CASAREZ: The very same day that Katherine Jackson was granted permanent custody of the children, this video is being released. You are seeing it for the first time in its entirety on this show. It is from Splash News, Prince`s 2nd birthday in 1999 and Paris`s 4th birthday in 2002. To Michael Walker, senior editor of "The National Enquirer." Your thoughts?

MIKE WALKER, "NATIONAL ENQUIRER": It just breaks your heart when you see that little girl. You remember, it`s the same thing that she said at the memorial service. I was there and I saw her, and it just caught us all when she said, You`re the best daddy in the whole wide world. Anybody who has a daughter knows that that was a great father. And that we can`t take away from Michael Jackson. He was greatest father probably that ever lived.

CASAREZ: I`m Jean Casarez of the legal network In Session, in for Nancy Grace. This is amazing video seen for the first time tonight right now in its entirety, released just today.

I want to go to the attorneys, Gloria Allred, victims` rights attorney, child advocate out of Los Angeles, Eleanor Dixon out of Atlanta and Peter Odom, also out of the Atlanta jurisdiction.

Gloria, I know that in the past, you have had issues with Michael Jackson having custody of his children. When you look at this video, any change of heart?

GLORIA ALLRED, VICTIMS` RIGHTS ATTORNEY: No, not really. I was concerned because he dangled the baby over the side of the fourth floor balcony, and that was clearly endangering the baby. But looking at this video, I have some questions about it, frankly. You know, it looks as though Paris is looking to the side. Did someone teach her to say what she said -- Daddy, you`re the best daddy in the world? And then, you know, the other child says that.

And I mean, I don`t know. I`m not saying that she didn`t feel that about him. But for me, it feels a little bit uncomfortable. It feels staged. And obviously, he`s very, very good at staging and theater. And even if it`s real, it`s making me very, very uncomfortable, especially the part where they sing about, Don`t take my daddy away. What was the purpose of that song?

CASAREZ: That`s right. And Gloria, this video was taken 1999, 2002. It was before the raid on Neverland and obviously before his criminal charges.

Let`s go out to Dr. Lisa Weinstock, psychiatrist. What do you have to say about what Gloria just said, an aspect of possibly staging this video. Is that what you see, or do you see love and a family?

DR. LISA WEINSTOCK, PSYCHIATRIST: Well, you know, it`s hard. You know, when I watched the video, it struck me a lot like videos you see of every other family. When, you know, people are videoing a birthday party or something, there`s always a staged piece to it because they`re being videoed. So I think it`s really hard to know in one small piece of video whether or not this is more staged than any other video.

Clearly, there were parts of the video that struck me as very normal, when he was sitting down and helping the kids clean up the puzzle. All of those were things that I think there had been questions about. You know, is he, you know, kind of a typical father? What is he really doing with the kids? But of course, it`s such a small piece of these kid`s lives that it`s really hard to make any assumption of what that means in terms of his parenting skills in general.

CASAREZ: Let`s go to Firpo Carr, Jackson family friend. You knew the children. You know the children. One thing that struck me is that, forever, Michael Jackson had his children with masks on when they would go out in public. Now this video is released. They have no masks. Your thoughts on all of that?

FIRPO CARR, JACKSON FAMILY FRIEND: Well, there`s a couple of things that I think are easy to be overlooked. One is that this video was not meant for public consumption. That`s the first thing. Secondly, it would be difficult for Michael to stage -- reach from beyond the grave how his daughter, Paris, responded at the funeral. No, it`s not staged at all. This is a genuine -- this is genuine love being shown by both Michael and his children toward him.

You also might notice that no one else is around. That is, it`s not a public party. You don`t have any children of any rich or -- stars or anyone like that there. Michael Jackson had this in private, and he wanted it to stay in private. Why is that...

CASAREZ: And Firpo, was that his way? Was that his way, to have an intimate family gathering without a lot of outside people?

CARR: Absolutely, especially when it comes to birthday parties because that`s not something he enjoyed or he experienced as a child, being raised as one of Jehovah`s Witnesses. And of course, you notice, not even any family members were there. Notice that. Even his mother, Katherine.

So this is more of an education than a celebration. He wanted his children to know, Hey, this is how it is to have a birthday party. Later on, I`ll give you the real deal behind the pagan roots in it.

CASAREZ: All right. And tonight`s case alert, the desperate search for a 17-year-old Colorado girl in extreme danger, Deanna Archuleta, kidnapped in the wee hours from her Bayfield (ph) home. The suspect is identified as armed gunmen 25-year-old Daniel Baker. Police say Baker fired a .40-caliber pistol multiple times before fleeing with 17-year-old Deanna. Authorities on the lookout for a black Mercury Mountaineer and 2002 blue Dodge Durango, both with New Mexico license plates.

Deanna is 5-7 with brown eyes, long brown hair and a piercing in her left nostril. If you have information at all, call the La Plata County sheriff at 970-382-7020.

CASAREZ: I`m Jean Casarez of the legal network In Session, in for Nancy Grace tonight. That video that you`re watching, you`re watching for the first time in its entirety, that portion right there shot in 2002, one year before the raid on Neverland and the arrest, the criminal arrest, of Michael Jackson.

There was a big, big hearing in Los Angeles today for the Michael Jackson case. I want to go straight out to Alan Duke, CNN producer standing by live in L.A. Alan, you were in the courtroom for that hearing today. I want to hear everything, but I really want to hear about the attorney for dermatologist Dr. Arnie Klein standing up in court.

ALAN DUKE, CNN WIRE: It was unexpected. It was somewhat bizarre. I think the judge was somewhat baffled until he called for a -- well, the attorney called for a sidebar conference, where representatives from each of the legal teams went up to the judge`s bench and found out what it was he was talking about.

None of those lawyers are telling us tonight why Dr. Klein sent an attorney to court to ask that he have some part in raising these children, in making decisions about their education and their health care. He said that it`s something that a -- that Michael said to Dr. Klein, that he wanted him involved in the children`s lives, if he ever were to be gone, and that other people heard him say that. But he has nothing in writing.

And he -- in fact, the attorney, Mark Kaplan (ph), said that Michael Jackson is the presumptive parent of the two oldest children that were born to Debbie Rowe. Those are the children in question that he`s talking about.

CASAREZ: And key word right there, presumptive parent. Eleanor Dixon, prosecutor out of Atlanta. OK, let`s be real here. Why did this attorney stand up in open court to put on the record that he wanted to be a part of the children`s lives? This is the dermatologist that worked for Michael Jackson in treating him. He was Debbie Rowe`s employer. He also said publicly he donated sperm to a sperm bank. He can be a part of the children`s lives if he wants to. Why do it in court?

ELEANOR DIXON, PROSECUTOR: Well, that`s interesting, Jean, because you have to have what`s called standing to be a part of the suit or whatever`s going on in court. So clearly, he has some sort of connection to the children and to Michael Jackson beyond just a mere friend.

I want to go to Dr. Lisa Weinstock, psychiatrist. Lisa, you know, on the one hand, Michael Jackson says at the beginning to his children, perseverance and confidence, you can reach any goal, your heart`s desires. But we also see his children singing to the song "You are my sunshine, please don`t take my daddy away," and it was one year after that that Michael Jackson was charged in the criminal case.

From a psychological standpoint, just a coincidence there?

DR. LISA WEINSTOCK, M.D., PSYCHIATRIST: You know, it`s hard to know. Obviously, the kids probably didn`t know about the legal issues that Michael Jackson would have been facing. But it does make me question whether or not these kids were worried about, you know, what would happen if something happened to daddy.

You know, if -- you know he was the only real caregiver there. Then it would be normal that they would be scared, as any children are, about what would happen if their parents went away or if their parents died.

And there`s something really tragic about hearing them sing that song and seeing what`s actually happened to them, you know, many years later.

CASAREZ: Very tragic, very ironic. Let`s go out to Mindy in Florida. Hi, Mindy. Thanks for standing by.

MINDY, CALLER FROM FLORIDA: Thank you. I have a quick comment and a quick question. Since Katherine was given full custody of her grandchildren, can the children still have advocates appointed to them to keep Joe Jackson away from the children in case something happens to her?

CASAREZ: Good question. To Gloria Allred, your thoughts.

GLORIA ALLRED, VICTIM`S RIGHTS ATTORNEY, CHILD ADVOCATE: Well, I think if she is the guardian and she was appointed as the permanent guardian today, than it is her role to keep the children safe. And therefore, if it`s necessary to seek a restraining order, if she feels they`re endangered, that`s her job to do that and be an advocate for those children.

CASAREZ: Are you surprised, Gloria, that a guardian ad litem was never appointed to actually represent the children in their interests?

ALLRED: Yes, I am. And actually because a guardian ad litem was not appointed when Debbie Rowe attempted to relinquish her parental rights years ago, that was a basis for reversing that, for the court of appeals later, to find that she had not relinquished her parental rights and still had them.

So I`m wondering why a guardian ad litem was not appointed here. Perhaps it was because there was no contested hearing. That is, there was no one else seeking to be the guardian of these children.

CASAREZ: That very well could be. And the children signed a declaration saying they consented to this custody arrangement.

Out to Michelle in Georgia, good evening, Michelle.

MICHELLE, CALLER FROM GEORGIA: Hello?

CASAREZ: Yes. Hi. Your question.

MICHELLE: Thank you for taking my call. My question is, what type -- what kind of physical did Michael Jackson have? Because the autopsy report said that he had visible signs of needle marks and collapsed veins.

When the doctors who gave him that physical, wouldn`t they have seen that? And if they did, how did he pass the physical?

CASAREZ: Dr. Zhongxue Hua, medical examiner of Union County, New Jersey. What about that when he would be given his physical, which wasn`t too far away from his death? Couldn`t they have seen needle marks?

DR. ZHONGXUE HUA, UNION COUNTY, NJ, MEDICAL EXAMINER: They should. I mean that simple as that. I mean it`s not difficult to identify any needle mark, especially for patient who use chronic and using drugs. Especially in this case, you talking intravenous giving drug chronically. You would expect lots of needle marks. Some are fresh, some are healing, some are more old ages.

CASAREZ: To Firpo Carr, Jackson family friend. How do you think Michael would feel about the children now public without masks? We saw it at the funeral? But how would he feel about that right now?

FIRPO CARR, JACKSON FAMILY FRIEND, KNOWS MICHAEL JACKSON`S CHILDREN: Well, he would think that that`s fine because it was Debbie Rowe`s idea to put them in masks. It was not Michael`s idea. So he had no problem with that.

I think that also going back to -- as far as how his children would be treated or -- something that Gloria Allred said I think it was, my friend Gloria Allred, I think we should keep in mind that it was not an idea at all that Michael -- I don`t know if something`s coming in my ear here -- but it was not Michael`s idea at all that they should be -- I`m sorry.

CASAREZ: I`m Jean Casarez of the legal network "In Session" in for Nancy Grace tonight.

Intimate home videos of Michael Jackson and his children seen for the very first time in its entirety here. It is amazing stuff. At the very same time, a big hearing in Los Angeles taking place today for Michael Jackson and the estate.

Out to Steven Futterman, CBS Radio correspondent. You were in court today. We see the children, precious children, in that video. What was decided in court today about custody? And also, what was determined as far as a family allowance, we`re talking money, to the mother, the grandmother and the children?

STEVEN FUTTERMAN, CBS RADIO CORRESPONDENT, IN COURT TODAY: Well, Jean, pretty much what we expected. Remember, the deal was announced last week between Katherine Jackson, Michael Jackson`s mother, and Debbie Rowe, the mother of the two oldest Jackson children.

And the judge basically gave the go-ahead, gave the green light, approved the deal today, whereby Katherine Jackson is now the guardian of all three children. Debbie Rowe does get visitation rights for her two children. She`ll also maintain this spousal support. She`ll continue to receive the spousal support she received when Michael Jackson was alive.

Now some people have suggested this might be a monetary agreement. But the attorneys on both sides say no, this is not a monetary issue at all. That this was going to happen anyway. And that this is for the best interest of the children. That`s why they`re going to be with Katherine.

As far as an allowance, the estate -- the two attorneys -- or the one attorney and the music executive, John Branca and John McClain, who are the handlers of the estate right now, they request that the court give both Katherine Jackson and the children an allowance. We don`t know exactly how much it was. One would suspect it`s quite substantial, though, allowing them to pretty much maintain the lifestyles they`ve been maintaining before.

The judge agreed to give Katherine Jackson 100 percent of the requested amount made by the executors. The children, I think, are going to get around 83 percent. The judge saying that some of the money was duplicitous, saying that some of the money that will go to Katherine Jackson would also be going to the children, so.

CASAREZ: And Steve, let`s talk about some of that right now because money is at the heart, and it should be, of so much of this.

FUTTERMAN: Oh yes.

CASAREZ: To Peter Odom, defense attorney out of Atlanta. When you look at the trust document, what we have is that 40 percent of the state is to go to Katherine Jackson, 20 percent to the children -- 40 percent to the children and 20 percent to charities.

The children that we have been watching all hour in this video are going to be very, very wealthy. Now Katherine Jackson has issues with the administrators of the estate. She wants to be a co-executor of this whole thing. The issue is not resolved yet. What do you think will happen?

PETER ODOM, DEFENSE ATTORNEY: Well, there`s a clause in the will called "no contest clause" that says that certain contests brought by beneficiaries could actually result in that beneficiary losing benefits under the will.

Just looking at that, I think that Katherine might be taking a risk in contesting the executors. But under California law, she`ll probably end up with everything that she`s entitled to under the will.

I don`t think that she`ll be able to change the executors of the will. That`s really up to the court to do that. And Katherine Jackson really has no standing to be an executor or to make those decisions.

CASAREZ: All right. To Melanie in Ohio. Hi, Melanie. Good evening.

MELANIE, CALLER FROM OHIO: Hi, how are you?

CASAREZ: Fine.

MELANIE: I have a comment, then a question, please. I have been watching this video of him and the children, and maybe this "daddy, daddy, daddy," maybe that was meaning something to Michael because he was the only individual in their life. And that he wanted. So maybe -- you know, that`s reason for the emphasis on daddy with the children.

My question being, will the children -- will they be staying at Katherine`s house or will they be able to go back to their own home?

CASAREZ: OK, good question. From what we understand, they`re going to be at the Jackson estate in Encino, California. That`s where they will be. But Debbie Rowe will have visitation. A psychologist will get involved to determine when and how that visitation should take place.

To John Lucich, former criminal investigator and president of High Tech Crime Network. As you look at this video, you see the children, you see them looking to the side, you see the interaction. As an investigator, what do you see in this video?

JOHN LUCICH, FMR. CRIMINAL INVESTIGATOR, PRESIDENT OF HIGH TECH CRIME NETWORK: You know, when you take a look at the children, they are truly beautiful young innocent children who just appear to love their father. But when you take a look at Michael Jackson, how he lived his life while he was dancing on top of the car during the allegations of child abuse, the way he took drugs according to Uri Gellar and other close friends of his.

I don`t think like one of your other guests said he was probably the greatest father that ever lived. I totally disagree with that. And I think it`s a part of being a parent to be a good role model. Unfortunately, I don`t think Michael met that standard.

CASAREZ: OK. But we heard some things that he said about perseverance and confidence and reaching your goal.

To Dr. Lisa Weinstock, psychiatrist. There are a lot of positive things about an endearing father in this video.

WEINSTOCK: Well, in the video itself, certainly, there are a lot of pieces of evidence that make it seem like he`s a loving, caring father. And, clearly, the kids look very happy and connected to him. But, again, you know, it`s hard to make an assumption about what that means about their relationship in the bigger picture because it`s only one small piece of their lives.

And so I`d be hesitant to make an assumption either way that he was the great father in the world or that he was the worst father in the world based on this video alone.

CASAREZ: But as Firpo Carr said, Paris said the same thing at the funeral she said at that video time.

Out to Mike Walker, senior editor of "The National Enquirer." You`ve had the hour to watch this video. Your thoughts now as you`ve seen it several times?

MIKE WALKER, SENIOR EDITOR, THE NATIONAL ENQUIRER, COVERING STORY: Well, having seen it several time, I still don`t believe this was staged any more than -- as somebody said any other video you`d do with children at a party.

Let me make one thing clear. One of your guests took me to task for saying Michael was the greatest father in the world. What happened at the top of the show, I suddenly got caught off by the music. I was leading up to a point. I was leading up a but.

But I believe in the bottom of my heart and with all the investigation that we have done that Michael Jackson was a pedophile who had an unhealthy interest in young boys. OK? So he also was somebody who put his children in masks and took them out in public.

And I`m stunned to hear Firpo Carr say that was Debbie Rowe`s idea and not Michael`s. Since when does Debbie Rowe tell Michael Jackson what to do? We never heard that.

CASAREZ: And Michael Jackson was acquitted of criminal charges in his criminal trial back in 2005.

NICOLE, CALLER FROM CALIFORNIA: Hi, how are you?

CASAREZ: Fine, your question?

NICOLE: Oh yes. Since -- if Dr. Murray`s charged with any crime, since he was hired by the AEG, could charges be filed against them?

CASAREZ: All right. First of all, he has not been charged yet. You are right. There is an investigation with AEG. That would probably come into a civil aspect but not a criminal aspect.

Tonight, let us stop to remember Army Captain Kevin Landeck. 26 years old. From Wheaten, Illinois. He graduated from Purdue University with a degree in criminal law. He was awarded the Bronze Star. The Purple Heart. And the National Defense Service Medal.

He`s remembered for his big smile. He loved exchanging letters with a fourth grade class back home, watching sports, and pizza. He dreamed of being an FBI or CIA agent. He leaves behind his parents, Richard and Vicky, sister Jennifer, and widow Bethany, who`s also serving in the army.

Kevin Landeck, an American hero.
