Lindsay Lohan Released From Jail, Goes to Rehab; Missing Teen Found Alive

JANE VELEZ-MITCHELL, HOST (voice-over): Tonight, Lindsay Lohan waltzes out of the slammer and straight into rehab. The Hollywood starlet didn`t even spend two weeks in jail. So, how she can survive 90 days in rehab? Tonight, stunning new claims about her alleged drug abuse. We`ll hear from Lindsay`s attorney as she denies these explosive new allegations.

And a beautiful missing teen has been found, and she`s alive. Brittany Kustes was so roughed up and mentally abused, she had to head straight to the hospital. So, why aren`t cops calling this a kidnapping? Tonight, I`ll talk one-on-one with Brittany`s mother as cops hunt for a convicted sex offender. ISSUES starts now.

VELEZ-MITCHELL (on-camera): Those stories coming up, but first, blockbuster breaking news in the Kyron Horman investigation. The missing 7-year-old`s biological mother, Desiree, Desiree`s husband, and Kyron`s biological dad came, all appearing before a secret grand jury just a little while ago. There they are right there, stoic and silent. What did they reveal about stepmother, Terri Horman, and does this bring cops closer to an arrest?

We are monitoring the situation. This is a major development in this case. We`re all over it. We have team coverage. We`re going to bring you the very latest and analyze those two people who are going through hell right now because they don`t know where their precious little boy is, and what did they say to a grand jury? Hang in. We`re going to tell you in just a minute. Meantime, our other big story of the evening, Lindsay Lohan, busts out from behind bars after serving just 13 days of her whopping 90-day sentence.

STEVE WHITMORE, LOS ANGELES COUNTRY SHERIFF`S SPOKESMAN: Ladies and gentlemen, Lindsay Lohan was released from custody at 1:35 this morning. And per a court order, she has been sent directly to her next destination, which is a treatment center.

But Lindsay is not a free woman tonight. Not. As we speak, Lindsay is spending her very first night as an inpatient at a UCLA Rehab Center.

(BEGIN VIDEO CLIP)

VELEZ-MITCHELL (voice-over): Lindsay was whisked away from jail in a blacked out SUV at 1:35 a.m. and sent directly to the top rehab facility for three months of intense treatment. You know, it seems like just yesterday, doesn`t it? That she was blubbering in front of the judge with those F-you fingernails.

LINDSAY LOHAN, ACTRESS: I know that I was ordered to go once a week, and I wasn`t missing the classes. I`m not doing anything like that. I was working mostly, and (INAUDIBLE) I was working with children. It wasn`t a vacation. It wasn`t some sort of a joke. And I respect this. I`m taking it seriously.

VELEZ-MITCHELL (on-camera): Yep, those were F-you fingernails right there. After light in the slammer, will rehab be a walk in the park? Lindsay`s already been to rehab three times before, people. And she still wasn`t able to kick her hard partying habit. In fact, we were told (ph) "OK Magazine UK" that said rehab was like a vacation. In previous rehab stints, Lindsay was snapped pumpkin picking, doing yoga, and flirting with a new boyfriend. That`s right. Last time Linds was in rehab, spent her time romancing this winner. Will Lindsay finally take rehab seriously?

Plus, an explosive new reports in addition to the slew of prescription pills Lindsay is allegedly popping. TMZ reports her treatment will focus on an addiction to methamphetamine. Is Lindsay addicted to dangerous and deadly meth? Lohan`s attorney denies it and says Lindsay will quote "come out of this surprise everyone." But "People" magazine reports Lindsay still does not think she needs any help. What? That`s not a good sign. I want to hear from you. Call me. 1-877-jvm-says, 1-877-586-7297. Straight out to my fantastic, expert panel, but first, Mike Walters, assignment manager for TMZ. Mike, what is the very latest?

MIKE WALTERS, ASSIGNMENT MANAGER: You said it. You know, she is now at UCLA. She went straight there from the jail to start the 90-day sober rehab experience, but the most shocking thing is the methamphetamine and opiates, I can tell you for sure that this was listed as something that her focus was to be on with treatment. That that was her drugs of choice going the Morning Side which, by the way, we all know now she isn`t there. She`s at UCLA. So, what`s interesting is I am told one of her key drugs is Adderall, and a lot of people kind of associate methamphetamines.

They have a similar effect on the body as crystal meth and those kind of drugs, Adderall, they kind of similar. But they are not the same and that is what`s on the list, so interesting. Does Lindsay have a problem with methamphetamines or is it just Adderall? But that is one of the major things, and like you said, Lindsay still thinks that she doesn`t have a problem. So, I think that`s the key. Right now, at UCLA, the first few days is identifying why she keeps denying she has a problem, then to try fix it.

VELEZ-MITCHELL: And we have to say, Lindsay`s attorney has vehemently denied that she`s hooked on meth and called that story 100 percent fabrication. That`s from Shawn Chapman Holley, Lindsay`s attorney. But a recently released probation report showed Lindsay tested positive for amphetamines and opiates. Lindsay is taking several prescription medications. She takes a Dilaudid, powerful painkiller likened to morphine and heroin, which she`s apparently taking for having a wisdom tooth pulled months ago.

She`s also taking the stimulant Adderall. She`s taking Ambien, Zoloft for anxiety and trazodone and anti-depressant. So, Marty Brenner, you`re a chemical dependency counselor. First of all, explain to us the difference between amphetamines, which it says in her probation report she`s taking and methamphetamine which she is denying that she has a problem with.

MARTY BRENNER, CERTIFIED CHEMICAL DEPENDENCY COUNSELOR: She`s denying anything that she has a problem with. She`s told she doesn`t have a problem. (INAUDIBLE) parents and everyone telling her she doesn`t have a problem, she`s going to believe she doesn`t have a problem. This poor girl has a lot of problems.

VELEZ-MITCHELL: I want to know. We all hear the words like crystal meth. We hear meth. And then there`s amphetamine which we know from her probation report she`s taking. What`s the difference? Is meth an illegal?

BRENNER: Yes.

VELEZ-MITCHELL: That`s one thing --

BRENNER: That`s the main reason. Amphetamines is like Adderall that`s prescribed drug for someone that they need to stay focused and everything else. Meth is against the law. But the other medication, I`m more concerned about the combination of all the medication that she`s taking, and she`s going to go through a hell of withdrawal. So, that`s my main concern.

VELEZ-MITCHELL: That is the big question, I think, when she gets to UCLA rehab, and she is there tonight, but she`s probably just, you know, unpacking. Kristina Wandzilak, you`re an interventionist. You`ve heard the slew of medications that is this giant loophole that she`s allowed to take because they`re quote/unquote "meds" even though one is from a tooth problem she had months ago. Is she still going to be allow to take those meds when she`s in rehab?

KRISTINA WANDZILAK, INTERVENTIONIST: No. She won`t be, ideally, particularly, UCLA medical center. That`s part of the process is to help addicts of all forms from prescription medication to illegal, you know, substances, come off everything. They need to get a clear read as to where she is. They need to get a clear baseline, which takes time, which is the great news that she is ideally going to be in treatment for 90 days. So, they have a lot of time to really look at what`s happening with her and how they can help.

VELEZ-MITCHELL: All right. Let`s go to my big issue tonight. Lights, camera, no action. Lindsay slipped out of jail unseen at 1:35 in the morning hopping into a blacked-out SUV. So, what about all those rumors that Lindsay wanted, you know, full hair and makeup team to get her out. She was going to make a debut. Remember Paris Hilton back in 2007, she sauntered out of that same jail. Look at that, like she was on a runway, smiling. She was waving at the paparazzi. Whose idea, Bonnie Fuller, was it to let her hide her face as she left jail?

BONNIE FULLER, EDITOR IN CHIEF OF HOLLYWOODLIFE.COM: I bet it was the judge. I bet the judge didn`t want any repeat of Paris Hilton glamorizing being in jail and having drug and substance abuse issues. And I`m sure that both the jail and the sheriff were in agreement because it was a circus when Paris got let out. And she made it seem as if she, again, was flouting the law. She didn`t have to have "F-you" fingernails. She did it in a different way.

So, I think it was very deliberate that they put her in a darkened van and had her rushed out in the dead of night over to the rehab facility. There`s one question I wanted to actually ask of Marty because we were actually talking to you, I think, earlier today in Hollywoodlife. Just about crystal meth, wouldn`t there be physical signs like -- wouldn`t her mouth be some problems with her mouth and teeth if she actually was on crystal meth?

VELEZ-MITCHELL: Excellent question. Marty?

BRENNER: Yes, of course, there would be. There`ll be signs of - there`ll be -- if she was on crystal meth, her teeth will be starting to rot. Her body will start changing. And there`ll be typical definitely signs of use.

VELEZ-MITCHELL: Let me say this. I have to say, I had the dubious honor of knowing people who`ve been hooked on crystal meth. And just because that happens eventually to somebody who is doing meth, crystal, all the time, it doesn`t mean that it pops up right away. You can go years doing crystal meth if you do it in the Hollywood way where your teeth don`t fall out and you don`t start picking at your face. I mean, just give me that, Marty.

BRENNER: I agree. And I know people who`ve done it for a short period of time and all of a sudden, all the symptoms are there. I have clients right now that are using crystal meth, and you wouldn`t even know it.

VELEZ-MITCHELL: That`s what I`m saying. Go ahead.

FULLER: And hasn`t Lindsay had a problem with scratching and having scabs all over her arms? I`m pretty sure. I don`t know if that`s the same symptoms. But she has.

BRENNER: Yes. That is a symptom. Yes.

VELEZ-MITCHELL: I hope you guys can hang in there because we`re just getting started on this, and we`re talking about this controversy. Is she just taking these prescription drugs or is she taking something far more serious? Actually, they`re all serious. All right. We`re taking your calls on this. 1-877-jvm-says. But first, Lindsay Lohan is now in rehab. What is she being treated for? We`re going to have more on today`s explosive drug allegations.

UNIDENTIFIED FEMALE: I think Lindsay is a talented young woman, and I appreciate very much the fact that she`s accepting responsibility and stepped up to the plate and is doing what`s been asked of her.

LOHAN: I`m not taking this as a joke. It`s my life, and it`s my career and something I`ve worked for my entire life. And, you know, I`ve learned through my experience if I take responsibility for my actions and I`ve tried to do the best I can in the past few weeks since I was here last (ph), which is the only time I`ve been, you know, present in front of a judge in any of my situations in terms of this case (ph).

VELEZ-MITCHELL: Was that an acting job or for real? Lindsay Lohan out of jail headed to rehab. Actually, she`s in rehab right now, spending her first night, probably bedtime (ph) just about now, maybe in a couple hours. She served just 13 days of her 90-day sentence. Here`s what our fans are posting on Facebook. Viewer, Ava, doubts Lindsay will take rehab seriously. She says, you mean, she`ll be going to the spa for 90 days?

Deborah says, she probably won`t even stay 90 days. She`s a rich, spoiled brat, and like the rest of them, she just gets a slap on the wrist. We got a few other, but I think that is a great question. Jeff Brown, what if she decides I`m going to get right out of rehab? And I`ll throw that to Brian Oxman. What if she decided, I`m going to get out of rehab. I mean, are there bars at UCLA Rehab Center?

BRIAN OXMAN, CRIMINAL DEFENSE ATTORNEY: No, there are not, Jane. There are no bars there. UCLA is known for its outpatient program. It`s the matrix institute which is very famous and is a part of UCLA. They do have a 30-day detox program, which she is probably being screened for right now. And if that`s the case, she`s in hospital and she`s not going to be going anywhere.

VELEZ-MITCHELL: They`re going to have guards outside?

OXMAN: They`re not going to have guards outside. It is strictly a program which is an outpatient program. That`s what they have at UCLA. It`s a locked program but no guards.

VELEZ-MITCHELL: No, no, no, no, no. She got to stay inside. That`s inpatient. That`s my understanding.

OXMAN: That`s the judge`s orders, yes. But UCLA is known for its outpatient program. But it has a 30-day Detox program where she`s inside.

VELEZ-MITCHELL: I got to wonder, though, if she`s not -- if there are no bars, could she just skip out? Kristina Wandzilak--

OXMAN: Sure she could.

VELEZ-MITCHELL: Could she skip out?

OXMAN: She could. But that would be a violation.

WANDZILAK: Absolutely.

VELEZ-MITCHELL: And then they go and find her and arrest her and take her back to jail?

OXMAN: That`s correct. Yes.

VELEZ-MITCHELL: All right. Judy in Michigan, your question or thought, ma`am?

JUDY, MICHIGAN: Yes, I really appreciate you taking my call. Love your show.

VELEZ-MITCHELL: Thank you.

JUDY, MICHIGAN: My question simply is I understand why she got out of jail after only 13 days, but wasn`t there any possibility of her serving more time other than that L.A. jail?

VELEZ-MITCHELL: Well, I think you have a good point because, Bonnie Fuller, she did go on a reckless driving spree that I think anybody else would have been charged with attempted assault with a vehicular weapon and all sorts of other charges. I mean, she got basically a slap on the wrist for this crazy high-speed chase down pacific coast highway.

FULLER: Jane, I agree with you. I think you`re absolutely right. That if she wasn`t a celebrity, she would have been charged in a way that would have made her up for more prison time, but under the circumstances, this was all the judge could do because of the incredible overcrowding problem in California. And as for whether Lindsay is really going to benefit from the program at UCLA, which is supposed to be very good, at this point, it`s a little doubtful because she`s already been expressing to her friends and family that she feels that, first of all, she deserves to have time off between prison and rehab.

So, she is still feeling very entitled. And she still doesn`t think that she has a problem. And that she doesn`t belong in rehab. So, whether she actually will stroll out, I don`t think so because she does know she would be put back in jail. But she hasn`t accepted yet. She`s still in denial that she has any substance abuse problem at all.

VELEZ-MITCHELL: You`re absolutely right. "People" magazine is quoting sources saying she still doesn`t think she needs any help. You know, I have to say, thank God she went straight from jail to rehab because if they had let her out for even one day, being the recovering alcoholic addict that I am, I know she would have gone to town. That`s just my personal opinion. She would have done everything she could, knowing she got to appear the next day.

Lindsay`s attorney vehemently denies Lindsay is hooked on meth. She calls the story 100 percent fabrication. Methamphetamine addiction, meth is a psychoactive stimulant. Its physical effects could include insomnia, palpitations, convulsions, and death to name a few. So, again, I`m going to Kristina Wandzilak on this. We know that she was taking amphetamines and opiates that were meds, and she got a free pass on that that`s what was in the probation report. What`s the difference between some of those meds and meth? I`m trying to get to the bottom of that.

WANDZILAK: The difference is like gentleman said earlier, one is legal. One is not. One is prescribed. One is not. It`s very similar to be honest with you between drinking alcohol and rubbing alcohol. They`re just a few molecules different. The interesting thing about Adderall is the body cannot tell the difference between prescribed substances and non- prescribed substances, but the body feels as high. And Adderall is a highly addictive substance. It is something that I intervene on. I get calls intervene on Adderall daily to my office. No, it is highly prescribed and highly abused.

(CROSSTALK)

VELEZ-MITCHELL: Along with Dilaudid which is like heroine.

WANDZILAK: That`s right.

VELEZ-MITCHELL: That`s what I call a giant loophole. We got more on --

WANDZILAK: It`s maddening.

VELEZ-MITCHELL: It`s madness.

Cops are now putting pressure on Terri Horman`s friends. Do they know what happened to little Kyron? Tonight, we`re going to go inside today`s explosive developments. A grand jury hearing testimony.

LOHAN: I`ve been compliant that was given out considering -- I have been incompliant with everything that occurs under acquaintances and for DUI (ph).

VELEZ-MITCHELL: Lindsay Lohan is out of jail and headed to rehab. But "People" magazine reporting tonight the troubled actress still thinks she does not need any help. And she`s reportedly very upset that she wasn`t given 24 hours to spend time with her family before checking into rehab for three months, even though her family immediately went to the rehab center, and she saw them there. Very interesting as they say. James in Arizona, your questions or thoughts, sir?

JAMES, ARIZONA: Yes, Jane. I`d like to thank you so much because you`re the only person who seems to stand up for the common man. I listen to your lawyers on there. They keep saying that if it out of this -- you know, she got more time -- if this had been a normal person, they would have been in jail for years.

VELEZ-MITCHELL: You are so right. Brian Oxman, there is a great website called Mothers Against Mandatory Minimums where you see one person after another, usually poor minorities locked up for life for being caught with one little piece of crack cocaine. She was found with cocaine on her, and she spent a total of 13 days in jail after violating every rule in the book.

OXMAN: It`s the original 82 minutes, Jane, which was just absolutely ridiculous. There`s where the problem started. We didn`t mean it with Lindsay Lohan from the very get go. And then when it came time to sentence her here, then it`s 90 days, which was a little bit higher than what we`re used to under these circumstances. So, it went from one extreme to the other. Both of them, I think, sent the wrong message. Even-handed justice is what was needed here, and we didn`t get it.

VELEZ-MITCHELL: If people are going to have sympathy for Lindsay Lohan, may I simply suggest they have sympathy for all the many, many others who are behind bars doing life in prison for non-violent drug offenses. America currently locks up more people than any other country in the world, and a goodly percentage of them are in jail for non-violent drug offenses. And most of those people are poor minority and they were found with illegal drugs like crack. Even though Lindsay was found with cocaine, but most drug abuse is prescription drug abuse.

Prescription drug abuse is the second leading cause of accidental death across the nation in some states. Prescription drug abuse overdose is the leading cause of death, the leading cause of death. They`re doing the same exact drugs except it`s legal. So, what`s next for Lindsay`s career? Check her out in this trailer for underground comedy 2010.

VELEZ-MITCHELL: OK. Bonnie Fuller, prospects when she gets out of rehab, career wise.

FULLER: It`s all going to depend on whether she takes rehab seriously. She may not think she got a problem, but she got a big problem career wise if she doesn`t get out of denial, get herself clean, get everybody in Hollywood to have a perspective that she is done with the old Lindsay that was a substance abuser because directors and producers are not going to take a chance on her, unless, they know she`s serious.

VELEZ-MITCHELL: Got to leave it right there, but an excellent point to leave it on. Thank you fantastic panel.

The trio remained tight-lipped and emotionless as they were bombarded with the media. Who knows what they were revealing about their relationship with Terri Horman, Kyron`s stepmom. Kaine and Desiree are absolutely convinced Terri, Kaine` estranged wife, the stepmom, is responsible for little Kyron`s disappearance.

DESIREE YOUNG, KYRON HORMAN`S BIOLOGICAL MOTHER: I fully believe she`s involved.

KAINE HORMAN, KYRON HORMAN`S FATHER: To what capacity is what the investigation is trying to figure out.

YOUNG: I can`t speak for Terri and I can`t speak to her circumstances. She`s the only one that knows about all of that.

UNIDENTIFIED MALE: (INAUDIBLE)

YOUNG: I have no idea. Terri would know. You can ask her.

VELEZ-MITCHELL: Remember, Desiree has now said that when she was eight months pregnant with little Kyron, her husband at the time, Kaine, was having sex with the woman you see there, Terri. That`s the stepmom.

Could a jealous rivalry be at the heart of this tragic mystery? Just what did the silent trio reveal behind closed doors today about their relationship with Terri? Is there more to the story than what they`re telling the media. Are police any closer to an arrest?

Straight out to Jean Casarez, correspondent with "In Session"; Jean, what is the very latest?

JEAN CASAREZ, CORRESPONDENT, "IN SESSION": Well, the very latest -- the pictures show that down at the court house today, unexpectedly the family of little Kyron Horman, his father, Kaine, his birth mother Desiree, her husband Troy. They were going into that court house to, we believe, testify before the grand jury.

But here`s my question, Jane. Last week police held a news conference. They said the reward was doubled. They were begging people to come forward. The family on Friday had a press conference. The same thing, come forward.

Is it for the disappearance of Kyron Horman that the grand jury proceeding is on or could it be another crime? Allegedly remember, that restraining order was that Terri Horman allegedly hired the landscaper to try to kill her husband. Could that be what this is about?

VELEZ-MITCHELL: Absolutely. Because -- listen, we hope and pray they find this little boy alive. That is all of our sincere wish. But as they say, "No body, no case."

So Brian Oxman, criminal defense attorney, can they even proceed until they find out what happened to Kyron?

BRIAN OXMAN, CRIMINAL DEFENSE ATTORNEY: They can certainly proceed, Jane. There`s absolutely no reason. If they have some kind of evidence that there`s been a murder or some kind of kidnapping that`s taking place here, they can proceed. That`s why the grand jury is here.

You`ve got Dede Spicher, who moved in with Terri almost immediately after the husband separated from her and filed for divorce. She`s not talking to the police. They want to bring her to the grand jury, force her testimony. And that`s what this grand jury is all about.

It`s not about a restraining order.

(CROSS TALKING)

VELEZ-MITCHELL: Yes. Let me jump in there and say that Dede Spicher actually appeared before the grand jury last week. She`s Terri`s good friend as you just heard who was doing her gardening job on the morning Kyron disappeared.

Now witnesses say Dede actually vanished for about two hours from about 11:15 to a little after 1:00; mystery has swirled around this woman. This is Dede Spicher, the friend. But her friends have stuck by her on CBS News.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Dede would never be involved in anything that would hurt anyone. If Dede that felt Terri had anything to do with this, Dede would not be standing next to Terri.

She said I need you now. And Dede -- because Dede is the friend that she is, that`s what she was doing and went out and stayed with her for ten days.

VELEZ-MITCHELL: Dede`s lawyer said she did show up, but did not testify before the grand jury. She did, however, show the grand jury text messages and e-mails sent between herself and Terri Horman. Her lawyer says she`s cooperating fully, ok, with authorities now.

So what is the deal with Dede?

Jeff Brown, do you have any thoughts on her role. Would she perhaps get immunity and then spill what she might know about Terri?

JEFF BROWN, CRIMINAL DEFENSE ATTORNEY: Yes, it`s a little early though for the government to be giving anybody immunity. I think what they want to find out is those ten days, and especially the 90 minutes where she`s unaccounted for, I think they want to know what was discussed between her and Terri.

Remember now, anything that a defendant says, if a person is charged as a defendant, can ultimately be used against them in that courtroom. If she`s made some incriminating statements or some things to Dede, Dede can repeat them and they`ll be used against Terri.

So I think they just want to find out through Dede, what happened during the ten days. What was her emotion like? What was her reaction like? What did she tell you? And try to account for the 90 minutes.

VELEZ-MITCHELL: Well, let me say this. Friends of Terri Horman started a Facebook page to show their support for that woman, the red head.

Here it is. ABC News now reporting that a photo of Kyron has just been taken off of that over the weekend and replaced by a photo of Terri. Also on the same page it says, quote, "There is not one piece of physical evidence that proves Terri is involved with Kyron`s disappearance", end quote.

That statement is now appearing on this page. Jean Casarez, that is - - is that damage control -- or is that -- that`s something that could backfire?

CASAREZ: It`s definitely not what the family is saying. The family has said, and I think this is one of the most critical thing that we`ve heard the family say that seems to be step in step with -- hand in hand with law enforcement. That Terri said when they were still all speaking that law enforcement told her that where she told them she was on June 4th was not what her pings from her cell phones were saying. There shows a major, major inconsistency on the day in question.

VELEZ-MITCHELL: Now Terri, the woman you`re looking at there has a very intriguing back story. She used to be an amateur bodybuilder.

There she is there -- let`s check her out from, I say about 5 years ago. Oh, yes. This is how she looked presumably. Presumably this is how she looked when she began having an intimate relationship with little Kyron`s father, Kaine. This was at the same time Desiree was pregnant with Kyron.

VELEZ-MITCHELL: So Terri and Desiree sharing one man. Now the boy that this guy had with one of those women is missing. And the other one is the focus of the investigation.

Sherri, your question or thought, ma`am.

SHERRI, INDIANA (via telephone): Hi Jane.

VELEZ-MITCHELL: Hey.

SHERRI: This is Sherri and my daughter Rebecca and I were talking. We was wondering maybe did little Kyron maybe walk in on his stepmom having relations with someone, and she felt like she needed to get rid of him so he wouldn`t tell his father?

VELEZ-MITCHELL: Pat Brown, that is brilliant. Not to say that that`s true. Not to say that Kyron`s dad was cheating with anyone at the time. But could it be the little boy saw something?

PAT BROWN, CRIMINAL PROFILER: Well, it`s possible, Jane because we have seen that Terri Horman has a lot of strange behavior that she`s very careless with. Like after Kyron goes missing, she`s texting with Kaine`s friend.

I mean this is just ludicrous behavior and if I was under investigation, I would be watching everything I do. Being very upstanding, going to church on Sunday. I wouldn`t be sexting somebody so that would come into play and people will say, "Oh, my God, what kind of human being is this?"

So, that she would do that leads me to believe that she would do other very foolish and very narcissistic things during her relationship with Kaine and before Kyron went missing. So, I think that`s a very good theory.

VELEZ-MITCHELL: Now, Brian Oxman, criminal defense attorney, you`ve been involved with so many grand jury investigations. Terri is clearly the focus of this, though she`s not been named a suspect or person of interest. But today three people showed up: Kyron`s biological mother, Desiree; his dad, Kaine; and Desiree`s husband as well, Tony (SIC).

Will these three be questioned about the intimate details of their relationship with each other? In other words, about this affair that Kaine had? Does the grand jury go into that kind of detail?

OXMAN: You bet you they do, Jane. They`re going to want to know all the details of these people`s lives because it seems that this sexual ring or this group of groupies here are the matters behind the disappearance of Kyron. You usually look to the family and their associations. Who is there? And that`s usually who the suspects are. You bet you; they`re going to look right square in the eye at this one.

VELEZ-MITCHELL: Jean Casarez, ten seconds. Do you think there`s more to the story than meets the eye? The family has not said very much publicly but you could kind of look between the lines a little bit.

CASAREZ: I think there`s a lot more than meets the eye. And I think we need to intently listen to what they say and read between the lines, as they say it.

VELEZ-MITCHELL: Yes. We sure do. And let`s hope this little boy is still alive. We pray -- we pray there`s a happy ending.

Tonight, switching gears: a family`s desperate search finally over; 19-year-old Brittney Kustes is back home tonight following two terrifying weeks hidden away by a sex offender. And now the hunt is on for suspect, Roy Vernon Elwell, who may have been involved in a murder?

Police say a dead body was found at the home where Elwell was hiding Brittney. Her mom told me the 36-year-old is obsessed with Brittney. And there is no telling what he might have done next.

KUSTES: This guy has actually tried to break into my home before. He`s threatened my life, my parent`s life, all to Brittney, if he couldn`t have her. So it`s a very sick, sick situation.

VELEZ-MITCHELL: Police say on Friday Brittney was driven to a drop- off spot by a woman who knows Elwell. Brittney called her boyfriend who drove her to a motel and then called police. That ended an extremely tense, aggravating and really heart wrenching time for Brittney`s family.

She vanished July 17th while swimming at her grandmother`s pool. Police immediately zeroed in on this Elwell fellow who has a very long rap sheet. Brittney was scheduled to testify against him last week in a kidnapping case.

But cops are now hesitant to call Brittney`s disappearance a kidnapping. Why not?

I`d like to welcome my fantastic panel and I`m thrilled to have Brittney`s mom Laurie back on ISSUES. Laurie, we are so happy that your daughter is back.

KUSTES: Thank you.

VELEZ-MITCHELL: You know we cover so many horror stories here on ISSUES that end in tragedy. We talk to so many parents who are -- their lives are completely shattered and destroyed because they`ve lost a daughter or a son.

But you found your daughter. That is a miracle. We are so happy for you.

KUSTES: Thank you so much. It was truly a blessing.

When we found her, we just stared at each other. And I just -- I told her over and over you`re safe now, you`re safe, you`re safe. And she just cried and cried. She`s -- she`s really been through a lot of horrible things.

VELEZ-MITCHELL: What has she been through? What condition was she in? What happened to her during her 13 days?

KUSTES: She was brutally, mentally tortured. And I mean, I really can`t go into details because of the ongoing investigation, but she`s going to -- it`s going to take a while to get past this for her.

VELEZ-MITCHELL: Was she hooked on drugs? Did he hook her on drugs?

KUSTES: Yes.

VELEZ-MITCHELL: Again?

KUSTES: Again.

VELEZ-MITCHELL: Oh my gosh.

Well, let me explain to our viewers. This was not Brittney`s first encounter with this man Elwell. Laurie in fact told us a bizarre story on ISSUES just last week when we were searching for the girl.

KUSTES: She came up missing. It was a little over a year ago. And the cops found her then with him. And when we got her back, she was addicted to meth.

VELEZ-MITCHELL: And what did you do then?

KUSTES: Sent her to a rehab. And she straightened up, doing great. Everything was great. Life was good.

VELEZ-MITCHELL: So she was just 17 years old when she disappeared the first time. What came of that case? Was Elwell ever charged with abducting Brittney the first time around?

KUSTES: No, he was not.

VELEZ-MITCHELL: Why not?

KUSTES: I don`t know. I don`t know.

VELEZ-MITCHELL: Well, detective Scotty McGaha. You`re at the sheriff`s department, why wasn`t Elwell charged with kidnapping her when he disappeared with her the first time about a year and a half ago and she ended up hooked on meth?

DET. SCOTTY MCGAHA, BULLITT COUNTY, KY SHERIFF`S DEPARTMENT: Well, Jane, the first time she was reported missing we took a report in our jurisdiction. She was found at a -- in Louisville and LAPD (ph) recovered her, found her. She was returned back home.

But at that particular time there was some concern that she went voluntarily with him. So it never was in my understanding there were never any a kidnapping on no charges on him, that first time because apparently she`d gotten back and got on the drugs then.

VELEZ-MITCHELL: Well, what about this time around? Apparently you`re not officially calling this a kidnapping this time around either. Are you suggesting that possibly this young woman went voluntarily with him and then once she was with him ended up being held against her will?

MCGAHA: Well, that`s part of the investigation right now. There is - - we just found Brittney Friday. She was taken to the hospital. At that particular time we really couldn`t even do an interview with her, just some preliminary things. I did meet with her today. I`m working this case along with the Kentucky state police detective because you`re getting into some other jurisdictions.

But we did do a video interview with her today and now that she`s recovered a lot more and we can speak with her. And that interview lasted probably over an hour. And from the information we got --

VELEZ-MITCHELL: And she -- she`s hooked on drugs. Right, she`s now hooked again on drugs, right?

MCGAHA: That is a concern. Yes.

VELEZ-MITCHELL: All right. Well, Kristina Wandzilak (ph), you`re an interventionist. We see a pattern here. In some way, shape or form she ends up with this guy twice and both times she ends up hooked on drugs. What do you say?

KRISTINA WANDZILAK, INTERVENTIONIST: I say that it`s a very strange and bizarre story; methamphetamine is a very strange and bizarre addiction. Crazy things happen to really good and decent people. I think more will be revealed. I think we`ll learn more as this story unfolds.

VELEZ-MITCHELL: What are you going to do, now, Laurie, with your daughter to get her off drugs this time around? Because you can`t just stop because you want to stop; the drugs hook you.

KUSTES: Well, we`re going to have to start all over with drug counseling, rehabs, what not. Also, I`m going to have to get her in with a psychiatrist for the past two weeks because the past two weeks, it wasn`t voluntarily for her to be gone. And so it`s just a bad situation. We`re going to have to start from ground zero.

VELEZ-MITCHELL: All right. On the other side, we`re going to have more. Are cops any closer to tracking this creep down?

KUSTES: No there was no problems for her to take off and leave. She hated this guy, actually.

VELEZ-MITCHELL: Nineteen-year-old Brittney Kustes somehow survived 13 days with a crazed sex offender, Roy Elwell, still on the run tonight as we speak. Police say a dead body was found inside the home where Elwell allegedly held Brittney captive.

Tell us about that, detective. Apparently there was a dead body -- some reports say it was hanging from a tree?

MCGAHA: Well, what I can tell you about that, we`re not -- that`s in another jurisdiction. We are not working that case. But what I can tell you is during the past two weeks when we began to receive tips in the whereabouts of Brittney Kustes we had actually received several calls that told us that she had been at that location that was in Spencer County where a body was found there, that of a deceased male.

I contacted a state police detective that was working there. That now is a death investigation. But what we do know is Elwell and Brittney Kustes were at that location. And Vernon Elwell was one of the last people to be seen with him that night before his death.

VELEZ-MITCHELL: This is a dangerous guy. Oh, my gosh. Quick question -- is Brittney under protection tonight? Police protection?

MCGAHA: She is not under police protection per se, but we are on alert to watch her. And she is at a location that we don`t believe he`s familiar with.

VELEZ-MITCHELL: Ok. Wallace, Ohio, your question or thoughts, sir?

WALLACE, OHIO (via telephone): My question is, do you think this young lady has any idea where this young man has gone to?

VELEZ-MITCHELL: Oh, good question. Well, detective, I have to ask you. I mean, have you asked her where the heck is he?

MCGAHA: We have asked her. She has no idea. She is still terrified, extremely frightened of him now. But we continue to get leads on the way in here again tonight. I`ve got like two leads on him. So we`re following up on those, but, no, we think he`s still in the area moving around because that is his connection. But we do not believe that she has any idea where he`s at right now.

VELEZ-MITCHELL: I`ve got to ask you a quick question Laurie. You are the mother of Brittney. There is a report here that says that this guy was living at Brittney`s grandparents` house. And that changes the equation entirely, does it not? Is there any truth to that published report?

KUSTES: There is absolutely no truth to that. No way.

VELEZ-MITCHELL: Ok. Well, I wanted to clarify that because that`s from fox41.com.

KUSTES: I heard that.

VELEZ-MITCHELL: So it`s wrong? We`ll get rid of it right now -- boom. But we had to ask you.

All right.

Pat Brown, what do you make of this case? I mean this guy seems to be eluding authorities despite a massive manhunt and numerous sightings.

P. BROWN: Well, Jane, I`m sure he has a lot of places he can go hiding -- he has a lot of connections in the drug world. He`s a sneaky little fellow. It really is, the police are doing the right thing trying to put their case together because they don`t want a defense attorney to say the girl went willingly and she stayed there willingly.

They want to make sure that they can prove she was either kidnapped or after he lured her that he wouldn`t let her leave which is also kidnapping and what kind of abuse went on at that particular time.

So they`re going to be very careful because you want to put this guy away forever.

VELEZ-MITCHELL: Laurie, you must be, despite everything, completely overjoyed that your daughter has been found. Tell us what you are going through emotionally given that, as I said before, so many parents, it`s the worst nightmare when they find out what happened to their child. They don`t find them alive, usually.

KUSTES: I didn`t know if I was going to find her alive and I was preparing myself for that. When we did find her it was just -- I have never had those feelings before. It was one of the greatest moments of my life.

I would like to add, though, for all the people, you know, going back and forth on not knowing what to believe, there has been another female, Brittney`s same age --

VELEZ-MITCHELL: We`re going to have you back.
