Spitzer Hooker Discovered on old "Girls Gone Wild" Video/Shooting and Hostage Stand-off at Virginia Beach Apartment Complex

Aired March 19, 2008 - 20:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

NANCY GRACE, HOST: Breaking news tonight. New York state governor Eliot Spitzer, AKA client number nine, vacates the governor`s mansion after the tough guy/crime fighter busted in a high-priced prostitution ring, Spitzer a regular customer to the tune of $80,000. Tonight, the 22-year- old hooker turned overnight star set to rake in millions -- that`s right, millions. Cashing in for breaking the law? Shouldn`t will be a crime against that? There is, the "Son of Sam" law. Let`s use it.
(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: We all know Eliot Spitzer. We know about the call girl Kristen, better known as Ashley Dupre. She`s going to cash in on this. She`s got book deals on the table. She`s an aspiring singer, record deals on the table. Joe Francis, Mr. Girls Gone Wild -- he wanted to offer Ashley $1 million. But before that could happen -- I mean, the lawyers were talking, he was almost ready to pony up the cash -- they start looking in the files of "Girls Gone Wild," and wa-wa, there is Ashley Dupre. So they didn`t have to pony up the $1 million. They already have her. So (INAUDIBLE) she signs her life away with the "Girls Gone Wild" people. Now at 22, she`s an actual prostitute. And again, she`s turning rich and famous out there.

(END VIDEO CLIP)

GRACE: And tonight, new evidence emerges in the mystery surrounding a stunning young actress/model found brutally murdered inside her Santa Monica home. Twenty-one-year-old Juliana Redding`s mother tries desperately to reach her for days. Tonight, an autopsy complete but still under wraps. Sources narrow down the timeline, reporting the actress dead less than 48 hours. No bullet wounds, no stab wounds, no forced entry, reports of a loud noise near the apartment and a trail of blood. Tonight, it boils down to forensics in the murder of 21-year-old actress Juliana Redding.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Beautiful. Now she`s dead, the result of an apparent homicide. Aspiring actress Juliana Redding`s autopsy has been completed, but police have requested the autopsy stay sealed. The coroner`s office says the investigation reveals no bullet or stab wounds. Police say it appears Juliana was assaulted. Cops don`t have a suspect, but say everyone is a person of interest in the death investigation of a rising star that never had time to peak.

(END VIDEO CLIP)

GRACE: And tonight: An Albuquerque Girl Scout troop selling Girl Scout cookies as usual, but now a 42-year-old Girl Scout volunteer behind bars, the evidence unfolded when a Girl Scout mom opens what she thinks is a Girl Scout cookies spreadsheet. Boy, was she shocked to discover graphic and disturbing child porn images. Tonight, Girl Scouts USA fire back.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: One local girl Scout Troop in Albuquerque, New Mexico, is in shock after one of their volunteers is accused of child molestation and child pornography, police arresting 42-year-old William Blaking (ph) for alleging a 6-year-old relative, the investigation heightened when a Girl Scout mother, thinking she`s looking at cookie sales spreadsheets, sees child porn instead. At his Albuquerque home, police find more disks, more child porn, and then a chilling discovery, several cameras, video recorders and computer equipment. The Girl Scouts say a background check on Blaking came back clean.

(END VIDEO CLIP)

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Tonight, the hooker that brought down a political dynasty, causing New York`s governor to move out of the mansion, set to make millions.

But right now, we`re getting live reports out of Virginia Beach. Police say multiple people victims in a Wednesday evening shooting. It happened around -- it happened around 5:00 PM, Inverness Road. You`re seeing live pictures. This is off Bonnie Road near Mount Trashmore (ph). What we are learning right now, multiple people shot there. We`re coming out of Virginia Beach. These are live aerial photos.

So far, we believe the shooter is still inside a building at the apartment complex. A SWAT team is on the scene. Right now, you`re seeing a live feed of what is happening. There is one witness who said she saw a man carrying a shotgun in one hand, another gun, a short gun versus a long gun, come out, shoot a woman. Suddenly, people began to scatter, more shots fired. After the shooting, the man goes back into one of these apartments.

Right now, a mass shooting out of the Virginia Beach. We`ll take you straight back as soon as we learn more.

But right now, we`re turning back to the story of a 22-year-old hooker that brought down a political dynasty, Eliot Spitzer having to move out of the governor`s mansion. And now she is making millions? Take a listen.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: We are all too familiar with the Eliot Spitzer sex scandal. You know the story, the former New York governor -- now former, anyway -- accused of spending tens of thousands of dollars on prostitutes, including a young lady known as Kristen, real name Ashley Dupre. And we wonder what`s going to happen to her? Well, how about this. Looks like she`s going to be rich and famous through all this. There are a half dozen book deals on the table. The aspiring singer could get a record deal, and she could get at least a half mil to pose nude for either "Penthouse," "Hustler." They`re wanting her services, so to speak. And she faces no charges, no charges for being a prostitute, which is -- again, is illegal.

(END VIDEO CLIP)

GRACE: Let`s go straight out to CNN correspondent Richard Roth. Millions of dollars, Richard?

RICHARD ROTH, CNN CORRESPONDENT: Well, we hear this in these types of situations. Sometimes we never really know how much someone gets paid. We do know how famous they eventually get. She could turn out to be the flavor of the month. I mean, look, the new governor of the New York, he has his affairs and women. Maybe they`re going to come forward.

But as for Ashley Dupre, she`s received offers that we know from "Hustler" and "Penthouse," a million dollars, Larry Flynt of "Hustler" saying he`s not going to go beyond that. And as previously mentioned, Joe Francis of the "Girls Gone Wild" video collection was ready to offer her a million dollars until he discovered after a reporter`s question that video of the younger Ashley Dupre was already in the files from a one-week drunken bus tour "Girls Gone Wild" organized. He says she was kicked off the bus because she was allegedly drinking. But no money has changed hands. She hasn`t been charged yet. She hasn`t been seen recently.

GRACE: To Ian Drew, editor at large with "US Weekly." Ian, there are laws on the books, Son of Sam laws, regarding making money off of a crime. What is she set to make, Ian?

IAN DREW, "US WEEKLY": She could make anything, but she has to strike right now. The deal is when she strikes is what`s really going to set the price. Her fame is vastly diminishing. And by the end of the week, she`s really not going to be a story anymore.

GRACE: Oh, really, Ian? Because now she`s downloaded a second song, and she`s getting more and -- it`s one of those situations where the more it`s downloaded, the more money it makes. It`s up to 98 cents per download. And so far, there have been nearly 300,000 downloads. That`s nearly half a million dollars.

DREW: That was actually last week, in the height of it. And we`ve seen this before with other celebrities. People all download the song out of a curiosity factor, and then it drops off the minute they fall out of the news. It really can`t maintain. Heidi Montag (ph), a big reality star, same thing. She released a song. It was through the roof on iTunes. The next week, no one wanted to hear it anymore. Unless it`s a good enough to song to stay out, it really isn`t showing that kind of staying power.

GRACE: Out to the lines. Shannon in Oklahoma. Hi, Shannon.

UNIDENTIFIED FEMALE: Hi, Nancy. How are you?

GRACE: I`m good, dear. What`s your question?

UNIDENTIFIED FEMALE: I wanted to know why this Kristen girl is becoming so famous. She`s a prostitute. But back in the `90s, Heidi Fleiss did the same thing and she went to jail for it.

GRACE: Why are you saying she`s a Christian girl?

UNIDENTIFIED FEMALE: That`s what they`re calling her, Kristen, instead of her name, Ashley.

GRACE: Well, all I know, Shannon, the earliest that I know of where she was 17 years old down in Florida, almost naked in a "Girls Gone Wild" video. Now, I don`t know where the young good girl comes into this scenario, but I`m still digging. There you go, Liz. Thanks a lot for that.

Let`s go to Houston, Texas. Standing by -- oh, everybody, that is the Web page from "Girls Gone Wild." Let`s go out to Andy Kahan. He`s the director of the crime victims assistant division with the Houston mayor`s office, a long-time victims` rights advocate.

Andy, welcome back. You know, you and I have spoken many, many times about serial killers and others that make money, blood money, off crime. In fact, you inspired a portion of my book, "Objection!" What about this? How is this any different, except we don`t have a dead body?

ANDY KAHAN, DIR., CRIME VICTIMS` ASSISTANCE UNIT, HOUSTON MAYOR`S OFFICE: Well, first of all, Nancy, a belated congratulations on your twin victim advocates. It`s nice to have some more of us out there.

First of all, let`s keep in reality, the Son of Sam laws deal with those who are convicted. Right now, Ashley Dupre has not been convicted of anything. Now, frankly, the last time I checked, prostitution is illegal. Yes, from my perspective, she should be charged not only in the New York City but also District of Columbia. If she`s charged and convicted of prostitution, the court then should order any proceeds she obtains from committing illegal acts and doing illegal behavior turned over to the courts. But until then, it`s fair game.

GRACE: Out to the lawyers, Randi Karmel, Remi Spencer, Renee Rockwell. Randi, will she face criminal charges?

RANDI KARMEL, FAMILY LAW ATTORNEY: Absolutely not. The prosecution here is using her as a witness, rather than as a defendant. They need her testimony, and most probably, they`re going to give her some sort of immunity.

GRACE: What about it, Renee?

RENEE ROCKWELL, DEFENSE ATTORNEY: Oh, I agree. But Nancy, I don`t even think she needs to face charges. This is a mere prostitution charge, and I`m just sorry that the governor of New York resigned over this.

GRACE: I`d like to see Renee`s face, please. Renee, yes, no -- isn`t prostitution still a crime?

ROCKWELL: Where?

GRACE: No, I`m asking -- are you being serious or are you being sarcastic?

ROCKWELL: Well, Nancy, prostitution is not a crime in Vegas.

GRACE: OK. What about your jurisdiction of Atlanta? Is it a crime there?

ROCKWELL: Yes, it is.

(CROSSTALK)

GRACE: That`s a yes, no question. I don`t need to hear a whole blah, blah. But it`s still a crime. Why are you saying it shouldn`t be prosecuted?

ROCKWELL: You get a ticket...

GRACE: Right. But...

ROCKWELL: ... for prostitution in Atlanta.

GRACE: ... it is a crime.

ROCKWELL: It is a crime. And Nancy...

GRACE: Hookers are busted all the time and spend the night in jail.

ROCKWELL: Maybe.

GRACE: This girl`s making $2 million!

ROCKWELL: And why shouldn`t she? She doesn`t have to talk about the prostitution. She can make money off of her songs.

GRACE: That`s all she`s got to talk about. Have you heard that song? "I know what you want. I`ll give you what you want. I know what you want. I`ll give you what you want." Please!

ROCKWELL: And Nancy, she hasn`t been convicted of anything. But the whole thing is...

GRACE: You guys can quit saying that over and over and over. I know she hasn`t been convicted yet.

ROCKWELL: But she should not have -- there`s too much todo over this entire thing. And the fact that the governor resigned over this is even more ridiculous.

GRACE: Yes. OK. Second verse same as the first. Thanks for that legal analysis, Renee Rockwell.

Let`s go to Remi Spencer. Will there be a prosecution of Kristen?

REMI SPENCER, DEFENSE ATTORNEY: Will there be? I don`t know. Can there be? Of course. I think the feds have done a very thorough investigation here, and their proofs are going to be compelling. Whether or not she can profit off this is going to be another question. You know, appearing in "Hustler" or in "Playboy" or appearing on "Girls Gone Wild," if you`re above age, is not illegal. And so long as there`s a public desire to see her, because this incident has catapulted her to superstardom, maybe that says something about our society -- but she has a right, a legal right, to profit by doing legal activities.

GRACE: OK. Hold on. Actually, I don`t know if you`re familiar, Andy Kahan, let`s talk about the Son of Sam laws. This is a very old case. Simon & Schuster took the book written by a mobster, "Wiseguy," and turned it into a movie, "Goodfellas," big, big hit movie. Long story short, Son of Sam laws struck down all across this country, but they have been replaced in many jurisdictions by notoriety for gain. What about it, Andy?

KAHAN: Well, again, let`s get her convicted...

(CROSSTALK)

GRACE: I`m going from the conviction on.

KAHAN: Let the courts deal with it from that perspective. I mean, we should be horrified in this country that we`re going to let somebody who goes out and commits illegal acts and now is going to make a bazillion dollars. I mean, what kind of role model are we setting an example for? Go out, sell your body, become rich. I mean, it`s just absolutely pathetic that we have to allow this in society.

This is a great test of the Son of Sam laws. And I think the New York officials, District of Columbia officials really need to look at are they going to allow this person, who was absolutely nothing before getting involved with Eliot Spitzer, to now catapult based on her infamy and become rich? That`s the million-dollar question, and I think this is where you`ve got to draw the bottom line.

GRACE: The new breed of Son of Sam law says you will not gain from illegal activity, period.

KAHAN: Correct.

GRACE: That`s what it says.

To Mike Brooks, former D.C. cop, former fed with the FBI. Mike, you really can`t use the girl`s testimony unless she works a deal, all right, because a jury is not going to bring down Spitzer if the hooker isn`t brought down, too. Sure, she may get a sweetheart deal, pay a $500 fine and testify, but that still is a conviction. The law says you don`t make money off crime. Why is everybody ignoring this?

MIKE BROOKS, FORMER D.C. POLICE, CNN LAW ENFORCEMENT ANALYST: No, you`re right, Nancy. I mean, even if it`s a misdemeanor, it`s still a crime, plain and simple. But there could be other charges that they could probably go after her. You know, it`s always follow the money trail, Nancy. Let`s see if she was reporting all of her income from all of her clients one through ten.

You know, but going back again, you know, will we see any charges against the former governor, Spitzer? That remains to be seen, too. The FBI is still looking into this on the public corruption side of things, and I`ll be very anxious to see whether or not they bring any charges against him. But you will see her as a witness. And will she get charged? Possibly, but highly unlikely.

GRACE: I say, in order to use her as a witness, they`ve got to bring a charge against her in order for the prosecution against Spitzer to have any credibility. It`s just like getting one co-defendant to flip on the other. You don`t grant that co-defendant complete immunity from prosecution, you work a deal. You can`t let a jury think that somebody walks scot-free just because they tell the truth. There has to be a prosecution of both of them.

Out to the lines. Patty in Oregon. Hi, Patty.

UNIDENTIFIED FEMALE: Hi.

GRACE: Hi, dear. What`s your question?

UNIDENTIFIED FEMALE: Well, my question is, if you really want to prosecute this person, I think the best way to go about it is that her income -- how much of it has she reported? How much of it is legal? And what has the IRS done to audit that person and what they`re doing wrong?

GRACE: What about it, Mike Brooks, the money?

BROOKS: I tell you what, the money. Follow the money. We started out -- this all started out as an IRS case. And then when they found out, Oh, we have a public official here, then it was turned over to the FBI. But Nancy, as you know, when people show up at your house in raid jackets, with FBI jackets on, and you see the ones with IRS -- they fear the IRS more than they fear the FBI.

GRACE: Not just them. I`m speaking personally. And I`m going to unleash the lawyers one more time very quickly, Randi Karmel, Renee Rockwell, Remi Spencer. Renee, let`s just get real just a moment, OK? Don`t crank up some BS about how prostitution`s not a crime. The reality is, this isn`t a murder. Nobody`s dead. Nobody`s dismembered. But still, you cannot turn your back on a crime and not prosecute these people, Renee.

ROCKWELL: Well, Nancy, when everybody gets prosecuted for prostitution in D.C., then it`s time to let the cards fall and have a governor resign. But until then, Nancy...

GRACE: Well, that`s not a prosecution. So thanks once again, Renee, for that legal analysis.

Leslie Austin, Dr. Leslie Austin, psychotherapist, why prostitution? Why?

LESLIE AUSTIN, PSYCHOTHERAPIST: Well, because people think they can do that. They want the thrill. It is illegal and they just want...

GRACE: I think it`s a lazy way to make a living. Have you thought of that?

AUSTIN: Yes. I`d like to know why they`re not prosecuting the johns, too. Where are all these men in the law?

(COMMERCIAL BREAK)

GRACE: Right now, we are taking you back to breaking news in Virginia Beach. Joining us from CNN affiliate WAVY, Jason Marks, on the story. Jason, what`s happening?

JASON MARKS, WAVY: Well, Nancy, we can tell you that it appears that we have a man who has shot several people tonight here at an apartment complex in Virginia Beach. This all happened around -- just after 3:00 o`clock, there were reports of shots fired, anywhere from 10 to 12 shots. Witnesses we spoke with say this man just started firing. We`ve heard reports of why he started firing. I don`t want to release that because police are not confirming those reports yet.

But he started firing. Several people were hit. Police are not saying that we have any people that are dead yet, but we`re hearing a lot of reports that there are. Right now, SWAT has surrounded an apartment where this man evidently is inside. We`re hearing reports that he does have several hostages. And SWAT has been trying to negotiate with him, Virginia Beach SWAT team, for about an hour-and-a-half. But we`re hearing reports that they might be ready to go in. They`ve been calling out to him over the megaphone, trying to get this man to come out, trying to surrender. But so far, that hasn`t happened.

Like I said, Virginia Beach police aren`t releasing a lot of information, only that they have multiple victims. And that`s all they`re saying. So they`re being very tight-lipped so far. The information that we`re getting is from people who were standing around, people who saw the shooting happen. But like I said, that`s very much unconfirmed at this point.

GRACE: Joining us there at Virginia Beach in a breaking story happening now -- you`re seeing a live feed -- Jason Marks with WAVY. According to our sources, two people have been shot, a gunman on the loose. Right now, police and SWAT using loudspeakers to try and get the gunman out of the building, still armed, we believe, with at least one long gun and more weapons, as well.

I want to go back to Jason Marks. I know you`re saying that police are not stating the reason for this, but it sounds awfully like some type of a domestic dispute that went far beyond that.

MARKS: Well, yes, I mean, Nancy, without really speculating on what happened -- this is all unconfirmed and I`m just going to tell you, what we`re hearing from people, and take that with a grain of salt. This is coming from people. This could be very much not the case. But what people are telling us is that the man who is holed up in the apartment is a maintenance worker. He was fired from the apartment complex and he was going to be evicted. And so this could be some sort of an employee who was upset at the complex. But like I said, that is very much unconfirmed at this point.

GRACE: Right now, we know two shot, according to sources, a stand-off at a Virginia Beach apartment complex, SWAT and police now using a loudspeaker to lure the gunman out of the building. Apparently, hostages still being held.

(COMMERCIAL BREAK)

GRACE: You are seeing a live feed there at Virginia Beach, Virginia. What we know right now, according to reports, two people shot. There is an ongoing hostage situation.

Out to Mike Brooks. What now?

BROOKS: ... they`ve got this guy barricaded inside with looks like some possible hostages. The negotiators are trying to contact him. That`s what he`s talking about. We heard the reporter there saying that they`re trying to make contact with him through a megaphone or bullhorn. He said that there`s a possibility that they may go in. Law enforcement, when the SWAT team first gets there, they put together an emergency assault plan, should everything inside that apartment just totally go -- you know, go to hell in a handbasket.

But what they`ll try to do is they`ll try to negotiate with this person as long as they can and try to exhaust all means before they make an assault into that apartment building where he`s holding the hostages.

GRACE: Back to Jason Marks with WAVY there on the scene covering the story. Jason, I understand police have closed off several streets surrounding the area?

MARKS: Yes. This is a very large apartment complex. It`s call Thalia (ph) Gardens apartments. It`s over here in the center of Virginia Beach. It`s very large. I don`t have an estimate on how many apartments are here, but I can tell you it`s pretty widespread. So they have a pretty large area blocked off and roped off and -- just around here. And this is (INAUDIBLE) off of main thoroughfare here in Virginia Beach, so yes, I mean, they have everybody...

(CROSSTALK)

GRACE: Jason Marks with WAVY. We`ll take you straight back to that as soon as we get more news.

When we come back, new evidence in the mystery surrounding a young model/actress found dead in her Santa Monica home.

(COMMERCIAL BREAK)

GRACE: Before we take you to Santa Monica in the death of a young model/actress found dead in her apartment, let`s go straight back to Virginia Beach. Standing by Jason Marks with WAVY. Update on the story, we know that there are hostages on the inside. Reportedly two people shot. The street surrounding the apartment complex have now been cordoned off, blocked off. No one can go in or out. What else is happening?

MARKS: Well, they`ve been blocked off for hours and the reports of hostages is, like I said, really unconfirmed. We do -- you know a lot of people are saying that out here. Right now we just talked about a few minutes ago, SWAT is still surrounding this apartment complex where they believe that the man who is the suspect, who police are saying has shot several people, multiple people, they won`t say how many, but they believe that he is held up with some very high-powered artillery. And they`re trying to get him to come out, trying to get the best possible outcome, especially if there are hostages in there. They don`t want anybody else to get hurt. They`d like to get this guy in custody, you know, and let there be the best possible outcome.

GRACE: Do we know of any -- the condition of any of the victims, Jason?

MARKS: We are hearing some unconfirmed reports that there are some fatalities, that there could be at least one person dead. But, as I said, police -- Virginia Beach police are just strictly saying, we know we have multiple victims and that`s it. One more thing.

GRACE: Jason, what are police saying to the guy over the loud speakers?

MARKS: Pretty much they`re calling out saying, you know, hey, if you are in here, come out. You know, come out with your hands up. Come out. We want this to end up peacefully is what they`re saying to him. They`re trying to -- I don`t know whether they`ve been able to talk to him on the phone in there. But they are using that loud speaker to get him to come out and to come out soon because eventually they`re going to have to go in.

GRACE: Is it true, Jason Marks, that Dominion Power has been called in to cut the power off?

MARKS: You know, I`ve seen several power crews here and I don`t know if they`ve gone ahead and cut power to that particular unit off. I know that police don`t want us to release the fact if there are casualties in this particular incident because they don`t want that to be a bargaining chip against him, they don`t want him to know that if they are people dead it may ruin their strategy with talking with him.

GRACE: To Mike Brooks, what good is it to cut the power off? Explain.

MIKE BROOKS, FMR. DC POLICE DETECTIVE SERVED ON FBI TERRORISM TASK FORCE: Well, Nancy, it`s one of the things they possibly could do. But that`s just -- you always bring the power company out. You bring the fire department, you bring all these people just in case you need to cut the power. But that`s not something you want to do right from the beginning because it`s negotiable.

GRACE: I still don`t understand. If you could explain specifically why cutting the power off is going to help negotiations.

BROOKS: No. That`s what I`m saying, Nancy. You don`t want to just cut the power of inadvertently right from the very, very beginning. They`re trying to develop a rapport with him inside to see exactly if he`s in there by himself or, in fact, if does have hostages. And if he does have people inside with him, are they injured? Are they OK? They also would try to introduce a crisis phone so they can have direct communications with him.

GRACE: Got it. Leslie?

DR. LESLIE AUSTIN, PSYCHOTHERAPIST: At some point they may want to cut the power off to use leverage. If he gets uncomfortable, he gets tired, there`s no heat, there`s no air-conditioning. It`s a negotiation thing that they can get him -- get back to him in return for something.

GRACE: Right now heavily armed SWAT team officers focused on the 4100 Block, (INAUDIBLE) road. Right now we believe that hostages are being held. So far we have reports of two gunshot victims. The hostage situation ongoing. The SWAT team now barking over a mega phone trying to get the guy out without any more shooting victims. We`ll keep you posted. We`re coming from Virginia Beach live.

Right now to Santa Monica, take a listen.

(BEGIN VIDEOTAPE)

UNIDENTIFIED MALE: She was young. She was beautiful. Now she`s dead. The result of an apparent homicide. Aspiring actress Juliana Redding`s autopsy has been completed. But police have requested the autopsy stay sealed. The coroner`s office says the investigation reveals no bullet or stab wounds. Police say it appears Juliana was assaulted. Cops don`t have a suspect but say everyone is a person of interest. In the death investigation of a rising star that never had time to peak.

(END VIDEO CLIP)

GRACE: Right now straight out to Lew Stowers, reporter with Metro Networks. We were talking about a young model actress, Juliana Redding, just 21 years old, found dead in her apartment. All the information being kept tight to the vest by police. What more do we know tonight, Lew?

LEW STOWERS, REPORTER, METRO NETWORKS: That`s pretty much it, Nancy. It is a very tragic tale here. You can see the flowers, memorial over the left side of the screen there over my right shoulder there. A lot of people are very upset and disappointed that Juliana is gone.

I just got off the phone just moments ago with the assistant chief of the L.A. County Coroner`s Office, Ed Winter, and he told me that they are not releasing the results of the autopsy. They`re putting a 30 to 60 day hold on that via the Santa Monica Police Department. But the autopsy did reveal there were no signs of bullet wounds or stab wounds on the body of Juliana Redding. When I asked Chief Redding -- or Chief Winters, excuse me, about any possibility of bruises around the neck area or signs of asphyxiation he had no comment which is very interesting to me.

Also, they are going to be depending on DNA evidence in this investigation. Lieutenant Alex Padilla of the Santa Monica Police Department saying that there was plenty of that around. There was no forced entry in the condominium that`s over my right shoulder. You can see the roof line just barely over the hedge there. As -- but there were no signs of forced entry. But Juliana was assaulted sometime between Friday night and Sunday evening when Santa Monica Police discovered her body in that condominium at about 6:00.

GRACE: To Mike Brooks, former fed with the FBI, Mike, there is no gunshot wound, no stabbing according to sources. Also we`ve heard from a different source it was not a bludgeoning death. That only leaves strangulation.

BROOKS: That sure sounds like it, Nancy, and we just heard, you know, when the coroner was asked that -- the assistant coroner was asked that he had no comment which I find also very, very interesting. But DNA is going to play a big role in this. Any kind of other evidence, trace evidence inside that apartment, no forced entry. So did she know this person or was this totally a random act of violence?

GRACE: Out to the lines, Tony in New York, hi, Tony.

TONY, NEW YORK RESIDENT: Hi. I have a question about if they have any list of convicted rapists in that area or molesters and if so have they tracked them down?

GRACE: To John Ramey, editor with KNX 1070, John, what do we know about possible convicts or sex offenders in the area?

JOHN RAMEY, EDITOR, KNX 1070: Well, if there`s a master list, Nancy, police certainly aren`t bringing it up and no -- none of the news sources have mentioned such a thing. Also this is obviously an enormous metropolitan area. So there are likely to be bad people around as you have a high number of people. Even a small percentage will be a sizable population.

GRACE: It`s also my understanding, back to Lew Stowers, there was no sex attack?

STOWERS: This is a very high concentrated area. We have Los Angeles just across the street, literally. This is the city of Santa Monica that we`re on right now.

GRACE: Was there a sex assault, Lew? Was there a rape?

STOWERS: A sexual assault? There was an assault. Whether it was sexual in nature, I don`t know. But just.

GRACE: OK.

STOWERS: By the fact that Lieutenant Padilla tells me that there is DNA evidence, that points the finger towards, yes, there was some sort of sexual assault.

GRACE: OK. According to our sources there is not a sex assault. But the evidence is still unfolding.

Let`s go out to Dr. David Fowler, medical examiner and forensic pathologist. Dr. Fowler, so often we hear that a time of death cannot be determined. Yet here we have a time of death that has been set forth by the medical examiner?

DR. DAVID FOWLER, MEDICAL EXAMINER, FORENSIC PATHOLOGIST: Nancy, in this case what you`ve been given is that the time of death is less than 48 hours. That`s a very broad window. So they really haven`t given you a time of death. What they`ve done is they`ve just drawn a single line in the sand, which is, you know, what the science can really do for us.

GRACE: I want to go now to a special guest joining us, Mike Urbanski. He is the administrator at Salpointe High School, Juliana`s alma mater.

What could you tell us about her?

MIKE URBANSKI, ADMINISTRATOR, SALPOINTE HIGH SCHOOL: What I can tell you about Juliana was that as one of her counselors said, she was a breath of fresh air. She was a bubbly personality. She got involved in a lot of things while she was at Salpointe Catholic High School. Three different sports. Was a great golfer. Did a lot of community service while she was here at this school. And I just was really very attractive young women in a lot of different ways in terms of just the way people were drawn to her.

GRACE: You`re seeing shots of Juliana Redding, 21, found dead in her apartment. The investigation goes on.

UNIDENTIFIED MALE: According to Girl Scouts of New Mexico Trails, William Blekkenk has volunteered with the troop as a cookie sale coordinator. Police are now looking at Blekkenk after a family member told police Blekkenk (INAUDIBLE) inappropriate place on her body. Police arrested Blekkenk soon after but authorities say the story took quite a different twist the next day. Police reports state a Girl Scout mother took a disk from Blekkenk that she thought contained cookie sale spread sheets. But she told police when she opened the disk on her home computer there were images of adults having sex with children. She turned that disk into investigators immediately.

GRACE: You know, right when you think you`ve heard it all something like this happens.

To Peter St. Cyr with 770 KKOB, I want to talk to you about the disk. The Girl Scout mom opens up a Girl Scout -- a disk she thinks is about the cookie sales and it`s adults having sex with children. Now, why, may I ask, Peter, aren`t there any child porn charges lodged against this guy right now?

PETER ST. CYR, REPORTER, 770 KKOB: Well, Nancy, we`ve just learned that a judge has signed off on the warrant. And now those computer forensic scientists, they`re going to get a chance to pore over this one- time volunteer`s computer, hard drive, CDs and video recorder. They`re going to be looking for more images of underage girls having sex with adults. I was told this afternoon that cops can charge Blekkenk with one count for each image, each animation and each video that`s found.

GRACE: How do you say it? Blekkenk?

ST. CYR: Blekkenk, Blekkenk is the correct pronunciation.

GRACE: Blekkenk. Peter, how did he come to be a Girl Scout volunteer? I know the Girl Scout America is very tight on that. Whenever there is -- I believe a man, a male helper, there has to be an unrelated adult female supervising as well. They`re very, very stringent about that.

ST. CYR: That`s right. While men are welcome to be volunteers, they work directly with the girls, but only under the supervision of the female role model. I did learn Blekkenk never had contact with individual girls.

GRACE: Thank god in heaven.

ST. CYR: His role as a sales coordinator was to work with the troop leaders to make sure that the orders came in on time. He tracked the sales.

GRACE: But why, why was he a volunteer with the Girl Scouts? How did he get connected to Girl Scouts?

ST. CYR: Well, you know they recruit -- they do, they do recruit. I was told this afternoon from schools, families and churches. And so it`s an interesting question for sure.

GRACE: OK. Right there. Let`s unleash the lawyers, Randi Carmel, Remi Spencer, Renee Rockwell.

Remi, I don`t care what you want to say about me. I just -- right now the antenna goes up when the guy suddenly develops an interest in the development of young girls not his own.

REMI SPENCER, DEFENSE ATTORNEY: Well, first, Nancy, I think you`re wonderful and I think you`re fabulous so that`s what I think about you.

GRACE: But go ahead.

SPENCER: Second, I think you`re right to have that suspicion. I think a lot of people have that suspicion. I think it`s for that very reason the Girl Scouts of America require that an un-related adult female supervise the male who`s volunteering. But we can`t take away from the fact that there are so many, many more good than bad, adult men who want to volunteer, who want to help, who have nothing criminal in their minds or in their hearts.

GRACE: Totally -- I appreciate the sentiment. Remi, not my question. I`m saying, right at the get-go, why is a man volunteering to see the development of young girls not his own.

Peter St. Cyr, you say the judge issued a warrant. Is it an arrest warrant or a search warrant for those disks and computers?

ST. CYR: Nancy, it`s a search warrant.

GRACE: OK. So far what have they found in the home? Cameras? Computers? What?

ST. CYR: There were CDs and video recorders as well. But they were lured to the home after a grandmother heard a secret. It all started, the concerns of lurking dangers, after the grandmother told detectives she had heard an alarming story. You see, she baby sits the girl, and after school she overheard the alleged victim telling the young cousin that she had a secret with an older relative. She warned the other girl she could not share the story because the man said he would go to prison and not be able to eat or drink.

GRACE: So the alleged molestation kicked off the search at the home. Then we get to the Girl Scout spread sheet and find child porn.

To Renee Rockwell, Randi Karmel, Remi Spencer.

Renee Rockwell, if you take a hard look at this, long story short, we`re going to have -- most likely if he goes to trial arguing a mental illness, what do you think?

RENEE ROCKWELL, DEFENSE ATTORNEY: Well, Nancy, this is the kind of case that is not going to go to trial, I can tell you that right now. Just because somebody`s charge does not result in a trial. As a defense attorney, this is damage control, period. You need to strike a deal to make the child avoid a trial and make the family avoid a trial. This is a case that`s going to plead out, Nancy.

GRACE: Randi Karmel, do you -- if it does go to trial, my question is, do you see a mental defense formulating?

RANDI KARMEL, DEFENSE ATTORNEY: I would hope not. This man probably knew exactly what he was doing. And image after image after image on his computer will aggregate into another count, another count, another count and he should go away for the rest of his life.

GRACE: Well, out to the lines, Jan in Illinois. Hi, Jan.

JAN, ILLINOIS RESIDENT: Hi. I really adore your show and your babies are beautiful.

GRACE: Bless you. Thank you. What`s your question, Jan?

JAN: My question is, didn`t anybody do a background check or like a security check on this man? I used to work in a school, and any time we volunteered with the Boy Scouts or, like, volleyball or basketball, the school would do a background check on us.

GRACE: What about it, Doctor Austin?

AUSTIN: They do a check. They`re pretty strict about this and unfortunately sometimes somebody slips through. I don`t think you can fault the Girl Scouts here. They do have procedures and they were followed.

GRACE: To Dr. David Fowler, medical examiner, in a child molestation case, what are you looking for in the examination of a child`s body to determine if you can corroborate the story?

FOWLER: Lots of things. The external examination of the child will certainly show whether or not there`s been any bruises, bumps, et cetera, on this child indicating forcible activity on the child. And then, of course, there is the examination of the genitalia and looking for injuries to that area.

(COMMERCIAL BREAK)

GRACE: To "HEADLINE PRIME`s" Glenn Beck. Hi, friend.

GLENN BECK, HOST, GLENN BECK SHOW: If you don`t know about black liberation theology, then you are missing important facts crucial to making a decision this presidential election. It is a radical and intolerant system that Barack Obama`s pastor based his beliefs off. After 20 years of sermons how did Obama take it in? How much of it does he believe? What are his policies? Are any of them based on this? We`ll have more in just a bit.

Then the Supreme Court has begun hearing oral arguments in the case of the D.C. handgun. Wayne (INAUDIBLE) will be here. Coming up.

GRACE: A Girl Scout mom opened up what she thought was a Girl Scout cookie spread sheet. Instead she found images of child porn.

Right now, Mike Brooks, what can police do to build a case?

BROOKS: Well, Nancy, they got -- we`ve heard, every single image is one particular charge. Now, they`re going to take a look at this computer. He may have thought he could erase things but you go back, pull that hard drive, it`s still on there. This guy needs to be buried under the jail, Nancy.

GRACE: To Anna in Pennsylvania. Hi, Anna.

ANNA, PENNSYLVANIA RESIDENT: Hi, Nancy. I just think you`re wonderful and your children are beautiful.

GRACE: Thank you.

ANNA: I have a question for you.

GRACE: OK.

ANNA: Now, my daughter is involved in the Girl Scouts. And whenever they have a meeting and there has to be the troop leader.

GRACE: Right.

ANNA: .and a parent or volunteer also involved in the meeting.

GRACE: Right. Question.

ANNA: Also, could the Girl Scouts of America be held accountable for not making sure.

GRACE: Good question. What about it, Randi Karmel?

RANDI KARMEL, FAMILY LAW ATTORNEY & CHILD ADVOCATE: Some sort of lawsuit against them. However, it seems they`ve done everything they normally do and in this case as in every any case and I don`t think that anything would actually stick. They did do a background check of him and interviews.

GRACE: Everyone, let`s stop and remember Army Specialist Benjamin Garrison, 25, Houston, Texas, killed, Iraq. Left Houston Community College to enlist. Awarded the Purple Heart and National Service Defense medal and Global War on Terrorism service medal. Kindhearted. Loved helping others. Leaves behind parents, Martha and Eddie, brother Ronnie, and widow, high school sweetheart, Carla.

Benjamin Garrison, American hero.

Thanks to our guests but especially to you. And tonight a special good night from Renee Rockwell and her Alabama and Texas friends, Ashton and Hannah. Aren`t they precious?

Everyone, I`ll see you tomorrow night, 8:00 sharp Eastern. And until then, good night, friends.
