Reports Sandra Bullock Headed for Divorce

JEAN CASAREZ, GUEST HOST: We begin tonight with breaking news on the case of Hollywood superstar, Oscar winner Sandra Bullock. Just days after America`s sweetheart takes home an Academy Award for the "Blind Side," reports hit the newsstand that Bullock`s husband, motorcycle enthusiast and mogul Jesse James, has had an 11-month affair with a tattoo model, pictured here in this disturbing photo from TMZ. Then three more alleged mistresses come out of the woodwork, including two strippers and a fetish model.

Major developments tonight. Reports emerge the divorce is on, Bullock planning to legally sever ties with her husband of five years, Bullock already moving out of the couple`s Orange County beach home, reportedly in seclusion, making plans to file for divorce.

SANDRA BULLOCK, ACTRESS: Life is hard enough, you know? It`s going to get bad when it gets bad.

UNIDENTIFIED MALE: Just days after winning her first Oscar for Best Actress, Hollywood sweetheart Sandra Bullock faces heartbreak...

BULLOCK: I`m just -- I`m wondering when it`s just going to hit.

UNIDENTIFIED MALE: ... as reports emerge her husband of almost five years has been cheating, allegedly with at least four other women.

BULLOCK: I didn`t aspire to this. This came out of left field.

UNIDENTIFIED MALE: Your husband`s very busy, obviously. How do you make the relationship work when you have such demands on your time?

BULLOCK: I haven`t been that busy. I`ve spent more time at home for that very reason.

UNIDENTIFIED MALE: Now Radaronline live reports that Bullock, embarrassed and humiliated by the alleged infidelity, is ending the marriage.

UNIDENTIFIED FEMALE: You stay as far away from me as possible.

UNIDENTIFIED FEMALE: And I always feel with these things, you can`t - - you can`t pick a winner.

UNIDENTIFIED FEMALE: She is devastated.

UNIDENTIFIED FEMALE: She`s heartbroken. This is a man that she really loves. She loves his children.

UNIDENTIFIED MALE: Bullock has grown close with James`s three children from prior relationships, but a representative told "People" magazine Bullock has not considered adopting any of James`s children.

BULLOCK: You spend a lot of time trying to figure out how to protect it if it`s valuable to you, and it`s really valuable to me.

UNIDENTIFIED MALE: A source tells Radaronline that Bullock has made up her mind to terminate her marriage to reality TV star Jesse James and has already started the process of obtaining a divorce.

CASAREZ: Good evening, I`m Jean Casarez of the legal network In Session on the truTV network, in for Nancy Grace tonight. Thank you so much for joining us. Major developments tonight in the case of Hollywood superstar Sandra Bullock. Reports emerge the divorce is on.

UNIDENTIFIED FEMALE: She was America`s sweetheart before, and now people just feel so bad for her.

UNIDENTIFIED MALE: Breaking news in the case of Oscar-winning movies Sandra Bullock and her alleged marital problems with husband Jesse James.

UNIDENTIFIED FEMALE: What is the secret ingredient to a successful marriage?

BULLOCK: I have no idea. No clue. And anybody who talks about it is shooting themselves in the marital foot!

UNIDENTIFIED MALE: Since Bullock won her Best Actress Oscar this month, several women have claimed to have had affairs with James.

BULLOCK: You know, I don`t want to leave home anymore, so whatever takes me away has to be really, really good.

UNIDENTIFIED MALE: Radaronline reports Sandra Bullock has decided to seek a divorce from husband Jesse James, and their sources say she has already taken steps towards ending the marriage.

BULLOCK: What`s good for one is definitely not the same recipe for someone else. Just do your life.

UNIDENTIFIED MALE: As of now, four women have allegedly been linked to James, reality TV star and owner of the famous bike garage West Coast Choppers.

UNIDENTIFIED MALE: Sandra Bullock has no plans to adopt her husband`s kids. That`s what her representatives told People.com. Jesse James has three kids from two previous marriages.

BULLOCK: Do what feels right. If you go with your own rhythm...

UNIDENTIFIED MALE: Sources tell Radaronline that Bullock feels her whole marriage was a sham and plans to end it soon.

BULLOCK: I think once you try to make it look like something that it`s not and you try to be the perfect couple -- no one`s the perfect couple.

BULLOCK: Oh, If I were Elin, man, I would have hit a lot more than she did. I would have kept hitting.

UNIDENTIFIED FEMALE: You would still be swinging the golf club?

BULLOCK: Yes. She stopped. She was respectable. I`d be -- I`d get the baseball bat. I`d get -- I`d get everything out.

CASAREZ: And that is audio obtained by WXXL FM radio of Sandra Bullock talking to reporters at the People`s Choice Awards.

Let us go straight out to Alexis Tereszcuk, reporter from Radaronline, who is standing out live in Los Angeles at Sandra Bullock`s home. What is the latest in this issue that now has become a legal story?

ALEXIS TERESZCUK, RADARONLINE.COM: Well, it`s quite a surprise maybe to no one that a few more women have come forward and said that they claimed that they`ve had affairs with Jesse James. Sandra, sources have told us, is devastated. She`s humiliated. She is beyond repairing this marriage. She, in fact, is taking steps to file for divorce from Jesse James. She`s not going down a path of forgiveness or maybe him going to rehab. But she`s mad and she`s going to try to get out of this marriage.

CASAREZ: All right, when did Radaronline find out that she, in fact, is going to file for divorce?

TERESZCUK: We`ve been talking to sources for a couple of weeks now, since the story broke, and we confirmed yesterday that she, in fact, is going to file for divorce, so we reported that today. And we understand that this is something that she`s taking very seriously, but she is not happy and that this is what she wants to do. She doesn`t want to work it out. She wants to end the marriage, is what our sources have told us.

CASAREZ: Now, where is Sandra Bullock right now? Because you`re in Los Angeles, near her home in Los Angeles.

TERESZCUK: I`m actually right outside of her home. There are lots of photographers here waiting for her. But she has left this home. This is her Hollywood Hills home that she lived in before she married Jesse James. They live about an hour away from here now. And she was here this week, but she`s left and no one has spotted her yet. So obviously, the price of a picture that -- of her has gone up significantly, and people are wondering where she is because they want to know. Everybody loves Sandra Bullock and feel really bad that she`s going through this situation and they want to see that she`s doing OK.

CASAREZ: All right, to Jon Baird, reporter of KNX Newsradio in Los Angeles, also live in Los Angeles, outside of Sandra Bullock`s home. What about Jesse James? First of all, I want to know, where is he? Does anybody know where he is?

JON BAIRD, KNX NEWSRADIO: We don`t know. We do know that there was a report that, apparently, a couple of days ago, he was on his way out of the state and got stopped by CHP officers. But we don`t know where he is right now.

CASAREZ: OK. California, obviously, Orange County is his home. Talk to us about why this all is happening. List for us the women who allegedly are coming out publicly that had affairs, allegedly, with Jesse James during his marriage.

BAIRD: Well, we know Michelle "Bombshell" McGhee, the stripper and the tattoo model. We understand that was an 11-month-affair, that she has text messages, supposedly, to prove it, and that this was going on while Sandra Bullock was filming the "Blind Side." And then there was Melissa Smith, who -- she is a stripper and a bikini model. She says they had a two-year relationship that ended back in March 2009. She says they had sex in Jesse James`s office. And then there`s Brigitte Daguerre -- I`m sorry if I got the pronunciation wrong, but she`s 40 years old, a fetish model and a photographer. Apparently, she had a short affair and has 195 text messages. And then the last person, we don`t know the name. We know that Gloria Allred supposedly is representing this person. We`re also told that there may be a fifth person who`s going to come forward. But those are the four we know of right now.

CASAREZ: To Kim Serafin, senior editor of "In Touch Weekly," also in Los Angeles. What more can you tell us about this story?

KIM SERAFIN, "IN TOUCH WEEKLY": Well, again, the latest reports are that she is looking to file for divorce. Sources also told "In Touch" that she has told friends that she may want a divorce. There`s also stories -- reports coming out about her adopting the children, saying that she has no plans to adopt any of these three children from Jesse`s prior marriages. Of course, we know that she does have a very close relationship with Sunny, his daughter from his second marriage to Janine Lindemulder, the porn star, got a lot of attention because she came forward during all the court dates because she was talking about getting custody of this girl, Sunny.

So this would definitely be difficult for her to not have this relationship with Sunny. But again, these reports are coming out saying that she does not want to adopt these children, has no intention of, and never did. So probably didn`t have anything to do with this specifically.

CASAREZ: To Ellie Jostad, NANCY GRACE producer. Give us a timeline here. How long have they been married? When did they meet? How did they meet? How long did they date?

ELLIE JOSTAD, NANCY GRACE PRODUCER: Well, they met back in 2004. Apparently, Bullock brought her godson to Jesse James`s garage for a tour. They started dating after that. They were married on July 16th, 2005. They`ve been married so almost five years now.

Apparently, this whole scandal came out March 15th. That`s the day that Sandra Bullock was tipped off by a tabloid that these allegations were about to be made public. She apparently confronted James that day, moved out of their home that day, and headed back to Austin, Texas, where she has relatives. She also owns property there, including a restaurant. And she was there for about a week before returning to California, to that home in the Hollywood Hills.

CASAREZ: Back to Alexis Tereszcuk in Los Angeles, reporter for Radaronline. Radaronline you said confirmed yesterday that she is going to file for divorce. What more do you know? Because they have homes in various states. Where do you believe or have you heard that the divorce will be filed? And have you heard a name of an attorney?

TERESZCUK: We have not learned the name of the attorney yet, but the divorce will be filed here in California. This is where they reside. They live here. So they`re going to file for divorce in California, is what our sources have told us. Now, we do understand that they have a prenup, which is a good thing because Sandra is worth close to $100 million, according to reports, so Jesse will not be able to get anything from her in terms of money, although he has enough money of his own.

But this is something that she`s being very thoughtful and methodical about it and talking it through with attorneys so that everything is done in the right way. But she is definitely going forward with this divorce, our sources have said.

CASAREZ: We are taking your calls live tonight. First to Jon Baird, reporter, once again, KNX Newsradio in Los Angeles. You know, Sandra Bullock, obviously, one of the highest paid, one of the most famous movie stars in this country. But Jesse James -- he`s a businessman, too, when he has time, obviously. What does he do? And how much money has he made?

BAIRD: I don`t know exactly how much money he`s made, but as Alexis said, he`s been very successful in his own right. He`s a reality TV star. West Coast choppers, his shop -- he built that, building antique motorcycles. So it sounds like he`s going to be just fine on his own, and the prenup will protect Sandra, of course, which is what this is all about, at this point. But basically, he`s done very well on his own. He also appeared on "Celebrity Apprentice." So he`s been around the block.

CASAREZ: It`s about the prenup and much, much more. We`re taking your calls live. We`re going to go to the lawyers in just a second. But first, Sheeba in Illinois. Good evening. How are you?

UNIDENTIFIED FEMALE: Fine. This is Sheila.

CASAREZ: Sheila!

UNIDENTIFIED FEMALE: Sheila, yes.

CASAREZ: I`m sorry.

UNIDENTIFIED FEMALE: Please don`t confuse me with Sheeba. Please, please, please.

CASAREZ: Sheila in Illinois. Hi.

UNIDENTIFIED FEMALE: Yes, Sheila. Hi. If Jesse`s ex-wives and the mothers of his other children -- if they want Sandra to have a relationship with their kids, especially Sunny, could Sandra possibly have custody of Jesse`s kids or -- I mean, is that something that she could fight for and possibly win, or is that something that -- you know, that Jesse could fight her on?

CASAREZ: Sheila, it`s a good question. It`s a complicated question. Let`s go to the lawyers right now. Jennifer Smetters, family law attorney in Chicago, Mickey Sherman out of New York, criminal defense lawyer, and Ray Giudice, defense attorney out of Atlanta.

Let`s go to Jennifer first, defense lawyer out of Chicago. What about that? She is the stepmother. She has no relation to the children, but she`s very close. She obviously doesn`t have custody at this point, right? He`s -- Jesse James has custody. She is his wife, correct?

JENNIFER SMETTERS, FAMILY LAW ATTORNEY: That`s correct. The custody is with him, and the biological mother also has parental rights. In my practice, if she came to me, I would suggest going after a guardianship if she wants to keep ties with this child and have the child reside with her.

Bottom line here is, is that in custody cases, the parental rights are never going to be trumped by a stranger coming into the relationship. The best that she could hope for right now would be guardianship.

UNIDENTIFIED FEMALE: Jesse`s ex-wife, who is the mother of Sunny, the youngest girl, has said that Sandra is a wonderful stepmother to the children and she wants them to keep in touch. So Sandra definitely will still stay involved with the kids. She loves them. She`s been with them for, you know, the last five years, and she really wants to continue a really strong relationship with them.

UNIDENTIFIED MALE: News broke that her husband, reality TV star Jesse James, carried on an affair with a model.

UNIDENTIFIED FEMALE: ... while Bullock was making the movie that won her the Oscar.

BULLOCK: This was such odd circumstances.

UNIDENTIFIED FEMALE: (INAUDIBLE) do a movie. She goes off on her career. She`s doing her thing.

BULLOCK: Things came together in a way that you just -- I didn`t see coming.

UNIDENTIFIED FEMALE: And now the temptation comes in.

UNIDENTIFIED MALE: The guy`s name, though, is Jesse James, and his ex-wife was a porn star. What part of that equation equals good guy?

UNIDENTIFIED FEMALE: Well, sources are telling us that there is, like, the worst kept secret around his chopper shop.

BULLOCK: (INAUDIBLE) please tell me that I at least covered some of the bases.

UNIDENTIFIED FEMALE: He had this way. He would rue (ph), this women, bring them in, put these ads on, Come on in and be a model for my motorcycle shop.

BULLOCK: I didn`t aspire to this.

UNIDENTIFIED FEMALE: I don`t think Jesse James has ever been billed as a Mensa member.

UNIDENTIFIED FEMALE: I always kind of pictured them as an odd couple.

UNIDENTIFIED MALE: Vanilla (ph) just doesn`t cut it. If they think that there`s other things out there that they haven`t sampled, they want to play in that field, as well.

UNIDENTIFIED MALE: She obviously (INAUDIBLE) good guy (INAUDIBLE) pick the right guy.

UNIDENTIFIED MALE: The movie start was completely blind-sided. (INAUDIBLE) scandal.

CASAREZ: I`m Jean Casarez of the legal network In Session, in for Nancy Grace tonight. I want to go back out to the lawyers. First of all, Jennifer Smetters, family law attorney out of Chicago. Now, you just said before the break that, obviously, Sandra Bullock is not a blood relative. She could apply for guardianship of especially the younger child, because Sunny, 6 years old, and is reported she was very close to Sunny.

But let me tell you the facts. Here are the facts. The mother of this child has been serving time in a federal prison for tax evasion. When you look at the best interests of the child, a court may not deem Jesse James`s alleged lifestyle would be appropriate. What is a judge to do at that point?

SMETTERS: Well, we have to look at what would -- like you said, what is in the best interests of the child? Who takes care of the child`s day- to-day needs? Is it Sandra Bullock or is it Dad or is it another care- giver? Just because Dad has an affair does not mean that he loses his parental rights. What we have to do is maybe step back and make sure that the household is being run and that this child is not being -- that he`s not flaunting this type of behavior in front of his child, OK? So you want to put protections into place, maybe incorporate some sort of therapy or some sort of counseling within the family unit.

But the bottom line here is if Sandra is the day-to-day caregiver of that child, then she definitely has some argument to be made to step in and become a guardian, if she so chooses.

CASAREZ: Very interesting. Mickey Sherman, criminal defense lawyer out of New York -- everyone says there is a prenuptial. I think we can say there is a prenuptial, and I`ll say why. I saw in legal documents that Jesse James had a prenup with his last ex-wife. So obviously, that`s his mindset, and I think he would and she would. Now, can you pierce the prenup agreement by infidelity like this, or could there be a clause in the prenup to pierce it?

MICKEY SHERMAN, DEFENSE ATTORNEY: There could be (INAUDIBLE) Certainly, nothing`s going to be in the favor of Jesse James, but there may be some penalty clause in there. I think Michael Douglas and Katherine Zeta-Jones did that. They put an enormous penalty amount in case he cheated during the marriage. I could be wrong about that. But a prenup really is a contract, and there may be a clause in there which will penalize him or deprive him of some benefit that maybe was going to be paid out to him, a piece of her money or whatever, if, in fact, he`s unfaithful or does other immoral conduct.

CASAREZ: To Ray Giudice out of Atlanta, Georgia. I know every state is different, but I`ve seen many states that allow for puniary (ph) damages, punishment damages, even in a divorce case, if you can prove that there was intentional infidelity such as this. Could that be a part of this case?

RAYMOND GIUDICE, DEFENSE ATTORNEY: It could be, but I -- you know, you`re talking about two people, both intelligent people who came to this marriage with equal opportunity to earn a lot of money. She obviously makes more than he. But they both have attorneys. They both probably contributed to the prenup. And unless there`s a clause, as Mickey says, in there for punishment for behavior, I don`t think that`s going to happen. This is primarily a business deal, at this point in time, of winding down this marriage. And the tax attorneys are going to be as important as the divorce attorneys.

UNIDENTIFIED MALE: How do you guys make it work given that you`re both...

BULLOCK: We don`t.

UNIDENTIFIED MALE: ... in the public eye?

BULLOCK: We don`t make it work. We`re not in the public eye.

I love stories about passion and love.

It was funny to everyone else but me.

BULLOCK: Our marriage has nothing to do with our work, nor will it ever.

BULLOCK: Now, when I go home at the end of the day, I don`t go home to them, I go home to my life.

BULLOCK: And if it`s not solid, I have -- you know, I`m at fault for that.

UNIDENTIFIED FEMALE: You know, I don`t know what goes on behind people`s closed doors.

UNIDENTIFIED MALE: How do you make it work?

BULLOCK: Blackmail! You just have to find the one thing that no matter how old they are, they`ll never divulge.

UNIDENTIFIED FEMALE: I think this is extremely sad. And Sandra`s probably thinking, you know, this time is spent probably better thinking about people that are missing and hungry.

CASAREZ: You know, Cindy, I think you bring up a good point. To Patricia Saunders, clinical psychologist. This is so sad. You know, I think a lot of us have just thought about this since the story broke. We`ve followed it. We`ve watched it. I`ve talked to so many people, and with the exception of one person, everybody tells me they feel for Sandra Bullock, they can`t believe what is happening, they believed in her marriage. Why do we all have this affinity to Sandra Bullock?

PATRICIA SAUNDERS, CLINICAL PSYCHOLOGIST: Well, she is America`s sweetheart. In reality, we don`t know who Sandra Bullock really is. But a 20-year-plus career, she`s created a persona for us that we want to identify with, someone we want to have a relationship with. (INAUDIBLE) idealized. She`s warm. She`s beautiful. She`s funny. She`s vulnerable. She`s unassuming. And now she`s become a victim. We don`t know who these celebrities, who the actors are in their real lives, but this is a very, very successful fantasy.

CASAREZ: But we know she has said so many beautiful things about her husband in the last few months, things that other people just don`t say. She has put him on a pedestal.

BULLOCK: If someone can say, I had -- I loved and I loved good, you know -- and it`s grammatically incorrect, you can`t get any more pure (ph) than that -- that is the ultimate accomplishment in life. It`s the hardest thing to do because...

Let`s go straight back out to Los Angeles. Alexis Terezscuk, reporter for Radaronline, standing live in Los Angeles next to Sandra Bullock`s L.A. home.

Your Radaronline has reported something. You said confirmed the future of the marriage for Sandra Bullock and Jesse James. What is it?

ALEXIS TERESZCUK, REPORTER, RADAROLINE.COM: There is no future for the marriage. We`ve learned that Sandra Bullock is not going to continue this marriage. She`s taking steps for a divorce. She does not want to be married to Jesse James after all of these mistresses have come forward.

She`s embarrassed. She`s humiliated. She does not want this continue. She`s ending it. That`s what our sources have told us. And really can you blame her? I mean so many women coming forward and it`s just -- it`s embarrassing to her.

She`s someone who`s loved him, she`s spoken about him so publicly and passionately. She loves his children. They`ve been a great team, she thought, and for this to come out in such a public way, it`s just not what she wants to continue her life with.

CASAREZ: So, Alexis, this broke the middle of March. Where has Sandra been in the last few weeks to your knowledge? And has she actually physically gone to visit a lawyer? And where?

TERESZCUK: We do not know if she`s physically gone to visit a lawyer, but she has spoken with lawyers. She has been -- we believe, in Texas -- Austin. She has a home there. And then she was here right behind me in her West -- I`m sorry, not West Hollywood. Her Hollywood Hills home.

And -- but she left here yesterday. And she just hasn`t been spotted at all. The last time anybody saw Sandra was the day after the Oscars when she was at the burger joint that her husband owns. They had lunch together and that was it. No one has seen her since then.

But she has been really keeping a low profile. She doesn`t want to be seen. She doesn`t want to deal with everything that`s been going on in the public eye. She`s too embarrassed.

CASAREZ: To Jon Baird, reporter, KNX News Radio in Los Angeles, also standing live in Los Angeles at Sandra Bullock`s home, what more can you tell us? You are out there in Los Angeles. What`s going on with all of this? In the legal front. This is a legal case when we are looking at divorce.

JON BAIRD, REPORTER, KNX NEWSRADIO, FROM NEAR SANDRA BULLOCK`S HOME: That`s a good question. You would think the prenups would take care of a lot of this, that Sandra`s protected in that way.

What`s going to happen in the future? I don`t know. I mean, basically I think when this came out -- when news came out of the first woman, everyone had to be wondering, especially after the comments -- other comments that she`s made, how much of this will she take?

And then basically the other women came forward, now we`re hearing talk, as Alexis mentioned, that she`s talked to lawyers. Who knows where this will go?

CASAREZ: That`s right. To Diane in Florida. Hi, Diane, thanks for holding on.

DIANE, CALLER FROM FLORIDA: Hi, Jean.

CASAREZ: Hi.

DIANE: Why does Sandra feel the whole marriage was a lie?

CASAREZ: OK. Good question. To Alexis Tereszcuk, you`re out there in Los Angeles with Radaronline. Why does she feel the whole marriage was a lie?

TERESZCUK: Well, the mistresses that have come forward and alleged the affairs, it`s not just from say two weeks ago. It`s been for a really long time. These mistresses have had relationships with Jesse for more than a year, some going back, you know, two and three years.

This is not something that just happened one time. It`s been a pattern. And she feels that this is not something that can be forgiven because it wasn`t just a one-time thing, it`s multiple women and it`s a long period of time.

As I said, it`s not just a one night stand here, but it`s been an actual relationship that he`s built with these other women and she doesn`t want to continue her marriage with somebody that`s having relationships with other women outside of the marriage.

CASAREZ: And also, Alexis, there are reports that there are numerous -- as even hundreds -- of text messages with these women.

I want to go to Vito Colucci, private investigator, extremely famous in this country, in Stanford, Connecticut. You`ve done so many high- profile cases.

When you`re talking about text messages. All right. First of all, are they becoming the evidence of the future? I mean, these are things that -- they`re not erased, right? And even if you delete them, can they still be found in a cell phone?

VITO COLUCCI, PRIVATE INVESTIGATOR, AUTHOR OF "INSIDE THE PRIVATE EYES OF A P.I.": Oh, yes. Definitely. It`s the biggest mistake these people make nowadays, Jean. Text messages are key. This case is a private detective`s dream if you`re working for Sandra Bullock.

But I could tell you one thing, Jean, once she gets a lawyer in place, she should get a private detective in place. That may sound strange, but let me tell you this.

CASAREZ: And what would you do for her? What would you do? Can you get text messages as a private investigator for her attorney?

COLUCCI: Yes, you can. As long as it`s legal in that state, you can get that. You can download the family computer, see who else she was talking to. But if you`re announced as the private detective for Sandra Bullock, you`ll have other people calling because I could assure you there`s many more than five people that had affairs with her, and your phone would ring off the hook and will continue to add to this case.

GRACE: All right. Let`s say you became the private investigator for Jesse James` attorney. What would you be doing right now to work for him?

COLUCCI: You know, you better come up with something relevant that happened over the last five years. Because you`re not going to find something that`s 10 years ago, eight years ago. That`s not going to work on a case like this.

She`s America`s sweetheart. You again would be announced as the private detective for Jesse James. Your phone may ring with some juicy thing on that. I doubt it, but that`s the only shot you would have on this.

CASAREZ: All right. To Dr. Evelyn Minaya, family, women`s health expert. You know, Dr. Minaya, when you look at stress -- and everybody in this case is going through stress. Sandra Bullock, Jesse James, the children especially.

Physically, what can that stress do to all of them?

DR. EVELYN MINAYA, M.D., WOMEN`S HEALTH EXPERT: Well, you know what? This is your best diet bet. It`s 20 pounds just like that. Right off. But you know what? We are all focusing not only on the psychological aspect of it, not only with the kids and everything else like that, but what about the risk that these women are put up against?

We`re talking about like AIDS and hepatitis and all these -- a plethora of diseases. OK? And especially for that little girl, Sonny. Sonny has the closest relationship to Sandra. And you know what? She`s going to feel it more psychologically than any one of her -- of his children.

And it`s such a shame because, like I said, we`re focusing on the psychological aspects, but there`s a lot of physical aspects. You can get sick to your stomach and you can also lose weight. But most importantly all the diseases that you put these women at risk.

CASAREZ: I think that`s a very, very good point in all of this, with the Tiger Woods case, with this case. Does someone in this position -- Sandra Bullock, does she go to a doctor?

MINAYA: I hope.

CASAREZ: Does she -- get a physical at this point?

MINAYA: Absolutely. And that was going to be my other point. I hope that that`s why she is not available. Because I hope she`s visiting her gynecologist and her internist immediately. Because she needs to know what she`s at risk for.

OK. There are blood tests to be done, there`s cultures to be done, and there`s a physical to be done.

CASAREZ: All right. To Bee in Pennsylvania. Hi, Bee. Good evening.

BEE, CALLER FROM PENNSYLVANIA: Hi, I have a question and a comment. First, I would like to say how would these so-called women like it if it would happen to them? And my comment is, hopefully some day they`ll get married and be head over heels with their husbands like Sandra was with Jesse, and then they`ll be cheated on with multiple women and knows how she feels now.

And another comment. Do they think they`re making their parents proud by coming on -- out on "Entertainment Tonight" and other shows saying that they were with a married man?

CASAREZ: You know, you have -- I think you`re speaking for a lot of women tonight, Bee. You really are.

To Patricia Saunders, clinical psychologist. You know, the father of one of these women came forward saying that his daughter thought they were estranged. They`re in the media all the time. They`re at all these awards shows together.

But how does someone do something like this? What the other women did? And are they actually enjoying themselves right now? Do they not have the stress psychologically?

PATRICIA SAUNDERS, CLINICAL PSYCHOLOGIST: Some of these women who have affairs with married men may convince themselves that it doesn`t matter that they`re the loved one.

In that case, then these women have a real failure in judgment. And a real failure in conscience. Some of them may be stressed. It depends what kind of promises were made. But they`re all morally responsible for cheating and for betraying her as much as he has.

UNIDENTIFIED FEMALE: Let me tell you something about the MO of the cheating married man. He pursues the other woman like a heat-seeking missile. He is relentless.

UNIDENTIFIED FEMALE: What is the secret ingredient to a successful marriage?

BULLOCK: I have no idea. No clue. And anyone who talks about it is shooting themselves in the marital foot.

UNIDENTIFIED FEMALE: I think she`s done it. Sources tell us she`s not staying with him.

BULLOCK: Never taken the bulls by the horns like that before, but I did.

CASAREZ: I`m Jean Casarez of the legal network "In Session" in for Nancy Grace tonight.

Radaronline says they have confirmed that Sandra Bullock is going to seek a divorce.

I`d like to go out to Kim Serafin, she is senior editor of "In Touch Weekly."

Kim, "In Touch Weekly" broke this entire case. ow did this unravel? How did it all become public to begin with?

KIM SERAFIN, SENIOR EDITOR, IN TOUCH WEEKLY: Well, it was good reporting on behalf of "In Touch" and the "In Touch" news department. There are some sources, they did some follow-ups.

And of course you were talking before about text messages. "In Touch" does have some text messages between Michelle "Bombshell" McGee and Jesse even as recent as March. Just a couple of weeks after the Oscars where Jesse was texting Michelle saying, just thinking about you, you know, I miss you. Things like that.

You know, Michelle did tell "In Touch" that their relationship went on for 11 months. There was texting back and forth. But five weeks of it, it was sexual, it was intimate while Sandra was off filming "The Blind Side."

CASAREZ: All right. To Ellie Jostad, NANCY GRACE producer, there is a fourth alleged mistress.

ELLIE JOSTAD, NANCY GRACE PRODUCER, COVERING STORY: Yes.

CASAREZ: That has yet to come forward. That may, that may. What can you tell us about this?

JOSTAD: Right. Well, this woman surfaced last week. And she hasn`t been named yet but she is apparently represented by Gloria Allred, a name that`s familiar to everybody who watches this show.

This woman hasn`t been identified, but she is described by her lawyer, Gloria Allred, as a model and a businesswoman. But Gloria is now saying that this woman does not have any interest in sharing her story.

So we don`t know the details other than this woman does claim to have photos, e-mails, text messages from James, and she claims to have had a three-year intimate relationship with him.

CASAREZ: Three years out of a five-year marriage. OK, to Avis in Virginia. Hi, Avis. Good evening.

AVIS, CALLER FROM VIRGINIA: Hi, thank you for taking my call.

CASAREZ: Yes.

AVIS: I just wanted to say that to me, Jesse looks very demonic as does his characters he supposedly had the affairs with. And my question is, why on earth would the beautiful Sandra Bullock want him to be her husband or any other thing?

CASAREZ: RACE: Patricia Saunders -- yes, I`m sorry, Avis.

Patricia Saunders, clinical psychologist. It`s a point that I think a lot of people maybe are thinking in their mind. Your thoughts on that.

SAUNDERS: Well, the bad boy can be attractive to a lot of women. And she may feel that she could really have changed him. And he may have shown her that face. Pleased her, told her what she wanted to see here. Because it was really cool to be married to a movie star.

CASAREZ: Back to Ellie Jostad, producer of NANCY GRACE. There was a sexual harassment lawsuit by one of Jesse James` senior female employees. Count one sexual harassment, count two, retaliation, count three, failure to prevent sexual harassment, count four, sexual battery, count wrongful termination, count five intentional infliction of emotional distress.

JOSTAD: Right.

CASAREZ: When was it filed? What happened to it?

JOSTAD: Right. This was filed back in 2000 which would have been before he met Sandra Bullock, certainly before their marriage.

Now the interesting thing about this lawsuit, although this woman claims that she was subjected to all kinds of harassment in the workplace, being groped by him, him exposing himself to her, him displaying pornography in the office, just a year later in 2001, she filed a request for dismissal with the judge and the judge did grant that. The case was dismissed.

CASAREZ: To Jean in Kansas. I have to go to Jean. Is your name really Jean?

JEAN, CALLER FROM KANSAS: Yes, it really is.

CASAREZ: Hi, Jean. What`s your question?

JEAN: I don`t really have a question. I just have a comment. I`ve been thinking about this and how everyone -- well, not everyone, but a lot of people have been comparing this to Elin and Tiger Woods.

But I keep thinking, well, Elin can hide, Sandra can`t, if she wants to have a career, she`s still going to have to come out and show her face. And I just feel that you can`t really compare that because she is embarrassed.

CASAREZ: That`s great. That is very astute, very smart, Jean, thank you.

Mickey Sherman, criminal defense lawyer. Defend Jesse James for me right now.

MICKEY SHERMAN, CRIMINAL DEFENSE ATTORNEY, AUTHOR OF "HOW CAN YOU DEFEND THOSE PEOPLE?": Well, first of all, as Vito suggested, if I was on his team, I`d be looking high and low for other girlfriends of Tiger Woods right now. Because that`s about the only way you can help this guy, is get him off the front page.

It`s a no-win situation. I mean -- you know, how do you defend him? He didn`t kill anybody, that`s about it. He just made the most sympathetic woman on -- in America look like a snook. And everyone`s going to be hating him for a long time.

And it`s that bad boy syndrome. I`ve seen it in court. I`ve developed a corollary, Jean. And that is, if there`s a directly inverse relationship between the disgustingness of the overnight prisoner and the niceness of the girl waiting there to post his bond.

Go figure.

CASAREZ: Yes. Go figure. To Ray Giudice, defense lawyer. Ray, I`ve got the legal documents of the government sentencing memorandum when Jesse James` ex-wife was being sentenced to federal prison for tax evasion. He wrote a letter to the judge and he said, "Everything I do and work hard for is my children. I want them to have every opportunity possible, including the best education and a stable and loving home life."

Defend that.

RAY GIUDICE, DEFENSE ATTORNEY: Well, I think that`s true. I mean I don`t think any father doesn`t love his children and want the best for them. Just because he has a sexual relationship with three or four models, I don`t think that spills this over into what is in the family life.

As was stated earlier by our divorce lawyer, she stated very accurately, a judge may not hold that against Jesse James at all.

BULLOCK: It`s true. There`s more damage done to women by other women. I like taking care of girls, not (INAUDIBLE), you know?

UNIDENTIFIED MALE: Sandra is a strong woman. This guy, it`s going to cost him. It`s going to cost him all the way around. Pocketbook, marriage, everything.

UNIDENTIFIED FEMALE: Yes.

To Patricia Saunders, clinical psychologist. You know early on in all of this, Jesse James actually apologized to his whole family and hoped that they would forgive him.

From a psychological standpoint, does that help or does that hurt Sandra Bullock get through this?

SAUNDERS: I don`t know that it really does either. I think it`s something he had to say, and in a way it might have helped a little bit that at least he acknowledged that he was wrong. He didn`t just blow it off.

CASAREZ: All right. To Dr. Evelyn Minaya, a women`s health expert, in regard to the children`s physical health right now, because they`re old enough to understand what is going on, what should they do to relieve the stress?

And the paparazzi, if they are out trying to get pictures of the children, that even makes it more stressful for them.

MINAYA: I absolutely agree. I think it`s going to be a little bit more stressful for the older children because I think that they are actually understand what`s going on, especially in the media and the paparazzi and everything else.

With the younger one, which is Sonny, which is the 5-year-old, I think that it`s -- her stress is going to be and probably, you know, her focusing on school and not keeping up with everything, I think that she is going to suffer more because of the relationship she had with Sandra because she`s the one that`s spent the most time with Sandra.

So I think it`s just two different perspectives that you have to look at. With the older kids, it`s definitely going to be more psychological. It could be them not focusing, not sleeping well and maybe not being hungry.

With the 5-year-old it`s going to be more -- her psychological aspect would be more that relationship and she`s going to feel sad and depressed. And like I said, not want to go to school and not get focused also in the school.

CASAREZ: And to Alexis Tereszcuk, live in Los Angeles, with Radaronline, what is next on all this? What do you believe that Radaronline will next be reporting?

TERESZCUK: I have a suspicion that we might be reporting that more women might be coming out, unfortunately, for Sandra, but I also hope that we`re going to report -- and in fact, that we will -- that, you know, that their divorce is getting finalized.

Obviously, there are a lot of steps to a divorce and legalities that she has to go through, but this is something that she wants to do. So there`s going to be, you know, some definite movement on Sandra`s part of where she`s going to take the steps to end the marriage.

And then also, you know, that unfortunately it seems like there are lots of -- there are a few women out there that Jesse James had an affair with, which is really sad for her.

CASAREZ: And I think the way we can sum this all up -- divorce, legal issues -- is sad. On a human level, it is just sad.
