DIAZ: Hello, I`m Carlos Diaz in for A.J. Hammer with big news breaking tonight.

Running for cover. The blame game went up another notch today following yet another TV interview about the Penn State child sex abuse scandal. This time with the assistant coach who claims he witnessed a young boy being sexually abused by Jerry Sandusky. And tried to stop it. The new TV interview came one day after Jerry Sandusky went on national TV to deny he sexually abused young boys at Penn State. But he seemed to stick his foot even further into his mouth.

But tonight SHOWBIZ TONIGHT can tell you if you think Sandusky is guilty as sin, there are signs that the public may not want to rush the judgment.

In Hollywood tonight is judge Mary Ann Gunn who raised TV show last shot with Judge Gunn. And Jean Casarez in at state at State College in Pennsylvania. Jean is a correspondent for "In Session" on our sister Network TruTV. And in New York, we`ve got Sunny Hostin, legal interpreter for "In Session."

Mike McQueary is the grad assistant who says he walked in on Jerry Sandusky raping a boy in the Penn State locker room in 2002. And people have been slimming McQueary asking why did he not stop the rape and why didn`t he go to the cops? Now he`s apparently saying he did try to stop it and he did go to the cops.

In the November e-mail reveal today by "the Morning Call" newspaper, McQueary sys of the 2002 rape, "I did stop it. Not physically, but made sure it was stopped when I left that locker room. I did stop it, but not physically."

What does that mean? He waited until it was over before he left the locker room?

Jean Casarez, you`re right there on the scene. What are you hearing today about what Mike McQueary said?

JEAN CASAREZ, CORRESPONDENT, IN SESSION: You know, I think what everybody is thinking about is looking at what the grand jury presentment says because that is the official document we have so far, and it specifically says under victim number two from 2002, that the police did not question Mike McQueary.

So is this an inconsistency, that e-mail that he wrote, or is this something corroborative, that he went to police but then they didn`t question him? He`s saying in that e-mail that he went to law enforcement. As far as we know, there was no police report ever written.

DIAZ: Man, specifically says that the grand jury report, no contact with police. Well, Mike McQueary also spoke out on TV, in his very first TV interview since coach Sandusky was accused of sexually abusing at least eight boys over 15-year period.

McQueary talked with CBS News. I got to tell you, he look like a guy who is absolutely shell shocked. Watch.

UNIDENTIFIED MALE REPORTER: Do you have any idea when you might be ready to talk?

MIKE MCQUEARY, WITNESS, JERRY SANDUSKY`S CHILD SEX ABUSE CASE: The process has played out, and I just don`t have anything else to say.

UNIDENTIFIED MALE REPORTER: Just one last thing. Describe your emotions right now.

MCQUEARY: All over the place. Just kind of shaken.

UNIDENTIFIED MALE REPORTER: Crazy?

MCQUEARY: Crazy.

UNIDENTIFIED MALE REPORTER: You said like a --

MCQUEARY: Snow globe.

UNIDENTIFIED MALE REPORTER: Like a snow globe.

MCQUEARY: Yes, sir.

DIAZ: McQueary is now saying he`s being falsely accused of not stopping it or not calling the cops about that alleged child rape. And we also, Jerry Sandusky are hurting at least on NBC on Monday night saying he`s being falsely accused of raping eight young boys.

Judge Gunn, meantime showbiz flashpoint, is the public jumping to too many conclusions in this Penn State abuse case?

JUDGE MARY ANN GUNN, HOST, LAS SHOT WITH JUDGE GUNN: Well, certainly it`s way too early, Carlos, to jump to conclusions because there are so many facts we don`t know. But what we do know and what we`re hearing right now is it`s evil. I mean he`s looking at 800 years in jail. The grand jury summary is inconsistent with his recent statement that McQueary did not -- he didn`t physically stop it but he didn`t leave the room until he knew that it was stopped and then he gave a statement to the police. I think it will be the beginning of lots of inconsistencies until we can actually get to the truth.

DIAZ: Yes. I think you make a really good point of these. There are so many facts we don`t know about, but will those facts clear Sandusky or further incriminate him? That`s the big question.

And Sunny Hostin, a lot of people today are claiming their innocence. Sandusky saying he didn`t abuse young boys. You have McQueary saying he tried to stop the rape.

Our showbiz flashpoint, is the public jumping to too many conclusions, Sunny?

SUNNY HOSTIN, LEGAL CONTRIBUTOR, TRUTV`S IN SESSION: Well, I don`t think so. I think the public is reacting to the information that we know, Carlos. I mean we know that there is this 40-count indictment. We know there is this grand jury report out there. There are witnesses, there are victims, alleged victims that have come forward. There are ten more, the "New York times" that have come forwarded and their stories are being vetted.

So I think the public is outraged, rightfully so, and I think the good thing that comes out of this, Carlos, is that we`re all talking about it. Because I used to prosecute child sex crimes and the bottom line is sex crimes, especially involving children, are always shrouded in secrecy. People don`t want to talk about it. And I think at least one good thing that is coming out of this is that raising the awareness that this happens every single day, every single hour to child somewhere in the world. And so, you know, of anything I think the public should be talking about and should be reacting to the information that we`re hearing.

DIAZ: Yes. Sunny, you make a very, very valid point, a very good point right there.

Alright now, to another case that we`ll be talking about SHOWBIZ TONIGHT can tell you there are other huge developments tonight in another sensational case that just won`t go away.

Casey Anthony. We learned today that lifetime is reportedly developing a TV movie about the Casey Anthony trial based on the book by the trial`s prosecutor, Jeff Ashton. Ashton reveals for the first time perhaps the most explosive lie told by Casey Anthony, that before the trial she told therapists that her little daughter Caylee was murdered by Casey`s father George.

And on "Issues with Jane Velez-Mitchell" right here on HLN, Ashton told Jane that it was Casey`s way of lashing out at her dad. Watch.

JEFF ASHTON, PROSECUTOR: It`s pure manipulation at work. It`s pure selfishness at work. It shows a pure malevolence towards her father that`s even hard to imagine. I mean it`s hard to envision anything that would have been more painful to her father than saying that he murdered this little child that he loved so dearly. So I do think the story was concocted not only to meet the evidence, to explain away the evidence that we had to the best she could, but also to just really put a knife in George`s heart.

DIAZ: More alleged shifting stories from Casey Anthony. Jean Casarez, you were there for the Casey Anthony trial. Does Ashton`s bombshell pretty much confirm that maybe Casey got away with murder?

CASAREZ: It is a bombshell. You know, I think Jeff Ashton`s book will be the best book of all because he didn`t have a confidential relationship with Casey or with the other attorneys. There is attorney-client confidentiality with the defense but not with the prosecutor.

My question is how did he get this information? This had to be psychological experts that the defense had examined Casey Anthony. I think it`s interesting that he got that information.

DIAZ: Judge Gunn, real quick, is this more proof of Casey`s guilt?

GUNN: It depends on what the book says, Carlos. But you will see through this book what you didn`t see at the trial. All of the investigation -- I mean, I`m assuming that`s what he`s going to do from the prosecutor`s side because he`s convinced that Casey was lying, he`s convinced that she was guilty, and he`s convinced that she would sacrifice anybody for her innocence.

DIAZ: All right. Judge Gunn, Jean, Sunny, thanks you guys so much.

I know Lindsay`s hard at work trying to get her life back on track, but is her million dollar playboy ploy, a brilliant career move or just plain desperate?

With us right now, in New York, for a showbiz news maker interview, Heidi Fleiss who is no stranger to spicy living in her own right. Heidi gets starring in the animal planet "Heidi Fleiss, from prostitute to parrots" which maybe the best title for a TV show in the history of television.

Alright, Heidi, I got to get your take on Lindsay. You too have a few things in common. You have your own legal troubles and we watched struggle to get away from drugs on celebrity rehab. Lindsay says she`s trying to get her life together starting with this you know playboy spread. What do you think about the playboy spread with Lindsay Lohan? Is brilliant or desperate?

FLEISS: She`s beautiful. I think it`s brilliant. And who know, when you give money, you need money. Maybe she needs money to get on the right track. She`s hot. She would have made a great hooker. I could have made millions off her.

(LAUGHTER)

FLEISS: I think Lindsay is so hot. I can make sigma off her.

DIAZ: Wait, wait, wait! Time out! You heard it here on SHOWBIZ TONIGHT. Heidi Fleiss said she could make millions off Lindsay Lohan being a hooker.

FLEISS: Oh, yes.

DIAZ: OK. Moving on now. We have to talk about another story making big news tonight. Cat Monde (ph), she hopped on facebook and told everyone her hubs, Jessie James, cheated on her with 19 women. Why not point out that Jessie in terms, they also cheated on 10 on bullet, too?

You said in another interview that all men cheat, Heidi, which I furfures (ph). And tonight, a lot of people are saying she shouldn`t have been surprised. Should Cat Mondee (ph) have been surprised?

FLEISS: She should know better. But as she - I`m sure she already knows it. But, it`s her way of venting. It`s just her way of venting. I`m surprised she didn`t put photos up of every woman that she got have witnessed. You know, just everyone has a strange way of venting. Unfortunately on hers, she should find another way of venting, but I was surprise the 19, with the number probably is a little higher.

DIAZ: You think for every three, there should be three more?

FLEISS: I know how men are. And thank God, they are that way. I love it.

DIAZ: Alright. Heidi, I love you a lot, you like it or not, Heidi. Your name has been tied to Charlie Sheen ever since your role as the Hollywood Madam was exposed in court.

Now, Sheen is just on the other side of a very public meltdown. He`s getting ready to start taping a brand new show. Did you see his whole spectacle playing out the way it has?

FLEISS: Well, when people refer to it as a meltdown, I don`t know if it`s really a meltdown. It`s Charlie being Charlie. Charlie is a rock star. He is different - he`s above an actor. Charlie does and can do whatever wants. And I love him. He spends all his money on women. Come on, he`s an awesome guy.

(LAUGHTER)

DIAZ: Wait a minute. That`s good for you by the way. If you`re running a chocolate factory and somebody has a sweet tooth, you`re like, I`m all behind it, you know. But --

FLEISS: Hey, you know what though, but the people that put Charlie down, they wish they were Charlie. He can do whatever he wants. He was born in Malibu. He`s a rich boy. He has a great life.

DIAZ: Alright, Heidi. Let`s talk Paris. Shall we?

FLEISS: My heart, my heart.

DIAZ: All right. You traded a very glamour life and the Hollywood lime light for a life Nevada`s surrounded by parrot poop. Have you reached the point where you`re beyond all this stumbles in your life? And are you finally where you want to be?

FLEISS: Well, yes and no. I love these birds. And I`m going to move back to Hollywood and I`m bringing my birds with me though, and I will find -- people act like it if impossible but I will find a property and place where we can all live in harmony and my neighbors will be OK. OK, My show is on tonight, and sure, it`s my first episode. So, it`s mostly my kooky behavior. But hopefully --

DIAZ: What do fans expect with you and parrots are just hanging out?

FLEISS: Well, I guess I am kooky in a way.

(LAUGHTER)

FLEISS: I love those birds. And I can`t get throw them away. I can`t turn my back on them, ever.

DIAZ: Very quickly, you said you`ll move back to Hollywood. What are you going to do?

FLEISS: I have a dating show coming up in the spring time.

DIAZ: A dating show.

FLEISS: A legal, legal, legal matchmaking show. It`s all legal dating.

DIAZ: I was going to say before the date, you have to write a check, no, it`s just very --

FLEISS: I will be making money out of it, that`s for sure, but it`s legal. It`s all legal dating.

DIAZ: Heidi Fleiss. Always making money out of love. I want to say, by wait, you look great. You do look amazing.

FLEISS: You have great makeup artists.

DIAZ: That`s cool. All right.

FLEISS: Sobriety. Sobriety.

DIAZ: Welcome back to SHOWBIZ TONIGHT. Its 30 minutes past the hour. I`m Carlos Diaz in for A.J. Hammer.

And I got some big news breaking tonight. He`s not the daddy. Tonight, SHOWBIZ TONIGHT brings you big news about the woman who claims she got pregnant after she and Justin Bieber allegedly had sex after one of his concerts.

But today we learned Justin Bieber`s baby drama has apparently been dismissed. The woman who claimed that Bieber fathered her baby boy has reportedly dropped her paternity suit against the Biebs. SHOWBIZ TONIGHT also learned today, "the sitch" is suing "the fitch" for millions of dollars.

Here`s the "Shore" star, Michael, the situation story show is suing retailer Abercrombie fitch over what he claims was supposedly stunt to sell clothes using his clothing. Now, fitch have probably offered to pay the sitch t not wear their clothing but the sitch claims he never saw a cent from them.

Let`s take this to judge. With me tonight, from Hollywood, is Judge Mary Ann Gunn who is host of the surrogated show "last shot with Judge Gunn." Also with me tonight, is attorney Sunny Hostin from "In Session" on our sister network, truTV.

Alright, I got to begin with the Bieber drama. Bieber baby drama today, SHOWBIZ TONIGHT learned today that the case has been removed from the parameter in San Diego where the case has filed. And one of her attorney`s as reportedly failed on her.

Judge Gunn, this whole thing sounded fishy to begin with, did these latest developments seem to you to be end of story?

GUNN: Should be end of story. I mean, her attorneys have failed, she`s failed, and the amazing thing is that she can say that Justin is the father of her child, she can allege that. She`ll have to prove it. And my advice for Justin is he really needs to watch who he hangs with.

DIAZ: But I mean yes, I mean could anybody say that? I mean, anybody can go, oh, I`m the mother and the whole thing. I think in this situation, if I`m Justin, I can hit her with you a lawsuit. I mean you have to lower the hammer. I`m just saying. I mean does anybody could say anything they want about you. Let`s not forget, by the way, Justin`s legal team vowed to sue this woman and her attorney, after taking a DNA test to prove he is not the father of the little boy. But no arrest take that DNA test for this afternoon, the Biebs rep told TMZ, he still may pursue that lawsuit. Sunny, do you agree with me, should he send a signal that nobody messes with the Biebs?

HOSTIN: I think there`s no question about it. And they made that threat before right? They said he`s going to take the DNA test and on top of it he`s going to sue. I think they should keep this promise because it`s unfortunate that all this happened. I mean he had this sort of squeaky clean image, and there was certainly I think some brand damage there for Justin Bieber. So there`s no question in my mind, he needs to send a message to everyone that you just can`t mess with the Biebs. No question about it.

DIAZ: Moving from the Beibs, the situation. I can tell you, the situation is looking for his day in court. It`s not a paternity suit, alright? Thankfully. But the situation is suing Abercrombie and Fitch for $4 million.

The retailer got itself a lot of attention after publicly demanding that the situation stop wearing their clothes. You got to say, he and his "Jersey Shore" reputation were bad for business and bad for their brand. But here`s the catch. The retailer agreed in t-shirts featuring "the Fitchuation" and GTL, you know the deal.

Judge Gunn, does sex scene to have a clear cut case here?

GUNN: You know, it`s very interesting case. At first flash, you say, what are these people fighting about? But it`s a very interesting case, and I think that both sides could have some merit. But the lawyers will certainly come out ahead in this case, it appears to me.

DIAZ: And I agree. They`re the ones that will definitely get paid no matter what. The situation once tried to trademark his own name but failed at that. He did trademark his catch phase, the GTL. Sunny, do you think he has a case here?

HOSTIN: I do, too, and I got to tell you, I don`t like what Abercrombie & Fitch did. I mean usually companies want to pay celebrities to wear you know their clothing. And so to do this reverse psychology thing saying, I`ll pay you if you don`t wear my clothes, it just sort of has this meanness to it that`s not nice. I think it turned off a lot of people. So, I think they have every right to sue them and I think he`s actually going to get some money. He`s not going to get $4 million, right, but he`s going to get something.

DIAZ: That`s good. More money for the Sitch. And the Sitch is "Jersey Shore" cast mate Snooki is also raging her own legal battle today. Snooki just filed a complaint claiming that a licensing company she partnered with, didn`t come up with the money they promised her. They claimed they brought Snooki many deals but she kept turning them down.

Judge Gunn, do you find it amazing a couple years ago nobody knew who these people were, and now they`re involved in lawsuit after lawsuit about their name.

GUNN: It really is, and a year from now it remains to be seen whether or not it will still be big news. But she`s kind of over the top with this because she`s asked for $250,000, and then claims that because the lingerie and the other items didn`t sell that they breached a contract. And now they said she`s breached the contract, and it`s a mess. A hot mess.

Tonight SHOWBIZ TONIGHT is exploring the mystery of the sexiest man alive. People magazine today named eligible bachelor Bradley Cooper the newest sexiest man alive. "the hangover" star graces the people hitting newsstands everywhere, Friday. But why Bradley?

With me tonight in New York with the inside story of Al Bradley which chosen is Julie Jordan. Julie is the senior writer with People magazine.

Alright Julie, break it down for me. Why was Bradley chosen as the sexiest man alive? Because I got to tell you, the SHOWBIZ TONIGHT staff, they picked some other possibilities, like Ryan Gosling. I mean they kind a surprised that you picked, Ryan Gosling? I don`t know if Bradley was the first choice. Ryan gosling.

JULIE JORDAN, senior editor, people magazine: Yes. OK. So, here`s the thing, always going to be a debate, right? Here`s why Bradley. OK, beside the piercing blue eyes, besides the fact he speaks fluent French, cooks gourmet, loves his mom, you know has a (INAUDIBLE) brought his mom and his dog to a photo shoot. He was very humbled when he found out he was sexiest man alive. He thought he was being punked, to be perfectly honest. He was looking around for the cameras. But you know what, he had fun with it. He`s a good guy. We voted for him because he`s got his romance and who is he dating, who is he not dating. But you know, he`s looking for someone who he says is kind. That`s his number one quality when it comes to a woman. It`s fun to watch.

DIAZ: Julie, you brought up the whole dating thing. I want to go there right now. I mean Bradley Cooper was linked to Jennifer Lopez, so I`m just asking this question, was the whole he dating Jennifer Lopez, you know, did that have anything to do with him being crowned the sexiest man alive? Did them dating have some weight?

JORDAN: Well, I was saying, it definitely elevated with status in terms of like dating men out there because of course more people were paying attention to him, there was a buzz around him. But we asked him, you know, are you dating anyone? He said, I`ll say this. I`m a 36-year-old single guy in Hollywood so that means people automatically assume I`m a player. But he thinks he`s not that much of a ladies` man. He loves women but there`s a difference.

DIAZ: Did you guys mean, by the way, did you guys mean to put Jennifer Lopez on the bottom right corner with her new man on the same cover of Bradley Cooper. It`s like, hey, Bradley Cooper. JLo has a new man and he`s 24 years old.

JORDAN: Yes.

DIAZ: Alright, some of the details will reveal in the magazine that hits newsstands on Friday. It`s got any women`s rule.

JORDAN: Of course.

DIAZ: He is fluent in French. He can cook, he likes his mom -- tell us more, please. I`m dying to know.

JORDAN: His dad died suddenly in January. The jewelry he wears is a ring that his dad gave him and he never takes off. Like I said, he loves his mother. He is dating a woman, you know, meeting the mom first right out of the gate at 21. And he has to deal with these rumors in Holly wood. And we`re just talking about that he`s dating like. He said, it is a kind of an obstacle.

DIAZ: Stop, stop. You hear all these positive things. He`s got to have some negative things. Negative things.

JORDAN: Yes, he does.

DIAZ: Your killing games for all the guys across America. Negative things.

JORDAN: Worst habit, he said that he picks his teeth with things and he burps a lot.

DIAZ: He picks his teeth and he what?

JORDAN: He burps a lot.

DIAZ: That actually makes him cooler for me. He`s a decorated burper. I like that.

JORDAN: He`s gorgeous and he deserves sexiest man.

DIAZ: He is gorgeous and he does deserve it, Ryan Gosling.

Welcome back to SHOWBIZ TONIGHT. I`m Carlos Diaz in for A.J. Hammer.

Tonight, quitting the Kardashians. Just when you thought reality TV most popular family might be fading in the spotlight, little brother Rob taking center stage on lighting up the voting lines on "Dancing with the Stars."

But hold the boat. While Rob is finally finding his group, tens of thousands of people are joining together and saying, they don`t want to keep up with the Kardashians anymore. They`re asking the "E" network to just make them go away. Are you kidding? No Kim? No Courtney? I can`t live.

With me from New York, newly reality TV worlds, Sherrie Austin and Shane Stevens from the ground breaking new series "girls who like boys," who like boys premiering this Friday on the (INAUDIBLE). I love that title, by the way.

So, this petition is really gaining seat. It went up just days after Kim`s divorce shocking headlines. Here`s what the officials said. "We are respectfully requesting that your network find other shows to air. Keeping up over the Kardashians is not just viewing that we the public would like to see from your network. Enough is enough."

But Shane, is it fair to call for all of the shows to be canned?

SHANE STEVENS, CO-STAR, GIRLS WHO LIKE BOYS WHO LIKE BOYS: No. I don`t know. I don`t know if I agree with all that. I think a lot of people have enjoyed watching and keeping up with the Kardashians, and just because she`s made a decision to not stay married, I don`t agree with that.

DIAZ: What would "E" run? They would have the soup and that would be about it.

STEVENS: That would be about it. I actually really enjoy -- I`m a gay man, but I really enjoy looking at Kim Kardashian.

(LAUGHTER)

DIAZ: That`s going to be on Kim`s tombstone. I like Kim Kardashian. I made gay men straight.

Alright, as if the petition is not enough, there`s this. Kim Kardashian is gushing, gushing about her soon-to-be ex-husband in the graduation of Marie Claire magazine. Of course the interview happened right before Kim-Kris Humphries. Kim told Marie Claire, " I feel like where Kris and I are, right now, he`s the best time of my life. And we have a lot of trust and I don`t think either of us would do anything to break that. He makes life so easy. He`s such a good guy."

Whoops. I have to shock her considered what we know things that turn out, Sherrie. A lot of people are thinking that there, there`s shadow, looking back and reading this article, I`m thinking it sounds like a woman who, I don`t know, maybe the mayor should have lasted at the cameras weren`t around. What do you think?

SHERRIE AUSTIN, CO-START, GIRLS WHO LIKE BOYS WHO LIKE BOYS: Yes. that`s the whole thing about reality TV. You know, you got to put an outfit and you just go to expect a whole lot of opinion coming back. I mean and I don`t - you know, with this kind of stuff too, the risk of sounding un- cool, I just haven`t really kept up very much with the Kardashians.

DIAZ: Sherrie, shame on you. I can`t believe you. What are you thinking?

AUSTIN: I know. I mean we`re busy shooting a reality show right now, so we`re in that world.

DIAZ: People are talking about making life style changes because of the show and you`re not even watching.

AUSTIN: We`re on a reality show. Who has time to watch them? Kip, tell them.

DIAZ: I agree. It`s really not a reality show.

Kim may be losing fans but her brother Rob is just gaining speed. Some people are saying Rob`s stint on "Dancing with the Stars" is making him the new, more likeable Kardashian. Now Shane, you being a gay man, I would think maybe you would like Rob better than Kim.

STEVENS: You know, he actually reminds me of my boyfriend, but I`m on the Ricki Lake team actually.

(LAUGHTER)

STEVENS: I grew up watching Ricki Lake. I love her. I`m a huge fan. I said earlier, anybody -- any woman who can push out a baby without an epidural got my vote, that`s for sure.

DIAZ: I`m in the J.R. Martinez camp, myself.

STEVENS: He`s a great guy by the way. I met with him last year, last May.

DIAZ: Really? What is your impression of J.R. Martinez?

STEVENS: He`s a great prayer. He`s a great man. He`s a great man, my God. Absolutely.

DIAZ: Alright, good stuff. Alright, I got to ask you guys about this new show. I can`t wait to see it. Let`s take peak out of a replay.

AUSTIN: It`s weird, you know, I came here from Australia to do the last season of a show called "the facts of life" like years ago, and it was skripted. That is a whole different world from doing reality TV. It`s like a whole different way of being presented, you know. I`m not playing a character, I`m being myself. So, we put a lot of stuff out there.

STEVENS: We put everything out there.

Brad backtracks. Brad Pitt has just revealed he`s not retiring from acting in three years, despite his own bombshell earlier this week that he plans to end his onscreen career by age 50. According to the Hollywood reporter, Brad was promoting his new movie "Money Ball" and just does a curve ball at his earlier statement, telling reporters now, "I wasn`t putting an exact deadline on my expiration date as an actor, but I just see it coming and I do have an interest in the producing side."

George opens up on his pal Pitt. SHOWBIZ TONIGHT was right there for the premiere of George Clooney`s new film "the descendants." And Clooney revels o us what he thinks about Brad`s early retirement plan.
