Audio Captures Mel Gibson`s Tirade

NANCY GRACE, HOST: Breaking news tonight. Hollywood superstar Mel Gibson under police criminal investigation. After years of racist, sexist, anti-Semitic hate talk, a DUI arrest, divorce, scandal and bitter custody disputes, Mel Gibson tonight under investigation for the brutal beating of a Russian singer, the mother of their 8-month-old baby girl.
An emergency restraining order claims Mel Gibson repeatedly punches Oksana Grigorieva, leaving her with two black eyes, knocking out teeth, and leaving her with a concussion. There are photos! Not only that, Gibson hurling more racist, sexist remarks and threats. It`s all caught on tape. Reports Gibson even admits to the attack saying she, quote, "deserved it."
Bombshell tonight. We obtain more newly released alleged Mel Gibson audio. It is stunning! Or is "sickening" a better word? Mel Gibson actually threatening to murder his singer girlfriend, saying she, quote, "needs a bat to the side of the head" and he will, quote, "put her in the F-ing rose garden." That`s the grave, people! The rose garden is the grave. Then calling her a sexual slur so disgusting, I will not repeat it on air in good conscience.
Gibson allegedly threatening to drive over, and only relents when Grigorieva says she will call police. Gibson ranting, raving, screaming to the point he can barely breathe, dropping the C-word and the F-word so many times, I stopped counting. Tonight, police say they want the tapes. Hey, LAPD, what are you waiting on? You worried he`s a big star? You think Lady Justice cares? No!

GRACE: So many people across this country have had such great respect for Mel Gibson over the years. Then there was the DUI. Then there was the sexual slur on a lady police officer. A lot of people chose to look the other way. He came out with "The Passion of the Christ." He -- when Hollywood wouldn`t have anything to do with it, he did it all on his own.
This guy is not crazy. But to listen to this tape, you`d think he was. Take a listen.

GRACE: I listened to the entire audio that I know of, the full eight minutes. It`s being released to the public tiny bit by tiny bit. It is so disgusting, I finally quit counting how many F-bombs and C- bombs he dropped on this one phone call alone.

He threatened to put her in the F-ing rose garden, which is the cemetery. There were so many sexual slurs and threats. He threatens to drive over there. And then he only relents when she says she`s calling the cops. What else is on the tapes?
ALEXIS TERESZCUK, RADARONLINE.COM: It is the most vile, abusive thing that you have ever heard. He confirms the claims that -- she says, I was holding a child and you were hitting me. And he says, You F-ing deserved it. He is insanely furious. As you said, he can`t even breathe, he gets so mad at her. He says that she doesn`t deserve him, that he made her career. He said that he will ruin her. He does everything he can to make her terrified for her life.

It goes on and on. You`re seeing a transcription of new audiotapes from Radaronline allegedly showing Mel Gibson`s verbal abuse and threats against his girlfriend, the mother of their 8-month-old baby girl. He goes on to make actual death threats on Oksana Grigorieva.
And what I don`t understand is what the LA sheriff`s office is waiting on. What are they waiting on? Back to you, Tereszcuk. What are they waiting on?
TERESZCUK: Well, they`ve actually subpoenaed a DVD which has the tapes on it. The DVD is the property of the court right now. It`s part of Mel and Oksana`s custody battle. They -- she had given it to them, but she`s also given it to investigators already. So we think that she -- they have all the information they need. They have the evidence. So we expect them to be taking action very quickly.
GRACE: Very quickly. Well, you know, I first started reporting on this last week. So Alexis Tereszcuk, I don`t know what your interpretation of "quickly" is, but if I knew about it last week -- of course, I`m getting more of it tonight in the last hours. More has been released. But if I knew about that portion last week, certainly, LA County sheriffs knew about it before I did, or I would hope so.
Out to you Ellie Jostad. What are the exact threats that we know about? We were not allowed to play all of them tonight yet...
ELLIE JOSTAD, NANCY GRACE PRODUCER: Right.
GRACE: ... but we`re playing what we can. Go ahead, Ellie. What do we know?
JOSTAD: Right, Nancy. Well, the threats we know about are the bat against the side of the head. He makes repeated threats that he`s going to come over to the house. He`s clearly very angry. You could argue there`s an implied threat there. There`s the rose garden threat, which you mentioned...
GRACE: Ellie? Ellie, Ellie...
JOSTAD: Yes?
GRACE: You`ve heard the audio, as I have, right?
JOSTAD: Right.
GRACE: It sounds like he`s hyperventilating, and he does it for, like, eight minutes. He sounds like a crazy person!
JOSTAD: Yes.
GRACE: What we`ve been allowed to play so far, you don`t really get the whole flavor. It sounds like a monster of some sort...
JOSTAD: Right.
GRACE: ... on the other end of the line. He can hardly breathe, he`s screaming and ranting and raving. He sounds like he`s frothing at the mouth.
JOSTAD: Well, and that`s what a lot of people are talking about now that have heard this tape. And CNN can`t confirm it`s Mel Gibson on this tape. He hasn`t commented about it. But the demeanor of the man on this tape is very terrifying. There`s parts where he just isn`t even talking for 30 seconds or so, he`s panting, trying to catch his breath, so out of breath from the screaming on this tape.
GRACE: To Cher in Texas. Hi, Cher. What`s your question?
UNIDENTIFIED FEMALE: Hi, Nancy. I love you so much. Very quickly, this man is a monster. I will admit to that. However, let me ask you. She leaked these audiotapes out to Radar? OK, is that admissible if he is not -- if he does not know that he`s being taped?
GRACE: Unleash the lawyers -- Susan Moss, Peter Elikann, Joey Jackson. Cher has a good point. But Sue Moss, as it was brought up earlier, if this is a two-party consent state -- in other words, both parties have to consent to being taped before it`s allowed in -- I don`t think that`s going to apply in a case where it`s a terroristic threat.
SUSAN MOSS, FAMILY LAW ATTORNEY: Well, there is a two-party consent rule in California, but there is an exception to that rule if it has to do with criminal activity. Domestic violence, assault with a deadly weapon, child endangerment -- these all are crimes. His film should have been called "Depraved Heart."

CARLOS DIAZ, SYNDICATED RADIO HOST, JOURNALIST: You know, I tell you what. We`ve heard the tapes of other stars going off -- Alec Baldwin, Christian Bale. Just when you think it couldn`t get any worse, listening to this eight minutes -- and I agree with you whole-heartedly, Nancy. When you listen to this eight minutes, you almost can`t listen to the entire eight minutes.
And let`s talk about some math here. If this went down on January 6th that he allegedly hit her while she was holding the baby -- this baby is eight months old at this time. So January 6th puts the baby at being a newborn. If she`s holding the baby while he`s allegedly hitting her, the baby is brand-new.
And also on the tape, He says the last three years have been a gravy train for you. Well, hold up. He just got divorced last year. So are you saying you`ve known her for three years? Has there been a relationship for three years?
There are so many things -- I mean, just forget about the fact that he uses the C-word like it`s the word "the" in this and the fact that he insults her constantly. Do the math in this, and he is implicating himself on several different occasions on this eight-minute rant.

Out to Peter Elikann, defense attorney and author of "Superpredators." Peter, in my mind, this at least goes to the level of terroristic threat. He threatens to put her in the cemetery with a bat up against her head, Peter. What`s the problem? What`s LA County sheriffs waiting on?
PETER ELIKANN, DEFENSE ATTORNEY: You know, I am surprised about this, Nancy. Even though I`m a defense counsel, normally, if one of my clients was on tape making a threat or admitting to an assault and battery, they`d probably be arrested within about, I don`t know, 20 minutes, 45 minutes, something like that.
I`m not quite sure what they`re waiting for, if they`re waiting to validate -- maybe they want to see if it`s definitely his voice and they need to validate that. Maybe there`s some other things they`re looking at. But this is unusual. Normally, they make the arrest. They just can`t take the risk of this woman`s safety.
GRACE: To Joey Jackson, defense attorney joining us out of New York. What`s the holdup with LA County sheriffs? Because Mel Gibson`s a big star?
JOEY JACKSON, DEFENSE ATTORNEY: No, Nancy, I don`t think it`s that at all. Look, the motivation is as follows. This happened January 6th. There were no reports or anything like that filed. They want to make sure the motives are pure. Now she`s in the middle of a custody dispute.

JACKSON: There`s a custody battle...

GRACE: As I was getting ready for the show tonight, we all got in a big huge argument. Let me say discussion to put it euphemistically about whether he`s crazy. But think about it.
Let`s go out to Janet Taylor, psychiatrist and medical doctor.
Dr. Taylor, this is a guy that when Hollywood said no to his movie, "Passion of the Christ," no studio would touch it. He took it on his own and built up such a huge grassroots movement that it became a huge blockbuster. He did that all on his own.
This guy is not crazy.
DR. JANET TAYLOR, PSYCHIATRIST: Well, I agree. I mean clearly he`s persuasive, he knows how to control people, he`s impulsive. What we do know is that he has a history of alcohol treatment. To imply that he has a psychotic disorder I think would probably be letting him off the hook.
He`s abusive and he wants to get his way and clearly he will stop at no boundaries before doing that.
GRACE: Lorie in Minnesota, hi, Lorie.
LORIE, CALLER FROM MINNESOTA: Hi, Nancy.
GRACE: Hi, dear. What`s your question.
LORIE: Hi, Nancy. I was wondering if there`s ever been any case of -- they have any animals in their house. Has there been any case of animal abuse in that family?
GRACE: Hmm, now that`s not anything that occurred to me just off the top of my head. My gut reaction was not, is there animal abuse since he is threatening to kill a woman. But I`ll throw it to you, Alexis Tereszcuk.
Animal abuse?
ALEXIS TERESZCUK, REPORTER, RADAROLINE.COM: We haven`t heard of any animal abuse, but he acts like an animal when he`s threatening his wife. I mean he`s -- he`s abusing her. He hit her twice. He`s threatening to kill her. He`s saying that she`s going to get raped. I mean he is doing -- he is an animal in this situation.
GRACE: Well, I want to go back to Ellie Jostad.
You cannot just throw this off, Ellie. You`re telling me she went to the dentist and she told a dentist that Mel Gibson -- the Mel Gibson -- had knocked her teeth out. Isn`t it the dentist or like a doctor`s duty they`ve got to report even the suggestion of abuse?
ELLIE JOSTAD, NANCY GRACE CHIEF EDITORIAL PRODUCER: Well, that is what TMZ is reporting that this could be a problem, that the dentist allegedly never reported this, never informed the authorities about it. But that if this is true that the dentist could be a key witness in this case. So we know that the police are investigating, hopefully they`re talking to this person.

KAREN, CALLER FROM CALIFORNIA: Hi, Nancy. I just have a comment and a question. Don`t you really find this ironic? This Mel Gibson, he picks up with this young girl after leaving his wife of many years. Probably picks her up for the very qualities he picks up with her for the very qualities that he`s ranting about her now? That he`s finding disfavorable. Her breasts, her youth to the way she dresses.
This is all probably what he found very appealing to flatter his huge ego at the time.
GRACE: What about it? Back to you, Dr. Janet Taylor. The very things that attract you to somebody can then disgust you?
TAYLOR: Well, absolutely. But think about this, he hasn`t had any real star power. He`s projecting his fears on to her that she will be attractive to someone else. It really suggests how insecure he feels, which is why he`s making her life so miserable.

To Marvet Britto, PR brand strategist at the Britto Agency. I -- at this point, I`m not all wondering what`s going to happen to his reputation. I`m wondering what`s going to happen to the reputation of the L.A. County sheriff for not making an arrest.
MARVET BRITTO, PR/BRAND STRATEGIST, PRESIDENT, THE BRITTO AGENCY: Absolutely. I agree. I mean this is very damaging because we`re hearing a first-person account of a very angry Mel Gibson. And I think that this sends the wrong message that it`s really taken this long to hold him accountable for the threats that he`s making.
It`s very damaging. I think the last thing anyone is thinking about is the restoration of his career. We`re just really thinking about the anger and the fact that there must be deep-rooted issues really fueling Mel Gibson`s tyrants and his racially charged, you know, outbursts really need to be addressed.
GRACE: To Bill Majeski, former NYPD detective, now at Majeski Associates, Inc. out of New York.
Bill, what did they have to do to ensure that this is Mel Gibson?
BILL MAJESKI, FMR. NYPD DETECTIVE, MAJESKI ASSOCIATES, INC.: Well, they can do a voiceprint. They can do conversations with her, interviewing her, and finding out exactly what precipitated this telephone conversation.
They`re going to be doing a whole host of things in their investigative process. They`re going to be talking to the dentist, they`re going to be talking to neighbors. They`re going to be interviewing people.
If this happened six months ago, somebody else had to see it other than the dentist. If she was walking around with two black eyes, people witnessed that. So the police are right now conducting an intensive investigation to find out what kind of witnesses are out there, to prove the allegations that she`s making.
And at this point, I`m not so sure that she made a complaint to the police. If she`s willing to press charges at this point. Clearly in January, she was not. So hopefully at this point in time, she is willing to press charges.
GRACE: Right.
MAJESKI: And then they should go out and arrest him.
GRACE: But -- back to you, Ellie Jostad, he`s not saying it`s not him. Isn`t his -- aren`t his lawyers PO`ed that it`s been released somehow, that it`s leaked?
JOSTAD: Right. Well -- and here`s the thing, Nancy. All of the documents in this custody battle that they`ve been having for a while now, all of them have been sealed. But we`re hearing reports that he got a restraining order against her. Not a protective order, but a restraining order that would prevent the release of the tapes.
GRACE: OK. Run that by me one more time. What about the restraining order?
JOSTAD: Right. Well, there are reports, Nancy, that Mel Gibson got a restraining order against Oksana Grigorieva, but his restraining order was specifically to prevent her from releasing these tapes. Now she denies releasing them, but they believe that the tapes came from her.
GRACE: Well, by him being angry or the lawyers anyway trying to stop her from releasing them, that says to me, Susan Moss, that he`s not even suggesting they`re not him. He just doesn`t want them released.
SUSAN MOSS, FAMILY LAW ATTORNEY & CHILD ADVOCATE: Absolutely. So much for not promising her a rose garden. Apparently he promised her one, but it was a gravesite. What`s his next case -- what`s his next film? "Really Mad Max?"
GRACE: What about it, Peter Elikann? The fact that they are challenging the release. They`re angry, they don`t want these to be released. They`re not saying it`s not me.
Elikann?
PETER ELIKANN, DEFENSE ATTORNEY, AUTHOR OF "SUPERPREDATORS": Well, that`s true. I mean if there -- yes, if there was -- if the judge ordered that they not be released and she -- I know she`d denied it. If she did release them, though, she would be in contempt of court.
And she`s got some legal issues on her own. But they`re not the biggest legal issues in the world.
And you`re right, I haven`t heard anybody yet deny it`s him. And I figured that would be one of the main defenses if you -- that you would bring up immediately if -- among other defenses.
GRACE: What about it, Joey Jackson?
JOEY JACKSON, DEFENSE ATTORNEY: Obviously the tapes are prejudicial, Nancy. As a result of that, of course, it devastates him. I mean they`re going to have to argue that these are empty rants that essentially he was just outraged.
GRACE: That`s not what I asked you.
JACKSON: He has lost it. And all the --
GRACE: Jackson.
JACKSON: Yes, ma`am.
GRACE: I asked you by his attorneys trying to stop the release of these tapes that in no way suggest that they are contesting the validity or the authenticity of the tapes.
JACKSON: Exactly. It`s acquiescence.
GRACE: They`re just trying to suppress them.
JACKSON: Well, I --
GRACE: In other words, they`re saying it`s him.
JACKSON: I would agree. It`s acquiescence and they`re already on to the next step as to what we do in the -- now that they are released, they`re going to have to exercise some other damage control, but I would agree with that, Nancy, that as a result of them not denying it, they are accepting the fact it`s him and now they`ll have to deal with it.
GRACE: To Dr. Marty Makary, the force it would require to knock several teeth out of her mouth. Comment.
DR. MARTY MAKARY, PHYSICIAN, PROF. OF PUBLIC HEALTH, JOHNS HOPKINS: Well, first of all, you can tell for a long time that the injuries to a tooth what force was applied, whether or not it was a fall. Those injuries are going to be there for a long time. And the person now has an opportunity to get a second opinion.

GRACE: Hi, Miss Pam, what`s your question?
PAM: My question is, has he ever went for any anger counseling or violence counseling --
GRACE: That`s a good question. Because after the last DUI, Pam in Mississippi, where he verbally attacked a lady cop.
To you, Alexis Tereszcuk, did he get -- was there any court-ordered anger management counseling last time?
TERESZCUK: You know, Nancy, I believe there was. I`m not 100 percent sure of this, but I believe he actually did have to go through a class that was part of his probation. He didn`t serve any jail time or anything like that for fighting with the police officers, as you (INAUDIBLE), or even getting the DUI.
But I do believe he did have to do some classes. I would want to double check on that, but I`m pretty sure that the caller`s right that he did have to do some.
GRACE: What about it, Ellie?
JOSTAD: It`s my understanding as well, Nancy. But -- another thing that everybody should -- has been talking about, too, is that back when Mel got that DUI back in 2006, he said that he was getting some sort of outpatient treatment for his alleged alcoholism.
He didn`t go to a rehab like we see other people go to like a (INAUDIBLE) or a Betty Ford Clinic. It was all outpatient.
GRACE: I want go to back to Alexis Tereszcuk, where is he right now?
TERESZCUK: Actually, Nancy, last week we learned that Mel Gibson had been filming a movie in New York. He was there in the morning and then halfway through the day they canceled filming for the rest of the day.
And our sources had said that he was -- they overheard him. They couldn`t exactly hear what he was saying, but he seemed very upset on the set. So when all this news broke, it was very upsetting for him.
And he was -- they canceled filming for the rest of the day. So he may possibly be still in New York and be working. That might be why he`s not being questioned by the Los Angeles Sheriff`s department in California. They may not want to go to New York to talk with him and they may be waiting for him to come back to California.
GRACE: Out to the lines, Karen in Maryland. Hi, dear.
KAREN, CALLER FROM MARYLAND: Hi.
GRACE: Hi.
KAREN: I would like to know if Mel Gibson had a history of abusing his first wife and family.
GRACE: What do we know about that, Carlos Diaz?
CARLOS DIAZ, SYNDICATED RADIO HOST, JOURNALIST, COVERING STORY: You know, they were married for almost 30 years. And that`s the thing. You know, you haven`t heard too much from Robin, his ex-wife. And she`s got to be listening to this tape saying to herself if she`s heard this before.
She never came forward. She never had tapes of this. We never heard about this side of Mel Gibson until 2006 when he was pulled over by cops in Malibu. That`s why it was so jarring at the time. But you look back at what happened that time after he had the run-in with the cops.
He went on every talk show he could to talk about how he, you know, is a better person now. He has changed. So that`s why it`s going to be increasingly hard for him to try to, you know, put together a career after this because we`ve heard it all before.
We`ve heard him say, oh, I`ve learned from my mistakes. And now not only has he offended Jews, he`s offended Hispanics. He`s offended African-Americans, and most of all, he`s offended women by going after his ex-girlfriend in this manner.
GRACE: Well, you know what I find interesting, Susan Moss, is that everybody`s more concerned about his various slurs. He slurs everybody there is. They less concerned by the fact that he hit her and basically admits to it on tape.
He punched her. She got a concussion. Teeth knocked out of her mouth, two black eyes according to what we are hearing on the audio. That concerns me.
MOSS: How about the fact that he beat up this girl when she was holding the baby. This poor little innocent child. That is when her teeth were broken by his fists. I mean, when a woman takes a punch from a large man while holding a baby, it`s only a miracle that she didn`t drop this kid. Apparently he knows the meaning of lethal weapon.
GRACE: To Rosemary in Arizona. Hi, Rosemary.
ROSEMARY, CALLER FROM ARIZONA: Yes, Nancy, I have a comment and a question also. First the question is, if the tapes aren`t supposed to be let out, if she`s not supposed to do that, how is she supposed to protect herself?
And my comment is that I don`t think any decent person would have such a filthy mouth -- just such a filthy mouth and would ever hit a woman.
GRACE: Well, you know, it`s not just his filthy mouth, Rosemary in Arizona, that`s him in the background wheezing and hyperventilating. He sounds so angry. He found -- he sounds like he can`t even breathe. He can`t get the threats out fast enough.
To you, Dr. Janet Taylor. What does it indicate to you?
TAYLOR: Well, clearly, I mean, he was exasperated, he was angry. But what women should understand is if they are in a domestic violent situation, get out. Get away, call the police. Do not stand there and take that.
And certainly if someone says they`re going to hurt you or kill you, they probably will. So get out of the situation.
GRACE: I want to go back to Marvet Britto. What is his best strategy right now?
BRITTO: I think his best strategy is really to come forward and be clear about the problems. Whatever`s fueling this really needs to be addressed. As we`ve all said, this is a habitual behavior that we`re seeing displayed time and time again. So him coming forward apologizing isn`t going to work. We really need to know that he`s dealing with these deep-rooted issues.

GRACE: To Dr. Marty Makary, physician and professor of public health at Johns Hopkins, joining us out of D.C. tonight.
Dr. Makary, isn`t it true that dentists are bound by the same duty that doctors are? When you see physical abuse on a patient, you have to report it?
MAKARY: Well, you know, that`s only true in California, but that, of course, is where this happened. In California there`s a law that says that any health provider -- dentist and doctor included -- has to report anything that`s abusive to a cohabitant or to a spouse.
And that`s to the authorities. The authorities may just document it. They may just be aware of it. Or they may start an investigation, which is what happened here.
GRACE: I mean, even schoolteachers that notice or suspect abuse on a child, they are bound by the law to report it. This dentist did nothing.
Out to Rosemary in Arizona. Hi, Rosemary.
ROSEMARY, CALLER FROM ARIZONA: Hey, Nancy. I just want to tell you, I love your show. But I wanted to ask the psychologist, do -- what do they think about Mel`s facial expressions when he`s doing interviews? He`s had like a lot of quirks. He looks angry a lot. His eyes are always darting around.
GRACE: You know that`s really interesting. To Dr. Janet Taylor, have you noticed that?
TAYLOR: You know, I haven`t noticing thing in these interviews that would indicate that what we`ve seen recently was how he treated Oksana. Now I mean he`s an actor and I think he has a lot of expressions. But a lot of actors have those expressions.
GRACE: Well, you know, another caller called in, Peter Elikann, and was wondering if there had been abuse claims by the wife of all those years. You know if you don`t know a horse, look at his track record, right?
ELIKANN: Right, yes. I guess we`re going to have to look into that to see. Certainly that would be damaging if they came up with prior previous allegations of abuse.
