VELEZ-MITCHELL: Tonight, stunning new developments. I mean stunning, people, as Misty Croslin`s family says the terrified teenager is now on suicide watch. Her ex-husband, Ronald, was just sentenced to 15 years in the slammer. Misty could be next. Is Misty losing it?

She`s going to be in court in just two weeks to face sentencing in her drug trafficking case. She could get up 240 years behind bars. Or, she could get just six years. Will it depend on whether she finally talks about what really happened to Haleigh that night? Time is fast running out for her to cut a deal.

Chelsea, thank you so much for joining us.

CHELSEA CROSLIN, MISTY`S SISTER-IN-LAW: Thank you for having me.

VELEZ-MITCHELL: I know it`s difficult for you, but we`re going to get through this.

You are married to Misty Croslin`s brother, Timmy, not Tommy, the one in jail. Timmy. You`re saying you know what happened the night little Haleigh vanished. Tell us your theory of what happened to Haleigh the night she vanished.

C. CROSLIN: My theory of what happened the night Haleigh vanished, as far I`m being told from Misty being brought into an interrogation a few days ago, they told her that if she didn`t tell the missing part, that she would get 50 years in prison.

My theory of what happened that night, is that Haleigh ODed in the home. I think that she got a hold of Ronald`s pills, and she died accidentally. I think that the argument phone calls between Ronald and Misty were over how to get rid of the body and Ronald threatening Misty to tell what the truth was.

I believe that the theory of Tommy and Joe being involved in this situation, have led me to believe at this point, that they would have just gone there to help basically cover up and set up the scene to make it look like a kidnapping. I don`t believe that Haleigh was taken out of that home besides deceased before she left.

VELEZ-MITCHELL: What proof do you have of this? In other words, where did you get this theory about the fact that we`d heard this before, that she took drugs. But you`re saying that she took drugs in the trailer, drugs that would belong to Ron and/or Misty. She ODed, and then who -- who -- what did Ron do?

C. CROSLIN: I believe -- well, Ronald knows that they were his pills. Ronald is the one who had possession of many pills. Ronald used to call himself the drug boy. He had a dresser in his bedroom that had his drugs in it that would be accessible to his daughter to get to.

As far as Misty not paying attention to her or, you know, leaving the home that night, I don`t believe that happened. I think Misty probably, with her three-day binge, was asleep. I think that she had -- she had fallen asleep and left the children awake, thinking that, you know, they were just going to be running around the home or playing, and had woken up to possibly Haleigh dead from taking -- from taking pills.

VELEZ-MITCHELL: And who disposed of the body?

C. CROSLIN: I don`t know who disposed of the body. But, as far as the stories that are being told, that, you know, Joe and Tommy were the ones that were called the scene to get rid of him, get rid of Haleigh. And it would make sense, because there was a phone call from Ronald calling Tommy when Ronald claims that he says that he told Tommy to go check on Misty, because she wasn`t answering the phone. I think that was Ronald calling Tommy to tell him to go help his sister get rid of the child.

VELEZ-MITCHELL: Well, you have something that Ron, you believe, was showing up at the house in a black outfit because the little boy said a man in black came and took Haleigh.

C. CROSLIN: Well, when Junior -- the story was released by Crystal in the very beginning. The first day that I seen Junior, I ran up and gave him a hug, and he told me his sister was missing. I told him, "Don`t worry, baby. We`re going to find her, and we`re going to bring her home. And he circled his hand around my face like this, and he said, "No, Aunt Chelsea. The man in all black came in and took my sister."

VELEZ-MITCHELL: And who do you think that is?

C. CROSLIN: The only theory I can think of is Ronald. Because that morning at the sheriff`s department, I was supposed to get clothes for Ronald and Misty to change into so they could take the clothing that they were wearing. And Ronald was wearing from the feet to the end of the arms a black jump suit and boots.

VELEZ-MITCHELL: OK. Well, let me say, first of all, that we called Ron`s attorney, and he had no comment. But he is invited on at any time to tell his side of the story. And again, nobody has ever been charged in little Haleigh`s disappearance, which makes it such a mystery.

The night Haleigh went missing, Ron made this frantic 911 call. So let`s listen to that again.

CUMMINGS: I just got home from work, my 5-year-old daughter is gone.

UNIDENTIFIED FEMALE: OK.

CUMMINGS: I need someone to be here now. I`m telling you.

UNIDENTIFIED FEMALE: OK. Listen to me. Listen to me. We`ve got two officers...

CUMMINGS: If I find whoever has my daughter before you all do, I`m killing him. I don`t care. I`ll spend the rest of my life in prison.

VELEZ-MITCHELL: Now everybody said that Ron sounded very sincere when he made that 911 call. It would appear that Chelsea is saying Ron already knew what happened to his daughter, and he was acting.

But here`s the problem with that. Ron has an air-tight alibi for the night that little Haleigh went missing. He was at work. People at work say him there. His cell phone pings also show that he was there. Now, he reportedly returned at 3 in the morning and made that 911 call when he realized that his daughter was missing.

I don`t understand how this theory, which I appreciate hearing, could be true, Mike Brooks, if he has an alibi for the time that she went missing.

MIKE BROOKS, HLN LAW ENFORCEMENT ANALYST: You know, Jane, how many theories have we heard? This is one of the very first ones, though, we did hear in this case about -- about little Haleigh possibly overdosing on some drugs.

But I still say -- and you know, I`ve said this a number of times -- I don`t know if any of these people -- we know that Misty was on a bender -- if any of them really know what happened to little Haleigh. Because they were so screwed up.

VELEZ-MITCHELL: Levi Page, what do you think of Chelsea, the sister in law of Misty, her explanation now, her theory that the child ODed and that everybody`s kind of involved in disposing of her body?

LEVI PAGE, CRIME BLOGGER: Well, I think that Chelsea Croslin should be a detective, because I think her theory makes perfect sense. I think it`s logical. And I think that Ronald is involved in this. And behavior points to a person that`s not a grieving father.

And guess what, Jane? I have sources close to this case and a woman who will not be named, but she told me that 20 days after Haleigh vanished, Ronald approached her and wanted her to engage in three-way sex with himself and Misty Croslin...

VELEZ-MITCHELL: Oh!

PAGE: ... after his daughter goes missing.

VELEZ-MITCHELL: OK. That`s -- that`s very, you know, scandalous. And anybody can say anything. Unfortunately, the behavior in this case has been so crazy with all the talk of drugs and sex. But, you know, it`s very hard to separate fact from fiction.

Again, we invite Ron`s attorney on any time -- any time -- to tell his side of the story.

Wendy Murphy, what do you make of what Chelsea has to say?

WENDY MURPHY, FORMER PROSECUTOR: Well, let`s talk a little turkey about the timing, shall we? Misty needs a little sympathy right about this time.

(CROSSTALK)

VELEZ-MITCHELL: OK, go ahead.

MURPHY: So, obviously, she needs a little sympathy now, since she`s coming up two weeks from now, facing an awful long time behind bars. It works for her as a PR matter to try to, you know, shift blame and make herself look like the innocent victim. I don`t buy any of it. It is, to me, nonsense.

I don`t disagree that there are drugs involved. Remember that Ron reportedly had a significant drug debt. I do think somebody took the child. I do think someone took the child. That is not uncommon when there`s a debt and you need to pay and you have no money, they could take your kid. But...

PAGE: Police ruled out an intruder. The police have ruled out an intruder.

MURPHY: Levi, stop, stop, stop.

PAGE: This is not an intruder.

MURPHY: Somebody took the child for a reason.

PAGE: It was in this -- it was in that family. In that family, Wendy. It was in that family.

MURPHY: My turn, Levi.

VELEZ-MITCHELL: Tonight, shocking new theories on what happened to 5- year-old Haleigh Cummings the night she vanished, that her own father buried the girl.

Misty`s sister in law feels that he, Ron, is involved. Plus, brand- new, never-before-seen photos of Haleigh`s father Ron and Misty that show the couple after Haleigh vanished. And in some of these, they`re smiling. They`re laughing. Look at that. Now, that`s supposedly a photo of Ron on a roller-coaster after little Haleigh vanished, looking like he was having a good time.

Chelsea, you gave us these photos. Do you think that they point to Ron being, what, too happy in the wake of his precious daughter`s disappearance?

C. CROSLIN: Well, I know that I have three children, and I would not be acting or have a smile on my face the way that he is 32 days afterwards.

Some of those pictures are in New York, when his daughter was missing.

And the one thing I do know about Ronald Cummings is that he is a controlling man. Never mind my sister, but the two other young women that he controlled and had children with. He is abusive. He had her mind warped. He distanced her from her entire family. And it hurts me to get on TV and say that I believe my sister had involvement, because I love Misty with all my heart. But I know that she is hiding something for Ronald Cummings. Not for anybody else but for the Cummings family.

VELEZ-MITCHELL: Yes, but Ron is now behind bars for 15 years. He can`t hurt Misty. This is -- Misty only has a few days. The clock is ticking to tell the cops what really happened.

C. CROSLIN: Misty is not afraid of Ronald hurting her. Misty is so infatuated and in love with Ronald that she thinks that she has to keep the secret for him. Whatever it may be, he has her so -- in her mind thinking that she is implicated just as much as she is, because she was the one at home that night with her. You know, not him. So, it was technically her fault for Haleigh taking the pills or ODing or, you know, this is a theory.

I don`t have proof behind this, but I`ve lived with this case for 19 months in my life. And I have gone through many different theories and many different aspects of it. And there is certain things that I do know, and the way that Ronald acted before his daughter went missing and the actions he had afterwards. Actions speak a thousand words.

VELEZ-MITCHELL: Like what?

C. CROSLIN: And Ronald was a happy man. He would go mud bogging. He wouldn`t pay attention to his son, Junior. The -- Aunt Trina, Hope`s mother, is the one who took care of Junior after Haleigh went missing. He didn`t give his son the time of the day. When you don`t have your daughter, you would want your son by your side at all moments. I know I would. And he...

VELEZ-MITCHELL: Go ahead.

C. CROSLIN: Yes.

VELEZ-MITCHELL: Well, finish it, Chelsea. He would what?

C. CROSLIN: He just -- he would go mud bogging. He`d go hunting. He would just go -- he went to Orlando to Universal Studios. You know, he went to New York. He took trips all the time. He got tattoos. You know, he just had a blast.

VELEZ-MITCHELL: Your thoughts. She`s saying basically Ron was having a good time. She`s making the point, the Casey Anthony thing, where Casey was seen dancing after her child disappeared in sort of a similar kind of argument.

ROBI LUDWIG, PSYCHOTHERAPIST: Well, it definitely sounds like that Ronald did not provide a home that was safe for his children and probably not a competent parent.

If these pictures were, in fact, taken after his daughter went missing, it is disturbing to see that he seems to be embracing and enjoying life as if nothing happened. It makes you wonder, what was his connection to this child?

I don`t know the details as far as what he did in terms of covering things up. It does seem like they ran in racy circles, where it`s very possible Ronald has a theory as to what happened.

VELEZ-MITCHELL: Chelsea, if you had one thing to say to Misty, if she`s watching from jail right now, she`s only got a couple of days to come clean to avoid going to jail, prison for 240 years, what would you tell Misty? Speak to her.

C. CROSLIN: I would say, Misty, please, we love you so much. And please just tell us what happened to Haleigh. It`s not going to matter. It`s not going to change anything. No matter what, you`re going to go to jail, and in the end, Ronald is not going to be there for you. He doesn`t love you, and you`ll never be together again.

Haleigh needs justice, and your family needs justice. We love you, Misty. And we`ll always be there for you, but please, I`m begging you to just tell the truth.

VELEZ-MITCHELL: Wow.

Wendy Murphy, ten seconds. Do you think Misty will listen to her dear relative?

MURPHY: She should. Chelsea`s absolutely right. She knows the truth. She should tell the truth. Because her choice is -- are you ready? Jail or a life of torture, threats and bullies? What does she want? Does she want to go to jail or tell the truth?

VELEZ-MITCHELL: Going to leave it right there.

JEFF ASHTON, PROSECUTOR: I don`t think that the defense in the last two years has been diligent in getting this evidence examined.

VELEZ-MITCHELL: Tonight, new indications that Casey Anthony`s lawyers might be hunting for a brand-new suspect. Casey`s attorney, Jose Baez, arguing in court today for fancy new DNA testing on evidence found near little Caylee`s remains. In particular, a canvas bag and a pair of Caylee`s shorts.

The prosecutor wasn`t buying it.

ASHTON: If you give them another two months to get their experts done, then what happens to the -- the deadline for me?

VELEZ-MITCHELL: This evidence has been sitting around since Caylee`s remains were found in December of 2008. Her mother, Casey, of course, charged with little Caylee`s murder.

Joining me now, former prosecutor Wendy Murphy. Wendy, Jose Baez wants to send this evidence out of the country to a Dutch DNA expert. What are they hoping for? Mystery DNA they could point to, a mystery suspect.

MURPHY: You know, it`s not a mystery Jane, what they`re trying to do. Look, if there`s one thing we`ve seen in this case, it`s every trick in the book to drag this case out, to delay the truth from coming out, to put off justice for this poor child.

If I were the judge I`d say, what took you song so long and what are you doing in the Netherlands? You know, we`ve got the best DNA labs in the world in this country. And they need to go to this special hired gun to do what -- to mess up the truth in this case even more? I wouldn`t give him a day`s worth of extra time.

And make -- I want to make a prediction here, Jane. More delays are coming. You watch. On the virtual eve of trial, Jose will probably get sick. He`ll get fired. They`ll need a new lawyer. You watch. You watch. This case is going to be dragged out until we`ve all dropped dead.

VELEZ-MITCHELL: I`ve talked to Jose numerous times. And say what you want about the case, but he`s a nice guy. He`s a legit guy.

MURPHY: I didn`t say that.

VELEZ-MITCHELL: OK. They attempted DNA testing on the canvas bag and the shorts a long time ago, but it wasn`t successful. Now, they fired back in court today when the prosecutor -- a prosecutor questioned his motive.

JOSE BAEZ, ATTORNEY: We didn`t bring Dr. Huntington to Orlando so that he could go to Disney World. We brought him down to do a job. It took his best efforts to do what he did. And it didn`t work out, based on -- based on the amount of evidence and the lack of proper equipment.

VELEZ-MITCHELL: All right, we`ve got a call. Julie, Kentucky, your question or comment. Oh, Julie.

CALLER: yes.

VELEZ-MITCHELL: Yes. What`s your question, ma`am?

CALLER: First of all, I believe that Casey is innocent.

I also believe that the lawyers that she has, are going to be very experienced lawyers. And I understand that she`s going to be getting some more in the future. So, I just think they may know something that we don`t.

VELEZ-MITCHELL: Well, to your point, Wendy Murphy, there is a lack of trust and maybe even of paranoia by the defense. The defense is arguing that all of the labs in Florida are affiliated with the government, in other words, sort of implying that they might not do these tests completely objectively.

MURPHY: That`s the issue. There are a lot of places that work almost exclusively for defense attorneys. I mean, it just doesn`t take this long to know that you might want to hire an expert for this.

Waiting for the last minute is usually just a delay tactic. This is not that creative. All I`m saying is there`s a time -- the caller is absolutely right. There`s a ton of evidence in this case we know nothing about. And that, I think, speaks to the truth here. The defense is dragging their feet. So why are they so worried about...?

VELEZ-MITCHELL: Up next, a cop...

VELEZ-MITCHELL: Stunning new video captures a cop faking the arrest of a 15-year-old boy who the officer says had sex with his stepdaughter. Is this an abuse of authority or just an overprotective dad teaching the teen a lesson he`ll never forget.

Tonight, outrage after a cop is accused of crossing the line when he allegedly stages the fake arrest of a 15-year-old boy, he says had sex with his 14-year-old daughter. The cop drove up in his motorcycle and barged into the boy`s house unannounced in full uniform, allegedly. Now here`s how it went down.

UNIDENTIFIED MALE: This does not bode well for you, you know what that means? No. Not a good thing that the person you had sex with is a cop`s daughter.

VELEZ-MITCHELL: We`ve got that video from the "San Jose Mercury News", the boy said he was terrified. His parents are furious and they told "Good Morning America", they didn`t know what to do.

(BEGIN VIDEO CLIP)

NICOLE VILLARRUEL, SON ALLEGED VICTIM OF STAGED ARREST: We asked him, why are you looking for him? And he just says well, he`s going to be arresting him for sexual assault.

VELEZ-MITCHELL: Yes. The parents did have the wherewithal to take out the cell phone camera and videotaped that. The officer is now on leave while Internal Affairs investigates. The cop`s attorney says that cop did nothing wrong and says the cell phone video actually proves it.

Is this is shocking abuse of police power or just a concerned dad who happens to be a cop trying to watch out for his stepdaughter? You be the judge. Call me, 1-877-JVM-SAYS.

Straight out to my fantastic expert panel: Mike Brooks, HLN law enforcement analyst, in your opinion did this officer cross the line?

MIKE BROOKS, HLN LAW ENFORCEMENT ANALYST: Yes, I tell you what, he might be a concerned father. But was this the way to go about it? Absolutely not. But somewhere in between all the different stories, between the boy, the 15-year-old boy`s parents, videotaping this on their phone.

And the father also said to him, "Use your head". During that you heard him say, "Use your head." Think about what he`s saying to you. Listen to his words. Replay them in your head. And that`s what the father said.

Did the father condone this to a point? And then they decided wait a minute, it`s not the way to go -- we can do better (ph).

Look the cop should not have gone over there in his uniform. They should have gone over and got together with his parents and gone about it a little bit different. But somewhere in between lies the real truth, I think, Jane.

VELEZ-MITCHELL: Well, you raised some good points.

My big issue tonight: is this a case of vigilante justice, even though it involves a cop? What if every police officer took matters into their own hands when something angered them?

UNIDENTIFIED MALE: Growing up and being in high school, a cop`s daughter is not someone you mess around with. You`re stupid.

VELEZ-MITCHELL: I mean, come on, Wendy Murphy, what if a cop buys a car and it is a lemon, should the officer be able to cuff the guy who sold him the bad car? What if a cop feels he got poor service at a diner? Should he be able to handcuff the waitress, Wendy?

WENDY MURPHY, AUTHOR, "AND JUSTICE FOR SOME": Look, cops get free doughnut. I already think that`s a problem, you know?

BROOKS: Hey, hey, hey, Wendy. Come on.

MURPHYS: Some of them are too fat. I think -- you know I actually think this is very scary and you know, I`m scared of cops. So I think he shouldn`t have done it. But, when I think this kind of thing can helps as is the family of a kid who`s 14 or 15, he`s moving in the wrong direction, if the family calls the police and says, can you help us? We`re a family in trouble. We`re trying to deal with our kid. He`s a little out of control.

That`s not what happened here. And that`s what makes it wrong.

BROOKS: Yes.

MURPHY: No, he can`t be a cop for his own personal family problems. It`s absolutely unacceptable. Is it a big lawsuit? No. But you know, will it get an internal investigation? Will he get a slap on the wrist? Probably.

VELEZ-MITCHELL: Well, you know what`s really kind of to me is that, the San Jose Police are saying, our department has no policy prohibiting an officer to prosecute a case when he or she knows the parties involved or is emotionally involved in the incident. And that kind of worried me, Robi Ludwig, because we know Internal Affairs -- they can do a great job. But sometimes they rubber stamp the officer`s behavior, too. That has happened.

ROBI LUDWIG, PSYCHOTHERAPIST: Right, exactly. And very often, we know police officers protect their own.

Listen, this is a boundary issue. And there was also an anger management. It does sound like this policeman was enraged. He used his power to intimidate this kid.

Did he have a point? Maybe. But, I think -- I think that it should have been handled out of his uniform in a much different fashion. It sounds like he was really enraged and couldn`t stop himself.

You can`t abuse your role and position to intimidate a child. I don`t care what the situation is when it has to do with your own family. It just doesn`t sound right.

(CROSSTALK)

BROOKS: And look Jane, you know, he held this kid basically against his will. Could he possibly be looking at false arrest, false imprisonment? Yes both possibly criminal which I doubt it, but also civil against the department and this officer.

VELEZ-MITCHELL: Yes. Now the 15-year-old boy has been charged with unlawful sex with a minor. When the officer came to the house, the boy`s father recorded the visit on his cell phone and then handed the footage over to the "San Jose Mercury News".

Here`s another look at what the officer told this 15-year-old boy.

UNIDENTIFIED MALE: If I see you anywhere near our house, anywhere near my home, anywhere near my daughter, I`ll arrest you. Do you believe this time?

VELEZ-MITCHELL: Now, we should add that the officer`s stepdaughter was also scared straight with a fake drive to juvie hall and she`s also facing misdemeanor charges related to underage sex. They`re both underage, they had sex with each other.

Here`s my question, Wendy Murphy, this cop lives a block away or so from this family. And now the family said they`re scared and the kid`s terrified that the cop is right down the block. Could he get a restraining order against an officer?

MURPHY: Unlikely. You know, look, it doesn`t sound like the cop was trying to be particularly vindictive or malicious especially knowing that the girl got in the same kind of trouble. Scared straight for some people is not a bad idea. Usually you do it with the parents` permission and that`s what I think is wrong here.

BROOKS: Right.

MURPHY: And I`ll say this, you don`t go after two underage kids of the same age that are doing sexual things with each other. That burns me and I`m a big victim advocate, but you don`t do that to kids. You teach them, you don`t punish them because sex at that age is a very important thing for them to explore. That makes me crazy.

(CROSSTALK)

BROOKS: Have the two kids sit down in front of all four parents. I think that probably would have scared them straight even more.

MURPHY: Right.

VELEZ-MITCHELL: I think it`s kind of sex and --

(CROSSTALK)

VELEZ-MITCHELL: -- the boy, if it`s consensual and their both underage, that the boy is to blame. But the girl is not -- I think they`re both doing essentially the same thing.

MURPHY: No, they both got in trouble.

VELEZ-MITCHELL: Yes, they did.

MURPHY: They both got in trouble in this case. But maybe there`s a different way to handle it, too.

VELEZ-MITCHELL: Joyce, Oklahoma, your question or thought, ma`am.

JOYCE, OKLAHOMA (via telephone): Well, I think it is just pretty ironic that the young man has not been charged with statutory rape and the little girl -- she needs to have more attention at home. It`s bothering me that all your panel up there, is thinking, ok, slap their hands and let them go.

We`ve done that for so long that look at the world now. This young man needs to be taught a lesson and her father, she -- I think he did probably overdo it. But, it needed to be brought out.

(CROSSTALK)

VELEZ-MITCHELL: Joyce, in Oklahoma, you seem to think that the boy is somehow more to blame than the girl and you know, when they`re both under- aged, Robi Ludwig, I don`t necessarily buy it. They`re both kids who are maybe exploring in the wrong way.

LUDWIG: Exactly. I think it`s chauvinistic to just blame the boy. But I do think your caller brings up a good point. There are reasons why kids have sex early. Perhaps that is the underlying issue. Instead of criminalizing the behavior, maybe it does have to do with seeking attention, needing love, not learning about sexual education within the home.

Who knows what the various factors are, but we have to look at this as a symptom of other things going on.

VELEZ-MITCHELL: Yes, but, I have to say beyond the whole technicality, the details of this story, what scarce me as an officer, crossing the line between professional and personal. And basically making personal threats to say you made a mistake by fooling around with the daughter of a cop. That`s personal.

That same mentality applied to somebody who stops me in the dead of night and says get out of your car. That`s what scares me, Mike Brooks.

BROOKS: Well, apparently this guy has apparently a clean record with the department up until this particular incident. So was this a father who was acting out because he was a cop? Yes. Did he overstep his boundaries as an officer? Absolutely.

VELEZ-MITCHELL: Yes. I`ll just say, they have guns, they have uniforms, they have a lot of power and that comes with a lot of responsibility. And I love the police.

MICHAEL LOHAN, LINDSAY LOHAN`S FATHER: It`s a horrible situation. I just hope the judge remands Lindsay to a rehab for a longer period of time. And that people in Lindsay`s life that are destroying her life and leading her down the wrong path are weeded out.

VELEZ-MITCHELL: Turning now to our tough and fair justice system that is finally treating Lindsay Lohan exactly like everyone else. I`m just kidding. The starlet has once again been served with a dose of revolving door justice, Hollywood style.

This case is truly out of control. Lindsay was ordered to court on Friday. We reported it here on ISSUES after failing a drug test. A violation of her probation, a tough judge sent Lindsay Lohan to the slammer for 30 days without bail, almost everybody cheered and said way to go judge.

But then just when we thought this judge had finally put her in her place, Lindsay`s lawyers pulled some last-minute appeal magic. And she was out

In hours Lindsay posted $300,000 bond and sauntered out after just 14 hours. How does this keep happening over and over and over again? This whole mess stems back to back DUIs in 2007; that`s when it all started.

TMZ reporting Lohan will head back to rehab sometime today, this evening, maybe she`s already there for the fifth time. Yesterday, she was out doing charity work at an L.A. homeless shelter. Was it a genuine gesture or is she using rehab and philanthropy to sort of butter up the judge?

And will it be enough to keep her out of jail yet again?

Straight out to my fantastic panel, I want to start with Dylan Howard, senior executive editor of Radar Online. Dylan, I don`t even know I want to know what the very latest is.

DYLAN HOWARD, SENIOR EXECUTIVE EDITOR, RADARONLINE.COM: Well Jane, breaking news in the last few minutes with reports that Lindsay Lohan is headed to rehab. This is not court-appointed this is of her own volition. Well, so she would have us believe that RadarOnline reported after speaking to a close confidante of Lindsay Lohan that she really hasn`t grasped with the severity of this.

As one person says she`s delusional and she doesn`t realized that her substance abuse issues has the potential to kill her. That said though, she is due to go to an undisclosed rehabilitation center in Southern California as soon as tonight.

VELEZ-MITCHELL: I`ve got to say, Howard Samuels, there are two issues here. And everybody seems to get confused with them. One is, is rehab or jail better for anybody? And the other is, is she getting treated just like everybody else? Those are two separate issues, because if rehab is one of the way to go, then I say way to go, go to rehab.

But let`s send everybody who`s behind bars doing hard time for drugs to rehab. Let`s not just have sympathy for her. Let`s have sympathy for everybody in the same boat. That`s where I get upset. We do have a two- tiered system of justice in America. And she embodies it -- Howard.

HOWARD SAMUELS, CEO, THE HILLS TREATMENT CENTER IN L.A.: Well, you know what, Jane, you`re absolutely right. I mean, the reason jail is a very important component of addicts like myself to get sober is because jail really helps create a bottom, it helps create the emotional pain of the realization of where your life has ended up.

So, that to me, is a very important ingredient in this case and in many cases. Because jail and the police and the courts are great intervention tools for people like myself to help people with.

Now, the second issue is, you know, going to rehab is just the beginning. And it really depends on the judge in this case on how far this client is going to stay in rehab.

VELEZ-MITCHELL: Yes, you know --

(CROSSTALK)

SAMUELS: But let me tell you, let me tell you, the client has money. If -- if a drug addict has no money, they would have never have gotten out of jail. The only reason Lindsay got out of jail is because she had money to pay a lawyer to do it.

VELEZ-MITCHELL: Exactly.

Now, here is my big issue, deja vu justice. That`s right. Just last month, Lindsay got an equally meaningless sentence. Let`s -- let`s listen back.

JUDGE MARSHA N. REVEL, PRESIDING JUDGE: The defendant is ordered to spend 30 days in jail on this reckless driving case, 30 days in jail on the first DUI case consecutive, and 30 days in jail on the second DUI case consecutive. That`s 90 days in jail.

VELEZ-MITCHELL: Did you see that? Remember that? Where she goes -- Lindsay serves just two weeks of the 90-day jail sentence. And she served only three weeks of the 90-day rehab sentence when they let her out and saying oh she wasn`t as bad as we thought she was.

Wendy Murphy, soon after that, she tested positive for cocaine. Could this happen anywhere but in Hollywood?

MURPHY: You know that -- that whole environment is so crazy that when you talk about the justice system, it`s like all the other 49 states and then L.A. or California. Look, it`s terrible to have a two-tiered system. But it is a reality. Wealthy people get a much better shot at justice and addiction generally is not treated like a crime compared to, for example, crimes of personal violence.

I think she deserves to be held, I do think when you drive drunk and you`re told if you -- you know, don`t do your probation you will go to jail. The system has to be honorable about its threat otherwise it looks like a stupid system which it exactly is.

(CROSSTALK)

VELEZ-MITCHELL: Exactly. It looks like that right now. It looks like a joke right now. It looks like a total 100 percent joke.

MURPHY: But Jane, but Jane, I just want to make --

(CROSSTALK)

VELEZ-MITCHELL: And if I were somebody -- if I were somebody behind bars doing hard time for a little bag of crack, doing a life sentence, I would be mad.

MURPHY: Yes but that`s my --

VELEZ-MITCHELL: I would be very mad watching this saga unfold on television. Let me go to a caller. Ten seconds.

MURPHY: I was just going to say, you know Phillip Garrido could be in that bed instead of her and we have to be careful about not putting too many people like her in there just to prove that the system should be fair.

VELEZ-MITCHELL: Robin, West Virginia, your question or thought, ma`am.

ROBIN, WEST VIRGINIA (via telephone): Yes, Jane, thanks for taking my call. I love you.

I believe Lindsay does need help. She probably does need some rehab. I think her problem is that she feels so empowered by the lifestyle that she`s led, that she knows that nothing can touch her. I feel --

VELEZ-MITCHELL: Great point. More on the other side.

A slew of spectacular celebrities showed up to fight cruel animal experimentation including Pamela Anderson, Eva Mendez -- there`s Eva -- Joanna Krupa, there she is. And Kelly Osbourne -- there`s Kelly, as well as CSI star Jorja Fox.

We had some fabulous fun with all of them and especially with Charo who got an award for cracking down on bull fighting.

All right, back to Lindsay Lohan. The question remaining, jail or rehab? We can`t forget Lindsay`s an addict. She clearly needs more than some brief half-hearted stay at some rehab.

BARBARA WALTERS, CO-HOST, "THE VIEW": It really takes a very long time. It`s not one month, or two month or three months. And if she`s going to rehab, then the court has to say -- I don`t know, a year, even two years.

(CROSSTALK)

WALTERS: This is a very sick girl who admits that it`s a disease. And she`s young enough to combat this disease. It`s not like we go in and we go out. Even six months in jail that`s not going to help her. It really has to be a long period. People do not understand what real rehab is because as you say, there`s too much making fun of it.

VELEZ-MITCHELL: Howard Samuels. Here`s my concern, she`s checking herself into rehab and we`re supposed to applaud her. But it could be a cynical PR move designed to placate the judge she humiliated when he sends her to 30 days and she got out after a couple of hours. Now, she has to face him on October 22nd. I mean why doesn`t the judge just send her away to rehab for a year or two?

SAMUELS: well, first of all, Jane, what she did was very typical. I mean most clients that are like this are about to look at a jail sentence, they all go to rehab. This is what their lawyer tells them to do.

They go to rehab. They try to get good conduct letters from the rehab. They go back to the jail. They go back to the court. The court then does a progress report.

And this is what I said earlier, this whole deal is up to the judge on how long she stays in rehab, the judge and the treatment team. Now, what her lawyers are going to try to do and she`s going to try to get her lawyers to get her out of there in 30 to 60 days. That`s what the courts and the treatment team have to fight against.

VELEZ-MITCHELL: Listen Dylan Howard, the reason I say it`s a totally two-tiered system is that let`s go back to what she originally did. There were two DUIs. In one of them, she allegedly commandeered a car with two people inside, took them on a high-speed chase down Pacific Coast Highway and chased after the mother of her personal assistant who was so scared she called 911.

Wouldn`t an average guy be charged, Dylan, with car-jacking?

HOWARD: They would, indeed. Unfortunately for Lindsay Lohan, she has appeared to become a law unto herself. And that`s exemplified by the fact that she thumbed her nose at the probation numerous times. To be done again with drugs.

The question now is, can someone be helped who can`t help themselves?
