Witness Said Tiger Was Drinking

NANCY GRACE, HOST: Breaking news tonight, live, Windermere Florida. Superstar golf phenomenon Tiger Woods leaving his home barefoot 2:00 AM after Thanksgiving Day celebrations, drives out of his multi-million-dollar compound and has a head-on collision -- with a tree and fire hydrant? His young wife, mother of his two children, reportedly hears the crash from inside the house, runs out and beats out both back windows of Woods`s Cadillac.

Over and over, Woods refuses to speak with police. A neighbor calls 911. We have the 911 call. Woods pulls out of his own golf tournament, as tonight the tally of alleged mistresses hits double digits. It all hits the newsstand just hours before the so-called crash. Now, after a slap on the wrist by cops, Woods still in hiding, not allowing his face or injuries to be seen.

Bombshell tonight. A witness at the crash -- a witness at the crash - - tells police Tiger Woods was drinking before the crash and he was prescribed sleeping pills and a super-powerful painkiller, Vicodin. Why -- why -- did prosecutors refuse a blood alcohol test when cops specifically asked for it? This as we learn Woods reportedly texting an alleged New York party girl mistress, trying to hook up even after the crash. Was Woods DUI, or was he fighting off an attack by golf club?

If Woods were an ordinary Joe, wouldn`t the charges be more serious, especially in light of an alleged DUI and cover-up not only to his wife but to police? All that money, all those trophies. He`s the very first athlete to surpass $1 billion in earnings. With an estimated $300 million prenup and two little children hanging in the balance, what really happened to Tiger Woods?

UNIDENTIFIED MALE: Breaking news. The Florida Highway Patrol wanted to take a blood test from Tiger Woods after the crash.

911 OPERATOR: What happened? What`s wrong?

UNIDENTIFIED MALE: I have a neighbor. He hit the tree. And we came out here just to see what was going on. I see him and he`s laying down.

UNIDENTIFIED MALE: In newly released police documents, an officer says a witness stated the driver, Woods, had consumed alcohol earlier in the day. The same witness, believed to be Woods`s wife, goes on to say Woods was prescribed Ambien and Vicodin.

UNIDENTIFIED MALE: After he crashed his SUV, neighbors say they found Tiger Woods lying on the ground without any shoes on.

UNIDENTIFIED MALE: Tiger Woods was actually passed out cold.

UNIDENTIFIED MALE: (INAUDIBLE) of Woods was suspected due to careless driving that resulted in the traffic crash.

UNIDENTIFIED MALE: Shoeless and snoring on the lawn.

UNIDENTIFIED FEMALE: We do know that Tiger Woods was not given a breathalyzer test. His blood and urine were not tested for drugs or alcohol.

UNIDENTIFIED MALE: A full-blown Tiger Woods scandal.

UNIDENTIFIED MALE: Hey, it`s Tiger. I need to you do me a huge favor. Can you please take your name off your phone? My wife went through my phone and may be calling you. Because she can, please take your name off that and, what do you call it, just have it as a number on the voicemail. Just have it as your telephone number. That`s it, OK? You got to do this for me. Huge. Quickly. All right? Bye.

UNIDENTIFIED FEMALE: Why wouldn`t Tiger Woods speak to police, and what exactly caused him to hit a fire hydrant and a tree?

UNIDENTIFIED MALE: Was he conscious, unconscious?

UNIDENTIFIED MALE: At that point, he was snoring.

UNIDENTIFIED MALE: He was snoring?

UNIDENTIFIED MALE: He was actually snoring.

UNIDENTIFIED MALE: OK.

GRACE: And tonight, live, Chicago, a beautiful 12-year-old little girl leaves her church choir practice and is never seen alive again. The girl`s family reports her missing, but no Amber Alert ever issued. Why? Tonight, the 5th grader found strangled just one block from her own home, disposed near garbage like she`s trash. Tonight, we want justice for this girl, 12-year-old Jahmeshia.

UNIDENTIFIED MALE: Twelve-year-old Jahmeshia Connor had just returned to her aunt`s home with her family after singing in the church choir. She boarded a bus around 8:00 PM, headed back towards her home less than two miles away. She never made it.

UNIDENTIFIED FEMALE: The body of Jahmeshia Connor was found in this alley at 64th and Marshfield, about a block from her home. An autopsy revealed Jahmeshia had been strangled.

UNIDENTIFIED FEMALE: Connor was missing for two weeks. Police say, however, they have information saying the girl had been spotted alive and near her home in recent days, but that`s all they`d say. Area 1 detectives maintain they did all they could to find her.

UNIDENTIFIED MALE: Authorities reportedly believe her body was likely in the alley no more than two days. Investigator workings the case have come under intense scrutiny after it was found that the media and the public were never notified that Jahmeshia was even missing and an Amber Alert was never issued.

UNIDENTIFIED FEMALE: If Jahmeshia Connor`s missing personal alert had seen on the streets of Englewood and all over TV, might she be alive today?

GRACE: Good evening. I`m Nancy Grace. Thank you for being with us. Bombshell tonight. Startling, disturbing new evidence, Tiger Woods DUI, on drugs and alcohol at the time of the crash? Why did prosecutors turn down a police request for the blood alcohol test? This as Tiger Woods`s alleged mistresses hit double digits. With an estimated $300 million prenup and two little children hanging in the balance, what really happened to Tiger Woods?

UNIDENTIFIED MALE: We`re learning Tiger Woods`s now infamous drive into the rough could have been caused because he was impaired.

UNIDENTIFIED MALE: My two officers arrived at the scene and noticed Tiger Woods laying on the ground.

UNIDENTIFIED MALE: Newly released documents reveal a police officer suspected Tiger Woods may have been impaired the night of the crash.

UNIDENTIFIED MALE: Troopers sought (ph) to get the results from Tiger`s blood work after he was treated at (INAUDIBLE) hospital for his crash injuries.

911 OPERATOR: Is he unconscious?

UNIDENTIFIED MALE: Yes.

911 OPERATOR: OK. Are you able to tell if he`s breathing?

UNIDENTIFIED MALE: No, I can`t tell right now.

UNIDENTIFIED FEMALE: This story just doesn`t make sense. You don`t get up out of your bed at 2:00 AM, drive your car and run it into a tree.

UNIDENTIFIED MALE: A highway patrolman says he spoke with a witness who admitted the driver, that being Tiger, had consumed alcohol earlier in the day.

UNIDENTIFIED FEMALE: The investigation has determined that Mr. Woods is at fault in the crash.

UNIDENTIFIED MALE: His wife came out of the house when she heard the accident, him hitting the fire hydrant, used a golf club, is what we were told, to break out the rear window to gain entrance into the vehicle, removed him from the vehicle and laid him down in the street.

GRACE: The facts really don`t seem to hang together between his and his wife`s story about what happened that night.

UNIDENTIFIED MALE: The witness stated the driver was prescribed medication, Ambien, a sleeping pill, and Vicodin, a pain pill.

GRACE: Now, when you saw Tiger, was he conscious, unconscious or was he snoring, like your brother (INAUDIBLE)

UNIDENTIFIED FEMALE: He was unconscious. I didn`t hear the snoring part because I wasn`t as close, but he -- never -- I never saw him open his eyes.

GRACE: Straight out to Drew Petrimoulx with WDBO joining us there in Orlando, Florida. Drew, please correct me if I`m wrong. I have in my hand a request to the state`s attorney, the Florida equivalent of the district attorney`s office, asking for the medical records on Tiger Woods`s blood to find out if alcohol or drugs were consumed and affected his driving. And the state`s attorney, an SNS (ph) Foster, I believe it`s Steve Foster, turned down the request. Why? Why?

DREW PETRIMOULX, WDBO: Well, what they said was that there was insufficient information to lawfully issue a subpoena in the case. And the only thing that I can gather from this is the fact that the witness in this -- in the crash who reported that Tiger Woods was allegedly drinking before said that he was drinking earlier in the day. So it`s unclear whether he was drinking right before the crash or if he would have been drunk at that time. Also, we talked about that she said...

GRACE: Whoa, whoa! Put Petrimoulx back up there! Drew Petrimoulx, that`s why you take a blood alcohol test, to find out if you`ve got alcohol in your blood, so we can find out how closely to the crash were you drinking, and if so, how much, and did it affect your driving. Plus, aren`t you saying the witness, who it also says pulled him out of the car - - it`s got to be his wife -- says he was prescribed sleeping pills and the super-powerful painkiller Vicodin, Drew Petrimoulx?

PETRIMOULX: Well, we do presume that to be his wife. But like I said, you know, it`s not clear if he was drinking right before. But to your point there, they did take a blood test. There is a blood sample of it. But the state attorney`s office wouldn`t issue a subpoena for investigators to have it.

GRACE: Refuses to get it. Let`s unleash the lawyers. We`re taking your calls live. With me, felony prosecutor Eleanor Odom out of the Atlanta jurisdiction, Shawn Chapman Holley, defense attorney out of LA, and Peter Odom, defense attorney renowned in his jurisdiction, Peter Odom out of Atlanta.

Eleanor, we don`t know when he was drinking. We don`t know how much he was drinking. We don`t know if he was drinking, although the eyewitness -- AKA, obviously, his wife -- says he was. We don`t know if he was on Ambien, although the next-door neighbor says, I was right there and he was snoring. He was on the ground, bleeding and snoring. We also know he`s got a prescription to Vicodin, according to this witness. That`s exactly why you get a blood alcohol test. And you are seeing newly obtained photos of his wife, a model.

Go ahead, please, Eleanor.

ELEANOR ODOM, PROSECUTOR: Well, Nancy, you`re right because, certainly, there`s problem cause here to get that blood test and see if he did, in fact, have enough. And clearly, you have unsafe driving, too, which in conjunction with the alcohol may be a DUI. But we just don`t know.

GRACE: OK, to the control room in New York. While I appreciate his wife`s extreme beauty, I do not believe that that is relevant as we are discussing a possible DUI, and really more important, the possibility that he was given celebrity treatment.

Many of us have held Tiger Woods up on a pedestal, including myself, because of his focus, his dedication. Let`s go to the lines. Angela, Oklahoma. Hi, Angela.

UNIDENTIFIED FEMALE: Hello, Nancy.

GRACE: Hi, dear. What`s your question?

UNIDENTIFIED FEMALE: Well, first I have a comment.

GRACE: OK.

UNIDENTIFIED FEMALE: Not to disrespect your parents or anything, but I believe they totally should have named you Amazing Grace.

GRACE: You know what, Angela? I`m going to get tonight`s show and I`m going to play it back to the twins when they turn 16 and they want to drive, God willing we get that far. But thank you. What`s your question, dear?

UNIDENTIFIED FEMALE: My original question was why was he not tested for drugs or alcohol? Us poor people out here that get stopped, we get tested.

GRACE: Let me tell you something. I was sitting at a stop sign, and the cop asked me to do a breathalyzer. I was completely stopped at a stop sign and had to do a breathalyzer. Now, Tiger Woods is passed out after a crash with a tree and a fire hydrant. His wife tells cops he`s been drinking, he`s prescribed Ambien and Vicodin, and he goes scot-free. Why?

UNIDENTIFIED MALE: My two officers arrived at the scene and noticed Tiger Woods laying on the ground.

UNIDENTIFIED MALE: Yes.

UNIDENTIFIED MALE: No, I can`t tell right now.

UNIDENTIFIED MALE: Reports concerning a prenuptial agreement between Tiger Woods and Elin. Did anyone notice signs of trouble between Tiger and his wife?

UNIDENTIFIED FEMALE: We`re hearing conflicting reports from neighbors, some who say they did hear some sort of argument going on.

GRACE: The facts really don`t seen it hang together between his and his wife`s story about what happened that night. Coincidentally, the incident occurred just hours after the story hit the stands with "The National Enquirer" front cover that Tiger Woods was allegedly involved in an affair with a New York party girl.

UNIDENTIFIED MALE: Originally, Elin would have gotten $20 million to stay with him for 10 years. Reportedly, she will now get $5 million immediately to stay with him. And then if she stays with him for the 10 years, she`ll get $55 million, so $80 million all told.

UNIDENTIFIED FEMALE: It`s probably very smart on her part and smart on his part to capitalize on a situation and maybe then get that out of the way and focus on repairing their personal relationship.

UNIDENTIFIED MALE: He is such a private person that I`m sure that this is agony personified. He has guarded his privacy so jealously over the years, and I`m sure that he`s hurting right now.

UNIDENTIFIED MALE: Did anyone ever tell you or did you ever hear anyone mention anything about someone possibly knocking a window out of the vehicle with a golf club?

UNIDENTIFIED FEMALE: No, sir. Again, they verbally did not speak to us at all, except for...

UNIDENTIFIED MALE: OK. And you don`t remember anything? And did you hear -- her name is Elin?

UNIDENTIFIED MALE: Yes.

UNIDENTIFIED MALE: Did you hear her make any statements, any comments at all other than (INAUDIBLE)

UNIDENTIFIED MALE: Besides when I initially went out there, before I called 911, just, Help me. You know, Help me. I said, OK. Just ran back.

GRACE: Tonight, a prenup estimated up to $300 million and the lives of two little children hanging in the balance.

Out to a special guest joining us tonight, along with our panel of attorneys, Eleanor Odom, Peter Odom, Shawn Chapman Holley, Raoul Felder. He is a famed divorce attorney and author of "Getting Away With Murder." He is joining us from our New York studios. Raoul...

RAOUL FELDER, DIVORCE ATTORNEY: Hi, Nancy.

GRACE: ... great to see you. And I pray I never have to use your services. No offense. But Raoul...

FELDER: Yes?

GRACE: ... with this prenup -- we know the prenup is estimated up to $300 million. Don`t people normally put anything in the prenup about, If we have an affair, then the whole thing changes or it`s out the window?

FELDER: Well, usually, experienced lawyers don`t put it in because you have another threshold that you have to have a trial about. You can`t just say you had an affair, you have to be able to prove it in court. So we usually don`t put that in the agreement. I actually heard that the agreement moved up the number of years from 10 to 7, so...

GRACE: I`m sorry, I couldn`t hear you. The agreement moved up what?

FELDER: The number of years when she gets a payout from 10 to 7, so that it`s even worth more because she gets the money if she sticks another two years with him.

GRACE: Oh, so that`s where the report is coming from.

FELDER: Yes.

GRACE: A report was circulating today that she gets a huge chunk of money, I believe over $5 million, if she sticks it out two more years.

FELDER: That`s right.

GRACE: So that`s where the two-year figure is coming from.

FELDER: Yes.

GRACE: These are photos of Woods`s wife, Elin, which now are pertinent to the discussion. She is a cover girl. She is a model. She was a success in her own right before Tiger Woods pursued her and they were married.

Back to Raoul Felder. So Raoul...

FELDER: Yes?

GRACE: ... you`re saying you don`t put clauses like, if somebody runs around, the whole prenup is out the window. But Raoul...

FELDER: Yes?

GRACE: ... if somebody runs around, does that throw the whole prenup out the window?

FELDER: No.

GRACE: Can it be struck down?

FELDER: But one of the termination events in any prenup is usually the entry of decree of divorce. Sometimes you put something as simple as writing a letter from one person to another, so that if he`s running around and the other person wants to trigger it, she doesn`t have hire detectives to follow him. She can just write him a letter, like, Consider this a letter of termination, and then it kicks in.

GRACE: So that would defeat the prenup?

FELDER: No, it basically invokes the prenup.

GRACE: Invokes the prenup. I understand. I understand. Raoul, what do you make of this? What do you make of this situation? I`m stunned that -- one of our reporters was saying that Tiger Woods is in agony, he`s hurting because he`s a private person. I don`t think a private person, you know, has affairs with waitresses and party girls, allegedly, all over the country and expects it to never be found out.

FELDER: You know, it`s like a bakery. Take a number and next, apparently. And I`m sure there are many more. I don`t like the idea they`re all called bimbos, which is what I see in the press...

GRACE: No, I don`t like that, either.

FELDER: Yes. Yes. But this guy is a playboy.

UNIDENTIFIED MALE: He was in and out of consciousness, with lacerations to his upper and lower lip, a little bit of blood in his mouth, but he was conscious enough to be able to speak a little bit. According to my officers, he was not -- it was not life-threatening injuries, according to them.

UNIDENTIFIED MALE: What did he say?

UNIDENTIFIED MALE: Nothing. He was mumbling. That was it.

UNIDENTIFIED MALE: At that point, he was snoring.

UNIDENTIFIED MALE: No. I mean, at this point, she was actually very quiet, just kind of in shock, you know, just kind of sitting there. She wasn`t very verbal.

GRACE: I`m going to go straight out to Lisa Lockwood, former police detective, author of "Undercover Angel." Lisa, thank you for being with us. Lisa also joining us from Florida. Lisa, I have the request by police...

LISA LOCKWOOD, FORMER POLICE DETECTIVE: Yes.

GRACE: ... for the blood drawn at the hospital when Tiger Woods was taken by ambulance to the hospital. Why did the state`s attorney, the prosecutors, refuse to grant the request by police? They don`t want to know the truth?

LOCKWOOD: Different -- there are different laws regarding jurisdictions, cities, states. And one of the things is when you`re in an accident, a vehicular accident involving personal injury, you must draw the blood. It`s just -- it`s a no-brainer. You must take the blood. Having the state`s attorney jump in and intervene and say, It`s not possible to have this, and we can`t reveal it -- there`s a piece of the puzzle that`s missing. So I`m a little bit curious, as well, as to why.

GRACE: So you, Lisa Lockwood, are telling me -- you`re a former police detective there in Florida...

LOCKWOOD: Yes.

GRACE: You`re telling me that in Florida law, under Florida law, when there is an accident and there`s personal injury, somebody is taken to the hospital, the blood has to be drawn.

LOCKWOOD: That`s the law in Illinois. I was formerly a police officer in the Chicago area.

GRACE: Right.

LOCKWOOD: I didn`t research Florida, what law. Jurisdictions do change. So that would be the thing that I would like to find out.

GRACE: You know, that`s incredibly interesting because there is no way, Lisa Lockwood, they did not draw his blood at the hospital.

LOCKWOOD: Eleanor Odom, Peter Odom, Shawn Chapman Holley -- weigh in again, Eleanor.

ELEANOR ODOM: Well, Nancy, you would think they would take the blood and that you should be able to get that with this type of search warrant. But again, the prosecutor said, No, we`re not going to do this. There is insufficient evidence. And that`s very curious to me.

GRACE: Peter Odom?

PETER ODOM, DEFENSE ATTORNEY: I think the prosecutor made a practical decision, Nancy, that this was a minor accident on private property. They just weren`t...

GRACE: Put his face up!

PETER ODOM: ... going to dig anymore.

GRACE: No!

PETER ODOM: And it was the right decision.

GRACE: He had been out on a roadway. He ran over a fire hydrant and a tree.

PETER ODOM: And he might not have believed that the personal injury came from the motor vehicle accident. It was a very minor accident. And he just made a practical decision, even though the law might have justified...

GRACE: Peter, Peter...

PETER ODOM: ... taking the blood...

GRACE: ... do you want me to take you seriously, or are you just trying to come up with a good defense argument?

PETER ODOM: This is -- well, you should take me seriously because I`m quite certain -- and I`ve made these decisions...

GRACE: OK...

PETER ODOM: ... many times, and it`s just not worth investigating anymore.

GRACE: OK, thank you. Shawn Chapman Holley. Shawn, I think you`re with us.

SHAWN CHAPMAN HOLLEY, DEFENSE ATTORNEY: Yes.

GRACE: Do you have a thought?

HOLLEY: Oh, I do. Would you like to hear it now?

911 OPERATOR: 911. What`s your emergency?

UNIDENTIFIED MALE: I have -- this is -- Isleworth Subdivision. I need an ambulance immediately. I have someone down in front of my house. They hit a post.

UNIDENTIFIED MALE: It seems like the walls are crumbling around Tiger Woods and his good guy image. We`re getting word of more alleged affairs, more alleged mistresses.

UNIDENTIFIED FEMALE: It`s all blowing up as we speak.

UNIDENTIFIED MALE: If he had come out, say, the Monday after the accident or whatever, acknowledged his problems and said I`ll try to do better, please leave us alone to settle our problems within our own circle, then I think things would have not gotten to this point.

UNIDENTIFIED POLICE: Was he conscious, unconscious?

JARIUS ADAMS, TIGER WOODS` NEIGHBOR: At that point, he was snoring.

UNIDENTIFIED POLICE: He was snoring?

ADAMS: He was actually snoring.

UNIDENTIFIED REPORTER: An FHP showed up, they said that Tiger Woods was mumbling and dazed. So it`s kind of hard to understand how they could definitely assume that he wasn`t intoxicated.

UNIDENTIFIED FEMALE: Tiger does not deserve privacy. He`s not rich and famous because he`s a good golfer. He`s rich and famous because we tuned in to see him, and were targeted to buy products that he endorsed based on a brand about integrity and character. And you know, Tiger, I want my money back because that`s not flying with women and children.

UNIDENTIFIED POLICE: Since you were the initial person out there and you actually orchestrated getting the blankets and the pillows for him.

ADAMS: Yes, sir.

UNIDENTIFIED POLICE: And you`re -- during the time that you were as close to him as you got, did you smell any alcohol on him?

ADAMS: No alcohol, no any other kind of drug whatsoever. None.

UNIDENTIFIED POLICE: Zero?

ADAMS: Zero.

UNIDENTIFIED POLICE: Did you get close enough that you think you would have smelled it had he been drinking?

ADAMS: Definitely, yes. Yes.

UNIDENTIFIED POLICE: OK. And you did not smell it?

ADAMS: Not at all.

UNIDENTIFIED POLICE: Did you or you, ma`am, did any one of you see a golf club out there near the vehicle in the area?

ADAMS: No. No.

KIMBERLY HARRIS, SISTER OF JARIUS ADAMS: I saw two sitting in the seat of the golf cart.

NANCY GRACE, HOST: To Dr. Michael Bell, Palm Beach County chief medical examiner. Dr. Bell, if someone had mixed alcohol with, for instance, Ambien, the sleep pill or Vicodin, the painkiller, what would the effect be?

DR. MICHAEL BELL, PALM BEACH CO. CHIEF MEDICAL EXAMINER: They would be sleeping.

GRACE: And we know.

BELL: And probably snoring.

GRACE: You know, succinct and precise. I like it. Dr. Bell, did you hear the interview that we played earlier of the neighbor who came right up on Tiger Woods and his wife, Elin Nordegren? He said Tiger Wood was lying there, bleeding, snoring. Snoring. S what does that say to you, Doctor?

BELL: Well, again, I think he was likely intoxicated. If he had a serious head injury that caused him to be unconscious, I would suspect he had more damage and likely would have stayed in the hospital for a longer period of time.

GRACE: Out to the reporters, Kim Serafin with "In Touch Weekly," weigh in, Kim.

KIM SERAFIN, SR. EDITOR, IN TOUCH WEEKLY: Well, you know, there also is this new police report that is out from the police officer that was on the scene before the Florida Highway Patrol got there. And in his report, it says that Tiger was lying on the ground on a pillow, covered with blankets, says that the car was still running.

There were two golf clubs on the floor with the -- on the ground with the golf cart, but he also says in this report that Tiger kept trying to get up and he kept trying to get him to lay back down to prevent any further injuries. So that does indicate that he was conscious, at least to a certain extent.

Also in this report, it says that there was in the car $245 worth of cash stored in the car.

GRACE: And to Alexis Tereszcuk, reporter with RadarOnline.com, what more can you tell us, Alexis?

ALEXIS TERESZCUK, REPORTER, RADAROLINE.COM: What I can tell you about is what led up to the crash that we learned that Elin had found Tiger`s phone and on it she had seen text messages from Rachel. She in fact picked up Tiger`s phone.

GRACE: Whoa, whoa, whoa. Who is Rachel? I don`t know all the alleged mistresses by first name. We`re not on that basis yet, Alexis.

TERESZCUK: You`re lucky for that one.

GRACE: So who are we talking about?

TERESZCUK: Rachel is girlfriend number one. We can put her that way.

GRACE: Alleged girlfriend number one.

TERESZCUK: Alleged girlfriend number one, Rachel Uchitel.

GRACE: Am I seeing -- is that Uchitel right there, Liz? Liz, is that Uchitel? Yes, it is. I know that`s Uchitel. OK, go ahead, Alexis. Thank you.

TERESZCUK: So, on thanksgiving, Elin found Tiger` phone in where she saw text messages and phone calls to and from Rachel. She picked up the phone, called Rachel, talked with her. Rachel apparently denied that she was having an affair at all with Tiger but this made Elin furious. And that`s what started the fight with Tiger that night.

GRACE: OK, Alexis Tereszcuk with RadarOnline.com, unless you`re there in the home, how do you know that? How do you know that that started the whole thing?

I want to go to Michelle Golland, psychologist and expert. Doctor, what do you make of what`s going on now and what do you predict on the prenup?

MICHELLE GOLLAND, PSYD., PSYCHOLOGIST, EXPERT ON MOMLOGIC.COM: Well, you know, the prenup situation, to me, is really about keeping Tiger`s image up and about saving him money in the end. Because he doesn`t want to destroy his squeaky clean image. I`m assuming that he wants it to appear if he really wants to try to save this marriage or he wants it to appear that that`s what he wants to do.

But I have t say, Nancy, the thing that is really important that I want to say is that, you know, infidelity in a marriage is one thing. And if you`re dealing with one infidelity, that can be a symptom of a marriage that is in distress. But a serial infidelity, a cheater, which what it appears to be what Tiger has done, is a symptom in the character of the person who is cheating, and that`s what`s distressing. And I think Elin has a really tough road if she wants to try to save this marriage.

GRACE: Are you saying.

GOLLAND: If Tiger want that.

GRACE: ... that it`s a personal character flaw? And look, all of us have character flaws.

GOLLAND: Yes, I know.

GRACE: We all have character flaws. This is about.

GOLLAND: But -- yes.

GRACE: . someone that apparently has risen above the law.

GOLLAND: Right.

GRACE: And is being treated differently and about an alleged $300 million prenup and two children. So.

GOLLAND: Right. And I guess -- yes, my issue, though, Nancy, is really as a relationship expert, I really want couples to work it out if they can for the children, for exactly that reason, even through infidelity.

GRACE: OK, let me ask you a question, Michelle Golland, how is it that people say I still love my wife. This has nothing to do with her. I would never leave her. This woman meant absolutely nothing to me. It was just an affair.

GOLLAND: Right. Well, I never think they`re just affairs. Again, they happen for a reason within a marriage. And again, I`m not talking about serial cheating. Serial cheating is another major issue. I mean, we could be dealing with a sex addiction. We could be dealing with a lot of larger issues. But that -- when it becomes an infidelity in a marriage that they want to work it out, that can happen.

GRACE: Right. OK, let`s go to the lines, to Benay in New York. Hi, Benay.

BENAY, CALLER FROM NEW YORK: Hi, Nancy. You, and John David and Elizabeth are awesome. And your husband has to give some credit in here, too.

GRACE: You know, John David looks exactly like David and Lucy looks exactly like my mother and grandmother, Lucy. And I was just completely left out of the whole -- anyway, thank you. I`m going to pass that on. What`s your question?

BENAY: Oh, no, I see Lucy in you, too or you in Lucy.

GRACE: Thank you.

BENAY: Anyway, my question is, if this Uchitel or any of these other women received sums of money, isn`t this basically extortion through the backdoor that they can`t get in through the front door?

GRACE: What about it, Eleanor Odom? Benay has a good point.

ELEANOR ODOM, PROSECUTOR: Why I think it is -- maybe technically extortion. But really it`s more bribery. Wouldn`t you think? They`re paying them to keep silent? And it seems to be working so far.

GRACE: Shawn? What about it, Shawn Holley?

SHAWN CHAPMAN HOLLEY, DEFENSE ATTORNEY: Well, you know what, I want to go back to something earlier. And that is that you have been passionately speaking out forever against domestic violence and I would bet you that when the police got there, they were less concerned about Tiger`s sobriety but perhaps whether or not he had been the victim of domestic violence. And it`s just interesting that now the tables are turned we haven`t heard any of that. We have heard that.

GRACE: Well, Shawn Chapman-Holley.

HOLLEY: . that his injuries were inconsistent with the car accident. So isn`t it interesting that perhaps it was clear that he had been the victim of domestic violence and that was the focus of the investigation of the police and not an accident on private property?

GRACE: Well, Miss Holley, our first few days of covering this story, we dwelled a great deal on the possibility on the suggestion of domestic violence.

Peter Odom, on the point at hand, weigh in.

PETER ODOM, DEFENSE ATTORNEY: Well, it`s not illegal for Tiger to pay people money to keep silent. This is not an official investigation into his infidelity, he`s just doing a smart thing, trying to protect his privacy.

UNIDENTIFIED REPORTER: Questions remain surrounding the death of missing 12-year-old Jahmeshia Conner, whose body was found in an alley next to trash cans just blocks from her own home.

UNIDENTIFIED REPORTER: Family members say Jahmeshia was last seen two weeks ago. They say the night of November 15th she was leaving an aunt`s house and was getting on the bus at 64th and Ashland, but she never made it home. She was reported missing and her relatives say they searched extensively for her, canvassing the neighborhood.

UNIDENTIFIED REPORTER: Her body was found by a passerby on November 30th. An autopsy concluded she had been strangled.

UNIDENTIFIED REPORTER: The family says that police didn`t take their missing persons report seriously and could have done more to help.

UNIDENTIFIED MALE: You can`t fault the police for the investigation that they conducted over these last two weeks.

UNIDENTIFIED REPORTER: Now the Chicago Police Department has come under fire after it was revealed that not only was no Amber Alert ever issued but the media was never notified about Jahmeshia`s disappearance.

GRACE: To Kathy Chaney, joining us from the "Chicago Defender.: Kathy, thank you for being with us. I`m extremely disturbed, not only about the death of this fifth grade girl, Jahmeshia Conner, but the failure of police to issue an Amber Alert, which could -- could have saved her life. Maybe it couldn`t have, but it could have. What happened?

KATHY CHANEY, REPORTER, CHICAGO DEFENDER (via phone): Well, you know, her body was found on November 30th in an alley one block away from her home. She was reported missing on November 16th. The news alert never went out to the media. Never. And I received every single one.

And the first time that we even heard about Jahmeshia Conner is we`re reporting her demise. The police said there was either technical error or human error that caused the report to not even go to the media.

I know the police don`t have any suspects at this point and I know that a reward has been offered and we`re just trying to find out what happened to Jahmeshia.

GRACE: To Marlaina Schiavo, our producer who has been covering the story from the very beginning. Marlaina, tell me exactly the time sequence, the timeline. What happened in Jahmeshia Conner`s disappearance and murder?

Everyone, we are talking about a little fifth grade girl out of Chicago. This child, Jahmeshia -- look at that smile. Can`t you just see her up in the choir, the church choir, singing, singing her little heart out?

One thing she loved the most was singing in that church choir, and that day she went to choir practice at her church, got on a bus and was never seen alive again.

Marlaina, fill in the gaps.

MARLAINA SCHIAVO, NANCY GRACE PRODUCER, COVERING STORY: That`s exactly what happened. She was at church that afternoon. She was with her family. Then she gets on a bus, Nancy, and she`s never heard from.

Her mother reports her missing the next day because she thought she was staying at her aunt`s home. And so when she didn`t arrive from school -- home that day, she called the authorities.

Now, Nancy, her body was not found until two weeks after she went missing. Police said she had only been dead for maybe 24 hours. That means.

GRACE: Oh, no. No.

SCHIAVO: Yes. Yes. If we had known.

GRACE: No.

SCHIAVO: If we had known, we could have said something. We could have done something and possibly we could have avoided what happened to this little girl. It`s really a shame.

GRACE: Marlaina, what was the condition of the body? What do we know? What are our clues?

SCHIAVO: Nancy, the medical examiner has told us that she was strangled to death. Now they didn`t say manual or ligature. It`s not even important at this point. Her mother told local media that her face had bruises and scratches and what she called bashed in.

She was fully clothed. We don`t have any other information other than that. The only thing that was missing was her shoes.

GRACE: To a special guest joining us tonight, Marc Klaas, president, founder of KlaasKids Foundation. He`s a tireless child advocate. His own daughter, Polly, was kidnapped from her home. She was attacked and she was murdered. It changed his life.

Marc Klaas, what do you think about this?

MARC KLAAS, PRESIDENT AND FOUNDER, KLAASKIDS FOUNDATION: Well, Nancy, what happened to little Jahmeshia is what regularly happened to kids in the early 1990s and before that. They would disappear and there would never be any kind of a media release at all and we would never hear from them again.

So, it just shows you how far things have gone and how sadly it is that this young girl fell through the cracks. Now there are a couple of things that should have happened. Law enforcement should have taken a report, entered in an MCIC number and the little girl`s missing flyer should have been posted in two places at least.

Number one, the Illinois State Missing Children`s Clearinghouse Web site. And, number two, the National Center for Missing and Exploited Children. So it should have been up there and it should have existed.

Obviously, it should have gone to the media as well. Obviously, she shouldn`t have been in the void for 24 hours before her parents even released the information or reported the information to the authorities.

At which time it might have even been too late to activate an Amber Alert because as we all know, Amber Alerts are about the immediate release of information to the public so the public can assist in the recovery.

GRACE: And very quickly, Kathy Chaney with the "Chicago Defender," how soon did the parents call the police?

CHANEY: The parents called the police the next day when she realized that she didn`t go to school, she didn`t make it to school because she was under the impression that she was spending the night at her aunt`s house, she called the police.

GRACE: Immediately?

CHANEY: Filled out the report -- immediately. We never got it. And if I could add, there are 21 child sex offenders within a half block radius of her home and where she was. There was one that lived on the block that she was found.

GRACE: I want to go to another special guest joining us tonight. Andrew Holmes. This is Jahmeshia`s family spokesperson.

Mr. Holmes, thank you for being with us.

ANDREW HOLMES, MURDERED 12-YR-OLD, JAHMESHIA`S FAMILY SPOKESPERSON (via phone): Yes, ma`am.

GRACE: Mr. Holmes, how is the family this evening?

HOLMES: Well, the family is still shell shocked, kind of traumatized because of the situation and the outcome. They`ll need plenty of counseling.

GRACE: Tell me about Jahmeshia and her photos. We`re showing you family video right now, everyone, and also video of protesters about what has become of Jahmeshia. This is a vigil that neighbors and community activists joined together to create.

I want to go back to Andrew Holmes, the Jahmeshia family spokesperson. What is their take on the Amber Alert not being issued, Mr. Holmes?

HOLMES: Well, they`re very upset about the Amber Alert not be issued. We tried diligently to talk to some of the media that put these kids` pictures on TV and tried to get to (INAUDIBLE) to help in Chicago Police Department and properly bring her home. If the Amber Alert had of been issued, who knows, this little child might have been still living today. But we don`t know, but we could have saved many other children, but this sends a strong message that we have to tighten up the gap.

GRACE: Well, you know, Sheeba, that a good observation. Kathy, Kathy Chaney joining us from "Chicago Defender." Kathy, it`s my understanding when she was found, she had been deceased over 24 hours. Not that she had been lying there over 24 to 48 hours.

CHANEY: Correct. And from understanding, if I am correct, she was found around 7:00 in the morning, so if she was dumped, likely, it would have been after dark where no one would have seen it and then just discovered it upon daytime.

GRACE: Got it.

Eleanor Odom, obviously, it`s someone that knew where she lived because the fact that it`s one block from her home, I mean, looks like Casey Anthony and Caylee Anthony, just houses down from their home. Somebody that knew her and where she lived.

E. ODOM: Exactly. And remember, she was taken from the bus so it wasn`t like she was taken her home. She was going towards to her aunt`s house.

GRACE: What if she was grabbed of the bus?

E. ODOM: Exactly.
