911 Calls From Missing Hailey`s Mother About Boyfriend Adkins

NANCY GRACE, HOST: Breaking news tonight, live, Texas. A 13-year-old cheerleader, broad daylight, leaves home by foot to head down the street to a little friend`s house. She`s never seen again. Bloodhounds scan the neighborhood and a local motel. Police combing motel surveillance video. No sign of Hailey. Did Mommy and the boyfriend throw a New Year`s Eve party just 72 hours after Hailey goes missing? Mommy says no.

Oddly, in police interviews, the boyfriend starts out saying, quote, what a "good girl" Hailey is, but then does a 180, claiming the 13-year-old little girl is promiscuous. A horrific scenario emerges. Hailey`s grandmother fears Mommy`s live-in molests 13-year-old Hailey, then murders her when she threatens to tell. Eerie slasher videos emerge, mommy`s live- in wearing a black hood, black S&M-type mask, black ninja outfit, acting out slice and dice scenarios on camera, chainsaws, machetes, knives, aprons for catching blood splatter, straight out of a horror movie. Oh, and he`s apparently smoking pot on video. We have the video.

And live-in Shawn Adkins speaks out, claiming he prays for Hailey`s return. But still at this hour, no one confirms he`s at church on his knees this past Sunday. Cops seize Hailey`s bed sheets, performing forensic tests to determine if a molestation and/or a murder occurred there. Did the live-in have access to sulfuric acid, and could it destroy a child`s body? And now to top it off, boyfriend Shawn Adkins goes on line, posting photos of himself with Hailey, talking about how much he loves her. We go to the boyfriend`s house to ask questions, but they claim he`s not there. But hey, his truck`s parked right out in front the whole time.

Bombshell, tonight. Multiple 911 calls, death threats by live-in Shawn Adkins, threatening to kill Hailey and her mother. We have the 911 calls. And tonight, we learn one of Hailey`s red hoop earrings found on her father`s living room floor, matching the earring Hailey wearing when she goes missing. But he and his girlfriend say he was never there that day.

As we go to air, child services yanks Hailey`s brother out of the family home, puts him into protective state custody. Why? Tonight, where is 13-year-old cheerleader Hailey Dunn?

BILLIE DUNN, HAILEY`S MOTHER: I really need to file a report on somebody, and I don`t have a car to get down there.

911 OPERATOR: What exactly happened?

BILLIE DUNN: I broke up with this guy a couple of days ago, and he`s a little MHMR (ph). And he`s telling me that he`s going to kill me and my ex-husband and that it`s going to be remembered for a long time. And he keeps on texting me and texting me. And I`ve texted back just to try to calm him down a little, but he said it`s going to happen.

911 OPERATOR: I`ve got a lady at 1804 Chestnut who wants to file a report on her ex-husband that`s threatening to kill her.

UNIDENTIFIED MALE: Oh, God! She`s been going all day.

BILLIE DUNN: My boyfriend and I just broke up yesterday, but he`s saying he`s going to go into my house to get his T-shirts, and I don`t want him in there while I`m gone because I don`t know what he`ll take.

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. Multiple 911 calls, death threats by live-in Shawn Adkins, threatening to kill Hailey and her mother. We have the 911 calls.

And tonight, we learn one of Hailey`s red hoop earrings found on her father`s living room floor, matching the earring Hailey wearing when she goes missing. As we go to air, child services yanks Hailey`s brother out of the family home, putting the brother into state custody. Why?

BILLIE DUNN: Hello. My name is Billie. My boyfriend and I just broke up yesterday.

911 OPERATOR: And what is his name?

BILLIE DUNN: His name is Shawn Adkins. And he`s telling me that he`s going to kill me.

911 OPERATOR: He wants to go get his T-shirt?

BILLIE DUNN: Yes. Apparently, he left his T-shirt over there when he spent the night one night. And I just don`t trust him enough to go in there. Is there any way anybody can keep an eye over there?

He`s wanting to go in there. He knows that I don`t lock up, like, my windows. Sometimes, I don`t even lock the doors. And he knows that. So I`m kind of worried he could walk out with a TV or anything, my son`s XBox.

UNIDENTIFIED MALE: OK, we`ve been having a big problem with those two all day.

BILLIE DUNN: And he`s telling me that he`s going to kill me. He said it`s going to happen.

911 OPERATOR: Colorado City Police Department. Jeremy (ph) speaking.

BILLIE DUNN: Jeremy, I really need to file a report on somebody, and I don`t have a car to get down there.

911 OPERATOR: OK. Where are you at?

BILLIE DUNN: I`m at 1804 Chestnut.

911 OPERATOR: Hold on one second. What is your name?

GRACE: We are taking your calls. Straight out to Rupa Mikkilineni, standing by at Hailey`s home there in Colorado City, Texas. Rupa, what can you tell me about these 911 calls?

RUPA MIKKILINENI, NANCY GRACE PRODUCER: Well, that`s right, Nancy. About a year ago, on February 14th, Valentine`s Day, we understand that she -- that Billie Dunn called 911 and basically said that she was fearful of her home and -- sorry, I don`t hear anything now.

GRACE: OK, Rupa, hold on. Tell Rupa to hold. Our satellite`s down. I`m going to go to Jean Casarez. Jean, I`ll go back to Rupa on the 911 calls. I want to talk about that earring, Hailey`s earring, the one her mom confirms she was wearing that set of earrings the day she goes missing, is found on the father`s living room floor?

JEAN CASAREZ, "IN SESSION": Yes.

GRACE: He and the girlfriend said she never came over that day.

CASAREZ: Here`s the background. Mother gave her red hoop earrings. She wore them over on Christmas Day. She spent the night at Clint`s, her father`s home, Christmas night, came back home. She thought -- I`m talking about Billie. She thought she still had the red earrings on. She didn`t think she came back with just one on or none on. But then after Hailey went missing, Clint and his girlfriend moved out of their apartment. Her son found one of those red earrings.

So the question is, did Hailey go to Clint`s house, her father`s house, who lives a short distance away, the day she went missing and somehow lost an earring?

GRACE: And Jean Casarez, that`s not all because the girlfriend, when originally asked, Clint Dunn`s girlfriend, Has Hailey been over there, she originally said, Yes, she came over. And then, I don`t know how much time passed, a couple of days, she goes, Oh, no, I was mistaken. She wasn`t here.

CASAREZ: And Nancy, in addition to that, the lady that owns the hair salon close by confirms that she believes she saw Hailey Monday, the 27th of December, between 11:00 and 1:00, walking near the house with a young boy. They believe that young boy would be the girlfriend of Clint the father`s -- her son.

GRACE: OK. Back to Rupa Mikkilineni. Rupa, I want to find out about these 911 calls.

MIKKILINENI: Right, Nancy. Billie Dunn, on February 14th, Valentine`s Day, called the police, frantically saying -- called from work saying that she had just broken up with her boyfriend -- this is Shawn Adkins -- and that she was worried that he might come back to the house. He mentioned he might come back to the house to pick up a T-shirt. But she was concerned because her 16-year-old son, David, was in the house, and that she didn`t want any trouble between her 16-year-old son, David, and Shawn Adkins.

She was also concerned that he might take stuff from the house -- a TV, her son`s XBox, who knows? And then we have a second call just a couple of hours later, her frantically saying that Shawn Adkins sent text messages, phone calls, phone messages threatening her life and Clint Dunn`s life. This is her ex-husband -- threatening their lives.

GRACE: Take a listen to the 911 calls.

BILLIE DUNN: Jeremy, I really need to file a report on somebody, and I don`t have a car to get down there.

911 OPERATOR: Hold on one second. What is your name?

BILLIE DUNN: Billie Dunn.

911 OPERATOR: Billie Dunn? What exactly happened?

BILLIE DUNN: I broke up with this guy a couple of days ago, and he`s a little MHMR. And he`s telling me that he`s going to kill me and my ex- husband and that it`s going to be remembered for a long time. And he keeps on texting me and texting me, and I`ve texted back, just to try to couple him down a little, but he said it`s going to happen.

911 OPERATOR: OK. And what`s your phone number?

BILLIE DUNN: (DELETED)

911 OPERATOR: OK, I`ll send an officer over to 1804 Chestnut.

BILLIE DUNN: Thank you.

911 OPERATOR: Thank you.

GRACE: Joining us tonight, Billie Dunn. This is Hailey`s mother. What led you -- can you hear me, Billie? Billie, can you hear me? OK, I`m not -- she can`t hear me. Try to fix the satellite.

What I don`t understand, Rupa Mikkilineni, is why, after he had threatened to kill her and the daughter, she let him back in the house. And what brought the whole thing about, Rupa?

OK, Jean, what do you know?

CASAREZ: Nancy, this was a time, it was very volatile. And they did break up. It was Valentine`s Day of last year, 2010. He had gone and taken one of her debit cards without her knowing it, so that`s why she believed that he could take other things. That`s why the first cell phone call came. The second one, it was reporting of a criminal threat. And law enforcement took it like a joke, and now a little girl has gone missing.

BILLIE DUNN: I broke up with this guy a couple of days ago, and he`s a little MHMR. And he`s telling me that he`s going to kill me and my ex- husband, and that it`s going to be remembered for a long time.

BILLIE DUNN: Hello. My name is Billie.

I`m scared to death that somebody hurt her.

His name is Shawn Adkins.

SHAWN ADKINS, MOTHER`S BOYFRIEND: We all get along just fine. I would never do nothing to that little girl.

BILLIE DUNN: I just don`t trust him enough.

ADKINS: It`s frustrating, you know, what she said about me.

BILLIE DUNN: Sometimes I don`t even lock the doors, and he knows that.

At first, of course, I never would have thought he could have anything to do with Hailey`s disappearance or could ever hurt her.

UNIDENTIFIED MALE: She called in saying that he was threatening to physically harm her and/or kill her.

BILLIE DUNN: But now he`s just not being cooperative and not talking to them.

ADKINS: I love her with all my heart, and I believe she loves me with all her heart.

UNIDENTIFIED MALE: We got a call over here from her boyfriend saying that she was possibly suicidal, threatening to take a bunch of pills.

ADKINS: We get along just fine.

UNIDENTIFIED MALE: We`ve been having a big problem with those two all day.

UNIDENTIFIED FEMALE: How close are we to an arrest in this case?

UNIDENTIFIED MALE: Well, it will really depend upon when the investigators, as well as prosecution, look at that and say they feel like they`ve got an overwhelming case to put somebody in jail and keep them there. So basically, the prosecution determines some of that. And there are a lot of different parameters to evidence that you want to have in place in order to make sure your prosecution in your case is successful.

There are still persons of interest beyond Mr. Adkins. And you know, they`re working on all those leads and still trying to corroborate, you know, all the different aspects of evidence that they have available.

UNIDENTIFIED MALE: Yes?

911 OPERATOR: You the officer on duty?

UNIDENTIFIED MALE: For now.

911 OPERATOR: I got a lady at 1804 Chestnut who wants to file a report on her ex-husband because he`s threatening to kill her.

UNIDENTIFIED MALE: Damn it, 1804 Chestnut!

911 OPERATOR: Yes, it`s Billie Dunn.

UNIDENTIFIED MALE: Oh, God! She`s been going all day. All right, I`ll go up there.

911 OPERATOR: OK.

UNIDENTIFIED MALE: Bye.

GRACE: I just wonder who that officer was that says, "Oh, God," basically using the Lord`s name in vain, "she`s been calling all day," like what a pain she is. Well, Officer, whoever you are, Hailey`s missing now. And that boyfriend, calling, threatening to kill her, is the number one suspect.

Let`s try to go back out to Billie Dunn again. Liz, do we have that satellite fixed? Billie, can you hear me?

BILLIE DUNN: Yes.

GRACE: Billie, what happened surrounding your 911 calls regarding Shawn Adkins threatening to kill you and Hailey?

BILLIE DUNN: OK. He didn`t threaten to kill Hailey. They weren`t frantic 911 calls. I called the police from work because Shawn had been threatening me, and he said he was coming to my house while I was at work and I didn`t want him in here. And he was making threats to my life.

GRACE: OK. In the affidavits, the police affidavits, it states that you said he had threatened to kill you and Hailey. So were you telling the truth...

BILLIE DUNN: He said that. I never said that.

GRACE: Who said that?

BILLIE DUNN: I was, and I didn`t say that in the affidavit. I think it says Shawn actually admitted saying that.

GRACE: So tell me why you called 911?

BILLIE DUNN: I called the police station from work because he was threatening -- he was threatening my life. He was saying he was going to come to my house and get a T-shirt. I didn`t want him in here getting anything when I wasn`t here.

GRACE: I`ve got the police affidavit right here. Colorado City police respond to 1804 Chestnut. Adkins alleged to have threatened to kill Billie Jean (ph) Dunn and Hailey Dunn during the dispute. Adkins informs investigators he never did that, but later confirmed he did threaten both of them. So the call was not made by him. The information was given by you. He first denied it. And then he confirmed it.

BILLIE DUNN: Well, I did, too. I denied it, too, because if he had ever told me that he was going to kill Hailey or David, he wouldn`t have been anywhere around.

GRACE: So all of your 911 calls were just because you were afraid that he was coming into your house without your authority?

BILLIE DUNN: Yes. And he was threatening me. I didn`t want him here.

GRACE: He was threatening you, saying what?

BILLIE DUNN: I can`t even remember now, but I know he was threatening to kill me and Clint, Hailey`s dad.

GRACE: Well, in this police affidavit, it says that Adkins alleged to have threatened to threatened to kill Billie Jean Dunn and Hailey Dunn during the dispute. And my question is, even if he hadn`t threatened to kill Hailey and the police have it all wrong, why did you think it was OK to take him back in?

BILLIE DUNN: We had a rocky relationship. The last year, things have been really good. The last six months, things have been awesome.

GRACE: What can you tell me about that earring, Billie, the earring that was found on Clint Dunn`s living room floor? Did it match what Hailey was wearing when she went missing?

BILLIE DUNN: Yes. I reported when she was missing that I thought she was wearing those red hoop earrings. She had been wearing them for about a week. She was actually trying to stretch out her earlobe, and I told her she could use those, but that`s the biggest she could go and she had been wearing them. And David found the earring on the floor whenever Clint and Naomi (ph) were moving out and brought it home.

ADKINS: And as far as me, Hailey, and Billie and David, you know, we all get along just fine.

BILLIE DUNN: My boyfriend and I just broke up yesterday.

ADKINS: I just wish for her safe return.

BILLIE DUNN: It`s just not helping getting Hailey found.

BILLIE DUNN: I never would have thought that he could hurt me or the kids.

He`s saying he`s going to go into my house.

If I had ever thought he was going to hurt -- definitely my children, but myself even.

My 15-year-old son may be there also, so I don`t want him going over there causing problems with him, either.

He would have been out of here and he wouldn`t have come back.

He knows that I don`t lock up, like, my windows. So I`m kind of worried.

I love him. Yet again, I`m still -- I worry. What if he did do something to Hailey?

GRACE: We are taking your calls. Out to Holly in Arkansas. Hi, Holly.

UNIDENTIFIED FEMALE: Hi, Nancy. My question is, in the video, he was smoking dope. He was on a boat. Does he have access to that boat to get it in the water? Because in Colorado City, there are two lakes. And have they dredged those lakes?

GRACE: You know, that`s a good question. To Billie Dunn. Does Shawn Adkins have access to a boat?

BILLIE DUNN: No. I know his grandma used to have that boat. It doesn`t run. And we do have the -- sorry -- the game warden out at the lakes has been looking.

GRACE: You have what at the lake?

BILLIE DUNN: The game wardens.

GRACE: So they have been looking in the lakes. OK.

I want to go to Lillian Glass, Dr. Lillian Glass, psychologist of body language expert, author of "Toxic People." Lillian, I`ve got in my hand and I`m reading verbatim where the police say they`ve gone to the home, Adkins alleged to have threatened to kill Billie Jean Dunn and Hailey. First he denies it, then he admits he threatened both of their lives. So why tonight am I hearing it wasn`t like that?

LILLIAN GLASS, PSYCHOLOGIST: Because it seems like Billie`s in denial. It seems like she hasn`t wrapped herself around the truth at this point in time because she is in denial. And it also sounds like she`s a victim of somebody who has been very abusive in the relationship. And this is typical behavior. They try to protect the person that they allegedly love. And even though somebody`s been threatened, they ignore it.

GRACE: Unleash the lawyers. Joining us tonight out of New York, Doug Burns. Out of San Francisco, Daniel Horowitz. Doug Burns, weigh in on the facts as we know them tonight.

DOUG BURNS, DEFENSE ATTORNEY: Well, it`s a highly suspicious situation, obviously. You have a boyfriend who`s threatened to kill at least the mother and her ex-husband, and as you say, in the affidavit, the child. But the question at this point, Nancy, is what can the police and the prosecutors reasonably prove? And we don`t know that yet.

GRACE: Daniel?

DANIEL HOROWITZ, DEFENSE ATTORNEY: I have trouble believing that Billie has not been beaten or roughed up by this guy at some time. I`d like to hear from her on that point.

GRACE: We are taking your calls. What we know tonight, an earring matching those Hailey wearing when she goes missing found on the floor of her father`s home.

BILLIE DUNN, MOM OF MISSING TEEN CHEERLEADER, HAILEY DUNN: He keeps on texting me and texting me, and I`ve texted back, just to try to calm him down a little.

UNIDENTIFIED MALE: He`s threatening to kill her.

UNIDENTIFIED MALE: Oh, god! She`s been going all day.

BILLIE DUNN: I don`t remember it, but I`m not going to deny it. I mean, we can say ugly things to each other. He`s telling me that he`s going to kill me.

UNIDENTIFIED MALE: That hurts. It does. I love her with all my heart.

BILLIE DUNN: If he did hurt my daughter, I`ll -- I`m -- I would be disgusted by that and would never speak to him again. And hope he gets what he deserves, anybody that hurt my daughter.

GRACE: Billie, you have a 16-year-old son. What time did he leave the house the night before?

BILLIE DUNN: I thought he left around -- he says he left around can 9:00 and Hailey was in his room playing his Xbox. I thought he left a little earlier.

GRACE: Now, what time did you see her last, the night before?

BILLIE DUNN: I saw her about 10:00 or 11:00 in her bedroom.

GRACE: Was she still playing games?

BILLIE DUNN: No, she was watching TV, laying in bed.

GRACE: Now, the next morning, you checked in on her before you left, and you believe you saw her lying in her bed, around 6:00 a.m., right?

BILLIE DUNN: Right.

GRACE: We are taking your calls, live. For those of you just joining us, we have just gotten a hold of 911 calls. They were back from Valentine`s Day where according to police affidavits, the live-in boyfriend Sean Adkins threatens to kill Bill Dunn and her daughter Hailey.

Tonight we also know an earring that little Hailey was apparently wearing all the time, wearing at the time she wept missing, found on the floor of her father`s home. But, remember, the father, Clint Dunn and his girlfriend say she wasn`t there that day.

Also tonight we learn the 16-year-old boy has been taken out of the family home and put into state custody.

Back to Billie Dunn, this is Hailey`s mother. I noticed in that 911 call you say "Sean Adkins is a little MHMR." Is that a mental health term?

BILLIE DUNN: I was calling him retarded.

GRACE: Can you tell me about that earring, Billie Dunn? The earring you think she was wearing?

BILLIE DUNN: It was a red hoop earring.

GRACE: I want to go to Priscilla Luong with KTAB. Priscilla, do you believe, based on your knowledge of the case, that police are keeping surveillance on the live-in boyfriend?

PRISCILLA LUONG, REPORTER, CNN AFFILIATE KTAB: Well, Nancy, as far as surveillance, I would not be able to tell you because they have not confirmed whether there are surveillance cameras around his house. But I am told they have officers patrolling the area keeping a really close watch on Sean Adkins.

GRACE: I want to go to Billie Dunn. Billie, I can see that you are angry or upset. You`re on the verge of tears. Look, we want to find Hailey. We want to find who`s responsible for her missing. And everything --

BILLIE DUNN: I want to be somebody looking for a live Hailey.

GRACE: I agree. Of course you do. That`s what everyone`s hope is. I know you don`t want to hear these 911 calls that happened in the past. I know you don`t want to think about all this. But every single thing matters, every little detail.

I know that you`re there with Marc Klaas. Marc, advise her, why everything, every detail is important.

MARC KLAAS, PRESIDENT AND FOUNDER, KLAASKIDS FOUNDATION: Well, you know, we know that and she knows that, but, you know, there`s a mother here that`s out of her mind looking for her daughter and there are guests on your show saying that she`s in denial. This woman isn`t in denial. This woman is trying to find her daughter.

There are plenty of scenarios that are possible in this case besides Sean Adkins. She seems to have, still, a decent feeling about this guy, and I would counsel everybody not to rush to judgment too soon.

You know, Nancy, she lives right off of Highway 20. It would be very easy for somebody to take the off-ramp, take this little girl, and then be driving off down the road. There are numerous things that could happen.

You know, we have search teams out here, looking for her now. And I think the focus has to be on finding a live little girl. There are plenty of avenues to investigate, but this is the most hopeful one and this is the one that I think needs to be pursued with vigor.

GRACE: You know what, Marc Klaas, you`re right. You are absolutely right. Police have come right out and said we have more than one suspect. As you and I discussed last night, same time, same place.

This is -- I don`t want tunnel vision on the live-in. He`s just given us so many red flags, Marc Klaas, so many, that you can`t help but look at him as police are doing, as a suspect. But, you know what, marc, my mind is open. I don`t want to ruin the case by tunnel vision. What other theories would you suggest?

KLAAS: Well, first of all, you know, I have to agree about Sean Adkins. Every day something else dribbles out that makes him look worse. Today that happens to be the 911 calls. But I think the whole possibility of somebody pulling in off the road and taking off with this girl is a very real possibility.

And I`ll tell you what I wish. I wish that America`s truckers had some way with of getting this information and being able to communicate it with each other via their DB radios. Because you know what, Nancy, there`s 2.5 million long haul truckers on our highways every day. They could be a great first responder force.

There are people in this town, there`s registered sex offenders in this town that could be hiding out this little girl. She could even have amnesia and be wandering around, I guess, in a worst-case scenario.

But the whole idea that people are saying that she`s in denial, people are saying that maybe she was alive at this point in time. Well, maybe she is alive. Maybe she`s waiting for us to find her. And that`s why we`re here right now. That`s why you`re here right now. And I would hope that we could sort of redirect some of that focus and try to look for this living little beautiful teenager.

GRACE: OK.

SHAWN: My first question is, early on we know that Hailey spoke to Clint`s mom and mentioned that Sean Adkins made her uncomfortable being outside of the door at night. And without being judgmental to Billie -- and Billie, you`re in my prayers all the time -- I want to know, did you notice any changes in your little girl? Was there a change in her behavior? Was there change in her sleep patterns?

Because usually if a child will speak out to an adult and say, you know what, I am uncomfortable, there`s something going. And I just want to know, was there any changes in Hailey that could help all of those around you to try to put all the pieces together as to what may have been going on when she disappeared?

GRACE: What about it, Billie Dunn? Any change at all in her behavior that you noticed?

BILLIE DUNN: No. Like I said, in the beginning, three years ago, she was very upset her dad and I broke up, but I don`t think Hailey feared Sean in the least. And she wouldn`t have been afraid to come to me. She knows that she was number one, her and David are number one. And I don`t think she would have been afraid to come to me.

And she didn`t sleep in her room until about a week ago. She slept in the living room on the couch. I think Clint`s mom is just upset. She wants someone to blame also, and that`s understandable. But I really believe Hailey would have come to me or her father. And I don`t think she was afraid of Sean.

GRACE: Why was your son, David, taken into state custody?

BILLIE DUNN: He wasn`t taken into state custody. From my understanding, it`s normal for CPS to come in and interview you, which they did. I placed David at my brother`s house. That`s best for him. I have people driving by, hollering awful things. But there was no courts involved. He`s not in state custody. He`s at my brother`s house and here every day

BILLIE DUNN: I wouldn`t kill myself, for sure. I have two children to take care of and I`m their -- I`m really their only caregiver. I`m the one who buys their food, their clothes. They need me. I`m their mother.

BILLIE DUNN: I really need to file a report on somebody and I don`t have a car to get down there.

UNIDENTIFIED MALE: What exactly happened?

BILLIE DUNN: I broke up with this guy a couple of days ago and he`s a little MHMR. And he`s telling me that he`s going to kill me and my ex- husband and that it`s going to be remembered for a long time. And he keeps on texting me and texting me. And I`ve texted back, just to try to calm him down a little, but he said it`s going to happen.

UNIDENTIFIED MALE: I`ve got a lady at 1804 Chestnut who wants to file a report on her ex-husband, because he`s threatening to kill her.

UNIDENTIFIED MALE: Oh, god! She`s been going all day.

BILLIE DUNN: My boyfriend and I just broke up yesterday. What he`s saying he`s going to go into my house to get his t-shirt and I don`t want him in there while I`m gone, because I don`t know what he`ll take.

GRACE: We are taking your calls live. Out to Jean Casarez. You know, I`ve got in my hand right here the wire, one of many, about the 16- year-old brother being taken into state custody, family protective custody. What do you know, Jean?

JEAN CASAREZ, LEGAL CORRESPONDENT, "IN SESSION": Child Protective Services in Texas. Well, your producers confirmed with police that temporary custody, the son was taken into that temporary custody. Now, maybe it`s a matter of semantics, but she did say that Child Protective Services had interviewed her and maybe they believed a safe place for him was her brother`s home, thus temporary custody by the state.

GRACE: What do you know, Rupa?

RUPA MIKKILINENI, "NANCY GRACE" PRODUCER: Nancy, that`s what I was told by a police spokesperson, Pete Kempner. He told me yesterday that David was in child protective services, as far as he knew. He confirmed again that as far as he knew today, that was still the case.

GRACE: And why was the son taken?

MIKKILINENI: He said that typically in these circumstances, when an investigation is going on and they consider the home is not exactly a safe environment, per se, they tend to reassess or assess whether the home is a proper environment for a child.

GRACE: And so a safe place could, in fact, be the brother, as Billie Dunn is telling us, be with the brother-in-law?

MIKKILINENI: That is absolutely correct.

GRACE: You know, to Andrew J. Scott, former chief of police, Boca Raton, now president of the AJS consulting, joining us out of Miami, I don`t like that cop`s attitude. I`m always on the side of cops, but I don`t like some cop saying, "Oh, god, it`s her again." This was about her child in her home and Sean Adkins. Now the child`s gone.

ANDREW J. SCOTT, FORMER CHIEF OF POLICY, BOCA RATON: Absolutely, Nancy. This is not the type of demeanor you expect from your paid law enforcement officers. Because an officer has been to a residence on and on and on does not necessarily give them any right to dismiss its validity. And that demeanor that comes across, it really sent chills up my spine.

If it was one of my officers, I could assure you that after listening to those tapes, he would be in my office or she would be in my office and she would be answering to it. And that also reflects possibly a lack of training and compassion. Domestic violence is an epidemic in this country. And we cannot have officers that just dismiss it the way this officer did.

GRACE: I want to unleash the lawyers again, as well as Ben Levitan, telecommunications expert joining us out of Raleigh. Jean Casarez, isn`t it true that the boyfriend has lawyered up. He`s got a defense lawyer who`s now made a statement saying he`s been wrongfully accused and the phone records placing him in the vicinity, back in the vicinity, of Hailey`s home that morning when he was supposed to be at work, could be wrong?

CASAREZ: Right, questioning the cell phone tower pings as to where physically Sean Adkins was, saying that you can be in one location, but it can ping on another tower. Well, that stuff`s allowed in court. A jury can determine based on the evidence of those cell phone pings what is relevant and what isn`t.

GRACE: What about it, Bill Levitan?

BILL LEVITAN, TELECOMMUNICATIONS EXPERT: The lawyers` statements are absolutely ridiculous, Nancy. I just can`t even believe that. I`ve looked at the records myself. I`ve placed, you know, I place him by his mother`s house, by Hailey`s house, and also in Stark. He was there. The records, you know, the records said that the police have got are very recent and very accurate. This is what`s used to make phone bills, and they`re challenged in courts all the time. What he`s saying is completely ludicrous.

GRACE: You know what I really want to find out, Bill Levitan, is about this mystery text we have heard was texted from Hailey`s phone at about 2:00 p.m., the day she goes missing Monday, saying, "What are you up to?" It`s said in slang, in letters, but that`s what she`s saying. Would we be able to tell from a text if that phone, Hailey`s phone, was at his mother`s house?

LEVITAN: Absolutely. We would know -- there`s always two times for a text message. There`s the time that it was sent and the time that the person received it. So you could send a text message and my phone could be off for a couple of days and I wouldn`t get it. And some people are trying to make something of that that there`s two different times. But that`s normal.

The technical data that the police can get from the phone company will tell you exactly within a couple of acres where Hailey was when she sent that text message, and it would also contain the contents of the message, and it will also tell you when the message was received. But that`s not relevant. What is relevant is when she sent the message.

To Dr. Leigh Vinocur, University of Maryland School of Medicine joining us out of Baltimore, thank you, Dr. Vinocur for being with us. Police say they have no forensics to suggest Hailey is dead. What type of forensics are they talking about?

DR. LEIGH VINOCUR, UNIVERSITY OF MARYLAND SCHOOL OF MEDICINE: Probably blood evidence, checked his truck and any other place that they suspected she would be and they were looking for blood evidence, DNA.

GRACE: Out to the lines. Kelly in Arizona. Hi, Kelly.

KELLY IN ARIZONA: Hi, Nancy. My concern is finding the neighbor or a temporary tenant who witnessed Hailey on the phone in the back yard. I think the timing of his departure is suspicious. He didn`t stay around long enough to talk to I in of the authorities. And I think he really needs to be identified and his vehicle needs to be searched.

GRACE: And remember, Kelly, we`ve also got to a woman I think kitty corner from their home as Billie Dunn has told me who does hair, and she`d just finished doing someone`s hair on Monday between 2:30 and 12:00, I believe it is, looks out and says she sees Hailey Dunn walking toward her father`s house.

I want to go back out to Priscilla Luong. What can you tell me about that neighbor spotting her at 12:00 in the back yard?

LUONG: Well, I speak to Jean yesterday, and she told me that she saw Hailey walking down the street with a small African-American boy about seven-years-old. She didn`t know who this young boy was. But she wanted to know whether that young boy has been questioned, Nancy.

TERESA IN TEXAS: Hi, Nancy. Thanks for taking my call. First of all, I just have a comment about the officer and the way he responded to his dispatcher as a fellow Texan. I`m highly embarrassed and appalled to hear that comment, a response out of an officer that`s there to protect and serve.

Second of all, no disrespect to Billie, I feel for her and pray for her daily, but in one of the pictures that they showed of Hailey and her mom, it looked like she had -- Hailey had a black eye in the picture. I was just wondering when the picture was taken, if that had been addressed, and if it was a black eye, do they know where that came from?

GRACE: You know, I have not seen her with a black eye in any photo. Not only me but to the New York control room, have you observed that? What about it, Billie?

BILLIE DUNN: She doesn`t have a picture with a black eye.

GRACE: Yes. No one`s able to confirm a black eye in any photo. Now, we can clearly see one on Zahra Baker. There`s no doubt about that. But believe me, I`ve looked over these photos with a fine-toothed comb. I have not seen any black eye on Hailey Dunn.

THEO IN MICHIGAN: Hi, Nancy. I love you. I was so happy when you became a mom.

GRACE: Me too.

THEO: I was very happy. Everybody knows that I love you and I follow you. Anyway, why did she file a police report on her boyfriend in the first place?

GRACE: Her account is that he threatened her and her ex-husband, Clint Dunn. The affidavit says he threatened all three of them, and that`s why she called. Everyone, the tip line, 325-728-5294, a $15,000 reward.
