Tiger`s E-mails and Texts to Alleged Girlfriends Published

Aired December 09, 2009 - 20:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

NANCY GRACE, HOST: Breaking news tonight. Live, Windermere, Florida. Superstar golf phenomenon Tiger Woods, leaving his home barefoot 2:00 AM after Thanksgiving Day celebration, drives out of his multi-million-dollar compound, and has a head-on collision with a tree and a fire hydrant. His young wife, the mother of his two children, says she hears the crash from inside the house, runs out and beats out both back windows of Woods`s Cadillac.

Woods refusing repeatedly to speak with police, immediately pulling out of his own golf tournament. Gatorade drops the Tiger Woods drink, and primetime TV ads dry up as Woods`s alleged mistresses hit double digits, including a swimsuit model, a porn star and a waitress at a pancake house. It all hits newsstands just before the so-called crash.

Woods gets just a slap on the wrist, even though a witness tells cops Woods was drinking before the crash and was prescribed sleeping pills plus a super-powerful painkiller, Vicodin. Why -- why -- did prosecutors refuse blood alcohol results when cops specifically asked for it?

Bombshell tonight. Hundreds of explosive e-mails and text messages secretly sent by Woods to two of a string of alleged mistresses goes public, Woods promising to leave his wife and two little children, claiming this woman is his soulmate, and complaining he wishes he met her before he married. In other texts, he allegedly tells another woman they`ll be together, quote, "forever." Texts and e-mails reportedly setting up late- night rendezvous, revealing Woods`s bankrolling luxury trips for an alleged secret lover just before the crash.

Also on the legal front, did Woods pay millions to buy the silence of an alleged mistress to keep their affair and their e-mails secret? When does hush money turn into a bribe? Woods`s wife closing on a family mansion back home in Sweden.

Bottom line, if Woods were an ordinary guy, wouldn`t the charges be more serious in light of an alleged DUI and a cover-up not only to his wife but to the cops? As the plot thickens, what really happened to Tiger Woods, and how will it affect child custody and a possible divorce? Woods still hiding out on his multi-million-dollar yacht, the Privacy. And hey, do you blame him?

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Breaking news. E-mails allegedly sent by Tiger Woods to alleged mistress Rachel Uchitel surface inside "In Touch" magazine, Woods allegedly writing, "I know it`s brutal on you that you can`t be with me all the time. I get it. It (EXPLETIVE DELETED) kills me, too. I finally found someone I connect with, someone I have never found like this, not even at home. You want someone to witness your life. I want you to lay next to me, lay on me, wherever you want to lay. (EXPLETIVE DELETED) Why didn`t we find each other years ago? We wouldn`t be having this conversation."

UNIDENTIFIED FEMALE: Oh, my God!

911 OPERATOR: Fire, rescue.

UNIDENTIFIED FEMALE: OK, hurry up, my mom just collapsed!

911 OPERATOR: OK, calm down, OK? What is the address?

UNIDENTIFIED MALE: "The Enquirer" claims team Tiger is working hard to silence alleged mistresses. Reports continue to swell (ph) that additional women may continue to come forward, and more bombshells continue to surface.

GRACE: Who are they? Where are they coming from?

UNIDENTIFIED MALE: We`re getting word of more alleged affairs, more alleged mistresses.

UNIDENTIFIED MALE: We`ve got Rachel Uchitel, obviously, the club hostess, Jaimee Grubbs, a reality show contestant...

UNIDENTIFIED MALE: No wonder the ladies call him Tiger.

UNIDENTIFIED MALE: Now we`ve got another swimsuit model who met him in Vegas, she claims. We`ve got another woman who worked for this lingerie Web site.

GRACE: So could all of these alleged affairs defeat a prenup?

UNIDENTIFIED MALE: We`ve also got former porn star Holly Sampson who`s added to the list, and it goes on and on.

JAMIE GRUBBS, TIGER`S ALLEGED MISTRESS: I have no words to explain, you know, what I have done to her family. I guess I would be deeply sorry for never considering her during the whole process.

(END VIDEO CLIP)

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. Hundreds -- hundreds -- of explosive e-mails and text messages between golfing phenomenon Tiger Woods and two of a string of alleged mistresses go public. Did Woods pay millions to keep it quiet? When does hush money become a bribe? And how will all of this affect child custody and a possible divorce? Woods still hiding out on his multi-million-dollar yacht, the Privacy. And do you blame him?

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Tiger isn`t out of the Woods yet. His troubles are just beginning.

UNIDENTIFIED MALE: ... like the walls are crumbling around Tiger Woods and his good guy image.

UNIDENTIFIED MALE: Now e-mails come public allegedly sent by Tiger Woods to alleged mistress Rachel Uchitel, published inside "In Touch" magazine, Woods allegedly e-mailing her, "Never thought I would care and be as emotional as I am with you. You bring a side of me I never thought existed, both good and bad. I don`t like feeling so vulnerable. It bothers me a lot. I`m much tougher than this. I just want you to know what`s going on inside me."

UNIDENTIFIED MALE: Hey, it`s -- it`s Tiger. I need you to do me a huge favor. Can you please take your name off your phone? My wife went through my phone and may be calling you."

UNIDENTIFIED MALE: A full-blown Tiger Woods scandal.

UNIDENTIFIED MALE: Another e-mail Woods allegedly wrote says, "I need you here! Just pack and get organized. Sorry if I hurt you. Get yourself together and get on the flight. We can fly down here and have makeup sex."

UNIDENTIFIED MALE: This guy`s a playboy.

UNIDENTIFIED MALE: How might these alleged e-mails affect any possible prenup (INAUDIBLE) the fragile relationship between Tiger and Elin Woods.

GRUBBS: I have no words to explain, you know, what I have done to her family. I`m not going to ever say what I did was OK. And like, she knows she loves him.

(END VIDEO CLIP)

GRACE: Straight out to Tom O`Neil. He is the senior editor with "In Touch Weekly." They have published some of these 100 alleged e-mails and texts. I don`t know what you`re smiling about because this is going to be most likely not only the end of a marriage but -- you know, forget those two. You know, they agreed up front. They bargained for each other. But what about those children? You know, right now...

TOM O`NEIL, "IN TOUCH" WEEKLY: Right.

GRACE: ... I could take a lot from my husband because I would not want to split up the family with the children. But with these going public, I mean -- hold on, Tom. Liz, let`s take a look at a couple of these. These are in "In Touch Weekly`s" this week edition. "I know it`s brutal on you that you can`t be with me all the time. I get it. It F-ing kills me, too. I finally find someone I can connect with, someone I have never found like this, not even at home." Oh! Oh! "You want someone to witness your life. I want you to lay next to me, lay on me, or wherever you want to lay. F. Why didn`t we find each other years ago? We wouldn`t be having this conversation."

Next, "Never thought I would care and be as emotional as I am with you. You bring a side of me I never thought existed, both good and bad. I don`t like feeling so vulnerable. It bothers me a lot. I`m much tougher than this. I just want you to know what`s going on inside of me."

You know, they go on and on and on, Tom O`Neil, him calling her his soulmate, according to your article, talking about how he wished he had met her before he married his gorgeous Sweden supermodel wife and had two beautiful, healthy children. You know, before, I thought, Tom O`Neil, that Elin Nordegren might say, OK, he had some flings, I`m not happy, I`m angry, but we`re going to work it out. But you know, saying essentially he`d rather marry somebody else other than her -- where did you get thee things anyway?

O`NEIL: It was a third party gave them to us. It`s very important...

GRACE: Whoa! Whoa! I didn`t hear you. Where? Where did you get these?

O`NEIL: A third party provided them to us.

GRACE: A third party.

O`NEIL: Rachel did not give us...

GRACE: Well, how could you get them from anybody but Rachel Uchitel? And Now I get why she thinks he`s going to leave his wife for her. He basically said that. It`s not all her chasing him.

O`NEIL: Right. Right. Right. Well...

GRACE: These e-mails...

O`NEIL: Here`s what`s significant, Nancy. You`re missing the point here.

GRACE: Oh, OK.

O`NEIL: We have two gals. We have Jaimee Grubbs...

GRACE: Don`t use "gals." It`s demeaning.

O`NEIL: All right. All right. Two...

GRACE: They`re grown women.

O`NEIL: We have two alleged paramours here, OK? Is that an OK word? And we have evidence of one of them, Jaimee Grubbs. That`s the phone message that you played a bit ago. But we have no evidence up until now for the first gal, Rachel. This is the source...

GRACE: You said it again.

O`NEIL: ... of the whole fight on Thanksgiving Day between Tiger and his wife, whether or not this tryst that they had in Australia really went on, when the tabloids broke the story.

GRACE: OK, I`m going to go back to the first question that you have danced all around, Tom O`Neil, senior editor, "In Touch Weekly." You say Rachel Uchitel, alleged mistress number one, the New York party girl, she`s been called -- she`s a hostess at a nightclub -- didn`t give you these e- mails. All right. Then who hacked into her e-mail account?

O`NEIL: We don`t disclose that, Nancy.

GRACE: How did they end up in the hands of you?

O`NEIL: We don`t disclose that, but we do have lawyers who vet all the -- all the information that goes into "In Touch" to validate all these things, so...

GRACE: Did you pay her?

O`NEIL: You know what? I really don`t -- I don`t -- no, we didn`t...

(CROSSTALK)

O`NEIL: We do not pay for editorial. We do not.

GRACE: Then how do you say I don`t know and in the same breath say no?

O`NEIL: Well, no, because sometimes, we pay for photographs. There is a distinction there.

GRACE: Oh, right!

O`NEIL: But "In Touch" weekly does not pay for articles.

GRACE: Paying for photographs is the same thing as paying for an interview. You just -- you know, you`re putting perfume on the pig.

O`NEIL: Well, we have no pictures here, Nancy.

GRACE: OK, forget it. I want to talk -- I don`t want to talk about you and your policy. I want to talk about these e-mails. You`re not going to tell me where you got them from.

O`NEIL: Right.

GRACE: They either had to come from her to a third party to you, or somebody hacked in. There. It`s out there. All right, how many are there?

O`NEIL: There are -- we have several. There are hundreds of these, of course, and text messages. And what`s interesting is that you can follow the story of the fight they have before they head to Australia, before the tabloids catch them down there, and which, of course, leads up to the big blowup on Thanksgiving Day.

GRACE: OK, give me the timeline you say that you can recreate.

O`NEIL: Right. Exact dates -- I think -- was it November 9th...

GRACE: Yes.

O`NEIL: ... the series of these e-mails take place where he first professes all this love for her. And then he starts telling her how jealous he is because she has told him in the past that she`s also been romantically linked with four other celebrities.

GRACE: Wait, wait, wait. Put his face -- there he is. Tom O`Neil...

O`NEIL: OK.

GRACE: So you`re telling me that Tiger Woods is mad at an alleged mistress because she`s dated other people?

O`NEIL: Right, right, right. Some...

GRACE: All right.

O`NEIL: ... four other celebrities. He said, That means you just probably want me for my fame. They end up having this big fight back and forth. And he says, Well, let`s not fight here, let`s jump on a plane, go down to Australia and have the fight there, and then have makeup sex.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: What would you tell his wife, Elin, if she was sitting right here?

GRUBBS: I mean, I have no words to explain, you know, what I have done to her, her family. I guess I would be deeply sorry for never considering her during the whole process. And not -- him not bringing her up was just a way for me to just pretend that he didn`t have one and for me not to deal with it. But I mean, I`m not going to ever say what I did was OK. And like, she knows she loved him, and you know, that is the way I felt.

UNIDENTIFIED FEMALE: Did you ever walk away? Did you ever say, I can`t do this anymore?

GRUBBS: I never physically told him I couldn`t do it anymore, but I did back away. You know, I did learn that he was having a second child. And at that point, you know, I just kind of thought to myself, What am I doing, you know? This isn`t right. You know, He has a wife, and it`s not you. And so I did. I tried -- I tried to just -- fewer text messages and far in between and phone calls. And there was a time where he did come out. He did physically come out for five days, and he texted me every day and said, Meet up with me, I want to see you, I miss you. And you know, I didn`t do it. I was, like, I`m not going to do that anymore.

UNIDENTIFIED FEMALE: Did you love Tiger?

GRUBBS: I didn`t ever say that I did love him. I wouldn`t let myself get that far.

UNIDENTIFIED FEMALE: Do you think Tiger loved you?

GRUBBS: There were times where I feel that, you know, he could have. But I mean, if you were to ask me that question now, I would have to say he didn`t.

(END VIDEO CLIP)

GRACE: That is the cocktail waitress, Jaimee Grubbs, in the middle of an interview where she is explaining why she thought Tiger Woods actually loved her, but now that she`s heard about an alleged string of mistresses, she`s not so sure. Well, you know what? How do you think his wife feels?

I want to go back out to Tom O`Neil. You say there are hundreds of text messages and e-mails that now support all of these affairs, or just the one affair with Uchitel?

O`NEIL: Well, Jaimee Grubbs has produced a number of text messages and other concrete evidence of her affair, which lasted, by the way, two- and-a-half years, Nancy. You want outrage? This relationship began when Tiger`s wife was pregnant with their first child.

GRACE: You mean Uchitel or Grubbs?

O`NEIL: Grubbs. The Uchitel relationship is only five-and-a-half months old.

GRACE: You know, I want to go to Dr. Lillian Glass, psychologist, body language expert, author of "I Know What You`re Thinking." Lillian, when we first heard about this story and all these alleged mistresses, all of whom I don`t believe, by the way, they sounded -- you`re looking right now at texts from "US Weekly," from Woods back and forth to Grubbs.

I didn`t think the women had that much credibility, but now that I`m listening to Uchitel and I`m listening to Grubbs, they`re extremely articulate. They`re beautiful, obviously, physically beautiful. But they`re not like bar flies or gold diggers. They seem like women who really thought he was going to leave his wife for them.

LILLIAN GLASS, PSYCHOLOGIST: Nancy...

GRACE: What?

GLASS: ... they are gold diggers. And it`s very interesting -- especially Rachel Uchitel. If you look at an article she was interviewed for, it`s called "Black Book" magazine, she said that she was looking for somebody very famous, she was looking for somebody very wealthy to help support her venture because she wanted to have a nightclub. She was using Tiger in this regard. She has been playing him, and he fell for it!

GRACE: I want to point out that Uchitel`s fiance was killed in the September 11 attack in New York. She married after that. It was a very brief marriage. Nothing would work out for her after her fiance was murdered. And I`m not taking her side.

I`m also pointing out to you, Lillian Glass, that none of these women have gotten any money, or come forward, until they started finding out about each other. I get the impression that they all thought they were the only ones, of course, in addition to the wife.

GLASS: Yes. They were playing him...

GRACE: I don`t know that that constitutes...

GLASS: ... and he was playing them right back.

GRACE: ... being gold diggers.

GLASS: Well...

GRACE: I`m not taking their side. What I am saying is he`s the one who`s married, not them. They don`t have a duty to anybody but themselves.

GLASS: No, you`re right.

GRACE: He has a duty.

GLASS: You`re absolutely right. He has a big duty.

GRACE: What is this I heard that you said Tiger Woods is suicidal? I don`t believe that for a minute! This man is not suicidal.

GLASS: Well, you know what, it`s not -- no, the bottom line is he doesn`t have a lot of coping mechanisms at this point. This is a guy that`s had everything done for him, everything done for him. And so...

GRACE: I don`t know about that. He gave up...

GLASS: Oh, he`s had...

GRACE: ... a lot -- no, no, no. Put Glass up, please. Lillian Glass, he started becoming essentially a professional athlete at age 5. He has done nothing but go to school and play golf and perfect his game. He has worked since he was a little boy. Don`t say he hasn`t worked for anything. He`s worked his head off!

GLASS: I didn`t say that, Nancy. I didn`t say...

GRACE: You said he had everything handed to him!

GLASS: ... he hasn`t worked for anything. He had a lot handed to him. He had a lot handed to him, and a lot done for him. Absolutely!

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: We were the first responding agency under mutual aid, which we have with Orange County. When we arrived -- we had a call of an accident (INAUDIBLE) with injuries. My two officers arrived at the scene and noticed Tiger Woods laying on the ground in front of his vehicle, with his wife over him, rendering first aid. My officers immediately exited their vehicles, went to Mr. Woods and began rendering first aid to him at that time.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: What would you tell his wife, Elin, if she was sitting right here?

GRUBBS: I mean, I have no words to explain, you know, what I have done to her, her family. I guess I would be deeply sorry for never considering her during the whole process. And not -- him not bringing her up was just a way for me to just pretend that he didn`t have one and for me not to deal with it.

I`m not going to ever say what I did was OK. And like, she knows she loved him. And you know, that is the way I felt.

This is -- this isn`t right. You know, he has a wife, and it`s not you.

(END VIDEO CLIP)

GRACE: OK, now I`m seeing the new piercing Jaimee Grubbs describes in her text message to Tiger Woods. It`s right here. That`s where he allegedly, if these text messages are to be believed, asked her to go into the bathroom while she`s at work and take, let me just say, private photos of herself and text to him.

I wonder if that -- out to you, Ellie Jostad -- is what his wife, Elin Nordegren, found just before the crash.

ELLIE JOSTAD, NANCY GRACE PRODUCER: Well, Nancy, there are conflicting reports about which texts, or if Elin Woods found some text messages. Some reports say that she caught him texting. She said, Who are you texting? And it turned out to be Rachel Uchitel. There are also these unconfirmed reports that it was actually Grubbs he was texting with. Now, "US Weekly" claims that they have a text message, or they`ve seen one, where he e-mailed Grubbs on Thanksgiving and wished her a happy Thanksgiving.

GRACE: To Eloise Parker with "OK!" magazine. In your magazine, Eloise -- thank you for being with us -- you have an interview with Rachel Uchitel, the alleged mistress number one. In it, she touches on Tiger Woods, but she does not talk about the alleged affair. Why?

ELOISE PARKER, "OK!" MAGAZINE: That`s right. That was one of the conditions on us sitting down with Rachel.

GRACE: OK. Did you pay her?

PARKER: I wasn`t involved personally in the negotiations, so I can`t confirm that. What I can tell you is our pockets certainly aren`t as deep as Tiger Woods`s.

GRACE: OK. That`s being very coy, Eloise. It sounds to me like you`re saying, Yes, but I can`t confirm it, and Tiger paid her more not to talk about it. Is that what you`re saying? I mean, just put it out there, Eloise!

PARKER: Well, as I`m reading between the lines, Nancy, you know, that`s certainly how it appears.

(BEGIN VIDEO CLIP)

GRUBBS: I`m not going to ever say what I did was OK. And like, she knows she loved him. And you know, that is the way I felt.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: What would you tell his wife, Elin, if she was sitting right here?

JAIMEE GRUBBS, TIGER WOODS` ALLEGED MISTRESS: I have no words to explain, you know, what I have done to her or her family. I guess I would be deeply sorry for never considering her during the whole process. And not -- him not bringing her up was just a way for me to just pretend that he didn`t have one, and for me not to deal with it.

But, I mean, I`m not going to ever say what I did was OK. And like she knows she loves him, and you know that is the way I felt.

UNIDENTIFIED FEMALE: Did you ever walk away? Did you ever say I can`t do this anymore?

GRUBBS: I never physically told him I couldn`t do it.

(END VIDEO CLIP)

NANCY GRACE, HOST: That is from "Extra," and that is alleged mistress number two, Jaimee Grubbs, describing how she was in love with Tiger Woods, thought he was in love with her. When you read their text messages, you can see why she thought that. Although let me just point out she was with him 2 1/2 years and he never left his wife. So I don`t know how realistic it is for her to claim she thought that.

Back to Eloise Parker with "OK!" magazine. This article with Rachel Uchitel is coming up in your "This Week" edition.

Eloise, thank you again for being with us. What was the crux of her interview? She stayed mum on her alleged affair with Tiger Woods.

ELOISE PARKER, OK! MAGAZINE: Well, that`s right. We felt we had enough sources to back up the story. So what we were really interested in here was looking at the woman behind the headlines and digging into the personality of Rachel Uchitel. She invited us into her home and we spoke with her. We wanted to know what makes her tick.

GRACE: Everyone, let`s unleash the lawyers. In addition to Tom O`Neil, "In Touch Weekly," Eloise Parker, "OK!" magazine, and our chief editorial producer, Ellie Jostad, with us tonight from L.A., Alexis Martin Neally, family law attorney, Raymond Giudice, defense attorney out of Atlanta, and Doug Burns, former federal prosecutor, now defense attorney in New York.

First to you, Ray Giudice. Ray, you know, a lot of divorces are purely emotional. For instance, I have literally known of a couple in divorce court who went to trial -- it cost them thousands -- over pots and pans.

RAY GIUDICE, DEFENSE ATTORNEY: Yes.

GRACE: And something to do with the dog. They went to trial. It probably cost them $50,000, $60,000 to go to a jury trial over that. So at one point if the wife Elin Nordegren says OK, she rationalizes in her head he had some affairs. We should work on our marriage so it won`t happen again, I`m going to stick it out.

But now these e-mails, they are incendiary. Just released, part of 100 e-mails and text messages in which Tiger Woods claims he`s found his soulmate? He wishes he had met Uchitel before he married and had children. This could push her over the edge.

And I`m just wondering, will it nullify the prenup?

GIUDICE: Tiger has multiple legal problems vis-a-vis his wife. That prenup is probably -- he`s in pure violation.

GRACE: I`m not paying you for that advice. I know he has problems, Giudice.

GIUDICE: All right. OK, but let me address them. But here`s his problems in a row. Number one, this is a slam dunk, no fault divorce granted in her favor. He may lose a lot of custody of these children. A judge might find him to be an unfit parent.

Last issue is finances. He`s going to dig out of a hole and be writing checks to her and those children for the rest of his professional career. So she`s got them. This is an easy case for her lawyer. And Tiger has done nothing to help repair this marriage.

GRACE: OK. Doug Burns, what if the prenup, as I suspect it is, is ironclad? Do all of these alleged affairs nullify a prenup?

DOUG BURNS, DEFENSE ATTORNEY: No, I don`t think it would. The issues attendant to the ante nuptial agreement are whether or not the person understood the terms, read them all. I don`t think the behavior`s going to nullify it, per se. But in the real world I think that obviously there`s a tremendous amount of public relations leverage and I think that`s going to translate into additional money for the wife.

GRACE: To Alexis Martin Neally, joining us from L.A., in prenups -- prenuptial contracts which specify terms in the dissolution, or the divorce, dissolution of a marriage, Alexis, can infidelity nullify a prenup? Is it possible there is a clause in that prenup that states if one of us, Woods or Nordegren, have an affair all bets are off?

ALEXIS MARTIN NEALLY, FAMILY LAW ATTORNEY: It`s possible. But knowing that Tiger knew who he is and that apparently this has been going on for many, many years, it would surprise me if he`d allow his lawyers to put that in.

GRACE: OK. Speaking of many, many years, back to Ellie Jostad. Ellie, reports are now surfacing that this past July, I believe it was, Tiger Woods was in Scotland, I believe, at a golf event.

And there are now reports that a domestic outbreak occurred over alleged affairs and the home in which they were staying, the private home, was torn up, destroyed, allegedly by one of them?

ELLIE JOSTAD, NANCY GRACE PRODUCER, COVERING STORY: Right. That`s actually a "Globe" magazine report. We can`t confirm it. But the report is that while they were at the British Open this past summer staying at this rented or borrowed home, and some sort of argument broke out and there was apparently some damage.

There are also reports that there`s been trouble.

GRACE: Ellie. It didn`t say some damage. It said it was destroyed on the inside.

JOSTAD: $16,000 worth of damage is what they`re reporting. Yes.

GRACE: So Michael Gordon, CEO of the Gordon Group in New York, crisis PR expert, and I would say this is a crisis, Michael Gordon. How do you keep $16,000 worth of damage to a private home secret? If it happened.

I mean, every time somebody like Lindsay Lohan throws a bottle into a mirror at the Chateau Marmont or wherever she stays, we read about it, we hear about it.

MICHAEL GORDON, CEO, GROUP GORDON, CRISIS PR EXPERT Right.

GRACE: $16,000 damage?

GORDON: Right. That`s the whole issue, Nancy. I mean the truth is coming out. Everyone just wants to get at the truth. "In Touch" wants to get at the truth, "OK!" CNN, everyone just wants to get at the truth. And that`s the whole problem that Tiger is facing.

He is not coming forward with the truth himself and take the gas out of everybody who wants to get at that truth.

GRACE: You know, Michael, if these reports are true and now with the e-mails and the texts, if they are corroborated, if they are for real, then it is true.

GORDON: Right. Right.

GRACE: Would it be best -- I mean, why is he holed up on the yacht? Other than having a goose egg on his forehead maybe. But.

GORDON: Right. It`s an enormous mistake.

GRACE: And please, don`t tell me he should come out and say he`s a sex addict? Don`t even go there, Gordon, because that is so tired. I`ve heard that from so many celebs that run around on their wives. Yes, it`s always the men. Sorry, gentlemen. But nobody believes that. He can`t come out and say he`s a sex addict.

GORDON: Right. No. He has to come out, admit what happened in his marriage, apologize to his fans, apologize to his wife. And if he`s going to stay in the marriage he`s got to stop fooling around or he has to get out of the marriage. But that`s the only way to start retaining the confidence of his fan base and his sponsors.

But if he keeps staying silent, this story`s going to keep getting bigger and bigger. You know what, Nancy.

(CROSSTALK)

GRACE: The only way out for him, Michael Gordon, I think, if he wants to hold on to his family and to his fans he`s going to have to say you know what, it`s all true, and I was the biggest horse`s ass on the planet to risk my wife and my children and my fans.

For what?

GORDON: That`s right. He.

GRACE: I mean, no offense to the ladies. But for what?

GORDON: That`s exactly right. He just needs to speak the truth, and I think he can get past this. But every day that he doesn`t talk is a lost opportunity. And, you know, because he`s such a big celebrity, everyone is interested. And he needs to change the name of his boat.

GRACE: OK.

GORDON: . from "Privacy" to "Reality."

GRACE: Very quickly to you, Ray Giudice. If in fact Tiger Woods did pay these women not to talk about the affair, when does that hush money become a bribe?

GIUDICE: Only when you interfere with legal process or have somebody do something that`s illegal. Right now there`s no litigation. They`re not in violation of anything.

GRACE: Agree or disagree, Doug Burns?

BURNS: Agree. Normally, bribery is of public officials, public conduct. I don`t see it here. I don`t see it here.

GRACE: What about it, Alexis?

NEALLY: I agree. There`s nothing illegal.

(BEGIN VIDEO CLIP)

GRUBBS: I tried to just fewer text messages and far in between and phone calls. And there was a time when he did come out, he did physically come out for five days and he texted me every day, and said you know (INAUDIBLE), I want to see you, I miss you, and you know, I didn`t do it. I was like I`m not going to do that anymore.

UNIDENTIFIED FEMALE: Did you love Tiger?

GRUBBS: I did never ever say that I did love him. I wouldn`t let myself get that far.

UNIDENTIFIED FEMALE: Do you think Tiger loved you?

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: What would you tell his wife, Elin, if she was sitting right here?

GRUBBS: I mean, I have no words to explain, you know, what I have done to her, her family. I guess I would be deeply sorry for never considering her during the whole process and not -- him not bringing her up was just a way for me to just pretend that he didn`t have one and for me not to deal with it.

I`m not going to ever say what I did was OK. And like she knows she loved him. And you know, that is the way I felt.

UNIDENTIFIED FEMALE: Did you ever walk away? Did you ever say I can`t do this anymore?

GRUBBS: I never physically told him I couldn`t do it anymore. But I did back away. You know, I did learn that he was having a second child, and at that point, you know, I just kind of thought to myself, what am I doing? You know?

(END VIDEO CLIP)

GRACE: That`s an interview between "Extra" and Tiger Woods`s alleged mistress, mistress number two, allegedly, Jaimee Grubbs.

I want to go out to Paul Penzone, director of Prevention Programs, Childhelp.org. He`s a former police sergeant.

Paul, it`s great to see you again. I want to ask you about one of my first questions to Tom O`Neil with "In Touch Weekly." They are the ones who know about these alleged 100 explosive e-mails and text messages. Where could they possibly have come from?

Unless this woman, Rachel Uchitel, gave them to someone. Her attorney is Gloria Allred. So Gloria knows what she`s doing. But unless Uchitel gave these to somebody and had them published, how else could they have been obtained unless someone hacked into her accounts?

PAUL PENZONE, DIRECTOR OF PREVENTION PROGRAMS, WWW.CHILDHELP.ORG, FORMER SERGEANT, PHOENIX PD: Well, I think you could look and say conspiracy theory. Was someone in a position to go into her account without her knowledge, pull those things out, and turn them over for sale. And it`s entirely possible. But if you really look at the big picture here, we`d be kidding ourselves to think that it`s not someone either close to her, you know, a second party was handed off to and then handed off to the destination.

It would just be naive of us to think that that was not the most likely scenario. There`s all kinds of other ways to do it. Technology can be your best friend or your worst enemy. But if you look at the totality of this situation and the money that`s involved and everything else I`d be real surprised if it wasn`t just a hand-off to somebody who handed it off.

GRACE: And back to you, Ray Giudice, usually when you`re looking at a scenario like this the most obvious choice is the correct one.

GIUDICE: That`s right.

GRACE: In other words, it did come from Uchitel. Although O`Neil swears it didn`t. It could have come through a third party.

GIUDICE: Right.

GRACE: But the fact that nobody`s been sued or there`s not a police report of someone hacking into her accounts.

GIUDICE: Right.

GRACE: Says volumes to me. It says nobody did hack into her accounts.

GIUDICE: I think there`s a lot -- that`s a good assumption. I think that`s fair. However, a lot of people don`t understand how easy cell phone records are to get, how people can throw cell phones away and if you don`t take that chip out of it people can download your text messages.

GRACE: I want to go to Doug Burns on another issue. His primetime ads have dried up. Gatorade has discontinued the Tiger Woods drink.

BURNS: Right.

GRACE: His ads haven`t aired since right after thanksgiving, if I`m correct.

Doug Burns, what do you know about morals clauses in contracts?

BURNS: Well, morals clauses say if the person engages in conduct that is inimical to the image and the brand and the promotion then we have the right to cancel the contract. The other point, though, I would make is, you know, he was represented, I`m guessing, by, you know, top, top counsel, so they probably negotiated it and battled back and forth in terms of how much room there would be to nullify it.

But having said that, he`s going to lose a lot of endorsements.

GRACE: I want to go back to Dr. Marty Makary. He`s a physician and professor of public health at Johns Hopkins.

Dr. Marty, thank you for being with us as always. A lot has been made of the fact that a witness at the crash, most likely his wife, told police he had been drinking that day before the crash and was prescribed Ambien, a sleep pill, and a very powerful painkiller, Vicodin.

Now, if he was DUI, what kind of injuries would you have expected him to have to suggest there was a cover-up?

DR. MARTY MAKARY, PHYSICIAN, PROF. OF PUBLIC HEALTH, JOHNS HOPKINS: Well, you know, everybody who comes in after a motor vehicle crash in the emergency room is tested for blood alcohol levels and also a standard toxicology screen.

We don`t know anything about that. What we do know is that there was a head injury because there was a claim that there was snoring at the scene, which is a sign of unconsciousness, and that the patient, Tiger, this situation was taken into taken into an ICU overnight and admitted the next day.

If somebody`s discharged from a hospital after 24 hours that means that they got a head scan, that head scan was negative, and the patient was released because of that. Any other reason they`d be watched for a long period of time.

GRACE: Now, are you saying it`s SOP, standard operating procedures, for the hospital to take blood when somebody`s admitted like this?

MAKARY: Because there`s no way to assign fault from an accident or make a decision, a judgment call, about who was involved and who was at fault, all motor vehicle accident victims get a standard toxicology and blood alcohol level in the emergency room.

GRACE: I want to go back to Dr. Lillian Glass, psychologist, body language expert, author of "I Know What You`re Thinking."

Lillian, I find it very odd that he is actually confronting one of the women in these alleged e-mails that she`s dated other people in the past. He`s married.

LILLIAN GLASS, PSYCHOLOGIST, AUTHOR OF "I KNOW WHAT YOU`RE THINKING": Exactly. Again, he fell for her.

GRACE: Look, Lillian, before marriage, whatever. Date everybody, anybody. Date different people. Whatever. But once you walk down the aisle, once you sign on the dotted line and have children, it`s over.

GLASS: I agree with you. And this is about his entitlement issues. He`s Tiger Woods, he can have it all. And he thinks he can. But he can`t.

GRACE: I want to go back to Tom O`Neil with "In Touch Weekly." Tom, you and I have both seen his advertising dry up. I mean, it`s kind of hard to sell the whole family man thing now. You`ve got Buick. You`ve got a lot of family-oriented advertisers.

I mean, he is an industry. Tiger Woods is an industry. He makes about $10 million a year, and most of that is from endorsements.

TOM O`NEIL, SENIOR EDITOR IN TOUCH WEEKLY, COVERING STORY: That`s right. And if we look back to a point earlier this year when we saw another heroic sports figure, Michael Phelps, the Olympic swimmer, get caught smoking marijuana, he lost the Kellogg`s account from that.

But then I think there`s another parallel here that may be even more appropriate. And that is five years ago Kobe Bryant was accused of rape, remember? And now, Nancy, he`s not only completely recovered his career, he is the second highest-earning sports figure in a tie with Michael Jordan behind Tiger Woods.

GRACE: And Kobe Bryant`s jersey is the number one seller in Europe, FYI.

To the lawyers, Alexis Martin Neally, Raymond Giudice, Doug Burns.

Alexis Martin Neally, how would all these different affairs -- if there is a prenup in place, of course that was signed before children come along. Do children being born nullify a prenup? And how do multiple affairs, if they happened, affect custody?

Could she take off and head home to Sweden? We know she just closed on a family mansion back home in Sweden. Can she take the children away if she`s got primary custody? And when did he have time to be with all these women with two children?

NEALLY: Well, we don`t know how much he was with his children. But hopefully she`s not going to take off no matter what. Even if she is granted primary custody. Because regardless of these affairs, the most important thing for his children is that he have a relationship with his children. That has nothing to do with these affairs.

GRACE: But how can they do that if they`re in Sweden and he is on the PGA Tour?

NEALLY: Well, he -- she shouldn`t take the kids to Sweden and she can`t right now, no matter what. So she`d have to go through the divorce process, she`d have to get custody, she`d have to get permission to do that.

That`s probably not going to be the case. If it was the case, hopefully she`s not going to take these kids away from their dad because he had an affair. It`s a whole other issue that needs to be addressed.

GRACE: Everyone, quick break. But as we go to break, we ask sincerely for your thoughts and prayers for a tiny little crime fighter, Georgia friend of the show, Jack, who is just 8. And this beautiful boy is battling cancer.

Sweet Boy, please stay strong.

GRUBBS: I tried to just fewer text messages, and bar in between, and phone calls, and there was a time when he did come out, he did physically come out for five days and he texted me every day and said, you know, put me, I want to see you, I miss you. And, you know, I didn`t do it. I was like, I`m not going to do that anymore.

UNIDENTIFIED FEMALE: Did you love Tiger?

GRUBBS: I did never say that I did love him. I wouldn`t let myself get that far.

UNIDENTIFIED FEMALE: Do you think Tiger loved you?

GRUBBS: There are times where I feel that, you know, he could have. But I mean, if you were to ask me that question now, I would have to say he didn`t.

(END VIDEO CLIP)

GRACE: Straight back to Tom O`Neill, senior editor, "In Touch Weekly," allegations that Tiger Woods has paid so-called hush money to various women and we see Uchitel giving an interview to "OK!" magazine that`s hitting the stands this week. She refuses to talk about the alleged affair.

How many women are out there that allegedly have been paid off?

O`NEIL: Boy, that`s a good question. There are 10 alleged mistresses or affairs total. The allegations of payments to them are only about two or three.

GRACE: What about it, Eloise Parker with "OK!"?

PARKER: Yes, that`s what we`re hearing. There was another one possibly today, a second porn star, but again, particular with the porn star.

GRACE: Wait, wait, wait.

PARKER: . alarm bells, in my mind.

GRACE: Eloise, did you say a second porn star?

PARKER: That`s right, yes, which releases warning bells in my mind, I don`t know. If he`s an opportunist, call me wrong, call me wrong, but it stinks to me.

GRACE: Ellie Jostad, so far two women are allegedly being paid hush money. What do you know about it?

JOSTAD: Right. Right. Well, there are reports out there, and again we can`t confirm any of this, but reports that Uchitel was paid anywhere from $1 to $3 million and that this number two, Jaimee Grubbs, claiming to the "Enquirer" and to Radar, they are both reporting that she was approached with an offer of $200,000 to keep quiet.

GRACE: Tiger Woods, still in hiding allegedly on his yacht, the Privacy. No word on his wife and children.
