Mistress Claims Rendezvous in Tiger`s Home

Aired December 11, 2009 - 20:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

NANCY GRACE, HOST: Breaking news tonight, live, Windermere, Florida. Superstar golf phenomenon Tiger Woods drives out of his multi-million- dollar compound barefoot, 2:00 AM, after Thanksgiving Day celebrations and has a head-on collision with a tree and a fire hydrant. His young wife, the mother of his two children, says she hears the crash from inside, runs out to beat out both back windows of Woods`s Cadillac.

Woods refusing repeatedly to speak to police, immediately pulling out of his own golf tournament. Gatorade drops the Tiger Woods drink, primetime TV ads dry up as Woods`s alleged mistresses hit double digits, including a swimsuit model, two porn stars and a waitress at a pancake house. Woods just gets a slap on the wrist, even though a witness tells cops Woods was drinking before the crash and prescribed pain pills, sleeping pills and Vicodin.

Bombshell tonight. In the last hours, Tiger Woods`s lawyers go to court to block papers and magazines from publishing alleged photos of Tiger Woods nude. Also in the last hours, one of Woods`s alleged mistresses reveals Tiger Woods romanced her in the family home while his wife and children were away. Moving vans show up at Woods`s compound, load up and leave. Reports Tiger Woods allegedly moves out the same day his mother-in- law collapses in the mansion. At this hour, Woods still in hiding, reportedly on his multi-million-dollar yacht, the Privacy. Do you blame him?

The affairs reportedly no flash in the pan, many allegedly going on for years. Also tonight, reports Tiger Woods can`t take the heat so he gets out of the kitchen. Is he leaving the country? And lawsuits threatening to boil over, New York club hostess, alleged mistress number one, facing a potential lawsuit by the source who breaks the story of the alleged affair. Even more women coming out of the woodwork, the tally rising, reports that hundreds of explosive e-mails and text messages secretly sent between Woods and mistresses go public, Woods promising to leave his wife and two children, claiming this woman is his soul mate and whining he wishes he met her before he married. Another text allegedly telling another woman they`ll be together, quote, "forever," reportedly setting up late-night rendezvous, bankrolling luxury trips for an alleged girlfriend just before the crash.

Also on the legal front, did Woods pay millions to buy the silence of an alleged mistress? When does hush money turn into a bribe? What really happened to Tiger Woods? And how does it affect child custody and a possible divorce?

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Tiger isn`t out of the Woods yet. His troubles are just beginning!

GRACE: British lawyers have gotten a court order or have gone to court to stop nude depictions, photos, of Tiger Woods.

UNIDENTIFIED MALE: Lawyers representing the superstar golfer said they don`t know that any images like that exist. They say they sought the court order to prevent anybody from publishing fake images of him nude.

UNIDENTIFIED MALE: More alleged affairs, more alleged mistresses, a full-blown Tiger Woods scandal.

UNIDENTIFIED MALE: Hey, it`s -- it`s Tiger. I need you to do me a huge favor. Can you please take your name off your phone? My wife went through my phone and may be calling you.

UNIDENTIFIED MALE: A woman who claims she had an affair with Tiger Woods is angrily denouncing newspaper reports that she took money from him. Jamie Jungers said she only asked Tiger Woods for money once during the alleged year-and-a-half relationship. Jungers said she never expected more than a one-time fling with the golf superstar but that it developed into a boyfriend/girlfriend affair.

UNIDENTIFIED MALE: There seem to be real relationships as you read these text messages. This wasn`t ships in the night. The odd thing about it is for a person like, hey, who was a playboy, for want of a better term, he really got emotionally involved with these women.

JAIMEE GRUBBS, ALLEGED MISTRESS: I did feel guilty that, you know, he`s spending his time with somebody, you know, that isn`t his wife. But you know, he never mentioned her and it was kind of -- you know, I never thought about it. I thought of our times together and how I felt about him and how my heart wanted what my heart wanted.

(END VIDEO CLIP)

GRACE: And breaking news tonight, live, Utah, the mystery surrounding the sudden suspicious disappearance of a gorgeous young stockbroker, the mother of two little children. Tonight, where is mom of two Susan Powell?

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Police are desperately searching for a missing mom of two who allegedly vanished from her own home in the middle of the night. Susan Powell was last seen around midnight Sunday sleeping in her own bed.

UNIDENTIFIED MALE: Her husband said he and their two kids were on a camping trip when the woman went missing.

UNIDENTIFIED MALE: When they returned the next afternoon, Susan was gone.

UNIDENTIFIED MALE: We just miss her and we want her back and -- and I love her and my boys love her.

UNIDENTIFIED FEMALE: How are they doing?

UNIDENTIFIED MALE: They`re doing OK.

UNIDENTIFIED MALE: Search teams have been scouring the west desert of Utah for any trace of Susan Powell, but the search is being suspended because of an approaching snowstorm.

UNIDENTIFIED MALE: Police reportedly find Susan`s cell phone, purse and keys all in the home. Family and friends say Susan would never abandon her two children. Police have executed search warrants on both the home and her husband`s car, hoping to find some clue that could bring Susan home safely.

UNIDENTIFIED MALE: Any help to try to find her would -- would be appreciated, so...

UNIDENTIFIED MALE: Investigators term Powell`s disappearance suspicious.

(END VIDEO CLIP)

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Breaking news tonight. In the last hours, Tiger Woods`s lawyers go to court for an order to block newspapers and magazines from publishing alleged nude photos of Tiger Woods. Also in the last hours, one of Woods`s alleged mistresses -- one of many -- reveals Tiger Woods romanced her in the family home while his wife and children were away. Moving vans show up at Woods`s compound, load up and leave.

(BEGIN VIDEO CLIP)

GRUBBS: I guess, if you -- if I were to seriously think about it, I - - you know, I did feel guilty.

UNIDENTIFIED MALE: A public apology from an alleged mistress to a scorned wife?

UNIDENTIFIED FEMALE: Do you think that Tiger`s a sex addict?

GRUBBS: The man that I knew, the Tiger that I knew, I would never think that. You know, it was never about that. He never, you know, just kind of said, Come over and that`s what`s going to happen.

GRACE: That is alleged mistress number two, Jaimee Grubbs, describing how she was in love with Tiger Woods.

UNIDENTIFIED MALE: The 24-year-old tells the TV show "Extra" she was intimate with Woods 20 times over a three-year period. She claims Tiger Woods never discussed his wife, Elin, and she feels badly for her.

GRACE: Just released, part of 100 e-mails and text messages in which Tiger Woods claims he`s found his soul mate.

UNIDENTIFIED MALE: The series of these e-mails take place where he first professes all this love for her, and then he starts telling her how jealous he is.

UNIDENTIFIED MALE: "I don`t know if this is going to work. I thought I was getting to know you, but it feels like I`m just another person who happens to be famous. Every time I think about it, I get a lump in my throat. Some of the other parts of your past really get to me. I don`t know what person I was falling for so hard, the one I got to know on the phone, e-mail, text and in person, or the one who likes famous people."

(END VIDEO CLIP)

GRACE: Straight out to Ellie Jostad, our chief editorial producer. Ellie, what can you tell me about this court order -- I`ve got the document right there in my hand...

ELLIE JOSTAD, NANCY GRACE PRODUCER: Right.

GRACE: ... where any nude photos of Tiger Woods, if they exist, are now blocked from publication? What happened?

JOSTAD: Right. So Tiger Woods`s lawyers went to the high court in London yesterday, got this court order late in the afternoon. What it says is, you know, number one, We don`t admit that there are any photos like this. But if there are, if there are photos that are faked to look like they`re pictures of Tiger Woods and you publish them, you can either be fined, you could be imprisoned, you could have assets seized. And they got this order yesterday. It was sent to media throughout the UK, possibly also some media here in the U.S. And this is going to stop any photos from coming out, if they exist.

GRACE: OK, so a Brit order...

JOSTAD: Yes.

GRACE: They don`t have jurisdiction over American newspapers and magazines.

JOSTAD: Right. You`re right.

GRACE: Unleash the lawyers, Susan moss, New York, Anne Bremner, Seattle, randy Kessler, Atlanta. Susan Moss, weigh in.

SUSAN MOSS, FAMILY LAW ATTORNEY: From Tiger`s lawyers` point of view, this case is great! They`re going to take this order. They`re going to bring it into an American court. They`re going to domesticate it. They`re going to present the same evidence, and they`re probably going to get the same order that will be enforceable in the states.

GRACE: Well, you know what? They better hurry. And I`m not saying that nude photos exist because practically anybody -- practically my two twins, who are only 2 years old, can go on line and take somebody`s head and stick it on somebody else`s body and it looks real, Anne Bremner. So I`m not saying that I believe these photos exist. Certainly, Tiger Woods would not be that stupid to allow photos of himself be taken. But a Brit order in Great Britain -- they can`t tell American magazines what to do.

ANNE BREMNER, DEFENSE ATTORNEY: Absolutely not. But like, we`re going to see it here next. But who knows? I mean, when you say he couldn`t be that stupid, Nancy, to be doing that, I mean, look what everything he`s been doing so far.

GRACE: Randy Kessler, both of the last two lawyers, Anne Bremner and Susan Moss say, Well, they`re going to domesticate it. In other words, they`re going to make that foreign order, a British order, domesticated to America. Hey, don`t you think they better hurry? Have they heard of anything called the Internet, where you can send photos instantly from Great Britain to America so if they get here, they could be published?

RANDY KESSLER, DEFENSE ATTORNEY: Well, you`re right. And this may be much ado about nothing because when a magazine that could be the first one to publish nude photos of Tiger Woods weighs the consequences of violating an order versus the publicity their magazine will get, it may be irrelevant, you know? But you`re right, the quicker the better.

GRACE: Well, here`s the other thing to keep in mind. Tiger Woods has what we call in the law a "deep pocket." If someone publishes a false photo of him, a nude photo of him, allegedly taken by one of these women, they`re in hot water. They will be sued out the yin-yang! That`s a technical legal term.

Out to Kim Serafin with "In Touch Weekly." Kim, what can you tell me about this alleged mistress who says Tiger Woods romanced her in the family home while his wife and children were gone?

KIM SERAFIN, "IN TOUCH WEEKLY": That`s right. Jamie Jungers, one of the alleged mistress, did this very explosive interview today. And it`s interesting because she, like some of these other women that are coming out, is not saying it was a one-night thing. She`s saying this was a romance. This went on for a long time. They had a relationship. He felt a connection and he pursued her. In fact, she was at their home.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Do you think he had a problem, I mean, there was something going on, or that he needed -- he needed prescription drugs to help him sleep?

GRUBBS: I mean, he is a world-renowned athlete, and I`m sure he has so much on his mind and I couldn`t imagine it ever being put to sleep.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

911 OPERATOR: Is he unconscious?

UNIDENTIFIED MALE: Yes.

911 OPERATOR: OK, are you able to tell if he`s breathing?

UNIDENTIFIED MALE: No, I can`t tell right now.

911 OPERATOR: OK. All right. We do have help on the way. What color is his car, too?

UNIDENTIFIED MALE: It`s a black Escalade.

UNIDENTIFIED FEMALE: What`s happened?

911 OPERATOR: Is anyone able to open the door?

UNIDENTIFIED MALE: (INAUDIBLE) we`re trying to figure out right now.

911 OPERATOR: OK, is he trapped inside of the vehicle or is he on the ground?

UNIDENTIFIED MALE: No, we`re just trying to get the police here right now. We don`t know what happened. We`re just trying to -- we`re figuring it all out right now. We`re just -- I`m on the phone with the police right now.

UNIDENTIFIED MALE: He was in and out of consciousness, with lacerations to his upper and lower lip, with a little bit of blood in his mouth, but he was conscious enough to be able to speak a little bit.

UNIDENTIFIED FEMALE: In his own statement, Woods also refers to his wife. Police say she told them she bashed out the SUV`s rear passenger windows with a golf club to get him out of the locked car.

UNIDENTIFIED MALE: His wife came out of the house when she heard the accident of him hitting the fire hydrant, used a golf club, is what we were told, to break out the read window to gain entrance into the vehicle, removed him from the vehicle. and laid him down on the street.

UNIDENTIFIED FEMALE: "My wife, Elin, acted courageously when she saw I was hurt and in trouble," Woods said. "She was the first person to help me. Any other assertion is absolutely false."

So I mean, the person that I knew, I would say no.

(END VIDEO CLIP)

GRACE: Anne, just a few hours ago, yet another alleged mistress breaks her silence. Take a listen to this.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Did he ever talk to you about his wife, ever mention her?

JAMIE JUNGERS, ALLEGED MISTRESS: No. The one time that his wife was mentioned was the first day that I met him and that we hung out, and I`m the one that asked him about her.

UNIDENTIFIED FEMALE: But you actually, from what I understand, spent time in their home in Los Angeles, as well?

JUNGERS: Yes, I did.

UNIDENTIFIED FEMALE: When she wasn`t there, obviously.

JUNGERS: Yes. Yes. This happened probably a month after we`d been seeing each other. And he flew me out, came and picked me up at the airport, and I stayed there for a night.

UNIDENTIFIED FEMALE: How do you feel now, knowing that you were never just one woman for him?

JUNGERS: I have a lot of mixed emotions about it. I mean, I still -- there`ll always be a place in my heart for Tiger. But he obviously has issues, so I`m -- there`s parts of me that`s angry and there`s parts of me that I guess kind of don`t find -- doesn`t find it, you know, unbelievable, you know? But I guess out of all, I`m pretty heart-broken.

UNIDENTIFIED FEMALE: Do you feel responsible, though, for some of the heartbreak that his wife is feeling right now?

JUNGERS: Yes and no. I mean, I wouldn`t want somebody to do it to me, so I guess I can, but I`m not going to take the full blame for this, you know? And I never wanted this to come out. And I never would have said anything or I could have done it years ago.

(END VIDEO CLIP)

GRACE: That`s Jamie Jungers, the alleged former mistress of Tiger Woods. She was on the "Today" show just this morning.

To Alexis Teresczuk, reporter with Radaronline.com. Alexis, what do you make of it and allegations that Tiger romanced her in the family mansion while his wife and children were gone?

ALEXIS TERESCZUK, RADARONLINE.COM: Nancy, I think that this is probably one of the more shocking things that the women have come out and said. I think if it was in Las Vegas, if it was in Dubai, if it was in Australia, that`s fine, but to be in someone`s home, where the wife...

GRACE: Whoa! Whoa! Whoa! Whoa! Back it up! Back it up! Did you just say it`s fine as long as it`s somewhere else?

TERESCZUK: No, it`s -- no! It`s...

GRACE: You did say that.

TERESCZUK: No!

GRACE: Well, you did.

TERESCZUK: I guess -- I meant that it`s less invasive for the wife. You know, if it`s right in the home...

GRACE: But you know what? I got to tell you something. It`s not fine. But I know what you mean. It`s not as disgusting. It`s not as shocking...

TERESCZUK: Exactly.

GRACE: ... as it is to bring somebody with your wife`s photos all around. I mean, what are they going to...

TERESCZUK: And pictures of your children in the house...

GRACE: ... do, have a glass of wine in the children`s nursery? I mean, to put it gently.

To Dr. Joseph Deltito, professor of psychiatry joining us from New York. You know, a lot of people have flings, Dr. Deltito. That`s not uncommon. Over half of married couples in America, somebody`s had a fling, all right? And I know that`s a euphemism for sex outside the marriage.

But here, if these women are to be believed, the relationship with Tiger Woods would go on for a couple years, where he would talk about them being together, quote, "forever," how he whined about being married to his wife and says he wished he met them before he got married. What is that? There`s got to be a medical term.

DR. JOSEPH DELTITO, PROFESSOR OF PSYCHIATRY: Well, I don`t know what the medical term is, but it certainly sounds like he had emotional needs or emotional deficits besides just sexual ones. As you listen to these women, it doesn`t sound like it was only about sex. But I would say that a lot of important men are essentially polygamists in their own minds and not monogamous.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Did you feel guilty?

GRUBBS: I guess, if you -- if I were to seriously think about it, I - - you know, I -- I did feel guilty that, you know, he`s spending his time with somebody, you know, that isn`t his wife. But you know, he never mentioned her, and it was kind of -- you know, I never thought about it. I thought of our time together and how I felt about him and how my heart wanted, what my heart wanted. So I never...

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Do you think that that -- he had a problem? I mean, do you think there was something going on or that he needed -- that he needed prescription drugs to help him sleep?

GRUBBS: I mean, he is a world-renowned athlete and I`m sure he has so much on his mind, and I couldn`t imagine it ever being put to sleep. But he very much does have a sleeping problem, you know? Whether it`s insomnia caused by stress or whatever it may be, I don`t know, but...

UNIDENTIFIED FEMALE: Do you think he has an addiction to painkillers or sleeping pills?

GRUBBS: I mean, that`s something that I wouldn`t be able to, you know, say. I wouldn`t -- I wouldn`t know. I never saw it.

(END VIDEO CLIP)

GRACE: I have just received breaking news in my hands that Tiger Woods is taking a, quote, "indefinite break" from the sport of golf. I`m reading verbatim from the release by Tiger Woods. "I am deeply aware of the disappointment and hurt that my infidelity has caused so much people, most of all my wife and children. I want to say again to everyone that I am profoundly sorry and I ask forgiveness. It may not be possible to repair the damage I`ve done, but I want to do my best to try. I`d like to ask everyone, fans, good people at my foundation, partners, PGA tour, competitors for understanding what`s important now is time for privacy and safe haven we need for healing. After much soul searching, I have decided to take an indefinite break from professional golf. I need to focus my attention on being a better husband, father and person." He goes on to ask for privacy. This is straight from Tiger Woods on his Web site.

I want to go straight break out to Dr. Joseph Deltito. Doctor, what do you make of it?

DELTITO: Well, if one is to believe it, I say bravo. He wants to repair his relationship with his wife. He should go somewhere with her, get out of the limelight and concentrate on that. He seems to admit that he feels that he failed. And I hope it`s true and I wish him good luck.

GRACE: To the lawyers, Susan Moss, Anne Bremner, Randy Kessler. Anne Bremner, this is, in a legal sense, a major admission of infidelity this as moving vans bull up to Tiger Woods`s multi-million-dollar compound, pack up and leave. Many reports that he is leaving the country. Now, what does this admission off his Web site mean for a possible divorce and child custody?

BREMNER: You know what I think it means, Nancy, is I think he`s going to make it work. And he probably should go into sex addiction rehab and maybe go on Oprah, as it`s been rumored, because otherwise, I don`t think the divorce is going to happen.

GRACE: What about it, Randy Kessler?

KESSLER: This is the best thing he could do. The court of public opinion is more important in this case than the normal court system. He needs his reputation back more than he needs the legal system.

(BEGIN VIDEO CLIP)

GRUBBS: I did put a lot of, you know, emotions into this and I did care very much for him. And when we were together, I mean, he did make me feel like I was the only girl. So to go back and see -- I mean, especially now, when there`s more and more...

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

REPORTER: Did you ever see him take drugs at all?

JAMIEE GRUBBS, TIGER WOODS` ALLEGED MISTRESS: I mean, I`ve never seen him, you know, take painkillers. I know he does have a hard time sleeping. He would take a sleeping pill occasionally. I mean, he did -- never sleep. I mean, even if he wanted to go to bed at maybe 10:00, I mean, he wouldn`t fall asleep until, you know, 12:30, 1:00, and then he`d be up at 3:00. I mean, that`s just the way he was.

REPORTER: And do you think that he had a problem? I mean, there was something going on? Or that he need -- that he needed prescription drugs to help him sleep?

GRUBBS: I mean, he is a world-renowned athlete. And I`m sure he has so much on his mind. I couldn`t imagine it ever being put to sleep. But he very much does have a sleeping problem, you know, whether it`s insomnia caused by stress or whatever it may be. I don`t know.

(END VIDEO CLIP)

GRACE, HOST: Just coming across our wires right now, off the Tiger Woods` website, Tiger Woods taking an indefinite hiatus, an indefinite break, from professional golf. As he said, quote, "I am deeply aware of the disappointment and hurt that my infidelity has caused so many people; most of all, my wife and children.

I want to say again to everyone I am profoundly sorry and that I ask forgiveness. It may not be possible to repair the damage I`ve done, but I want to do my best to try. I would like to ask everyone - fans, people of my foundation, business partners, the PGA tour, competitors - for understanding. What`s important now is that my family has the time, privacy and safe haven for personal healing. After much soul searching, I have decided to take an indefinite break from professional golf. I need to focus my attention on being a better husband, father and person. "

To Mike Brooks, former fed with the FBI, I appreciate the apology. What really matters in my mind, is if he can repair the marriage and if he can really change. If he cannot do those things, and we land in divorce court, how do, say, forensic accountants and private investigators prove this case?

MIKE BROOKS, FORMER FBI AGENT: Nancy, you know, in any case like this, especially divorce case, follow the paper trail. I`m sure there`s e- mails, text messages. Where`s he spending all this money? We heard this one woman say, "He flew me out there." Dates, times, money spent. These are all part of building a case in a divorce. Right now, nothing criminal. But in civil court, you know. But the real victims here, Nancy, are his wife and his two little children. They`re the real victims in all of this.

GRACE: To Dr. Howard Oliver, former deputy medical examiner, joining us from LA, Dr. Oliver, I noticed this statement is given without Woods coming out of hiding; apparently still covering up his injuries. What type of injuries would take this long?

DR. HOWARD OLIVER, FORMER DEPUTY MEDICAL EXAMINER: Well, chiefly emotional injuries. He needs time to heal. He needs time to protect his family while he repairs the relationship.

GRACE: Straight back out to Kim Serafin, Senior Editor, "Intouch Weekly."

With this breaking news, how does it factor in with what you`ve learned, Kim?

KIM SERAFIN, SENIOR EDITOR, "INTOUCH WEEKLY": This is huge news, especially because there had been reports coming from both Sweden and here in the U.S. that both him and Elin were going to go to Sweden very soon to kind of work on their marriage. So this would imply, especially because in the statement he`s talking about his family, he`s talking about his wife, his kids. This would imply that he really does want to work on his marriage. And divorce is maybe not the next option.

GRACE: What about it, Ellie Jostad?

ELLIE JOSTAD, NANCY GRACE PRODUCER: Nancy, you know, I`m looking back over Tiger Woods` previous statements. The first time a couple days after the accident, all he said was, "I got in this wreck. It was embarrassing. My wife acted courageously."

A few days later, he admits transgressions without saying what those were. And then finally today we`re hearing the first admission of any kind of infidelity.

GRACE: And to you, Alexis, with radaronline.com. What do you make of it? Is it for real?

ALEXIS TERESZCUK, REPORTER, RADARONLINE: I think it`s for real and I think it`s amazing he`s admitting what so many women have come forward and alleged, that it wasn`t one woman, it wasn`t two. We think the number has been up to 13. It`s very surprising and huge news that he is admitting these infidelities because we have so many sources and so many women tell us he did, in fact, have these affairs.

GRACE: Also, we learn that apparently moving vans pull up in front of Tiger Woods` multimillion-dollar compound. This, just before this statement is released.

To Ellie Jostad. What, if anything, does it mean? I mean, Woods has moved out of the home for several days according to neighbors.

JOSTAD: Right.

GRACE: But what now?

JOSTAD: Well, Nancy, the big speculation is, where is Tiger? There have been reports that they`ve been living separately. That he had moved into one of their other residences, either, you know, permanently or for a few days. Who knows? But the point is nobody`s seen Tiger Woods. We`ve only seen Elin a couple of times back when her mother was sent to the hospital. She came and went to the hospital. But no one`s seen them; no one`s seen their children.

GRACE: To you, again, Ellie Jostad, what can you tell me about a possible lawsuit pending against alleged mistress number one, Uchitel?

JOSTAD: Right. Rachel Uchitel, she is that New York City nightclub hostess. Apparently she came forward and denied, denied, denied, denied, this alleged affair with Tiger Woods. And went so far as to say, oh, this woman who told the "Enquirer" I was having an affair with Tiger Woods, she said she was a train wreck. She made allegations about her using drugs, alcohol. And so now, that person who talked to the "Enquirer" is contemplating suing Rachel Uchitel for what she said.

GRACE: And while I`ve got you, Ellie, this order blocking the nude photos of Tiger Woods, why in Great Britain? Why was it filed in Great Britain?

JOSTAD: Well, you know, that`s not 100 percent clear. There has been speculation, you know, that the U.K. press, especially those tabloids, is so aggressive in their reporting, they were, you know, perhaps afraid that that would be the first place where something like this would surface. So that`s kind of the theory, but no one does.

GRACE: And to Kim Serafin. Reports now swirling that it got just too hot in the kitchen, Tiger Woods getting out. Not only out of the game of golf, but out of the country. What have you heard there, in "In Touch Weekly" about the possibility he`s leaving the country?

SERAFIN: Exactly. Well, there had been reports he was leaving for Sweden with his wife, but of course we know he has homes all over. He`s got homes in Florida, he`s got homes in California, in Jackson Hole, in Dubai. So there are certainly a lot of places that he and his wife could escape to or he on his own could escape to, to get some privacy and to try to work this out.

REPORTER (voice-over): Utah authorities continue to investigate the disappearance of mom of two, Susan Powell, allegedly vanished from her own home Sunday night. Susan`s husband, Joshua Powell, says he decided Sunday evening to take the couple`s two young sons on a late-night camping trip, something he says they do frequently. Powell`s sister, not hearing from the family for almost two days, calls to report the whole family missing. The father returns with the two boys later Monday afternoon. But Susan is nowhere to be found.

Do you have any idea what happened to her?

JOSHUA POWELL, HUSBAND OF SUSAN POWELL: No. She`s somewhere.

REPORTER: I know there was quite a huge effort out in the west desert looking for any sign of her. Is that where you were camping?

POWELL: I just have to go get my boys. Thank you.

MALE REPORTER (voice-over): The 28-year-old Powell simply disappeared from her home leaving her cell phone and car behind.

REPORTER: While there are reports the couple was in marriage counseling, family and friends say Susan would never leave her children. Police executed a search warrant on the home Wednesday and say they`re conducting forensic testing on items taken during the alleged search.

(END OF VIDEOTAPE)

GRACE: Out to Jim Kirkwood with KTKK News Radio joining us from Salt Lake City, Utah.

Jim, there are some very unusual circumstances, to say it euphemistically, surrounding this woman`s disappearance.

JIM KIRKWOOD, KTKK NEWS RADIO: This is heartbreaking and very suspicious. Very. Susan Powell disappeared. Apparently she went to bed Sunday night. The next thing we know, she`s not to work Monday morning. Around midnight, Josh Powell is taking the two boys, age 2 and 4, off to the west desert. Now, this --

GRACE: Whoa, wait. What time?

KIRKWOOD: Around midnight.

GRACE: Midnight?

KIRKWOOD: Sunday night.

GRACE: Midnight?

KIRKWOOD: Midnight, a 2-year-old and a 4-year-old.

GRACE: A 2-year-old and 4-year-old, at midnight?

KIRKWOOD: Yes. And right --

GRACE: Wait a minute. With me, Jim Kirkwood. We`re showing you footage from the scene. I believe I see snow.

KIRKWOOD: It`s really cold --

GRACE: So why is he taking them out at midnight, a 2-year-old and 4- year-old, in the snow?

KIRKWOOD: That area`s really wild, and it had to be that night near zero or below. I mean, it`s unbelievable, Nancy.

GRACE: He takes them out, Jim Kirkwood, for what?

KIRKWOOD: Supposedly to test out a new generator and to make S`mores. That`s the story.

GRACE: You know what, Mr. Kirkwood, you have an excellent reputation. And I admire that you said that with a straight face.

KIRKWOOD: Yes.

GRACE: Because you know what? It`s almost laughable. But the fact is, this woman is gone. She`s gone. The mother of these two children. And having two children myself, of course, somebody else could come in and change their diapers or make sure they got to playschool. But it`s not the same as a mother. And for him to say he took a 2-year-old out at midnight in the snow --

KIRKWOOD: Yes.

GRACE: -- to test out a generator?

KIRKWOOD: Yes.

GRACE: What happens then, Mr. Kirkwood?

KIRKWOOD: Well, then he is on a new job, had been out of work for a while. He does not show up or call in to work Monday morning. She does not show up or call in to work Monday morning. He returns Monday afternoon with the children, on a new job. And no one does that, Nancy. I mean, with the financial --

GRACE: What was his excuse, Mr. Kirkwood?

KIRKWOOD: He didn`t have one. He just was out there with the kids.

GRACE: Well, you know what I was told from a different source, from Rupa Mikkilineni, our producer on the story, is that he said he got the days confused and he didn`t realize it was Monday.

KIRKWOOD: Yeah, right. Except they go to church here at the LDS Ward House and they were at church on Sunday. He knew very well it was Sunday.

GRACE: Latter Day Saints?

KIRKWOOD: Yes.

GRACE: What about it, Rupa? What more can you tell me?

RUPA MIKKILINENI, NANCY GRACE PRODUCER: That`s right, Nancy. What we know is he`s somebody, according to the family, according to Susan Powell`s father, who knows Joshua Powell quite well, he`s somebody that typically time runs away from him. He loses track of time. He will say he has an appointment at 10 a.m. .

GRACE: Rupa, please stop. Did he get to church on time the day before?

MIKKILINENI: I believe he did, Nancy.

GRACE: OK, continue.

MIKKILINENI: So he is the kind of person that apparently will say -- he`ll show up at 10:00 and will show up at 2:00 instead.

GRACE: Shelby Gifford, family friend and spokesperson joining us tonight from Seattle. Miss Gifford, thank you for being with us. What are police saying right now?

SHELBY GIFFORD, FAMILY FRIEND AND SPOKESPERSON: Well, when I talked with them this morning, they are continuing to investigate leads. They`re being very, very thorough. We`re appreciative as a family of their efforts. They`re doing a great job keeping in touch with us and letting us know, you know, we`re 16 hours, 17 hours away by car and hard to get a feel for what`s going on down there exactly. But at this point, they`re not calling Josh a suspect or a person of interest.

GRACE: Shelby Gifford is a family friend. What can you tell me about her, about Susan Powell? She`s just 28 years old.

GIFFORD: Susan is a fabulous person and an exceptional mother. You know, there are good moms out there all over the place, but Susan is exceptional and those boys are her life. And we believe as a family that if she is separated from them right now like she is, it`s because somebody else has control of the situation.

GRACE: Are you saying --

GIFFORD: There`s no way that she would stay away from them.

GRACE: Shelby, when you say that she was such a great mother, give me an example. What do you mean by that?

GIFFORD: You just couldn`t separate her life from her kids` lives. When she was happy, it was because of something that her kids did or were doing. She just -- she`s just a good mom and a good -- a great lady. And we miss her and we want to know where she is. Some moms are great moms. Susan is exceptional.

GRACE: To Marc Klaas, president and founder of KLAAS kids foundation. His expertise, missing people. Marc, give us your advice.

MARC KLAAS, PRESIDENT AND FOUNDER OF KLAAS KIDS FOUNDATION: Well, I think they have to focus in on the husband here. This situation has more red flags than a Chinese New Year parade. I think that Shelby perfectly contained it when she said that if she`s not with her children, somebody else is in control of the situation. Given the odd behavior of this man and the fact that there`s no signs of a break-in and, in fact, that her purse and her cell phone are still at home, point directly at the husband and absolutely nobody else.

GRACE: You know, Marc, when I leave for work to come here, I hate being away from the twins.

KLAAS: Sure.

GRACE: I just can`t imagine being taken away, separated possibly forever from them and not being there to raise them as the very best that I can. Marc, what jumps out at you about this story? And let me reiterate, Joshua Powell is not a suspect. He`s not a person of interest. He`s not been named either of those by police.

Go ahead, Marc Klaas.

KLAAS: The thing that jumps out at me is his behavior. This whole idea of leaving in the middle of a Sunday night when it`s cold and freezing outside to go camping and to make S`mores with two very young children makes no sense on any level. I`ve never heard of anybody doing anything close to that. And the whole idea that this is an exceptional woman that loves her children more than anything else in the world and would never want to be separated, yet she is separated and nobody`s heard or seen anything. There`s a huge period of time here that needs to be dealt with. And it`s the time from he left till the time he got back Monday afternoon.

GRACE: Let`s go to the expert. Mike Brooks, former fed with the FBI joining us. Mike, what do you think?

MIKE BROOK, HLN LAW ENFORCEMENT ANALYST: Nancy, this isn`t adding up. First of all, let`s try to put together a time line here. I mean, where was this guy? Has he done this before with his two boys? Who goes out in this weather, in Utah, Nancy, with two children, 2 and 4, in conditions like we`re seeing here?

It`s ridiculous. It`s not adding up. Where -- does he have a cell phone? You know this whole thing about he loses his time. You know, does he have a watch? Does he have a cell phone? They have clocks on them. And his cell phone can also be traced. So I`d be anxious to see what he was doing before, during and then after.

GRACE: We`ll unleash the lawyers. Back with Mike Brooks when we get back.

As we go to break, thoughts and prayers to the family of Jacqueline Slaton. She passed away at 84. In 1954, she started the Georgia Marine Boat Company. A lady entrepreneur. She loved food. She loved to laugh. A deacon devoted to her church. Taught Sunday school 20 years.

But she was most proud of her husband, Lewis Slaton, the longest- standing elected district attorney in this country, nearly 40 years in office.

On a personal note, back in 1987 when I joined the district attorneys, women and minorities rarely were allowed in court in front of a jury. Mr. Slaton broke that unspoken rule and gave me the chance to be a litigator. He later made me a special felony prosecutor, nurtured my TV career. Even after his death, his beloved wife, Jackie Slaton, would send me money, gifts for the twins.

At my last book signing, she came. She was so ill, my husband, David, had to help her walk. She missed her husband, Lewis Slaton so much. And tonight, she`s finally with him in heaven. She leaves behind a grieving family. Jackie Slaton, good night, friend.

(COMMERCIAL BREAK)

GRACE: What a week in America`s courtrooms. Take a look at the stories and more important, the people who touched our lives.

UNIDENTIFIED MALE: Breaking news. The Florida highway patrol wanted to take a blood test from Tiger Woods after the crash.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: I have a neighbor. He hit the tree.

(END VIDEO CLIP)

UNIDENTIFIED MALE (voice-over): The newly released police documents. An officer says a witness stated the driver, Woods, had consumed alcohol earlier in the day. The same witness, believed to be woods` wife, goes on to say Woods was prescribed Ambien and Vicodin.

UNIDENTIFIED FEMALE (voice-over): Twelve-year-old Jamesha Conner had just returned to her aunt`s home with her family after swinging in the church choir. She boarded a bus around 8:00 p.m. headed towards home less than two miles away. She never made it.

The body of Jamesha Conner was found in this alley at 64th and Marshfield about a block from her home. An autopsy revealed Jamesha had been strangled.

Her body was not found until two weeks after she went missing. Police said she had only been dead for maybe 24 hours. That means --

GRACE: Oh, no, no.

UNIDENTIFIED FEMALE (voice-over): Yeah. If we had known, we could have said something. We could have done something and possibly we could have avoided what happened to this little girl. It`s really a shame.

UNIDENTIFIED FEMALE: Breaking news in the case of 9-year-old Elizabeth Alton who cops say was stabbed and strangled to death by 15-year- old Alyssa Bustamante. Shackled and in a green jump suit, Bustamante appeared in court today where she pled not guilty to first degree murder in the brutal slaying of Elizabeth Alton.

GRACE: The defense has asked the judge to take her to a psyche unit to put her in the mental ward, the sick bay, because of an alleged suicide attempt. And that suicide attempt would be, she tried to scratch herself with her own fingernails; that`s the suicide attempt?

Before I thought that Elin might say, okay, he had some flings. I`m not happy, I`m angry, but we`re going to work it out. But saying essentially he would rather marry somebody else other than her - where did you get these things any way?

UNIDENTIFIED MALE: A third party gave it to them to us. Sometimes we pay for a photograph. There is a distinction there.

GRACE: Paying for photographs is the same thing as paying for an interview. You`re putting perfume on the pig.

Let`s stop and remember Army Sergeant Jason Shaffer, 28, Pennsylvania, killed Iraq, on a second tour, awarded the bronze star, Purple Heart, Iraq campaign medal. Loved music, photography, outdoors, rock climbing, dreamed of being a cop. Leaves behind parents, Roger and Gwen; widow, Kathleen; stepson, Kaden (ph). Jason Shaffer, American hero. Thanks to our guests, but especially to you for being us. And a special good night from the New York control room. Good night, Liz.

Good night, everybody; Norm, Rachel, and tonight, good night from Georgia friend, Cheryl. The greatest wine steward at Kroger they`ve ever had. She`s been with them for 31 years. And thank you to a Canada friend of the show, children`s author Marion Quentin for the beautiful books you sent for the twins. Everyone, I`ll see you tomorrow night, 8:00 sharp Eastern. Good night, friend.
