Nancy Grace

Joran Van Der Sloot to Face Judge in Days

Aired June 16, 2010 - 20:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

NANCY GRACE, HOST: Breaking news tonight in the disappearance of Alabama beauty Natalee Holloway, missing off her high school senior trip, Aruba. Aruban police refuse to make a case against judge`s son Joran Van Der Sloot, even after he describes Natalee`s death and admits he hid the body.

Tonight, live, Peru, Van Der Sloot kills again. Another young girl meets him at a resort casino, found dead just hours later, brutally beaten, bloody, her neck broken, partially clothed on the floor of Van Der Sloot`s hotel. Van Der Sloot goes on the run to Chile. After a massive manhunt, Van Der Sloot captured.

Spine-chilling video of Van Der Sloot with 21-year-old Stephany just before she`s found dead. Bloody clothes from the murder found with Van Der Sloot on the run. U.S. feds busting Van Der Sloot on a quarter-million- dollar scam to sell the location of Natalee`s body. Killing machine Van Der Sloot confesses to Stephany`s murder, and after beating her to a pulp and breaking her neck, Van Der Sloot kicks back with a cup of coffee and Danish just feet from Stephany`s dead body. We obtain Van Der Sloot`s confession verbatim. He`s charged with murder one and booked into one of Peru`s most notorious jails. We have the photos.

Bombshell tonight. Police seize Van Der Sloot`s laptop after he claims a FaceBook death threat over Natalee Holloway popped up, triggering the fatal argument between Van Der Sloot and his latest victim, that evidence set to torpedo the defense and show there was no argument, that Van Der Sloot is just a cold-blooded killing machine who murdered Stephany for money.

Also tonight, the cab driver who drove Van Der Sloot while on the run charged with obstruction. Will they talk? And tonight, reports a new map by Van Der Sloot as to where`s Natalee`s body. Tonight, Van Der Sloot in isolation in a Peruvian jailhouse, angling a free trip home in exchange for the location of Holloway`s body. But wait a minute! What about the dead Peruvian girl and two other girls missing from casinos in Bogota, possibly linked to Van Der Sloot? What, they`re going to let him go home to Aruba for a home-cooked meal and a get-out-of-jail-free card? No!

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: "I would like to talk about the case of Natalee Holloway of five years ago."

UNIDENTIFIED FEMALE: Stephany went through his computer while he was gone. She found out information about himself associated with Natalee Holloway.

UNIDENTIFIED MALE: Peru and Aruba have agreed to work together in the investigation against young Joran Van Der Sloot.

UNIDENTIFIED FEMALE: They`re putting a written formal request in to Peruvian officials.

UNIDENTIFIED MALE: He and his lawyers are looking to structure a sweetheart deal in Peru, a confession to the Holloway murder?

UNIDENTIFIED MALE: The Holloway family desperately wants to know what precisely happened to the daughter.

UNIDENTIFIED FEMALE: ... alleged that the laptop had information possibly about Natalee Holloway.

UNIDENTIFIED FEMALE: Our family, we`re pretty desperate for answers to find out whatever happened to Natalee.

UNIDENTIFIED MALE: "Opened my e-mail and saw a message that said, I`m going to kill you, mongoloid, referring to the Holloway case."

UNIDENTIFIED FEMALE: These are the early morning hours of the five- year anniversary of Natalee Holloway.

UNIDENTIFIED MALE: "At that time, I spoke with Stephany, telling her about the case five years ago where I was detained and I was a suspect in the disappearance of this girl."

UNIDENTIFIED FEMALE: She hit him, he says, on his left temple.

GRACE: He gets slapped, so he breaks her neck?

UNIDENTIFIED MALE: It wasn`t self defense.

UNIDENTIFIED MALE: (INAUDIBLE) Natalee`s body to be found, we`ll be happy.

UNIDENTIFIED MALE: ... Castro Castro prison...

UNIDENTIFIED MALE: It`s one of the worst in the world.

UNIDENTIFIED MALE: He`s in for a rough ride.

(END VIDEO CLIP)

GRACE: And tonight, live rural Oregon. A 7-year-old little boy goes to school, walks down the hall to class, he`s never seen again. How does a 7-year-old go missing from his own classroom? Tonight, where is 7-year-old Kyron?

(BEGIN VIDEO CLIP)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: When Kyron was in the school that morning, it was actually a science fair that was going on prior to classes.

UNIDENTIFIED FEMALE: Kyron never made it to class after his school science fair on June 4th.

UNIDENTIFIED FEMALE: From that particular point, he did not show up to his first class.

UNIDENTIFIED MALE: We are in the process of conducting and completing a secondary canvas of the neighborhoods.

UNIDENTIFIED MALE: Either they know something they`re not telling...

UNIDENTIFIED MALE: Investigators say Kyron`s stepmom brought him to school Friday morning, took this picture of him at Skyline Science Fair, and last saw Kyron near his classroom at about 8:45.

UNIDENTIFIED FEMALE: They`re moving forward on a criminal investigation since scaling back on the search efforts.

UNIDENTIFIED MALE: This will not become a cold case for us. We will continue to investigate this case until we have it solved.

UNIDENTIFIED FEMALE: He was seen walking around with his stepmother by one teacher and one other staff member.

UNIDENTIFIED MALE: Law enforcement did a search for seven days, then ended the search, which was very comprehensive, and only then announced that they were launching a criminal investigation. Typically, those investigations are launched simultaneously.

UNIDENTIFIED MALE: They`re waiting for part of this case to play out, or they may not know anything.

UNIDENTIFIED MALE: We, as an investigative team, sheriff`s office, and all of the people that are directly involved in this effort are resolute in bringing Kyron home.

(BEGIN VIDEO CLIP)

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. Police seize Van Der Sloot`s laptop after he claims a FaceBook death threat over Natalee Holloway popped up, triggering that fatal argument between Van Der Sloot and his latest murder victim.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Joran Van Der Sloot may finally be ready to come clean about Natalee Holloway.

UNIDENTIFIED FEMALE: During the interrogation, Joran Van Der Sloot said that he knew where the remains of Natalee Holloway were but he would only tell Aruban authorities.

UNIDENTIFIED MALE: "This is a case that I have had for years, and I would prefer to talk with the Aruban police."

UNIDENTIFIED FEMALE: Peruvian authorities say they`re going to let Aruban investigators into their country to interview Joran Van Der Sloot.

UNIDENTIFIED MALE: "There is a possibility to close the case. I will be willing to solve the case."

UNIDENTIFIED FEMALE: After so many years of investigators wanting information from him, now it appears he`s giving up a lot of information.

UNIDENTIFIED FEMALE: In his confession, he says she was looking him up on his laptop. She invaded into his private life, and that`s when he lost it.

UNIDENTIFIED MALE: He`s going to say that when she hit him in the head, he just snapped.

GRACE: Everything about him is a lie.

UNIDENTIFIED FEMALE: ... twist things around. It`s a partial truth.

UNIDENTIFIED MALE: Peruvian media are speculating Flores`s killing was premeditated because it happened on the fifth anniversary of Natalee Holloway`s disappearance.

UNIDENTIFIED MALE: (INAUDIBLE) going to take the custody for the moment.

UNIDENTIFIED FEMALE: Prison officials tell us, We know his life is in our hands.

(END VIDEO CLIP)

GRACE: Straight out to Jean Casarez, legal correspondent, "In Session," joining us from Lima, Peru, at the Justice Ministry. Jean Casarez, in just 24 hours, so much has changed. What`s the latest?

JEAN CASAREZ, "IN SESSION": The latest is, Nancy, mark your calendar because for the first time on Monday, June 21, Joran Van Der Sloot as a defendant in a murder case will be face to face with a judge here in Lima, Peru. This is according to Peruvian law. He must give a formal statement to the judge. He can`t refuse to do it. Normally, it`s done at the Justice Palace, which is right behind me here in downtown Lima, but the judge will go to the jail on Monday because of the high security issues in this case. He will get that formal statement from Joran Van Der Sloot one on one.

GRACE: OK. Jean Casarez, so there`s no way he can get out of answering the judge`s questions?

CASAREZ: No, because under the criminal procedure code in Peru, this is mandatory.

GRACE: OK, Jean, when he goes in front of a judge, this is unlike anything we have in the American system. This judge can ask him cross- examination questions. And there`s nothing he can do. What if he says, I don`t want to answer?

CASAREZ: He could say that, it will be held against him, though, because this is such a mandatory procedure. But here`s the fact (ph) the judge in Peru is now the fact finder. The case has virtually been given to him by prosecutors. He is the one that focuses on the investigation. He is the fact finder and also determiner of law.

Prosecutors continue with their investigation. They give the judge information. And defense counsel defends the rights of Joran Van Der Sloot. But the end-all in all of this is the judge in this district court.

GRACE: And Jean, what can you tell me about Peruvian authorities seizing Joran Van Der Sloot`s laptop? From what I gather, part of his confession, which was a pack of lies -- the only thing truthful is that Stephany Tatiana is dead with a broken neck on the floor of his hotel room. But he told them that as she, Stephany Tatiana, was looking at his computer, a FaceBook death threat came up that said, I`m going to kill you, you mongoloid, and that Stephany asks him about it. At that time, he divulges that he was a suspect in Natalee Holloway`s murder, which leads to a fight.

If that is not true, Jean Casarez, what it boils down to is he cracked her neck for her money, for casino winnings.

CASAREZ: That`s right. Now, we`ve confirmed with police, Colonel Miguel Carnya (ph), that the computer of Joran Van Der Sloot is with the high technology division of their forensic units with the Peruvian national police. But they will comply with the order of law. What that means is, just like the United States, the judge issues the order for the search of the hard drive of the computer to begin. In a press release late today from the judge, in very vague terms, he says that that will be done.

GRACE: Jean, what can you tell me about what Van Der Sloot is doing right now, about the conditions in which he is living?

CASAREZ: Well, he`s in solitary confinement. He is actually right next to an alleged Colombian hit man. They have "hit it off," quote, unquote. They talk. They watch television together. They go to the exercise room together. And they`re getting the food of those that work at the facility because they`re so concerned about food poisoning. A typical breakfast is oatmeal and typical meal is arroz con pollo, a national dish here in Peru, chicken and rice.

GRACE: Everybody, you are seeing video right now of Lurigancho prison, Peru. It`s from National Geo`s channel "Inside." It`s airing June 23, 9:00 PM. As you see there, prisoners do not wear uniforms. In Peru, they say that denigrates the individuality of the prisoner. Well, that may be true, but look at the conditions in which they live. We are taking your calls.

Back to Jean Casarez, standing by in Lima. So what time tomorrow will he be in front a judge, Jean?

CASAREZ: It will be Monday and it will be mid-day. The judge is going to him at Castro Castro, highest security prison in Peru.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Behind me you see the fishermen`s huts. The next morning, when the fishermen arrived, they noticed that two or three of these doors, the padlocks were broken. And missing was a very large knife and a crab trap. There is speculation that this crab trap, large enough to hold a small human body, may have been used by Van Der Sloot to dispose of Holloway`s body.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Peruvian authorities may not necessarily believe that Joran Van Der Sloot acted in a moment of rage.

UNIDENTIFIED MALE: "I didn`t want to do it. The girl intruded into my private life."

UNIDENTIFIED FEMALE: Was it premeditated? Was it something that he planned ahead of time, or was it something that happened at the spur of the moment?

UNIDENTIFIED MALE: Premeditation can be made in the blink of an eye.

UNIDENTIFIED FEMALE: Van Der Sloot, in his confession, he says that he was struck first by Stephany Flores.

UNIDENTIFIED FEMALE: In the confession, he went straight for her throat.

UNIDENTIFIED MALE: He did confess, but the lawyer would say, Well, it`s a coerced confession. You can`t believe it.

UNIDENTIFIED MALE: I don`t think they believe it. That`s why they`re going to corroborate everything he`s said.

UNIDENTIFIED MALE: Peruvian media are speculating Flores`s killing was premeditated because it happened on the fifth anniversary of Natalee Holloway`s disappearance.

UNIDENTIFIED FEMALE: We`ve seen pictures of him without his shirt on...

UNIDENTIFIED FEMALE: ... nothing that projects (ph) that Flores assaulted him.

UNIDENTIFIED FEMALE: ... when he was getting medical exams, and if you look all over him, there`s really not a scratch on him.

UNIDENTIFIED FEMALE: He is a psychopath, and he`s going to play the game to the best of his ability so he can get away with as much as he can get away with.

(END VIDEO CLIP)

GRACE: We are taking your calls live. Right now to Lisa in California. Hi, Lisa.

UNIDENTIFIED FEMALE: Hi, Nancy. How are you?

GRACE: I`m good, dear. What`s your question?

UNIDENTIFIED FEMALE: It`s really disturbing how he says that he loses control when during the -- the strangling, he says that he lets go and she was still breathing, but yet he takes his shirt and finishes her off. Now, that sounds like, to me, like somebody who is in control of what he`s doing.

GRACE: To Mark Hillman, clinical psychotherapist, author of "My Therapist Is Making Me Nuts," out of New York. Martin (SIC) Hillman, we have the e-mail content that allegedly started this whole chain of events. He says, Van Der Sloot, that when Stephany Tatiana was looking at his computer, a FaceBook message popped up, I`m going to kill you, you little mongoloid. That`s what he says the message said. She asked about the death threat and that led to confrontation about Natalee Holloway`s murder, and she ended up dead.

You heard Lisa in California`s question. If that e-mail doesn`t exist, he`s a cold-blooded killer that killed for money.

MARK HILLMAN, PSYCHOTHERAPIST: You`re absolutely right. And let`s get a couple of things straight. One, no man has a right to hit a woman. Second, this snap defense I don`t agree with whatsoever. This guy is a psychopath. He is psychosis. He`s embezzled money. He`s extorted money. He stole her money. As the woman, the caller, said, he killed her when he knew she was alive. And all of a sudden, he has exact details. And then all of a sudden, now he doesn`t remember. Look, he`s psychotic. There`s no emotional connection. He`s completely narcissistic. It`s all about him. It`s all about immediate gratification. And this entitlement is what is going to ultimately bring him down.

GRACE: Well, we`re going to also address Lisa in California`s theory, which is not just a theory, it`s proven by the evidence, that this was not an out-of-control rage killing, which could get him something like manslaughter. But before go to the lawyers -- Michael Griffith, John Burris and Alan Ripka -- to Rupa Mikkilineni, standing by in Aruba. Rupa, now we learn that the Aruban authorities won`t even question Van Der Sloot for about three or four months. But what have you learned there in Aruba?

RUPA MIKKILINENI, NANCY GRACE PRODUCER: Nancy, we`ve learned that they will be coming down to Peru, the Aruban prosecutors, and they will be questioning Joran Van Der Sloot. Meanwhile, what we`re also learning is that they`re awaiting information here through the police so that a search can go on in certain areas here in Aruba. Now, there`s a map and there`s a search team in place. Dave Holloway, the father of Natalee Holloway, was here for the last few days talking with Aruban authorities to determine which locations can be searched, based on permission by the prosecutors and by the authorities. Now, they`re still waiting for guidance on where, based on Joran Van Der Sloot`s statements.

(BEGIN VIDEO CLIP)

GRACE: By his own admission to authorities, Joran Van Der Sloot...

UNIDENTIFIED FEMALE: He admitted to killing 21-year-old Stephany Flores Ramirez.

UNIDENTIFIED MALE: ... confessed to the killing of 21-year-old Stephany Flores Ramirez...

UNIDENTIFIED FEMALE: ... she confronted him and that she hit him. He said that at that point, that he took his right elbow and he hit her on the face real hard and blood started going everywhere.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Peruvian authorities say they`re going to let Aruban investigators into their country to interview Joran Van Der Sloot.

UNIDENTIFIED FEMALE: Our family is pretty desperate for answers to find out whatever happened to Natalee.

UNIDENTIFIED FEMALE: ... the computer...

UNIDENTIFIED MALE: ... the laptop that was so much part of this investigation, the one that was being used at the time that this murder took place...

UNIDENTIFIED FEMALE: Do we know yet what`s on that computer?

UNIDENTIFIED FEMALE: The computer sits in the hands of authorities unopened.

UNIDENTIFIED FEMALE: The FBI is heavily involved in this investigation. They are involved in data mining that laptop.

UNIDENTIFIED FEMALE: A plethora of information may come from that computer.

UNIDENTIFIED FEMALE: ... the lone suspect in Holloway`s disappearance in Aruba five years ago.

UNIDENTIFIED FEMALE: Yes, we would like answers. But I think that`s something that`s just really out of our control.

(END VIDEO CLIP)

GRACE: Of course, many of you court watchers, you legal eagles, believe that Joran Van Der Sloot`s latest confession is nothing but a pack of lies, but apparently included a new map -- this is the front page of "The Enquirer" this week -- divulging the location of Natalee Holloway`s body. Why should we believe it now?

But first, unleash the lawyers, Michael Griffith, international law attorney, New York, John Burris, famed defense attorney, San Francisco, Alan Ripka, defense attorney, New York, practicing in multiple jurisdictions.

Michael Griffith, you have handled cases in Peru. Thank you for being with us tonight. Michael, to many of us, it is so foreign for a defendant to appear in front of a judge and the judge ask whatever he wants to or she wants to about the murders and the defendant has to answer.

MICHAEL GRIFFITH, INTERNATIONAL LAW ATTORNEY: Nancy, under the civil system, the European system of the Napoleonic Code, you can do that. I had the same thing in Monaco on the Safra (ph) case. But let me...

GRACE: Hey, Griffith -- Griffith...

GRIFFITH: Yes?

GRACE: ... we already know you try cases all over the world.

GRIFFITH: OK.

GRACE: We know you`re the lawyer in "Midnight Express," the movie. You don`t have to sling around what you tried in Monaco, OK?

(LAUGHTER)

GRACE: Just try and answer the question. We know you`re famous. Go ahead.

GRIFFITH: It`s the same system. But Nancy, here`s what I don`t understand. I`ve don`t understand why the Aruban authorities are getting involved here. This was a crime committed against a U.S. citizen. Under the passive personality (ph) principle of international law, we can prosecute anywhere in the world someone who`s killed one of our citizens, like in the Klinghoffer case. And I`ll tell you something. If he gets convicted, he won`t survive that prison. And if he does, I`ll send your -- I`ll send your twins to college.

GRACE: You think -- you think that`s bothering me? To you, John Burris. What do you make of it?

JOHN BURRIS, DEFENSE ATTORNEY: Well, I think that he can be prosecuted here in the United States. He can be prosecuted in Aruba, as well. And I think the Aruban people do have right to go over to Peru and ask questions about this. It is surprising, the system they have in place. This is unusual. But that`s their system.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED REPORTER: Peru and Aruba have agreed to work together.

UNIDENTIFIED REPORTER: Investigators hope the cooperation will lead to new information about the disappearance of Alabama teenager Natalee Holloway.

JORAN VAN DER SLOOT, MURDER SUSPECT, STEPHANY FLORES CASE (Through Translator): This is a case that I have had for years, and I would prefer to talk with the Aruban police. And if there is possibility to close the case, I will be willing to solve the case.

UNIDENTIFIED REPORTER: Van Der Sloot says he left Natalee Holloway alone, but alive and well on the beach.

NANCY GRACE, HOST: Of course that story is a lie.

UNIDENTIFIED REPORTER: Joran Van Der Sloot claimed a friend dumped Natalee Holloway`s body at sea.

GRACE: That story is a lie.

UNIDENTIFIED REPORTER: Van Der Sloot says Natalee Holloway plummeted to her death off a balcony she was dancing on, and then with the help of a friend he dumped Natalee`s body into a swamp.

GRACE: That story is a lie.

UNIDENTIFIED REPORTER: Aruban prosecutors are awaiting that laptop data to be turned over to them via the FBI. There is information pertaining to Natalee Holloway.

UNIDENTIFIED REPORTER: Van Der Sloot was twice arrested but never charged in that case.

DAVE HOLLOWAY, FATHER OF NATALEE HOLLOWAY: Whether we get the -- the justice that Natalee deserves that`s the ultimate question. And we certainly are not going to quit.

(END OF VIDEO CLIP)

GRACE: We are taking your calls live tonight. We have the contents of the e-mail that purportedly triggered the entire drama the deadly drama that led to the death of Stephany Tatiana.

The content, "I will kill you, you little mongoloid." Allegedly that e-mail message, a Facebook message popped up. Stephany Tatiana sees it and asks Van Der Sloot about it and he kills her.

It`s not fitting together for me, Alan Ripka.

ALAN RIPKA, DEFENSE ATTORNEY: Well, at end of the day, Nancy, it appears that this was not a premeditated murder. It appears she was up there and this occurred with the Facebook message and he snapped. As he may have snapped in the Holloway case as well.

GRACE: Well, you know, if you take a look at what he said -- back to you, Jean Casarez, joining us from Lima, Peru. He says that -- just as Lisa in California pointed out -- that he stopped as she was still breathing then he continued to kill her.

In the U.S., of course, which is different from Peru, that`s time to form premeditation. Premeditation doesn`t mean a long drawn out scheme such as poisoning someone with arsenic over months and months. Premeditation can be formed in an instant.

JEAN CASAREZ, CORRESPONDENT, "IN SESSION": That`s right. Now let`s look at the facts, too. All right. We confirmed with the police. They met on the 27th of May. On the 24th of May, she won $10,000 -- Stephany Flores. They meet on the 27h.

On the 28th, her father gives her $1,000 the night she died. And the next early morning hours she won 600 soles. We also know, because of your show, Nancy, and a friend of Van Der Sloot`s going on your air that an e- mail was sent to him hours before Stephany was killed by Joran saying, I need money to get back home to Aruba.

So if you put it together, you see the felony murder that prosecutors are building here also. A killing during the commission of a robbery of the victim Stephany Flores.

GRACE: So at this point, Jean, when he appears in front of the judge Monday he is not even going to go to court because of security risks? The judge is going to go to Castro Castro?

CASAREZ: The judge will go to Castro Castro -- you`re exactly right - - because of the security concerns. But the judge must, under Peruvian law, get this formal statement -- and that`s what they call it, a formal statement -- during this investigative part of the case.

GRACE: To Ellie Jostad, our chief editorial producer on the story.

Ellie, what is all this business about the map which I consider to be just more of Van Der Sloot`s BS?

ELLIE JOSTAD, NANCY GRACE PRODUCER, COVERING STORY: Right, Nancy. Well, back in March, you`ll remember, we got this really crudely drawn map that was from an interview that Joran Van Der Sloot did.

He gave an interview to a guy named Japp Amez. He`s the guy who won the Dutch version of the show that`s like "Big Brother." Anyway, he told this guy that Natalee Holloway fell off a balcony. She died. He and a friend dumped her body in the swamp area called Bubali Puddle or Bubali Bird Sanctuary.

That`s an area they hope to search but it`s unclear if this map will really lead to Natalee Holloway`s body.

GRACE: Well, Ellie -- Elizabeth, show me that map again. It looks like a fifth grader drew it. Let me see the map again, Elizabeth.

Ellie, that reminds me of the last time he drew a map.

JOSTAD: Yes, Nancy. I mean he has drawn many maps. He`s given many versions of what happened. He also claimed at one point that he sold her on the beach. It`s not clear whether any of those really panned out.

As you know we obviously haven`t found her body, no clues discovered. Don`t know if the new map is going to lead to any evidence.

GRACE: To Rupa Mikkilineni, standing by in Aruba.

Rupa, have Aruban authorities searched this location he is alluding to?

RUPA MIKKILINENI, NANCY GRACE PRODUCER: They have, Nancy. Back when he made this confession, they searched this area. But remember, it`s 700,000 square meters and 200,000 square meters of it is water and swamp land. So they`ve searched a portion of it, but not all of it.

Not knowing which location precisely the area where Joran Van Der Sloot allegedly dumped Natalee`s body.

GRACE: OK. To Clark Goldband, standing by a telestrator (ph). What can you tell me about the new search that Aruban authorities claim they`re going to launch. I will believe it when I see it.

CLARK GOLDBAND, NANCY GRACE PRODUCER, COVERING STORY: In the context of this, Nancy, as you can see behind me, Natalee was last seen at Carlos & Charlie`s with Van Der Sloot. That`s three miles from this bird sanctuary. The sanctuary we were just talking about.

Also reports indicating there is another area about four miles away towards the east that will also be searched. This is the Monsorat Dam, Nancy. You will in fact remember that`s the dam area where a witness claims to see a man running on the street, missing a shoe who was wet. He was leaving that dam area the night Natalee was last seen.

GRACE: Joining me, a special guest. This is Natalee`s aunt, Linda Allison. She is joining us from Jonesboro, Arkansas.

Miss Allison, thank you for being with us. What do you make of the reports that Joran Van Der Sloot has drawn yet another map to show us where Natalee`s remains are?

LINDA ALLISON, NATALEE HOLLOWAY`S AUNT: Nancy, he`s made so many different hypothesis of where Natalee is. Before you know it we`ll have searched the entire island and still haven`t come up with any answers.

GRACE: I feel the very same way. I mean even his story about how Stephany Tatiana died -- the 21-year-old girl he met in a Peruvian casino - - it`s just so inconsistent. And like -- with so many other murder defendants that I have examined their statements, their confessions, their so-called confessions, they go off on long tangents, on very unimportant details like what the cab driver said, and what he said back, and what they had for dinner.

But when it gets down to the nitty-gritty of the crime -- in this case, the murder -- everything gets vague. He has given two stories that I know of including a pack of armed men attacked him and Stephany. And he leaves the hotel room to the ATM machine to bring the money back to the armed men?

Who would do that? Nobody. I mean everything he says is a lie. I think, Linda, he is just angling to get back home to Aruba so they`ll let him go.

ALLISON: You know, and I think you are right, too, that he is trying to use every possibility. He`s now saying he wants to speak to Aruba officials and only to Aruba officials when they come to Peru.

You know if you go back and read some of those early police reports, Joran went into great detail how he pulled up at the Holiday Inn and told where he exactly pulled up, and that Natalee got out, and she staggered, she fell and hit her head. Went into great detail about the security guards and what colors they were wearing.

And of course, as we know there was no security cameras showing any of that on camera. And the Holiday Inn, whoever the night manager was, said there were no guards dressed in black. So there couldn`t have been any of their security guards.

But with all that being said, he is fabricating stories one right after another. So it is difficult to understand really what is the truth in all that.

GRACE: Out to the lines, Shannon in New York. Hi, Shannon. Hold on, I think I have lost Shannon. Let`s go to Debbie, in Rhode Island.

Hi, dear.

BETTY, CALLER FROM RHODE ISLAND: Hi, I love your show. Watch it every night. I have a question.

GRACE: Yes, ma`am, what`s your question?

BETTY: If he didn`t let Stephany leave the room why isn`t he being charged with kidnapping?

GRACE: Well, here -- I think this is Betty in Rhode Island.

Betty, with kidnapping, you actually only have to move the person an inch or so or even less. It`s called aspertation. In the kidnapping statute.

Do I still have Betty, Elizabeth?

BETTY: Yes.

GRACE: Is she asking me why he didn`t let her -- take her out of the room? Give me your question again, Betty.

BETTY: He wouldn`t let her leave the room. Why isn`t he being charged with kidnapping? He held her there.

GRACE: OK. You`re right. Kidnapping or false imprisonment.

You know, Jean Casarez, Betty in Rhode Island is correct. Are the Peruvians considering additional charges?

CASAREZ: They have not charged it yet but he made a statement that is very incriminating in regard to kidnapping.

He said that when the altercation began that Stephany wanted to leave the room and he wouldn`t let her.

(BEGIN VIDEO CLIP)

UNIDENTIFIED REPORTER: The Holloway family desperately wants to know what precisely happened to the daughter.

ALLISON: He did that with Natalee. He said is was her coming on to him.

UNIDENTIFIED REPORTER: Now allegedly that laptop had information possibly about Natalee Holloway.

GRACE: Suddenly Aruba says it may start additional searches for Natalee Holloway`s body. I will believe it when I see it.

(END OF VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED REPORTER: Police believe that Van Der Sloot killed 21- year-old Stephany Flores.

UNIDENTIFIED MALE: An apparently grisly crime scene.

UNIDENTIFIED REPORTER: Authorities say she was found face down on the floor.

UNIDENTIFIED MALE: Allegedly had been beaten.

UNIDENTIFIED REPORTER: Wrapped in a blanket.

UNIDENTIFIED MALE: And was in a puddle of blood.

UNIDENTIFIED REPORTER: Cops say he remains the prime suspect as well in Natalee Holloway`s disappearance.

UNIDENTIFIED REPORTER: Investigators say Van Der Sloot told them it was Flores` interest in the Holloway case that set him off.

UNIDENTIFIED REPORTER: He became enraged, started hitting her, attacking her.

CASAREZ: The mattress on the bed was totally off its box springs.

GRACE: Broken neck. Blunt trauma to the torso.

UNIDENTIFIED REPORTER: Ultimately breaking her neck.

(END OF VIDEO CLIP)

GRACE: We are taking your calls live. To Dr. Leigh Vinocur, joining us out of Baltimore from University of Maryland School of Medicine.

Dr. Vinocur, thank you for being with us.

DR. LEIGH VINOCUR, M.D., UNIVERSITY OF MARYLAND SCHOOL OF MEDICINE: My pleasure.

GRACE: They didn`t get Van Der Sloot until three days later. If he had been under the influence of methamphetamine, speed, crack, it would be out of his system by then, wouldn`t it?

VINOCUR: Well, certain drugs like cocaine or drugs like that can be in your system longer. Marijuana shows up longer. A lot of the -- speed type drugs, sometimes are metabolized a little bit quicker than that but --

GRACE: Well, take a listen to this, Doctor. He said by his own admission that he had at least 10 Pisco Sours -- now put up the recipe -- and/or whiskey colas, rum and Cokes.

Let`s see the recipe for a Pisco Sour, Liz, that you put up earlier. There is a lot of alcohol in there. But of course all of that would have been gone by the time they arrested him and did a blood test.

VINOCUR: Yes. Alcohol, you do metabolize rather quickly. I mean three days later unless he had been drinking while he was on the run. You wouldn`t see that much alcohol in his system.

GRACE: To Bill Majeski, former NYPD detective, now with Majeski & Associates out of New York. We now learned the Aruban authorities are not going to Peru for at least four months as if it will make any difference with them.

It`s not going to make any difference at all. Not at all.

BILL MAJESKI, FMR. NYPD DETECTIVE, MAJESKI ASSOCIATES, INC.: It won`t make any difference at all. Not at all.

GRACE: That`s what I wanted to ask you. Even if he confesses, I still don`t see Aruba doing anything.

MAJESKI: No, the reality is -- you know, all of these stories that he`s creating, there`s a big issue with that. I dealt with informants a lot over the years. These people thrive on the power of creating stories, watching law enforcement run around and prove the stories to be untrue.

There is a methodology in terms getting the information from -- in terms of where Holloway is -- the body remains are. The first thing create a timeline. All the events leading up to the actual murder of Holloway if that can all be borne out factually then you start making a deal about where the body was disposed.

So that -- they`re not approaching it the right way. As far as Aruba going there, they haven`t done anything up to this point in time. Doesn`t -- not likely they`re going to be doing anything when they get there.

GRACE: What about it, Michael Griffith?

MICHAEL GRIFFITH, INTERNATIONAL LAW ATTORNEY/CRIMINAL DEFENSE ATTORNEY: He is right. But, you know, I don`t know why the Aruban authorities are going. They have no power. They have no authority. It`s the Dutch government. It`s like Saint Thomas for American Samoa making a deal with Italy.

Remember he`s an -- Natalee Holloway was an American citizen. It should be the U.S. Department of Justice and the Peruvian embassy in Lima who should be on top of this and tell them we`re going to extradite you back to the states if you give her up now as to where she is buried. Maybe we`ll give you a deal.

GRACE: Right now we are switching gears and taking you to Oregon, and the disappearance of a 7-year-old little boy in his own school.

To Janine Wolf with 750 KXL, what is the latest in the search for Kyron?

JANINE WOLF, NEWS REPORTER, 750 KXL NEWS RADIO: Well, the search is going on. But last night there was actually a candlelight vigil, Nancy, at a church in a neighboring area, and about 400 people showed up. They were singing and praying, gathering fliers and buttons with Kyron`s picture on it. It was very emotional.

This is a very tight-knit caring community. And today dive teams were out with the assistance of one other county. They`re still searching the waterways, any kind of body of water in the six-mile area right around the school.

We don`t know when they`ll be finished. And on Monday we`re hearing that --

GRACE: Right.

WOLF -- Skyline command post will shut down and move back to an in- office command post.

GRACE: To Matt Shelby, the public information officer at Portland School District. Matt Shelby, I find it very difficult to believe that somebody came into that school, got the child and nobody saw a thing.

MATT SHELBY, PIO, PORTLAND SCHOOL DISTRICT (via phone): Well, you`re exactly right. It is difficult to believe. There were a host of people, parents and teachers and students in the building there before school that day. It was a public science fair. So prior to the school day you had a whole -- whole host of people in that building. It was a very full building.

The last time anyone from the school saw Kyron, he was with his stepmother. Now authorities have taken statements from all the students, all the parents, and all the staff there at the school. So they`ve got a much better picture right now --

GRACE: Right.

SHELBY: -- of just exactly what happened on Friday than we do at this point.

GRACE: Let`s hear from Marc Klaas, the president and founder of KlaasKids Foundation.

Marc Klaas, something is wrong. Something is wrong with the timeline and the story that we`re getting.

MARC KLAAS, PRESIDENT AND FOUNDER, KLAASKIDS FOUNDATION: Well, I`ve always found it confusing as well, but I think that the key is going to lie in those interrogations that have been done with the different -- with the kids and the teachers and the different parents at the school.

What the cops need to do and what they usually do is they launch parallel investigations. They`ll do the searches, but they`ll also investigate the family. They`ll investigate friends. They`ll investigate the people at the school, registered sex offenders and then eliminate the various possibilities, one after another, until the truth reveals itself. And that`s what`s going to have to happen in this case.

GRACE: What about it, Natisha Lance?

NATISHA LANCE, NANCY GRACE PRODUCER: Well, Nancy, the sex offenders in the area, 176 are being looked into. The family is also being spoken to at this point and no one has been ruled out.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Please help us bring Kyron home.

UNIDENTIFIED MALE: This will not become a cold case for us. We will continue to investigate this case until we have it solved.

UNIDENTIFIED REPORTER: As the hunt for Kyron moves from a search for a missing and endangered child to a criminal investigation, law officers will not comment on whether there are any suspects.

(END OF VIDEO CLIP)

GRACE: To Marc Klaas, president and founder of KlassKids Foundation joining us out of San Francisco. What exactly did the stepmother say happened?

KLAAS: Well, that`s the part that I don`t quite get, Nancy. I`ve never been able to get a completely straight story, except for the fact that she took the little boy to the science fair, waved good-bye to him.

He didn`t get on the school bus. He was reported missing after he didn`t get on the school bus. She called the school then. Apparently called 911 and started the -- started the gears in motion.

GRACE: Janine Wolf, 750 KXL News Radio, what is the stepmother`s story? Did he -- did Klaas leave anything out? That`s the same exact version I`ve gotten.

WOLF: Well, actually, she is not the one, from what I understand, that called 911. It was the secretary at the school but she did call the school when Kyron didn`t come off the bus.

Apparently people feel, too, that the stepmother posted trivial updates on her Facebook page about going to the gym and things like that. It didn`t put Kyron`s picture on her -- on her Facebook page for six days after he disappeared.

GRACE: When did she make the postings about the workout?

WOLF: Apparently right away, but authorities also have told us that they asked the family to go around and do their normal routine and --

GRACE: Right.

WOLF: And do things that would make them feel normal. So it could have been something do with that.

GRACE: Hm. Everyone, let`s stop and remember, Army Specialist Travis Virgadamo,, just 19, Las Vegas, killed Iraq. Also serves Civil Air Patrol, Military cadet at Fort Stewart. Awarded two Army Commendation medals, Army Good Conduct medal.
