Aired August 15, 2011 - 20:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

NANCY GRACE, HOST: Another American girl goes missing, Aruba. After Aruban police refuse to make a case against judge`s son Joran Van Der Sloot in the disappearance of Alabama girl Natalee Holloway, a young Maryland tourist, Robyn Gardner, disappears without a trace from the same spot as Holloway. American girl Robyn Gardner heads to an Aruban vacation with Giordano, a so-called traveling companion, as apparently just friends, no strings attached, never seen again.

Reports Gardner snorkeling just off Baby Beach, known for warm water and no waves, then, quote, "drifts out to sea." But not a single witness places Gardner at Baby Beach in the water snorkeling or even with snorkeling gear. Gardner`s so-called traveling companion, within minutes of hopping a plane out of the country, changes his story, now no longer even speaking with police.

The FBI swoops down in a late night search of Giordano`s Maryland home, a $1.3 million stone fortress with a vast security system, complete with multiple cameras in every area, including bedrooms. Cops searching for Gardner as far away as Venezuela.

Investigation on traveling companion Giordano reveals a dark past, cops now fearing Giordano named the wrong place to search for Gardner. Tonight, we uncover a string of seven women all who claim to have been stalked, harassed, propositioned or even secretly videotaped by Giordano.

Bombshell tonight. As Aruban police give up the search of Baby Beach, at this hour cops being lowered by rope and harness down into Aruban phosphate mines and wells, hundreds of feet deep, in the search for Robyn. So far, a lady`s pink tank top and black sandals recovered. Are they connected?

Cops compiling reams of surveillance tape from local restaurants, nightclubs, casinos to spot Gardner. In the last hours, a positive ID of Robyn with Giordano just hours before she`s reported missing, the two having a seaside lunch and both bone dry in street clothes. Two hours later, she`s gone.

Giordano`s lawyer demanding he be released immediately, the FBI and Aruban police scrambling for evidence before Giordano walks free. With Giordano set to walk free in just days unless more evidence uncovered, tonight, where is missing American girl Robyn Gardner?

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Mystery surrounding the disappearance of an American woman in Aruba.

GRACE: Where is Robyn Gardner?

UNIDENTIFIED MALE: It`s very hard not knowing.

UNIDENTIFIED MALE: Heads to court.

UNIDENTIFIED FEMALE: Fifty-year-old man named Gary Giordano.

UNIDENTIFIED MALE: Dubbed the prime suspect.

UNIDENTIFIED MALE: He is going to be detained.

UNIDENTIFIED MALE: Maybe he did something awful.

UNIDENTIFIED MALE: There were allegations going back and forth.

UNIDENTIFIED MALE: What`s very concerning, obviously, is his past trouble with women.

UNIDENTIFIED FEMALE: Now, this is the home where several women allege that he secretly videotaped them when they came over on dates.

UNIDENTIFIED FEMALE: Giordano and his former wife, Cline (ph), frequently fought.

UNIDENTIFIED MALE: (INAUDIBLE) and violence.

UNIDENTIFIED MALE: A mine was searched.

UNIDENTIFIED MALE: This man isn`t right.

UNIDENTIFIED MALE: Back in the States, his home was raided.

UNIDENTIFIED MALE: "Calculating" would be a good way of describing him.

UNIDENTIFIED MALE: They launch a pretty extensive search, but no sign of Robyn Gardner.

(END VIDEO CLIP)

GRACE: And to the heartland, Missouri, a suspect in the disappearance of the little girl on the pink bike, training wheels still attached. In just 20 minutes, 3-year-old Breeann disappears from in front of her parents` own home. Now a neighbor charged with murder.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: She`s just 3 years old.

GRACE: Vanished without a trace.

UNIDENTIFIED MALE: Out by herself, with her bicycle.

GRACE: Snatched directly in front of her own home.

UNIDENTIFIED MALE: You may remember the 3-year-old little girl with the curly brown hair. Well, she vanished last week while riding her bicycle in front of her yard.

(END VIDEO CLIP)

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. As Aruban police give up the search on Baby Beach, at this hour, cops being lowered by rope and harness deep, deep down into Aruban phosphate mines and wells hundreds of feet deep in the search for American girl Robyn Gardner.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: American woman missing in Aruba.

UNIDENTIFIED FEMALE: The judge decides if this man should still be held in the case.

UNIDENTIFIED MALE: Aruban authorities.

UNIDENTIFIED MALE: Have asked the FBI with help in obtaining computer and phone records.

UNIDENTIFIED MALE: Gary Giordano.

UNIDENTIFIED FEMALE: They think they`ve got their man that has the information as to what might have happened to Robyn Gardner.

UNIDENTIFIED MALE: He`s staying in jail.

UNIDENTIFIED MALE: A steady stream of FBI agents moved in and out of Gary Giordano`s house.

UNIDENTIFIED MALE: We`re here this evening to execute a federal search warrant on the residence of Gary Vincent Giordano.

UNIDENTIFIED MALE: His apartment was raided, laptops, cell phones taken out of there.

UNIDENTIFIED MALE: And any other evidence that might prove useful.

UNIDENTIFIED MALE: Going through the computer diagnostics could take some time.

UNIDENTIFIED MALE: They`re trying to establish any kind of link, any kind of communication between Giordano and Robyn Gardner.

UNIDENTIFIED FEMALE: He started telling me that if I went and I slept with him, he would make sure I was taken care of well financially. He said, If you let your daughter sleep with me, too, I`ll take care of both of y`all for rest of your lives financially. He started telling me stuff, like, that he would protect her. He said, It`s not going to be another Natalee Holloway or anything.

(END VIDEO CLIP)

GRACE: We are live in Aruba. That was video from ABC`s "GMA." It`s a woman who had contact with Aruban suspect Gary Giordano. He is an American who promised to take this girl, Robyn Gardner, on a trip as friends, no strings attached.

Tonight, we confirm that the two last sighted, as of tonight, in the place we identified last week. It`s called Jads dive shop. They showed up there -- it`s right there at Baby Beach -- bone dry. They were not dressed for diving. They were not dressed for snorkeling. They didn`t buy any snorkel or dive gear. In fact, they went into the restaurant and had a nice seaside lunch. Two hours later -- two hours later -- she is gone, according to traveling companion Gary Giordano.

We are live in Aruba. To Martin Savidge, CNN correspondent, joining us at Aruba. Today, Giordano, the American traveling companion, in court. What happened?

MARTIN SAVIDGE, CNN CORRESPONDENT: Well, this was a big day for the prosecution, no doubt about that, Nancy. They have been seeking to detain him for a further eight days. Of course, his defense attorney had said, Look, this is nothing more than just an accident in which Gary Giordano was witness to. There is no evidence that this is a crime.

Well, apparently, the judge did not buy it. Not only did the judge say, I`ll give you eight days, he gave them an additional eight more days, total 16 days that Gary Giordano will now be spending detained by Aruban authorities. This gives them extra breathing room to continue their investigation. He will now be moved to the only prison on the island.

GRACE: You know what? I do not feel any sense of security at all, Martin Savidge, by the fact that Aruban police have now bought eight days.

Everybody, this guy, traveling companion Gary Giordano, was technically already on American soil. He was trying to hop a plane out of the country, out of Aruba. He had already made it through Aruban customs, onto the other side, about to get on that plane, when authorities swoop down and pull him back into the country.

And tonight, live at Gaithersburg, Maryland, Rupa Mikkilineni, outside Giordano`s home -- it`s been described by his former girlfriend as a, quote, "stone fortress" -- there are videocameras all over the home, inside and out, including inside the bedroom, even a big sign posted to visitors, If you come here, you will be video and audiotaped.

Kind of creepy, Rupa, the FBI doing a late night search of that Gaithersburg home. What do you know, Rupa?

RUPA MIKKILINENI, NANCY GRACE PRODUCER: Nancy, I`m standing right in front of Gary Giordano`s home here in Gaithersburg, Maryland. You can see it behind me here. You see the driveway, and the house is set back. And it`s been described as a fortress. We know he bought this place for $1.2 million in 2005, Nancy. Now, how did he make this money? Nobody really knows.

Now, here`s what else I saw today. I saw a couple of surveillance cameras, sitting perched on top of the house. Now, we couldn`t get around back, of course. And this property is about three-and-a-half acres, so it`s quite difficult to get real close to it. Otherwise, we would have trespassed, of course.

So this is -- this is -- also what we know is this is the same home that various women have come out of the woodwork alleging that they came to this home and where Gary Giordano secretly videotaped them while they were having sex.

GRACE: You know, Rupa, number one, all I can really see is your head, so let me get you to move over a tiny bit to your left, just a couple of steps to your left. Yes. No. The other way. Your other left. There you go. Somebody help her out. Go back to where you were because I can see -- let me see Rupa in full, please. I want to see Giordano`s home. There you go.

Rupa, that`s a huge home back there, and it`s sitting on three acres of lawn and forest in Maryland. Now, you just stated that women are coming out of the woodwork. I don`t like the way that sounds because it`s making these women sound like they`re nuts. These women, several of them, have actually gone to court to seek protection against Giordano.

And the one you described that said -- alleged he was videotaping her having sex -- that`s not all. He was beating her and choking her about the face, the neck, the head and the legs during sex, and he was videotaping that, according to her, Rupa.

MIKKILINENI: You`re right, Nancy. That`s right. There are several women that have come forward and announced and alleged that they -- that he has been stalking them. He had been harassing them, that he had even -- one woman comes out and actually alleges that he hit her, beat her, choked her even. And then of course, the secret videotaping when they agree have dates and come to this home right behind me.

GRACE: Everyone, we are taking your calls live. We are live at Gaithersburg, Maryland, at Giordano`s home, police swooping in in a late night search of the home, seizing boxes of evidence. We are also live in Aruba with Martin Savidge. Tonight, Gary Giordano appears in court, but he is set to walk free. FBI and Aruban police scrambling for evidence. Where is American girl Robyn Gardner?

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: A frantic search is on for Robyn Gardner.

GRACE: Another American girl vanishes.

UNIDENTIFIED FEMALE: This is the same island that Natalee Holloway vanished six years ago.

UNIDENTIFIED MALE: And in both cases, they vanished without a trace.

GRACE: History is happening all over again, hopefully, without the same tragic result.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: A steady stream of FBI agents moved in and out of Gary Giordano`s house.

UNIDENTIFIED MALE: The search is being conducted pursuant to a criminal investigation.

UNIDENTIFIED FEMALE: Gary Giordano`s past coming back to haunt him.

UNIDENTIFIED MALE: Now he comes before a judge.

UNIDENTIFIED MALE: He`s got domestic violence allegations.

UNIDENTIFIED MALE: The troubled past with women.

UNIDENTIFIED FEMALE: He was, like, stalking me, and it freaked me out.

UNIDENTIFIED FEMALE: Characteristics of some sort of violent predator.

UNIDENTIFIED MALE: The gloves are off now in this investigation.

UNIDENTIFIED FEMALE: Yanked my arm really hard.

UNIDENTIFIED MALE: Apparently, this guy would go on line, get to know attractive women.

GRACE: A guy that was giving out free trips to Aruba to any young woman that would take him up on it.

UNIDENTIFIED MALE: After he would meet them on line, they would meet in person a couple of times, have consensual sex. But what they didn`t know...

UNIDENTIFIED FEMALE: This is a guy who`s videotaping them.

UNIDENTIFIED MALE: Anybody who knows anything about him, come forward.

(END VIDEO CLIP)

GRACE: We are live in Aruba and Maryland. The FBI is swooping in on Giordano, the so-called traveling companion`s, stone fortress home in the middle of the night, bringing out boxes and boxes of evidence.

We also learned, in the last hours, Giordano in an Aruban court, before an Aruban judge. We also learn that he and his lawyer refuse to give DNA to Aruban police in the search for Robyn Gardner. But then the judge orders him to give DNA, most likely a buccal swab from inside the mouth.

I want to go back to Martin Savidge, CNN correspondent joining us in Aruba, along with Mark-Benson Denz from "The Aruba Herald."

You know, Martin, I understand that in the last hours, Aruban police being lowered into phosphate mines and wells, deep, deep, hundreds of feet deep. Take a look at this video we obtained for you. At the end of that, there is a guy on a harness, going down, down, down, down, looking for Robyn Gardner, the missing American girl.

What do you know, Martin Savidge?

SAVIDGE: Well, this search was -- it`s interesting. It was conducted within sight of Baby Beach. You could be on Baby Beach and just look up in the hills, and that is the area where this phosphate mine is located. And there are a series of tunnels there, very deep shafts that are located in very inhospitable terrain. We went up there and took a look, and I mean, it is thick with thorns and cactus, very difficult to navigate through. But that`s where authorities were searching.

They say that they only found articles of clothing, and now they`ve told us that those articles are not related to this investigation. But they don`t say why.

GRACE: The pink tank top and the black -- ladies black sandals not related to Robyn Gardner. Well, that`s encouraging in the fact that they were found there in the phosphate mines in the wells. But that still leaves the question, where is the American girl Robyn Gardner? We can also confirm in the last hours, we learn that police absolutely have in their custody her passport. So she did not leave Aruba by air, by land or by sea, by legal means anyway.

We are taking your calls. Out to Christie in California. Hi, dear. What`s your question?

UNIDENTIFIED FEMALE: Hi, Nancy. This is just horrible. How can Robyn have just disappeared? My question for you is, how big is this island?

GRACE: That`s a great question. To Mark-Benson Denz, CEO of "The Aruba Herald." How big is the island? How many people live there? And is it true that tourism is up 6.5 percent, Mark-Benson?

MARK-BENSON DENZ, CEO, "THE ARUBA HERALD" (via telephone): Good evening, Nancy. Well, we have about 110,000 people that live here on the island. And you can drive from one point to the other point in about one hour. And we have to say that we are very happy that tourism these last years is up, yes.

GRACE: You know, it`s amazing. After all the Natalee Holloway PR, apparently, people are still flooding to Aruba.

Another interesting point -- very quickly to you, Rupa Mikkilineni -- it`s my understanding that the dive shop, the dive and snorkel shop that we identified last week, Jads dive shop and restaurant, now are saying that she and Giordano were there in bone dry clothing around 4:00 o`clock the day she was reported missing. Is that correct, Rupa?

MIKKILINENI: That`s absolutely correct, Nancy. We`re hearing at about 4:00 PM, they were having lunch in the restaurant area of Jads Diving Center that day she went missing. Two hours later, he called 911.

GRACE: About 6:30 PM, he approaches a couple on the beach, asks to use their cell phone to report this girl, American beauty Robyn Gardner, gone. But now we learn just two hours before that, she was having a seaside lunch with him there at Jads dive shop and restaurant. Tonight, where is Robyn?

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: The mystery surrounding the disappearance of an American woman in Aruba heads to court.

UNIDENTIFIED MALE: The defense attorney likely is going to say, Look, there`s no proof.

UNIDENTIFIED MALE: No proof to my knowledge.

UNIDENTIFIED MALE: No evidence. My client witnessed a horrible accident.

UNIDENTIFIED MALE: There is no proof and there`s no motive. I don`t see any motive here.

UNIDENTIFIED MALE: I just don`t think that she was snorkeling. I feel in my heart that something happened at this person`s hand.

UNIDENTIFIED MALE: I don`t see any proof.

UNIDENTIFIED MALE: He came ashore and she apparently did not. They launch a pretty extensive search, but no sign of Robyn Gardner.

(END VIDEO CLIP)

GRACE: We are taking your calls live. I want to go out to a special guest joining us tonight. Carrie Emerson and Taylor Tyler (ph) -- this is Carrie`s daughter -- are joining us from our Manhattan studios. Ladies, thank you for being with us. Carrie says Giordano propositioned and threatened her. Her daughter says the same thing.

Now, in a minute, I got to go to a shrink about propositioning the mother and the daughter. But first to you, Carrie Emerson. Are you surprised at what`s happening with the American girl Robyn Gardner in Aruba right now?

CARRIE EMERSON, SAYS GIORDANO PROPOSITIONED HER AND DAUGHTER: No, actually, I`m not.

GRACE: Explain.

EMERSON: Human trafficking has been around for ages. And the more I think about it and the more that I know about the case, the fact that he was trying to get my daughter to go, who is also a blonde, he was trying to get other girls to go who are also blond, it makes sense to me that maybe he had a sale for a blonde.

GRACE: What was your experience with him?

EMERSON: When he called, he was looking for my daughter to go with him. She`s into modeling. She`s trying to build a nice portfolio.

GRACE: Well, hold on right there. We were just showing you photos of Taylor Tyler, who was contacted by Aruban suspect Gary Giordano after seeing her modeling on line at Daphne (ph) Photos. These are gorgeous shots of your daughter. Go ahead, Carrie.

EMERSON: Yes, he actually contacted us to -- he -- when he called, he talked to me, thinking that I was her, and he said that -- he was very interested in having her come to Aruba, that it was a $5,000 photo shoot, and he just -- he made it sound too good.

GRACE: Was that supposed to be in Aruba, too?

EMERSON: Yes, he said that it was going to be the end of July, first of August. The photo shoot was going to be in Aruba, and that it was for the largest swimsuit company in America, and it would not be a one-time...

GRACE: Now, hold on. Hold on. Carrie, Taylor, don`t move. To his lawyer, well-respected lawyer out of Annapolis, Bob Flynn. I thought your former client, Giordano, ran an employment agency. What`s this business about being a talent scout and taking photos of women, photo shoots in Aruba for 5,000 bucks, Bob?

BOB FLYNN, FMR. GIORDANO ATTORNEY (via telephone): It`s nothing I knew about at all, Nancy.

(COMMERCIAL BREAK)

(BEGIN VIDEOTAPE)

UNIDENTIFIED MALE: Gary Giordano dubbed the prime suspect is due in court.

UNIDENTIFIED FEMALE: Robyn Gardner.

UNIDENTIFIED MALE: She just disappeared.

UNIDENTIFIED MALE: Now he comes before a judge.

UNIDENTIFIED MALE: Back in states, his home was raided.

UNIDENTIFIED MALE: 15 mark and unmarked cars arrived at the house.

UNIDENTIFIED MALE: The search is being conducted pursuant to a criminal investigation.

UNIDENTIFIED MALE: Search warrant and asked the FBI to help in obtaining computer and phone records.

UNIDENTIFIED FEMALE: Tracked down an incident report.

UNIDENTIFIED MALE: Domestic violence charges.

UNIDENTIFIED FEMALE: He was, like, following me.

UNIDENTIFIED FEMALE: Giordano was drunk and began throwing things in their home.

UNIDENTIFIED FEMALE: He`s abused one woman after another.

UNIDENTIFIED MALE: I feel in my heart that something happened.

(END VIDEO CLIP)

GRACE: Welcome back, everyone.

We`re live, not only in Gaithersburg, Maryland, at the so-called stone fortress, $1.3 million home belonging to traveling companion Gary Giordano, last seen with missing American girl Robyn Gardner in Aruba, but also live in Aruba.

We are taking your calls.

In the last hours, Giordano in front of an Aruban judge, the FBI and Aruban police now scrambling to get evidence as to the whereabouts of the missing American girl Robyn Gardner. This man, with her, just before she goes missing.

And joining us tonight, two special guests, Carrie Emerson and her daughter Taylor Tyler.

They claim he propositioned the two of them, mother and daughter, for a photo shoot in Aruba. And at this hour, as you can see, Aruban police going down deep phosphate wells and phosphate mines by rope and harness in the search for Robyn.

So far, they have only uncovered a pink lady`s tank top and black sandals. We now learn from Martin Savidge, not connected to Robyn.

Back to Carrie Emerson and her daughter Taylor Tyler. Before I question his lawyer, Bob Flynn, you were telling me he also asked you to go on a free Aruban vacation and a $5,000 photo shoot.

CARRIE EMERSON, CLAIMS SUSPECT PROPOSITIONED HER FOR SEX AND THREATENED DAUGHTER: : Yes. He was quite the charmer. He really came off as a professional producer and he said he was a manager, he was a talent agent, he was, you know, all of these different things. And that he had a girl back out of the shoot at the last minute . He was willing to pay $5,000 if she could come, unsupervised is what he was getting at, and -

GRACE: Unsupervised?

EMERSON: Yes. He wanted her to come. He said he would be with her the whole time. He would - she would stay in the room with him, that he would make sure she was safe, well protected, and there would be no - it wouldn`t turn into another Natalee Holloway thing.

GRACE: He actually said this won`t be a Natalee Holloway thing? He said that to you?

EMERSON: Yes, he did, thinking that was going to make me comfortable to send my daughter with him.

GRACE: That`s good for this guy to bring up Natalee Holloway on the phone. When did the proposition part come in, about sleeping with him?

EMERSON: I got off the phone, I was pretending I was her on the phone, I told him that, you know, would he mind speaking with my mother who is also my manager? And he said, yes, that would be great. And I got on the phone with him, as me, and he then told me, you know, he got - he turned very professional. Very professional, very fast.

"Ma`am, I had somebody back out, I need her to go to Aruba to do the shoot. My name is Gary." I said, Gary who? Because I keep records of everybody I talk to for her career. I have names, numbers, addresses, times when spoken to, what was said. I`m very thorough.

And he said Gary Giordano, producer. OK. I never heard of this guy, yet he`s coming off like he already knew us. He started telling me more about how safe she was going to be, how much fun she was going to have, but he would be there to protect her. I said, no, no, she`s not going.

First off, she`s still young, she`s legal age, but doesn`t go anywhere without me, not to any shoots. So he turned around and he said, well, if you would like to come, I could get you a mother/daughter shoot and photo shoot for a bathing suit company.

Of course, I`m not interested but I wanted to hear what this guy had to say so I would know what to write in the book. He starts telling me that, you know, she`s a gorgeous girl, I`m a gorgeous woman, I said, how do you know? You don`t know me? You never met me. He said, if you`re anything like your daughter, just the typical line.

GRACE: Well, when did he finally break down and ask to have sex with you?

EMERSON: Right after I told him that, you know, that she`s not going, he says, well, I`ll make you a deal, if you let - if you go with us, and you sleep with me, he says, I`ll take care of you financially. I said, OK, you got to be kidding. I said, I`ll go you one better. He says, if you both go, and you both sleep with me, he says I`ve always had a mother/daughter fantasy, he said, if you both sleep with me, I`ll take care you`ve financially the rest of your life.

GRACE: Tyler, can you hear me you girl?

TAYLOR TYLER, DAUGHTER OF CARRIE CAMERON: Yes.

GRACE: Do you know how lucky you are tonight to have your mother taking care of you? Do you have any idea?

TYLER: I do. Gosh.

GRACE: Unleash the lawyers. Michael Griffith, international criminal defense attorney, Anne Bremner, high profile Defense Attorney Seattle.

Michael, you and I have watched so many cases together. We all three tried more cases than I can count. When I was just talking to Carrie Emerson and Taylor Tyler, I got chills over my whole body. This does not look good, Michael Griffith. You`ve been around the block a couple of times. International lawyer. Weigh in.

MICHAEL GRIFFIN, INTERNATIONAL CRIMINAL DEFENSE ATTORNEY: Well, Nancy, I believe immediately that if he had something to do with it, the body could be in the water because it would not be in a mine somewhere. That would be inconsistent.

GRACE: No, put Griffith up. Put Griffith up. Michael, the cops have told us, to us directly, that if she had drowned at baby beach, which you`re familiar with baby beach, snorkeling, shallow, that her body would have come right back. They would have found her body by now. That girl is not out in the water, Michael. That is not what happened.

GRIFFIN: Nancy, Nancy I think she may be in the water because it was in a mine, it would be inconsistent with where he saw her last, it would be a suspect.

GRACE: Did you ever think he could be lying?

GRIFFIN: No, Nancy, he could, but --

GRACE: Try having lunch at 4:30, 6:30 she drowned?

GRIFFIN: But, Nancy that was two hours before. If he disposed of the body, it could be in the water. But, let me caution you on something. Is that these Arubans seem to be bumblers because of the Van Der Sloot case. I would opine that to let this guy be freed, let him be brought back to the United States, we have an MLAT, an MLAT is a Mutual Legal Assistance Treaty with the Netherlands. And whatever evidence is produced down there, we could use it to prosecute him in the United States.

GRACE: No, no, no, no. You do not let him out of jail. Anne Bremner, you`re the high profile defense attorney. His lawyer is saying there is no concrete evidence connecting him to Gardner, but we now know that after Gardner is reported missing, Anne Bremner, her computer is on, well into the next day. Somebody is on her computer. And it was in their hotel where they stayed together, Anne. What about that?

ANNE BREMMER, DEFENSE ATTORNEY: Well, it doesn`t look good, Nancy. The fact is, this is almost like deja vu all over again with Natalee Holloway, with the case that may go nowhere. I mean there is no true evidence other than speculation right now.

And they have got suspicion, that`s all they need to hold him. That`s it.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

RUPA MIKKILINENI, CNN PRODUCER, NANCY GRACE SHOW: I am just a few feet away from Gary Giordano`s house here in Gaithersburg, Maryland. Now, this is the home where several women alleged that he secretly videotaped them when they came over on dates to his home.

And if you pan over here, you can see right next to me the house. It is a really large house, it sits on about 3 1/2 acres of land. It is about 6,000 square feet. And property records indicate that Gary Giordano bought the place in 2005 for $1.3 million.

(END VIDEO CLIP)

GRACE: We are live in Maryland there with Rupa Mikkilineni outside Giordano`s home and live in Aruba with Martin Savidge, bringing you the very latest and taking your call in the last hour.

Traveling companion, no strings attached, free Aruban vacation, Gary Giordano, before an Aruban judge. He`s set to walk free in days unless the FBI and Aruban police can find Robyn Gardner and or compile evidence against him in her disappearance.

We`re taking your calls.

Very quickly to Woody Tripp. Woods is former police commander. Weigh in, Woody. What do we do now? She`s not out in the water. Forget that.

WOODY TRIPP, FMR. POLICE COMMANDER: No, I absolutely degree, Nancy. And what I would look right now forensically is his clothing. They say that the terrain there is very dense, cactus, different things like that. As you know with transfer evidence, he`s going to carry things away just as he`s going to leave things. And I would certainly be looking at his clothing. I would want to see has there been any transfer, cuffs, pants, shirts, sandals, the type of sand that may still be there. I would be very interested in his clothing. It may lead us to where he was last at with her.

GRACE: We are taking your calls.

But very quickly to Pat Brown, criminal profiler, author of "The Profiler". You know, a lot of people have been considering this a straight kidnapping or potentially a murder case. But after hearing Carrie Emerson and her model daughter Taylor Tyler, it could be even more sinister, such as human trafficking.

Did you notice as they pointed out every single woman he tries to lure down there is a blonde, American girl?

PAT BROWN, CRIMINAL PROFILER: I don`t think it is has anything to do with human trafficking, especially we`re at lunch in the afternoon and two hours later he reports her missing. So I think what happen was when that man spends money on you for dinner or for an hour or for vacation, he expects what he expects. And something was going wrong with that, Robyn was not happy with it, I think they were having an argument about that time and he drove up into the mountain. He didn`t go to the beach, that`s where he got rid of her, likely, and had to go down to the beach and say she just drowned. Because yet he couldn`t say, it was coming back with an empty car. What you are going to do? At some point in time you say, where is the girl? So that two-hour period, I think they`ll look up and down where he went.

GRACE: You know, Alexis Weed, our producer on the story, she`s right. It could boil down to something as simple as so many women have pointed out, Alexis. You detail them for the viewers.

One woman after the next is offered a free vacation. I`m not talking just about Taylor Tyler and Carrie Emerson, her mom. Other women. There are protective orders against him by women. One woman claims he videotaped himself beating her during sex in his bedroom. There are - there is a string of seven women with the same complaints.

ALEXIS WEED, CNN PRODUCER, NANCY GRACE SHOW: That`s right, Nancy. There are about seven. There is a host of women who made complaints against this guy. Although there aren`t any charges that have stuck with relationship to these women.

However, we did learn a little bit more about some 2003 charges against Giordano and they were for theft, Nancy. He pled guilty in 2003 in August to one count of theft. He was charged, though with over a month -

GRACE: Alexis.

WEED: Yes.

GRACE: I don`t care about him stealing electronic equipment. But thanks. I`m worried about where is Robyn Gardner. Yes, I know this guy stole, there is a guilty conviction for months on end from target. And not just a little bit, a lot he did it over and over and over and over.

What I`m concerned is about the way he treats women.

To Catherine Smerling, Doctor Smerling is a Psychologist out of New York. What is your assessment, Dr. Catherine?

DOCTOR CATHERINE SMERLING, PSYCHOLOGIST, NEW YORK: This man has absolutely no regard for human life, no regard for his own. He is a peeping tom. He is someone who borders on the Psychotic. He`s also someone who has no internal control and looking, seeking to control everything else. Everything else around him. I would have to concur with Pat Brown, who says that perhaps it was sex gone awry. From the patterns of his behavior -

GRACE: That would be rape, sex gone awry. That`s putting perfume on the pig.

SMERLING: It certainly would be. But it also is consistent with his behavior and I wouldn`t be surprised if when they look at all of the things in his home, in Maryland, that he - they find that he`s addicted to internet porn.

GRACE: You know what, that`s an interesting observation, Dr. Smerling. Because we know somebody was on Robyn Gardner`s computer well after she`s reported missing. And, again, she was spotted at that dive shot and restaurant at 4:30, probably on surveillance video, bone dry, nobody bought scuba equipment, rented, nobody bought snorkeling gear, nothing.

Very quickly to Dr. Stanton Kessler, Consulting ME, Associate Professor University of South Carolina, Department of Pathology.

Dr. Kessler, it is so great to have you with us. Thank you for being with us. We learned in the last hours that he`s also refused to give DNA, but the court ordered it. Typically how is DNA taken from a suspect?

DOCTOR STANTON KESSLER, Well, you can take it from the buckle mucosa, that`s fine. You could get it from cigarettes if smoked, glasses they have been drinking what have you. But he`s obviously has something to hide. I think there is a scene somewhere. I don`t know where. But I think there is a crime scene that is missing here. And we need to find that. Could be the beach.

They need to sift the sand, look for trace evidence, why would he even mention that beach? Sometimes people say the dumbest things when they`re cornered. But I would really work on the forensic evidence, try to eliminate that beach to see if the scene is there, see if he covered something up, see if there is blood a foot or two down, what have you. Work it as a crime scene. Or the room. There are not many places it could be. Also, I would re-evaluate the car they were in. Even though it was cleaned and brought back.

GRACE: Dr. Kessler, you`re right on. That car, I think, would have been key. And just because it has been cleaned and vacuumed does not mean that all the forensic evidence is gone, Dr. Kessler is exactly correct.

To Mark Benson Denz with the Aruba herald. In the last hours, cops lowering themselves into hundreds of feet deep phosphate mines and wells in the search for Robyn Gardner. But time is running out, Mark. In about eight days, Gardner is going to walk free if they cannot get enough evidence.

MARK BENSON DENZ, CEO, ARUBA HERALD (via telephone): Well Nancy, we have to say that everyone was expecting that the prolongation would be eight days, but we understand from the prosecutor that he has been prolonged for 16 days. So they have a little bit more time to get more facts in.

GRACE: So they have got two weeks to put together some evidence before an Aruban judge sets Giordano free.

We are taking your calls.

To Brenda in New York. Hi, Brenda, what`s your question?

BRENDA, CALLER, NEW YORK: Hi, Nancy. I love you so much. I love all you do for victims and their families.

GRACE: Thank you.

BRENDA: Yes, sure, sure. I`m so happy to talk to you. I want to find out if this lovely woman that`s missing, Robyn, what did she do for work?

GRACE: I can tell you what she did for work. She was running dental assistants within a dental office and had just been laid off and was very, very depressed about that. And was actually going out of town to try to cheer herself up.

Very quickly Steve in Canada, what`s your question?

STEVE, CALLER, CANADA: Hello?

GRACE: Hi dear, what`s your question? Quickly.

STEVE: Hi Nancy, I`m a huge fan of yours and your show. I was wondering if you believe that the Aruban authorities are doing everything in their power to find Robyn.

GRACE: You know Steve in Canada, I think that they are trying. But I also think it`s a day late, a day late and a dollar short. All of this should have been done immediately when she went missing.

(COMMERCIAL BREAK)

GRACE: Welcome back. Last week we told you about the girl missing off her pink bike, training wheels still attached. Tonight a suspect charged with murder.

Joining us is Todd Bonacki from KZIM. What happened?

TODD BONACKI, REPORTER, KZIM NEWS RADIO: A tremendous ending to this story that gets sadder by the minute, Nancy. Police as you eluded to have arrested 43-year-old Sean Morgan late Friday night at his house. Five doors down from where the 3-year-old Breeann Rodriguez and her family live.

Morgan is now charged with murder in the first and tampering with evidence. She went missing of course Saturday the 6th, nine days ago, broad daylight on a Saturday morning. I`ll warn your viewers, Nancy, the description of what happened gets awfully graphic.

She rode her bicycle down the street to Morgan`s house while her brother went inside you recall to get a drink of water. Went to his back yard and climbed on to his pool ladder in his back yard.

Morgan then came out and grabbed Breeann off that ladder. He took her inside no doubt kicking and screaming. He then proceeded to suffocate her with a white plastic trash bag by holding it over her face and mouth. He described it as if it felt like an hour for her to finally take his last breath.

Morgan then placed her body into that same trash bag. Drove 20 minutes to a flood way ditch in the county where he disposed of her body by tossing it over the railing.

GRACE: Todd, I just don`t think I can stand to hear anymore. Todd Bonacki joining us from KZIM. Our hopes that Breeann Rodriguez would be found alive have been dashed. Tonight`s our prayers with her family.
