JANE VELEZ-MITCHELL, HOST (voice-over): Tonight Lindsay Lohan headed to the slammer. The Hollywood starlet was sentenced to 90 -- count them -- 90 days in jail for violating her probation. She has been let off the hook her whole entire life. This is wake-up call. She needs to clean up her act.

And murderous new allegations in the massive search for adorable little Kyron Horman. Shocking new reports say his stepmother tried to hire a landscaper to murder Kyron`s father. Tonight seismic details that this landscaper was wearing a wire for cops. Is this murder-for-hire plot connected to little Kyron`s disappearance? I will talk to another landscaper who says he replied to the very same ad.

Plus, it`s every parent`s worst nightmare. A beautiful young girl abducted while playing in her front yard. She`s only 4 years old. Look at this beautiful child. Her young brother watched the entire thing. Tonight, what happened Alisa Maier?

VELEZ-MITCHELL: But we`re leading with this one. The party is over for Lindsay Lohan. Today, judgment day. The troubled starlet broke down and wept -- oh, waterworks -- as the judge sentenced her to 90 days in jail.

The party-hardy actress was at the center of a heated, furious hearing that dragged on all day long. Lilo boldly blew off the judge`s very simple order: attend alcohol education classes once a week. Lindsay broke down and, tearfully sobbing, insisted she did everything she was told. Again, check out the waterworks on this one.

LINDSAY LOHAN, ACTRESS: I just wanted to take a minute to say that, you know, I -- as far as I knew, I was being in compliant with my program. Having said that, I did do everything that I was told to do and did the best I could to, you know, balance jobs and showing up.

I`m sorry. I wasn`t missing the classes just to -- I wasn`t doing anything like that. I was working mostly. I was working with children. It wasn`t a vacation. It wasn`t some sort of a joke. And I respect you and would take it seriously.

And I appreciate the program has done so much to help me finish early because I wanted to make sure that I would come back here making you happy and the court system and show that I meant everything I put into it. It`s just been such a long haul, and I don`t want -- I don`t want you to think that I don`t respect you and your terms, because I really did think that I was doing what I was supposed to do. I mean that with all my heart.

VELEZ-MITCHELL: You`ve got to hand it to her. That was a performance of a lifetime! Luckily, the judge did not buy it.

Lindsay missed class several times and offered a slew of what I consider totally lame excuses. Let`s see: she was promoting her clothing line. She was in Haiti. She was in Morocco working with children. The list goes on and on. Yada, yada, yada.

For most of the hearing, Lindsay doodled and played with her hair and whispered to her attorney. But hey, she actually showed up in court this time. We`ve got to give her that. Last time she had a court appearance she showed up late. The time before that she missed it completely, because she was on a yacht-hopping bender in Cannes and said she lost her passport.

Straight out to my fantastic expert panel, but got to begin with the host of "In Session" on TruTV, Vinnie Politan.

You and I have been watching this all day, Vinnie. What a showdown. Recap it. What`s the very latest?

VINNIE POLITAN, TRUTV`S "IN SESSION": Well, the latest is she`s getting 90 days in jail, and then once she gets outs of jail, you know what she does? Ninety days inpatient rehab.

So for Lindsay Lohan, where she really failed was how you can fail in life. You know how they say: you know, 50 percent of life is just showing up? Well, 75 percent of probation is just showing up. The other 25 percent is sometimes leaving something in a bottle to find out what you`ve been doing.

But at the end of the day, Jane, she failed probation. She tried. She didn`t try hard enough. Too little too late.

And you know, me as a former prosecutor, I`ve seen it a million times. They come into court. Now they know they`re at the end of the rope. Now all of a sudden they`ve seen the light. But she`s been given chance and chance again, and now it`s game over. And hopefully, though, this is a wake-up call.

VELEZ-MITCHELL: I`ve got to go to Alan Duke, the CNN producer extraordinaire who was in the courtroom when the waterworks went off. What was the reaction to Lindsay`s sob fest? Because frankly, I think she`s a great actress, but I didn`t buy it. To me it was just a performance. What say you?

ALAN DUKE, CNN PRODUCER (via phone): My cell phone is breaking up a little bit but what I can tell you inside of the room, we were pretty stunned sitting there amongst the press because the prosecutor had only asked for 30 days in jail, which seemed like a lot for Lindsay Lohan. The judge tripled it. (UNINTELLIGIBLE)

VELEZ-MITCHELL: Guess what? You`re breaking up.

Bonnie Fuller, do you think she`s actually going to do 90 days? You and I have watched Paris Hilton, and all these others get sent to jail. And a couple minutes later for some reason they get sick, they come up with some wild excuse. You`ve got to give it to them for ingenuity. They`re out of there. Do you think she`s really going to spend 90 days in jail?

BONNIE FULLER, EDITOR IN CHIEF, HOLLYWOODLIFE.COM: Yes, I think that Lindsay will spend 90 days in jail and 90 days in rehab. But I think she will try every trick in the book to get out.

I think we`re going to see more hysterics than we saw with Paris Hilton, because she`s going there for a longer time. And she sure didn`t expect it. If she expected it, she would have shown up for her probation. She would have come back from Cannes and not lost her passport.

I think she was dumbfounded today. And -- but she`s a tricky girl. So I think we`re going to see all kinds of machinations to get out of this.

VELEZ-MITCHELL: Danny Bonaduce, OK, I`m a recovering alcoholic with 15 years of sobriety. You have your experiences with alcohol, which I will not characterize. To me, this was the best thing this judge could have done. I said, "Hallelujah!" First of all not because I`m a mean person but because I think it`s going to save this young lady`s life.

She`s already done three rehabs. Rehab No. 4 without a real taste of real life is not going to help her, I don`t think. I think jail is exactly what she needed to show her, honey, you`re not special. You`re terminally unique. You think you`re special. We`re going to show you you`re not special. The rules apply to you -- Danny.

DANNY BONADUCE, ACTOR: Well, I agree with you completely. As a matter of fact, I told one of your producers about six hours ago, and if you were kind enough to ask me back on the show, that first of all, this judge is going to have to throw out the SCRAM device because it only pertains to bail.

But she is -- with her first 100 words, she had convicted Lindsay to jail when she said, "I will not tolerate this. I will not tolerate this. I will tolerate this, but I`ll let you go." She could never say that. I have known that Lindsay was going to jail since one minute into the judge opening remarks, and there was no missing it.

And the judge had little discretion in this point. The public would not stand for another celebrity walking.

So do I think Lindsay has a wake-up call? Yes, but I think when you need a real -- real legal expert on this, because I could have told you exactly what was going to happen. As a matter of fact, I did tell your producer exactly what was going to happen. I think a prosecutor, an ex- prosecutor makes the best defense attorney, but if you need a real expert, call a criminal. And I`m happy to be of service.

VELEZ-MITCHELL: Well, thank you for that offer.

Now, the judge ruled Lindsay has to turn herself in in two weeks. I understand she was going to do a big party tonight at Dre`s. I wonder if that`s still on. It could be. She has to wear the SCRAM bracelet for those next two weeks.

Now, Lindsay`s alcohol bracelet, as we all know, already went off once at the MTV Movie Awards. Check this out.

All right. Well, don`t check it out. We don`t have it. But I`ve got to tell you Lindsay wore a sparkly pants suit to hide her accessory, and the SCRAM recorded that she did drink that night. Lindsay claimed somebody spilled a drink on her leg. OK. She was slapped with 200 grand bail after that. She paid 10 percent.

So basically, Midwin Charles, she had a $10,000 to $20,000 cocktail, depending on how you calculate it.

Do you think the judge was really tired of her habit, as am I, of insulting our intelligence with these ridiculous excuses? "Oh, I lost my passport" or "somebody spilled a drink on my leg. I`m in Morocco taking care of kids." I think she`s insulting our intelligence, and that`s one of the reasons the judge threw the book at her.

MIDWIN CHARLES, LEGAL CONTRIBUTOR, TRUTV`S "IN SESSION": Oh, but of course. I mean, if you look at when the judge was handing down the sentence, one of the things that she did was go back to the primary offenses, which lands everybody in court today, which is the DUI offenses.

And remember, she lied about each and every instance. She tried to blame it on someone else. And when they found cocaine on her pants, she said they weren`t her pants. And I think the judge noticed a pattern of practice of lying.

VELEZ-MITCHELL: You think? You think?

CHARLES: The judge was not going to...

DARREN KAVINOKY, CELEBRITY ATTORNEY: Jane, I can`t take this anymore. Jane, please. Is there anybody really who`s surprised about an alcoholic or a drug addict lying? And just if I could be a contrarian for just one moment, it`s the reverse celebrity justice. Her case is now being treated with so much additional scrutiny, there`s no other defendants that are going through...

VELEZ-MITCHELL: No, no, no, you`re wrong. You`re wrong, you`re wrong, you`re wrong. And I`ll tell you what. Hold on, hold on. You go to Mothers Against Mandatory Minimums, and you see all the people, mostly poor, mostly minority, who have been sent away for life sentences for crack cocaine under their bed.

This woman went on a high-speed chase, endangered lives, chased women into a police station in Santa Monica, and she spat in the face of the court system.

OK. We`ve got to -- hang on. On the other side -- on the other side, everybody stay right there. Lindsay is headed to the slammer. It could save her life, in my humble opinion. Your calls on the other side of this break: 1-877-JVM-SAYS.

Plus, a 4-year-old girl snatched from her front yard. Her younger brother witnessed the entire thing. Did he recognize the kidnapper?

But first, she`s tried it the easy way. Now Lindsay`s going down to the slammer.

UNIDENTIFIED FEMALE: Once maybe you could excuse. Twice, an oversight. Three times, you still haven`t caught her attention. Four times, she just doesn`t care. Seven times, the court is irrelevant to her.

VELEZ-MITCHELL: An explosive showdown in court. Lindsay Lohan tearfully begging, pleading, weeping saying, "Judge, spare me from jail."

Judge is not buying it, and I couldn`t be happier. She says Lindsay has been given way too many chances, and now Lindsay needs to pay. She has sentenced the starlet to 90 days in jail. And then after that, she has to go to rehab right after, in-house rehab for another 90. If this doesn`t teach Lindsay a lesson, I do not know what will. I hope it saves her life. I`m not just being mean.

Crystal, Iowa, your question or thought. Crystal?

CALLER: Hello.

VELEZ-MITCHELL: Yes, hi.

CALLER: Lindsay said it was her job as a celebrity to party and to go out in pubs and drink. Does anybody really expect anybody to believe that? And has she ever heard of virgin drinks?

VELEZ-MITCHELL: Oh, yes. I mean, Danny Bonaduce, one thing I know, as a sober person is I know I can go out there and have a great time and go dancing all the time, because I know I`m not going to make a fool of myself because I`m not imbibing. She could have gone to these award shows and just not chosen to drink. She could have had a sparkling water, but instead, her SCRAM bracelet goes off.

BONADUCE: Well, to answer the young lady`s question, I have heard virgin drinks. I don`t think Lindsay Lohan has heard the word "virgin" in the same sentence as her name in quite some time now.

VELEZ-MITCHELL: That`s true. Go ahead.

CHARLES: Jane, Jane, I just want to say, at Hollywoodlife.com we did a calendar last week of Lindsay`s last month. And here she`s supposed to be preparing for court, changing her ways, getting ready to work. Instead, she was virtually out, I would say 20 out of the 30 days. I mean, we had to look at it every single night out partying.

VELEZ-MITCHELL: Yes. Listen, I don`t want to pass judgment on her. I am a recovering alcoholic. When I was her age, I was doing the exact same thing. Thank God I didn`t get a DUI. Thank God I didn`t go on a high speed chase down Pacific Coast Highway in Malibu with a couple of people on board who are now suing.

But I relate to the idea of powerlessness over substance. She`s powerless over alcohol. But she`s -- she could have a lower bottom than going to jail. She could end up dead. And so I think jail could save her life.

Now, here`s my big issue tonight. I believe, frankly, justice has been served here. Lindsay spit in the face of the legal system. All she had to do was go to class one day a week. How hard is that? Instead, she blew it off. Check this out. Hopefully, we`ve got this one.

LOHAN: I know that I was ordered to go once a week. And it wasn`t -- you know, I wasn`t missing the classes just to -- I wouldn`t do anything like that. I was working mostly. In Morocco, the trip, I was working with children. It wasn`t a vacation. It wasn`t some sort of a joke. And I respect you and would take this seriously.

VELEZ-MITCHELL: OK. I don`t know if I buy those tears. I would be willing to take comments from members of our panel. I really thought that was a performance. Darren Kavinoky, did you think it was a performance? Because you are a person who has done interventions. You know how addicts can manipulate.

KAVINOKY: Well, of course. And whether it was a performance or not it was already clear that she had lost any credibility that she hoped to have with a court. And as a defense lawyer sitting next to your client who`s making a statement such as that, you can`t help but pucker a little bit and just -- and just hope it goes well, because clients often have a way of making things worse when they address the court.

I just think that, as somebody that`s done work with -- with interventions and people that are in active addiction and people that are in recovery, jail may be a great attention-getter, but that`s not where we`re going to address any of these underlying processes, these...

VELEZ-MITCHELL: Not necessarily. They have AA in jail. They have AA in jail. They do. Who said they do, because I`d like to hear from that person?

KAVINOKY: Danny said it. He`s the only one that`s been in jail.

BONADUCE: You know what the best thing about the AA meetings in jail is?

VELEZ-MITCHELL: Danny, go ahead.

BONADUCE: The best thing about AA meetings in jail is you can`t leave them and go to a bar that night.

KAVINOKY: But it`s not just about AA. And clearly, she need some humility. Candidly doing a little Monday morning quarterbacking here, I think the judge could have done even more by having her do CalTrans work and showing -- getting her...

VELEZ-MITCHELL: Oh, please. What, like Naomi Campbell? Like Naomi Campbell? Hold on. Let me bring Vinnie in.

Vinnie, go ahead.

POLITAN: One big thing that the judge did order today and made it official, that it`s now an official condition of her probation that she cannot consume alcohol anymore. So officially, she can`t take any drinks legally any more. And I think that`s another important thing that happened in today`s hearing. Because she knows now she drinks, she`s going back to jail.

VELEZ-MITCHELL: You know, it was a rough day for Lindsay. On top of 90 days in the big house, as she was walking into court she got slapped with a lawsuit. A clothing company is suing her for $17,000. They say she took clothing and never paid for them.

This is the second lawsuit Lindsay is facing. She`s also being sued by those men who were riding in her SUV when she took off on that drunken high-speed chase. And Bonnie Fuller, I`ve got to ask you: how is she going to pay for all this? My understanding is she`s broke.

FULLER: Well, that`s pretty much our understanding, too. I don`t know how she`s going to pay for it. Now, she did have some work. She`s got a movie in the can called "Machete" with Robert De Niro. I don`t believe she was paid a lot. She was supposed to play Linda Lovelace in a movie coming up. That was actually a role that I thought could be a career killer, not an enhancer.

No matter what, I agree with you: this is the best thing for her, because what` s most important is saving her life. And after jail she`s going to rehab for three months. That`s a six-month stint where, no, she can`t be making money. And you know what? The rest of her family that has been -- has been living off her are going to have to -- they`re going to have to take this seriously now, too, because that wasn`t fair. She was supporting them.

VELEZ-MITCHELL: It`s a victory. It`s a victory for blind justice. She shouldn`t be treated differently just because she`s a cute blonde who is a starlet. That`s not the way our justice system is supposed to work.

MARSHA N. REVEL, JUDGE: Defendant is ordered to spend 30 days in jail on the reckless driving case, 30 days in jail on the first DUI case consecutive, and 30 days in jail on the second DUI case consecutive. That`s 90 days in jail.

VELEZ-MITCHELL: You could see Lindsay Lohan as she was sentenced to jail say, "Oh, my God, what?" Lindsay Lohan breaks down in tears as her tough-as-nails judge sentenced her to 90 days in the slammer. Lindsay, weeping, insisted she had taken the judge`s order seriously. The judge didn`t buy it. Perhaps that`s because she had nine unexcused absences and a litany of excuses. She`s got two weeks to turn herself in.

Dee, Louisiana, your question or thought, ma`am?

CALLER: Hi, good evening. How are you doing?

VELEZ-MITCHELL: Good.

CALLER: My thing is this. Why did it take her to miss nine classes or nine visits for her to just finally say enough is enough? Secondly, her tears, I think they were sincere, but they were a little bit too late.

And I think, hopefully, from this, I would hope that she would get herself together because, see, she is young and she does have her life ahead of her.

VELEZ-MITCHELL: I agree with you, Dee. She`s only 24. But Vinnie, I agree with the caller, as well, that boy, it took them a long time just to get the schedule, hours of arguing before they just read a list that was very simple. They could have read it in five minutes at the start of the day.

POLITAN: Well, welcome to the wheels of justice, Jane. They turn very, very slowly sometimes. At the end of the day, this demonstrates to the folks at home and across this country what happens in our courtrooms every day, where criminal defendants are given opportunity after opportunity after opportunity.

And it`s finally when you`ve tested the judge`s patience enough that you finally end up getting a real sentence, and here she got real jail time. And my hopes tonight, Jane, are that she doesn`t meet some real mean girls when she`s in prison.

VELEZ-MITCHELL: Yes, and I`ve got to say...

KAVINOKY: Vinnie, spoken like a true prosecutor there. Wait a second. What about the legions of people who take the opportunity straight away to do the right about face, to get well in the face of addiction or alcoholism.

POLITAN: I don`t know. I didn`t meet them when I was a prosecutor, Darren.

BONADUCE: I didn`t meet them when I was a drug addict, Darren.

VELEZ-MITCHELL: One at a time. I`m bringing out the big gavel.

FULLER: I`ve some bad news, some bad news for you. You`re not going to be happy about this.

VELEZ-MITCHELL: OK.

FULLER: Apparently the sheriff -- the representative for the sheriff just came out and spoke to the press. And he said that it`s unlikely that Lindsay is actually going to do the full 90 days because of overcrowding.

VELEZ-MITCHELL: No!

FULLER: She may only do 25 percent of her sentence.

VELEZ-MITCHELL: That makes me so angry! That makes me so angry! You know what? I just want to pull my hair out in tufts when I hear that.

(CROSSTALK)

KAVINOKY: It doesn`t look so good. I tried it.

VELEZ-MITCHELL: Look, I was hoping that this would send a message that our system can be blind, our justice system. I have gone into these courtrooms covering these celebrity cases and gotten there early and seen defendant after defendant who is poor, minority, maybe has trouble speaking English, using a public defender, sent away to the slammer with just a couple of words between the judge and the lawyers, that the defendant doesn`t even understand.

And yet now they`re cutting her another break. There`s always an end run. "Forget about it, Jake. It`s Chinatown." Remember that line from the movie "Chinatown"? I say forget about it, Jake. It`s Hollywood. She`ll never get the justice that she needs to save her life.

VELEZ-MITCHELL: Breaking news. A shocking sentence for Lindsay Lohan after an explosive day in court; the troubled actress was sentenced to 90 days in the slammer. Lindsay has two weeks to turn herself in. The actress completely broke down, weeping, begging the judge to believe she had done everything in her power to respect the court`s order.

VELEZ-MITCHELL: That may be Lindsay`s finest performance in years. The judge didn`t buy it. Lindsay seemed shocked, stunned that she wasn`t being let off the hook. She said, "Oh, my God, what, what? Oh, my God." That`s what she said when she was sentenced.

But we`re not being mean here. We`re trying to say, hey, Lindsay needs this wake-up call, ok? She needs this wake-up call so that she can save her life, so she doesn`t become another statistic.

But now we`re learning -- and this is just in, just moments ago, that overcrowding in the L.A. jail system could let Lindsay off the hook again. And we just heard from Bonnie Fuller who said that somebody from law enforcement came out of the court and said she could get out in 25 days even though she`s just been sentenced to 90.

Danny Bonaduce, actor, radio host, knows Hollywood like the back of his hand.

I think this is a travesty. We just got justice. We just got a sentence and yet five minutes later they`re taking it back and saying she could be out in 25 days because of jail overcrowding. What the heck?

DANNY BONADUCE, RADIO TALK SHOW HOST: Well, I`ll tell you what the heck. This is kind of interesting because you just said a rich blonde girl is not going to get fair treatment like a poor indigent person would with a public defender. Am I the only one who remembers the very recent California scandal where the poor and public-defended people were sentenced to five years in jail and the sheriffs were escorting them to the back door and sending them on to skid row within hours?

The jails are in fact overcrowded. In any other sentence two for one is standard so she could be doing 22 1/2 days. This is fairly standard and nothing that special.

VELEZ-MITCHELL: Once again -- once again, I suggest everyone at home who thinks that poor indigent criminals get off easy go to "Mothers against Mandatory Minimum" to see how many young people who are caught with crack and this one was caught with cocaine -- she was under the influence of cocaine, Lindsay. But see how many poor caught with crack end up getting sentenced to life in prison. Ok.

BONADUCE: And when you find out how, many find out how many beds are in the California penal system and you will find out you are right, Jane. There are more people arrested every single day than we have beds for.

I would like Lindsay to go away and to go to jail for the whole six months. Don`t get me wrong. She`s a criminal and should have paid the price the last time she was in court. But the fact that California jail system is overcrowded is incredibly well-documented and two-for-one good time is also incredibly documented.

She is getting what she deserves as long as we can contain her. They can`t contain her in Los Angeles.

VELEZ-MITCHELL: All I can say is that I think this sentence is as good as it`s going to get in terms of saving her life. She has shown repeatedly -- she`s gone to rehab at least three times. It didn`t work. Rehab number four isn`t going to save her life. Being out there isn`t going to save her life.

BONADUCE: I agree with you.

VELEZ-MITCHELL: Going to jail and maybe she`ll attend some 12-step meetings behind bars. We pray -- it`s not to be nasty -- it`s to say, Lindsay, you need help.

VELEZ-MITCHELL: Did Kyron`s stepmom hire a landscaper to kill her husband? That is next.

But first here is my issue tonight. I`m mad about something else tonight.

How much more do we American taxpayers have to take from BP and the U.S. Government before we say enough with corruption, incompetence, laziness, arrogance and elitism? They`ve just told us that Americans, including journalists, cannot go within 65 feet of the so-called clean-up operations without risking jail and fines.

Now we`re learning BP was wildly -- and I mean wildly inaccurate about the amount of oil it could skim from the water. BP said it could skim and remove almost 500,000 barrels a day but in reality they`ve skimmed on average less than 900 barrels a day; 500,000 promised -- 900 delivered.

Turns out most of the oil removed has been burned, sometimes with turtles trapped in there, not skimmed or just sucked right out of the explosion site.

You know, there`s another word for that kind of discrepancy. Let`s see. What is it, what is it? What`s that other word? Lying. That`s my issue tonight.

Also tonight, wild and crazy -- and I mean crazy, crazy drama in the disappearance of little Kyron Horman. Even as the entire nation hoped and prayed the adorable 7-year-old would be found alive, his stepmom Terri Horman was allegedly meeting with a hit man to have her husband, Kyron`s dad, murdered.

The big question tonight, did Terri Horman hate her husband enough to have something to do with little Kyron`s disappearance? Here they are, Terri and Kaine Horman holding each other tight in the days after little Kyron vanished on Terri`s watch, I might add.

But Terry allegedly told the would-be hit man that she was in a bad marriage and that she thought her husband was cheating on her with somebody at work. Kyron vanished June 4th from his school. Terri Horman was the last known person to see him.

When cops told Kaine Horman about the alleged plot by his wife to murder him, he packed up their 19-month-old daughter and moved out. Who wouldn`t? Two days later Terri was slapped with divorce and a restraining statement. Now Terri cannot even come near her own children

The family wants to keep the focus on finding Kyron but all this family drama certainly is not happening. And the big question remains could Kyron still be alive? .

Terri Horman, the stepmom, still has not been named a suspect or a person of interest. But with all this stunning new information, could an arrest be imminent? And you thought this story couldn`t get any wilder?

Straight out to my fantastic expert panel, but we begin with investigative reporter Michelle Sigona. Michelle, tell us this astounding story of this landscaper and this alleged murder-for-hire plot.

MICHELLE SIGONA, INVESTIGATIVE REPORTER: Well, it was on the fourth of July when "The Oregonian" had actually broke a report that stated there was a landscaper that was possibly hired by the family and that particular landscaper was approached by Terri Moulton Horman allegedly and was asked and was possibly presented with a large sum of money and asked to kill Kaine Horman. This was six or seven months as you mentioned prior to Kyron going missing.

This information allegedly was brought to Kaine from the sheriff`s department. And the sheriff`s department and that`s when possibly the divorce proceedings were presented and also the restraining order granted. So there`s a lot of information within a short amount of time over this holiday.

In addition, the family did speak out yesterday and did address a lot of questions and answers. We also did learn that other family members have in fact taken a lie detector test and that at this particular time they`ll do whatever is necessary to be able to try to find their child.

VELEZ-MITCHELL: Ok. KGWTV reports Terri Horman actually posted an ad in the newspaper about needing a landscaper and may have allegedly tried to hire other hit men. They report her ad said she was looking for someone to clean up a medium sized yard? Was that code for something else like, "Hey can you come and clean up my medium-sized life and get rid of my medium- sized husband?

One Portland landscaper who answered Horman`s add is Zach Gallinger. In an ISSUES exclusive, Zach joins us right now. Zach thanks so much for coming on.

What do you think Terri was looking for? Tell us everything you know from the ad on; what was the ad like? What did you do?

ZACH GALLINGER, LANDSCAPER CONTACTED BY TERRI HORMAN: I received the information on April 27th through a lead generation service that I use and I acted on the lead the next day, left a voicemail for Terri. I understood that she needed a yard clean-up of a medium sized yard. And I left a voicemail and then I followed that up with an e-mail and never heard anything back.

I tried again the next week and still nothing and then just counted it as a dead lead and left it alone.

VELEZ-MITCHELL: Well, you`re probably lucky that she didn`t call you back. I understand you did speak with investigators. What was that like? What happened there?

GALLINGER: About two weeks ago I got contacted by the Portland Police Department and they wanted to know how I was connected to the Horman case. I was pretty interested as well since I didn`t know that I was connected. I was able to find out that they were in my lead book and Terri had requested services -- landscape services back in April.

I relayed that to the investigator and figured it was a closed loop. It didn`t seem like anything important at the time, just a detective doing a due diligence. Then about yesterday I learned about the alleged hit job.

VELEZ-MITCHELL: What`s really fascinating is that apparently this all started before little Kyron disappeared. But then after he disappeared and the original landscaper called police and said, "Hey, you know, this is purportedly what she asked me to do," they put a wire on him.

And then just a week ago Saturday, he went and met purportedly with Terri and an undercover cop and they tried to take the conversation but she became suspicious and ended the conversation.

Quickly, I only have about ten seconds. You`re thought on all of that, Zach.

GALLINGER: Well, I would think that if you -- if I was approached in that situation I would definitely go to the police right away and that would in my estimation would give you the best chances of catching somebody in the act, not six months later.

And I -- I wish that that gentleman had come forward sooner regardless if there is a missing child or not. It would just be the right thing to do.

VELEZ-MITCHELL: Yes, well, that`s a very good point because it all started before little Kyron went missing and if he had maybe they could have done something about the situation in that family before the child disappeared.

VELEZ-MITCHELL: Kyron Horman`s stepmother once again steals the headlines away from little Kyron who is missing by allegedly trying to hire a hit man to kill her husband. It`s exactly what Kyron`s parents don`t want to happen. They want the attention to stay on finding Kyron.

Jim in Oregon, thanks for your patience, your question or thoughts, sir?

JIM IN OREGON: Yes, I just find it really strange that Terri Horman, the stepmother, originally was a friend of the family and came in as a caregiver when the mother was sick. She ends up stealing the husband away and now six years later she thinks he`s having an affair so she tries to have him killed. And the lady is a loon.

VELEZ-MITCHELL: Well, when you say the word loon, I always think of Dr. Dale Archer, psychiatrist. But I have to say we attempted to reach Terri Horman`s attorney and we also attempted to reach authority -- authorities about these published reports and we haven`t heard back.

Terri and her attorney have a standing invitation to come on this show and tell their side. We want to be fair.

Dr. Dale Archer, here is my big issue tonight. Target Kaine. If Terri Horman hated her husband enough to allegedly hire a hit man, could -- and I say could hypothetically speaking -- the ultimate revenge be harming his beloved son Kyron? I mean, you could imagine this woman is home with three kids and thinking her husband is cheating which has never been proved. And the pressure builds.

What about this theory, Dr. Dale that the best way to get back at your spouse is to kill the progeny?

DR. DALE ARCHER, PSYCHIATRIST: Yes, I think that`s a possibility. And you know, murder for hire is the worst crime imaginable. I think all of us can understand murder that takes place as a crime of passion in the heat of the moment, you lose your temper and you go too far.

But in murder for hire you`ve got to decide who do you trust to get to do it, how do they do it, where are you going to be when it happens? How do you keep from getting caught? And you`re thinking about all this with somebody you have a relationship with.

So I think anyone who does it is pure unadulterated evil and I think anyone who would do that then, any heinous crime you can imagine would be on the table and of course if that failed --

VELEZ-MITCHELL: Ok.

ARCHER: -- as it sounds like it did --

VELEZ-MITCHELL: Yes.

ARCHER: -- then going after the son could have been an easier option.

VELEZ-MITCHELL: Rod Wheeler, you`re the former homicide detective. Why is she still not listed as a suspect or even a person of interest and there has been absolutely no arrest here?

ROD WHEELER, FORMER DC HOMICIDE DETECTIVE: Well, that`s an excellent question, Jane. First of all she is a person of interest even though the cops may have not said that. But it`s important that we don`t jump to so many conclusions. I`ve heard so many conclusions and all these investigators out there with their theories.

The point here Jane with this case is that we have to still focus on the fact that Kyron still may be alive. And you have to focus on the fact where could he be and whether or not, if Terri did something to this child, who worked with her? Because whatever happened to this kid, Terri didn`t do it by herself.

So I think it`s important that we look at the big picture and not so much develop what we call tunnel vision and only focus on Terri.

VELEZ-MITCHELL: Ok, a reporter confronted the local sheriff over the weekend and the sheriff made it sound like something big is about to happen in case. Let`s listen and then analyze.

STATON: I have to make a lot of decisions this coming week. And so it`s going to be based on what the briefings are and what comes out of the course of the investigation between now and the end of this coming week.

VELEZ-MITCHELL: Pat Brown, read between the lines. What is the sheriff waiting for?

PAT BROWN: Well, I think that Jane, that he`s deciding whether to make an arrest of Terri Horman. I think he`s trying to figure out he`s got a probable cause to do it; whether all this information and all of this stuff he`s got going is actually enough without a body of the child or actually knowing what happened to him. I think that`s what we`re really waiting for.

I want to comment on the caller. It`s very confusing when you see behavior like this. She`s not a loon. If she actually did knock off her stepson or do something to him and then she did have a murder-for-hire for her husband and we`re seeing a psychopathy all over the place here. Even back to when she took the child into her life. She might have been looking for attention.

Let me care take of the baby, look at me, I`m taking -- doing this and then she, you know when she gets fed up with her husband or she`s annoyed with him that`s something else she wants to do.

Maybe she wants to get rid of the son because she wants to be in a big "CSI" drama because she loves "CSI".

We don`t really know because psychopaths have lots of reasons for doing things and they`re not always the reasons we would pick.

WHEELER: Pat, even that`s probable cause, though.

VELEZ-MITCHELL: Mark Eiglarsh -- Mark Eiglarsh her --

MARK EIGLARSH, DEFENSE ATTORNEY: Yes.

VELEZ-MITCHELL: She`s now lawyered up and presumably her attorney has said not talk, do not talk. But that`s also another way of saying don`t cooperate with authorities. I mean, if she`s innocent maybe she should talk and clear up this mess.

EIGLARSH: Not necessarily. There are plenty of people for many reasons who choose to get an attorney, which I recommend, when law enforcement comes a-knocking. And that`s what I recommend.

Let me say this. Merely because they`re not calling her a suspect doesn`t mean anything. She is the only one I think on the number one spot on their radar. She has every reason to get an attorney by her side. I told you last week that there is probably more to this, that it wasn`t just about her child -- that the child gone missing, that she was probably lying for some other reason.

And if this is true -- and we don`t know that it is -- but if it`s true obviously there`s murder for hire plot as to reasons why she might be lying.

VELEZ-MITCHELL: Nancy in Pennsylvania, your question or thought, ma`am?

NANCY, PENNYSYLVANIA (via telephone): Yes, Jane. I have a theory. I actually think that the reason that Terri Horman is involved in all of this -- but we know the thing about she did this contract for hire for her husband.

VELEZ-MITCHELL: Yes.

NANCY: Maybe she hired someone to kidnap Kyron to use him as a pawn you know just in case things didn`t work out one way that she would have some kind of leverage.

Whatever she`s doing this for is for her own, you know, selfish interest. And if you even check out her body language, there`s no real concern for him or even for her husband or the other one, you know.

VELEZ-MITCHELL: All right, Dr. Dale Archer, I`m going to give you the last word on this. We only have 20 seconds.

DR. DALE ARCHER, CLINICAL PSYCHIATRIST: Well, I think that we have to think in terms of options here. And if she was trying to get at the husband and the murder-for-hire failed, the option of taking the little boy is something she could have done on her own. She didn`t need help for that. So that needs to be considered strongly.

VELEZ-MITCHELL: Yes, absolutely.

And once again, she is not, officially, considered a person of interest and she is invited on our show or her attorney to explain her side anytime she likes.

EIGLARSH: Jane, come on.

From one missing child to another, a beautiful little girl snatched from her front yard. We`re going to try to help find this child, next.

VELEZ-MITCHELL: Tonight, breaking news in the frantic search for 4- year-old Alisa Maier who was snatched right from her own front yard. Cops in the town of Louisiana, Missouri, say little Alisa was playing with her 5- or 6-year-old brother last night when a black car pulled up, a man got out and took off with this precious little child. Sickening.

MARY FOILES, ALIAS MAIER`S GREAT-GRANDMOTHER: Trusting little girl and she might have just got in the car with him. She`s so sweet-natured. I can`t picture anybody wanting to hurt some sweet little baby like that.

VELEZ-MITCHELL: Meantime, cops say it was Alisa`s brother who witnessed the terrifying ordeal and gave them critical details. She described the car as black, four-door, probably a convertible with tinted windows. He also said the man who abducted his sister was thin.

As for Alisa`s mom, a neighbor says she made a desperate attempt to chase down that car by jumping into her van and going in the direction her son pointed. As we speak, police are combing local surveillance video and asking for the public`s help, any tips.

Straight out to Michelle Sigona with michellesigona.com; what is the very latest? How can we find this child?

SIGONA: Well, I just received another e-mail from Rebecca Voo (ph); she`s with the FBI. And she says that they`ve received dozens of tips. They`re still on the ground right now. I`ve also talked with the local authorities and other FBI agents on the ground there today.

There`s a command post set up, Jane, and they are fielding the tips through there. At the local elks lodge there in Louisiana, what they`re doing is they have a search area set up. So there`s about 130 volunteers on the ground. They`re passing out flyers, they`re going door to door. They`re trying to obtain any kind of information --

VELEZ-MITCHELL: Did they issue an Amber Alert so that everybody in America is looking for this car?

SIGONA: Everyone right now is looking --

VELEZ-MITCHELL: This is near the Illinois/Missouri border.

SIGONA: It is. It`s near there.

VELEZ-MITCHELL: It could be Illinois, it could be Missouri. Tell us? Yes, an Amber Alert?

SIGONA: It could be, yes. And also, it`s very close to Highway 79, just a few blocks away. This is the North Carolina street within this particular small town; there`s only about 4,000 people that live there. And so if someone -- if this car did, in fact, pull up in front of this child`s home and put her in it, it could have easily jumped on the highway and be in another state by now.

VELEZ-MITCHELL: I`m also joined right now on the phone by the Maier family neighbor, Anita McKlevis. Anita, thank you so much for coming on.

This has got to be heart wrenching for all of you. You saw little Alisa`s mom give chase after this car with her precious daughter inside took off. Tell us what you saw.

ANITA MCKLEVIS, NEIGHBOR OF MAIER FAMILY: Well, I came around the corner and the poor lady was sitting on the curb, with another neighbor with her hand on her shoulder. She was just beside herself. You know, this is before the police even got there yet. It just happened.

And she jumped up and went across the street, got her car keys and got into her van and took off towards the way, apparently the way the vehicle went. She was just upset. And it`s really a shame, because these people here in this little town we have here is great. And I never see this little girl without her parents.

VELEZ-MITCHELL: Yes, well, she was playing right outside, the parents were inside. All they had to do was look away for a second and some sicko has her now.

I know you`re near the Illinois/Missouri border. I hope everyone in this area of the nation is looking at this child`s picture and looking at that vehicle description.

Once again, Michelle Sigona, tell us everything you know about this suspect, so people can look for him.

SIGONA: Absolutely. He is described as being late teens to early 20s, Jane. He has curly hair; he`s a white male. There`s possible damage to the front and the rear of the vehicle.

VELEZ-MITCHELL: All right. Look for this child with a thin white male with curly hair in a vehicle that may be a convertible with damage to it. We`ve got to find her; Illinois or Missouri.
