this point. In her life, she`s had nothing but turmoil. Her mother is dead; at this point, nobody knows exactly who the dad is.

All this happening at what seems to me to a time when a baby needs the most nurturing. Should we be concerned?

COOPER LAWRENCE, DEVELOPMENTAL PSYCHOLOGIST: Yes, we should be very concerned.

And A.J., you know I`ve been saying this to you from the very beginning: what about this baby? Now at six months, the baby can anticipate pleasure when its needs are met, and it can anticipate frustration when the needs are not met. So this baby does have a sense of her environment.

Plus, you know, if Anna Nicole was on drugs and alcohol while she was pregnant, what about assessing the baby? Does she have fetal alcohol syndrome? Is there a problem?

So - so the baby should be the utmost concern here.

HAMMER: Needs being met. That seems to be the operative term I`m going to go with here, Jane. Because it seems to me - and I`m curious to get your take on it - so many of the characters in this drama appear to be taking their own interests ahead of the baby`s, which just doesn`t make any sense to me.

JANE VELEZ-MITCHELL, INVESTIGATIVE JOURNALIST: Absolutely.

I mean, Howard K. Stern could argue, no matter what the test results, he should be the father because he has bonded with the child. Well, those who have been observing all this say, `Nonsense, he and Anna Nicole left the child in the Bahamas and went to Florida to buy a yacht.` And that`s the point at which Anna Nicole Smith died.

Also, a former nanny issued a scathing affidavit and said this child was growing up in a wild and unpredictable household where drugs were rampant and there was no bonding going on. And she was underweight and not thriving. That`s in a sworn statement.

HAMMER: Well, let`s - let`s look to the future a little bit here. And Cooper, I`m curious to get your take, as a developmental psychologist - let`s say it is determined that, oh, Larry Birkhead is the father, when those DNA results finally come through. Then the baby gets turned over to him.

So this could be, you know, perhaps, a couple of months out before that happens. So now, at this point, the baby is seven, eight months old, in a totally different environment at this point. How could all of that, in what should be a stable time in a baby`s life - how could all of this impact Dannielynn`s development?

LAWRENCE: You know, better late than never. She should have been with him from the very beginning. Because this isn`t a boat they`re arguing over; this is a child, and her development is at stake.

So this could only impact her in a positive way, because the research is very clear on this. It says that a child with her biological father has all the thriving factors just built in right there in terms of - the closer she is with the father, the less likely she`ll be delinquent, drop out of school - all of those negative things that happen to kids later on. It`s all about being close with one biological parent. And right now, she only has the one.

So we`ve got to get her with Larry as soon as possible.

HAMMER: Should Larry be named the father.

Now - now Jane, let`s take a step further. DNA aside, from what we now know of these two - and I think I know how you feel about Howard K. Stern from comments made previously on this program - but between what we know about Howard and Larry Birkhead, who do you think would be best suited to raise this child?

VELEZ-MITCHELL: Well, I think assuming that Larry Birkhead is proven to be the dad, he would certainly be of a better father. And his motives have seemed far more stellar throughout this whole thing. I mean, he seems to have fought valiantly for this little girl.

Howard K. Stern`s motives - everybody in the world`s questioning them. And the big question is, why would he want to hang on to a child if it turns out that it`s not his? The answer, of course, would be money. This child could be worth half a billion dollars if they win the estate battle with J. Howard Marshall`s estate.

Not only that, but Anna Nicole Smith`s name and likeness - the rights to that could be worth a fortune. So everybody`s saying, `Hey, the reason he`s hanging on to her is money.`

HAMMER: Yes. And that`s no good in terms of a child`s welfare.

I want to throw the same question out to you, Cooper - Cooper. And I think what is lost in all of this, because we`ve been dealing with it so intensely since Anna Nicole died - is the fact that this paternity battle was going on before Anna Nicole died.

Who do you think would be better suited to - to wind up parenting up this child? Larry or Howard?

LAWRENCE: I think clearly Larry. Because from very beginning, he`s been very honest and very upfront. He`s been willing to give DNA. He`s not been cagey at all. Everything we`ve seen about him is just that he`s a very loving, caring human being.

You know, he is the one who wanted to stay with Anna Nicole. She rejected him. So he seems to be a very loving, nurturing caring person. And what a great environment for a little girl, especially because daughters are more attached to their fathers, when you looked at the attachment literature, than sons are.

HAMMER: Yes, I - I .

LAWRENCE: So there you go.

HAMMER: I - I think you`d have a hard time finding somebody to disagree with you.

Cooper Lawrence, Jane Velez-Mitchell, thank you both for joining us tonight.

(CROSSTALK)

HAMMER: We`ve been asking you to vote on our SHOWBIZ TONIGHT "Question of the Day" on this very subject: "Anna Nicole Smith Baby Battle: Is Howard K. Stern hiding something?"

ANDERSON: OK, now from a Hollywood baby battle to a wonderful star baby adoption. Here are the pictures that the whole world has been waiting to see, and tonight -- right here, right now - we`ve got him. Angelina Jolie and her just-adopted, 3-year-old Vietnamese boy Pax Thien.

"People" magazine got an exclusive interview with Jolie and some really amazing pictures, too. I spoke with "People" magazine`s Mike Fleeman, who told me, Thien and Pax - Angelina and Pax are doing just fine.

(BEGIN VIDEOTAPE)

ANDERSON: I want to read first what Angelina exclusively told "People" magazine. And she says - quote - this is very interesting - "You can imagine what courage it takes to be in all-new surroundings, with new people and a new language. He is very strong."

Now it seems that Angelina is really acknowledging that this could be a very difficult transition for this child, who has lived his first three years in a totally different culture and a totally different environment, right?

MIKE FLEEMAN, "PEOPLE" MAGAZINE: That`s correct.

You know, he doesn`t speak English; Angelina only speaks a few phrases in Vietnamese. And, you know, he`s been growing up surrounded by children. He`s never actually been in a family.

On top of all that, put in the paparazzi pressure, the star factor - he`s got a very interesting road ahead of him.

ANDERSON: He certainly does. And yes, he was abandoned at birth. So like you say, he`s been in this orphanage, surrounded by children his entire life.

And, you know, this is a new experience for Angelina as well. She already has three children, two of those adopted. But this is totally different, adopting an older child in this situation.

What challenges does she herself face in making this transition?

FLEEMAN: Well, it was very interesting - and Angelina Jolie, one of Hollywood`s biggest actresses is going to be a stay-at-home mom. She realizes the challenges ahead, and she`s going to put her career on hold. She says she wants to stay home, be a mom to these children.

ANDERSON: I love that.

And - and, you know, because Vietnamese law doesn`t allow unmarried couples - which she and Brad aren`t married - doesn`t allow unmarried couples to adopt together, Angelina is adopting Pax on her own.

But can we expect, Mike, that Pax will then go through a second adoption process here in the United States, so Brad can officially be named the father, as he has been with Zahara and also with Maddox?

FLEEMAN: That would be very likely. You know, Brad has already adopted Angelina`s other children very early in their relationship. They`ve taken a - a dual surname. So for all intents and purposes, Brad Pitt will be the father of Pax.

ANDERSON: Pax Thien Jolie-Pitt most likely.

And, you know, Angelina has gone to great lengths to - to shield little Pax from the media frenzy. But, you know, Mike, as we`ve seen time and time together, everywhere Brad and Angelina go - whether it`s them alone or whether it`s them with the kids - it turns into this huge media event.

I would assume we can expect this same thing to happen here.

FLEEMAN: Oh, sure.

You know Angelina. She`s flying home from Vietnam; expect the paparazzi at the airport; expect them out in front of their house. You know, she leads and Brad leads a very fascinating life. And - and, you know, this is something that they just have to cope with, and this is something that`s going to be very new and astonishing for their new addition.

ANDERSON: It certainly is. And did she give any hints as to how big her brood may ultimately become?

FLEEMAN: Well, you know, she always said she wanted a big family. And years ago, Brad famously said he wanted a big family. Well, they`ve got a big family. And yes, the question is, how much bigger is it going to get?

ANDERSON: They seem like good, loving parents. Attentive parents.

OK, Mike Fleeman, thanks so much for being here. We appreciate it.

FLEEMAN: Thank you.

(END VIDEOTAPE)

ANDERSON: And one thing I should tell you: Angelina gave gifts to all kids in the Vietnamese orphanage, and that was because she didn`t want to single her new son out in front of the other kids.

And the Angelina Jolie exclusive interview in the April 2 issue of "People" magazine is on newsstands this Friday.

HAMMER: And, of course, Brooke, Angelina Jolie and Brad Pitt not married. A lot of people wondering when and if they actually will ever tie the knot.

ANDERSON: You know what? They`ve both been down the road, Angelina more than once. But you know, A.J., regardless, married or unmarried, they seem to adore one another.

HAMMER: I couldn`t agree with you more on that.

And tonight, Halle Berry has some real controversial to say about marriage and kids. We`ll get into that coming up. Plus this:

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Give me your hand.

SIMMONS: No, no, no, no. I - no.

UNIDENTIFIED MALE: Oh come on, one finger.

SIMMONS: Ah, what did they do to you?

(END VIDEO CLIP)

ANDERSON: KISS` Gene Simmons and his lady are very happily unmarried. They`re so tight - well, they tightened up their faces together. Gene and Shannon - Gene Simmons and Shannon Tweed are right here. And you know, we got to ask them, what were thinking getting his-and-hers facelifts?

HAMMER: Oh, we`ll get to the bottom of that.

Also, Donald Trump showed his face on "The View" today, believe it or not. He kind of stopped by to wish Rosie O`Donnell a happy birthday. I`d be pretty shocked if they are playing nice now, though. That is coming up.

(COMMERCIAL BREAK)

ANDERSON: Welcome back to SHOWBIZ TONIGHT. I am Brooke Anderson in Hollywood.

Well, it`s Rosie O`Donnell`s 45th birthday today. And to celebrate, Donald Trump of all people showed up - sort of. Even though the ladies of "The View" have sworn off talking about the Rosie-Donald Trump nasty war of words - well, they just couldn`t help themselves today, when co-host Joy Behar gave Rosie her birthday gift.

(BEGIN VIDEO CLIP)

JOY BEHAR, "THE VIEW": Take it out.

ROSIE O`DONNELL, "THE VIEW": Take it out. Like this?

BEHAR: Like that. Yes.

O`DONNELL: And you made this?

BEHAR: Open it up. Remember what - what your son said about the.

(CHEERING AND APPLAUSE)

O`DONNELL: Very creative, Joy. Very creative and quite interesting.

(CROSSTALK)

BARBARA WALTERS, "THE VIEW": Rosie is being quietly confident.

O`DONNELL: I`m being quietly confident. Well, that is crafty, but you don`t win the craftiest gift of all the hosts.

BEHAR: I might win the funniest.

O`DONNELL: That`s true.

(END VIDEO CLIP)

ANDERSON: OK, so the story behind the Donald dump truck is that one of Rosie`s kids couldn`t really pronounce "Donald Trump." Instead, he said "dump truck." And you know what? As cute as that is, I think that these two should just kiss and make up. Right, A.J.?

HAMMER: Oh, that gives me an opportunity for a great segue, Brooke.

Speaking of KISS, plenty of kissing going on between our next two guests. And they`re still not married. KISS front man Gene Simmons, a guy who`s definitely not shy, and his partner Shannon Tweed, have been happily unmarried for 20 years, as they proudly say.

And get this: they decided to go under the knife together - talk about love - for his-and-hers facelifts - huh? Well, all that is caught on tape in the new season of their reality show, "Gene Simmons Family Jewels."

Gene Simmons and Shannon Tweed joining me in New York.

Welcome back to SHOWBIZ TONIGHT. Lovely to see you both.

I - I got to - I got to you ask you.

SHANNON TWEED, ENTERTAINER: Are we pretty now, A.J.?

(CROSSTALK)

HAMMER: Well I got to ask you about the plastic surgery thing right off the top, because Gene, you`re a powerful and attractive man.

TWEED: He`s throwing you a line.

HAMMER: Shannon, you`re a lovely, beautiful woman.

TWEED: Thank you.

HAMMER: Why do the surgery?

TWEED: Because I had a couple extra chins.

SIMMONS: That`s - she`s talking from a woman`s point of view. You know she`s the most beautiful woman that`s every been created. I tell her this all the time, everyday - you`re hot.

But - but the truth is that we were minding our own business doing the "Gene Simmons Family Jewels" shooting, which debuts second season.

TWEED: Sunday night.

SIMMONS: .Sunday nights on A&E - watch it. By the way, A&E - I`ll answer your question in a second - A&E is a really nice bunch of people led by a guy named Bob Depetetto (ph). Very cool, proactive, hip television people who deserve a lot more credit than get.

HAMMER: You got to be pretty hip to put Gene Simmons on TV getting plastic surgery.

Now - now Gene.

SIMMONS: Well.

HAMMER: ..Gene, I want to know.

SIMMONS: Yes.

HAMMER: .why you did it. Because it - it - it strikes me as a little surprising. You`re not a vain man, are you?

SIMMONS: Well, of course I am.

(LAUGHTER)

SIMMONS: You know, they literally came to me and said, `Do you wanna?` And it was sort of - one of those sort of bungee jumping - bungee- rope junk .

TWEED: Bungee jumping.

SIMMONS: Bungee.

(CROSSTALK)

HAMMER: It was sort of like jumping off a bridge.

SIMMONS: Thank you very much. It was sort of like, `Oh, what the hell.` No caution to the wind. You know, through your shoulder - throw your face over your shoulder and just see what happens.

By the way, we filmed all of it. And as much as television will let us watch - you know, watch that stuff.

HAMMER: Right.

SIMMONS: .we will show it. But also on broadband, you`ll be able to see the entire operation.

(CROSSTALK)

HAMMER: Yes, I imagine that`s the nitty gritty - look - we`re look at the results here.

SIMMONS: It`s open like this. I was fascinated.

TWEED: OK, wow. No. Stop.

HAMMER: But - but - but again, you`re not answering the question why you wanted to get it done.

SIMMONS: I never even thought about it seriously, and it was those, `Yeah, why not?` It really was like that. One of those.

TWEED: And I didn`t want him to look younger than me, so I had to do it.

HAMMER: Ah. All right. Well then the key question is: are you happy with the results?

Now during the commercial break, you were looking at an older picture of yourself, presurgery, and saying, `I kind of look better then.`

Do you - do you really feel that way, or are you happy with how things came out?

TWEED: No, I look - I look better with one chin.

HAMMER: So that`s - so that`s - that`s - that`s what you had done, is basically a little chin reduction (ph)?

TWEED: Yes.

HAMMER: And - and yours was.

SIMMONS: I - I had - I (INAUDIBLE). My - my assessment of myself has very little to do with looks. Carlo Ponti will tell you - even that guy can get Sophia Loren. So it`s got very little to do with that.

But look at that handsome devil. My God, you are a good-looking (INAUDIBLE)

(CROSSTALK)

HAMMER: Your - your kids are - what? - 14 and 18 now?

TWEED: Mm-hmm.

HAMMER: Were they a little freaked out by that? Because I - I imagine you come home, and.

TWEED: They will never ever have plastic surgery.

HAMMER: Seriously, because you come home, you`re all bruised up when you see them. That`s not a good way to see your folks.

SIMMONS: But I have - I have to tell you that both are the most wonderful children. You`re supposed to say that if you`re mothers and fathers, but they really are exceptional human beings - polite and so on and so forth - and it was a heartbreaking moment, and we film all of it.

TWEED: They`re - they`re very well-adjusted.

SIMMONS: But it was a heartbreaking moment to have Sophie turn away really sort of feel (ph). We were feeling no pain; it just looked like we just landed from another plant.

TWEED: It looked - it looked uglier than it felt.

HAMMER: You know, and I`ve - I`ve met your kids before, and they are really sweet. And one of the things I love about you, Gene, is despite your rock star status, you`ve never had a drink in your life, you`ve never smoked in your life.

That`s really tough, especially when for kids.

SIMMONS: It`s not.

HAMMER: No, no - for kids, when they`re growing up in the environment they are - we`ve been talking all show long about Britney Spears and Lindsay Lohan going into rehab, keeping things in check.

How do you keep your kids from falling into that trap?

SIMMONS: Well, the.

TWEED: How do you let them do that? That`s what I want to know. How - ask the other parents, `Why do they allow that?`

SIMMONS: The parents - the parents are responsible.

TWEED: You can`t allow it.

SIMMONS: It`s a little pathetic that in this society we`ve even come to the point where we can say, `How do you control your children?` Even the question infers that this permissive society has gone to the twilight zone.

The - you know - "love your mother, fear your father." There has to be consequence once you cross the line. The word "no" means the same thing, `Can I kill somebody?` and `Can I leave crumbs on the table?`

HAMMER: Yes.

TWEED: I think parents spend too much time trying to be friends and be liked by the children. And it`s not - it`s not the time to make friends. You need to be the parent.

HAMMER: Well, we look forward to your family dynamic unraveling these season on the "Gene Simmons Family Jewels."

Gene, Shannon, thank you both for being with us tonight. I appreciate it.

"Gene Simmons Family Jewels" Sunday nights on A&E. Catch it.

ANDERSON: Well, it looks like being together but unmarried works for Gene Simmons. Now being married for Halle Berry - well, I think it`s fair to say that was a disaster.

Up next, you don`t want to miss Halle`s controversial comments about marriage and kids.

(COMMERCIAL BREAK)

HAMMER: And welcome back to SHOWBIZ TONIGHT, TV`s most provocative entertainment news show.

Well, right here, right now, I can tell you for sure that you will never, ever see Halle Berry go through another nasty divorce. But that doesn`t mean you`re not going to see her changing diapers. I don`t know if you`re actually going to see her changing diapers, but Halle says she`s never getting married again.

Now, the super-hot 40-year-old - yes, she`s really 40 - she`s telling "In Style" magazine that while she does have a boyfriend, she is not going to be walking down the aisle ever.

"I will never, ever again get married," she said. "Actually, it`s just now that I`ve come to a place where I think two people can share their lives without the ring, without the piece of paper."

Halle`s first divorce, from baseball player David Justice, was so bad that she said it nearly killed her. And then there was her second husband, R&B singer Eric Benet, who cheated on her and admitted it.

Well now, even though she doesn`t want to get married again, Halle Berry does want to be a mom, saying - quote - "I definitely want children very much. I want my kids to realize it`s only through hard work that any success or real joy comes. It`s not about money. It`s the intangible rewards - having integrity and doing what you say you are going to do."

Sounds to me like she`ll make a terrific mom.

You can read more on the life of Halle Berry - what`s going on with her now - in the April issue of "In Style" magazine, which is on newsstands Friday.

ANDERSON: Well, yesterday, we asked you to vote on our SHOWBIZ TONIGHT "Question of the Day": "Lindsay Lohan Out Clubbing: Is she setting herself up for rehab disaster?"

Check this out: almost all of you, 96 percent, say "yes, she is." Only 4 percent of you say, "no, she isn`t."

Here are some of the e-mails we received:

Cynthia from Canada writes, "Of course. She and Britney should pay more attention to the Anna Nicole story. They`re headed down the same path."

But Shay from Alabama thinks, "This whole rehab thing is overrated. Going out to clubs and drinking all night is a normal thing for people Lohan`s age."

All right. Well, keep in mind, Lohan isn`t quite 21 yet.

HAMMER: Let`s now find out what`s coming up tomorrow on SHOWBIZ TONIGHT.

And tomorrow, it`s rehab of the rich and famous. From Britney Spears to Lindsay Lohan, SHOWBIZ TONIGHT takes you right there, inside the rehab facilities of the rich and famous. How much do these places cost? What exactly do the stars go through? Are they really cleaning toilet bowls with toothbrushes?

And a SHOWBIZ TONIGHT exclusive: we`re going to go one-on-one with the head of the rehab facility Lindsay Lohan checked into.

All of that tomorrow, and only on SHOWBIZ TONIGHT.

And that is it for SHOWBIZ TONIGHT. Thanks a lot for watching. I`m A.J. Hammer in New York.

ANDERSON: I`m Brooke Anderson in Hollywood. Have a great night, everyone.

"GLENN BECK" is coming up next, right after the latest headlines from CNN Headline News.
