Nancy Grace

Casey Anthony`s Video Diary

Aired January 05, 2012 - 20:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

NANCY GRACE, HOST: Bombshell tonight. Tot mom, Casey Anthony, last seen hiding her face under a blanket, running toward a private jet moments after she`s released from jail -- a Florida jury said she`s not guilty in the horrific murder and disposal of her 2-year-old little girl, Caylee, Caylee`s body found decomposed in a swampy marsh just 10 houses down from the Anthony home.

But tonight, tot mom blasts back into the national media by covertly leaking her own so-called video journal. Why? It`s literally about money, generating interest in herself since no TV outlets will touch her with a 10-foot pole.

What do we learn tonight from tot mom`s home-made movie? Well, against the backdrop of 2-year-old Caylee`s death and decomposing body, the video is gut-wrenching -- in one word, nauseating.

(BEGIN VIDEO CLIP)

CASEY ANTHONY, CAYLEE`S MOTHER: So this is my first video diary.

UNIDENTIFIED MALE: Casey Anthony speaking out for the first time since being acquitted of murdering her daughter.

CASEY ANTHONY: And I`m extremely excited.

UNIDENTIFIED FEMALE: Never mentions her daughter Caylee.

CASEY ANTHONY: And I have something I can finally call mine. It`s been a long time since I`ve been able to call something mine.

UNIDENTIFIED FEMALE: Casey provides few details about where she is as she serves her probation at an undisclosed Florida location.

CASEY ANTHONY: These are things that are mine, and I don`t have to -- (INAUDIBLE) I don`t have to give back and that I`ll be able to take with me after I leave here next year.

UNIDENTIFIED FEMALE: She really is a sociopath. She`s dissociated herself from that other world.

CASEY ANTHONY: I`ll be here for many, many months more, even if I`m only here for six months, even if I get off probation early.

UNIDENTIFIED MALE: Questions as to what is she talking about.

CASEY ANTHONY: It`s just been such a blessing in so many ways. And now I have someone to talk to even when I`m by myself, so I`m not bothering the poor dog.

UNIDENTIFIED FEMALE: A black-and-white YouTube video supposedly shows Casey Anthony making a video diary.

UNIDENTIFIED MALE: Casey Anthony speaking out for the first time since being acquitted of murdering her daughter.

CASEY ANTHONY: I`m very -- I`ve adopted. And I love. And he`s as much my dog as any of the other pets I`ve ever had.

(END VIDEO CLIP)

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. Tot mom blasting back into the national media by covertly leaking her own so-called video journal. Against the backdrop of 2-year-old Caylee`s decomposing body just a few houses down from where tot mom put her head on the pillow every night, the video is gut-wrenching to watch -- in one word, nauseating. Let`s take a look at it.

(BEGIN VIDEO CLIP)

CASEY ANTHONY: So this is my first video diary. It is October 13th, which is a Thursday, 2011. And I`m just starting to figure out my new computer. And I don`t know, I guess I`m liking it so far. It`s, obviously, a different ballgame for me because I`ve never used this before. So I guess these will be as tedious as my audio recordings have been.

And I guess to start off this one, just a few updates from the last few days. There really hasn`t been all too much going on, except now for this. And you know, I`m extremely excited. I`m extremely excited that I`ll be able to Skype, and obviously, keep a video log, take some pictures. And then I have something I can finally call mine.

(END VIDEO CLIP)

GRACE: We are taking your calls. But I want to go straight out to Jean Casarez, legal correspondent, "In Session." From where did this emerge?

JEAN CASAREZ, "IN SESSION": Well, Nancy, I just got off the phone with Cheney Mason, who not only confirms that it is Casey Anthony, but issued a quote that he wants me to read in its entirety. So here it is.

Quote, "Casey has maintained notes and memoirs for her personal counseling. She did not upload or release this to YouTube. She doesn`t know how the video got on YouTube. She did not authorize it, and therefore, it had to be obtained illegally," unquote.

GRACE: Good to know. Let`s go to Jon Briley. He`s joining us from Columbus, Ohio, exclusively tonight. He says he was the first to post the video to YouTube. He manages the Boycott Casey Anthony page on FaceBook.

Jon, thanks for being with us. Where did you find this?

JON BRILEY, FIRST TO POST VIDEO TO YOUTUBE (via telephone): There was a picture that was posted onto our site. It was a picture of the video, and that was all. There was no video.

I went looking for the video. And after about 45 minutes, I found a pay site that wanted, I think, $2. And I didn`t give it. I tried another one. I think it was $3 or $5. I would not give money to that, either. I kept looking and looking and looking.

I finally found it -- a link to it free. I hurried up, I downloaded it into my computer. It was five or ten minutes later, that link was gone. You couldn`t get to it.

But I already had the video. I uploaded it into YouTube and to the boycott -- that we use up there. And the reason I uploaded it was so it was free for everybody. There would be no paying for it. There would be no money made off of it.

GRACE: You know, Jon Briley, it`s good to hear that because you could have somehow managed to finagle this thing where you made money yourself. But you`re saying as soon as you got to the site where you could actually look at it for free, within minutes, that link was gone?

BRILEY: Yes, ma`am. That link was gone in about -- it took me about 30 seconds to download the video. And when I went back and clicked on it again, it was gone.

GRACE: So Jon Briley, you just heard Jean Casarez say that tot mom`s lawyers are saying this was hacked illegally and posted illegally. From what I`m hearing, you`re saying you did absolutely nothing illegal at all. What`s your response?

BRILEY: I did nothing illegal at all. It was free on the Internet. And to be quite honest with Cheney Mason, I have things in my laptop, I have information in there and such, and there ain`t nobody going to hack into my computer and get it because it`s not there.

GRACE: You know, Jon Briley, you are saying what many of us have been thinking since this came out this morning, this bombshell where tot mom, Casey Anthony, again injects herself into the national media.

You`re seeing the video right now that is now free for everybody to see, tot mom apparently trying to make money on pay-per-view on line. Here you see tot mom with a new hairdo, new glasses, giving her side of her new life. Is it all about money and her own narcissistic nature?

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

CASEY ANTHONY: It`s been a long time since I`ve been able to call something mine. And now that I have something, even, you know, as silly as saying that I have a computer and a camera and a phone -- granted, you know, I wouldn`t have the phone without -- and I`ve actually now paid for my own computer.

The camera was a gift, but these are things that are mine that I don`t have to -- I don`t know, that I don`t have to give back. It`s kind of nice finally being able to say that I have some belongings that are mine that I`ll be able to take with me after I leave here next year.

(END VIDEO CLIP)

GRACE: We are taking your calls. As you see, tot mom, Casey Anthony, has injected herself once again into the limelight, her defense team now tuning back up and issuing a statement that she did not release this, it had to be hacked. Whatever! You really believe someone hacked onto her brand-new private laptop? Here`s the reality. She`s in hiding. She`s a recluse now. Who is going to get on her computer or somehow hack into it with her in hiding? That is what the lawyers have to explain.

Again, we are taking your calls. Out to Cheryl in Florida. Hi, Cheryl. What`s your question?

UNIDENTIFIED FEMALE: Hey, Nancy. How are you?

GRACE: I`m good, dear.

UNIDENTIFIED FEMALE: Been following this case since day one with you.

GRACE: Thank you.

UNIDENTIFIED FEMALE: Well, we all know that Casey Anthony thinks she`s the smartest person in the state of Florida, but we all know she`s not the sharpest tool in the shed. Take a zoom in on those photos behind her, and I bet that you`ll see that it`s probably her female attorney`s office, in her home. I`m sure that those photos, if you could zoom into them, will tell us where she is in her undisclosed location.

GRACE: Well, you know, Cheryl in Florida, many of us have observed that we think this looks like a home office. And I`m wondering if the photos behind her, which we are trying to zoom in on, are going to be turned out -- turn out to be something strategically placed for everyone to identify.

We have confirmed that this is paneling and seemingly interior of a Florida home. Where? We don`t know. We notice that she mentions early probation release. Is that true? Also, we hear her talking about a series of audio recordings and how tedious it is for her to talk on audio recording.

Unleash the lawyers. Penny Douglas Furr, defense attorney, Peter Odom, defense attorney Atlanta. Also with us, Sheryl McCollum, crime analyst and director of the Cold Case Investigative Research Institute.

First to you, Sheryl. Audio recordings? This has to be in furtherance...

SHERYL MCCOLLUM, CRIME ANALYST: Sure.

GRACE: ... of a book deal, a movie deal...

MCCOLLUM: Sure.

GRACE: ... an audio book deal. Why else would she be making audio recordings of herself?

MCCOLLUM: Nancy, this is not a diary. Diaries, you say personal things. You say private things. You give details. She doesn`t tell you anything private. She doesn`t tell you anything personal. She`s giggling. She`s tossing her hair back. She`s basically flirting with this camera.

She tells you that a guy got her a phone and somebody else gave her the camera. Why would you give somebody a videocamera for a computer as a gift unless they were going to make video and you knew it?

GRACE: Also with us today, a special guest, attorney Mark Lippman, the attorney for George and Cindy Anthony. He`s joining us out of Orlando. Mark, I can only imagine how it made George and Cindy Anthony feel when she basically talks about a dog as being her only family.

MARK LIPPMAN, ATTORNEY FOR CASEY`S PARENTS: Well, Nancy, my clients just found out about this video at about a quarter to 7:00 this morning, and they`re not going to comment on the validity of it. They`re just upset that it was released because it puts their daughter`s safety at risk once again, as people can identify, if this is her in the video, what she looks like these days.

GRACE: Well, her lawyers have already given a public statement that it is her.

LIPPMAN: Yes. And I`m just hearing that on your show now. So I`m just surprised that whoever thought it would be a good idea to release it, even, you know, for whatever reason -- if you don`t like her, that`s your business, but there`s no reason to continue to put her safety at risk or do anything that would cause jeopardy for her. Everybody is just trying to go on with their lives at this point.

GRACE: Mark, are you suggesting that you, George and Cindy, do not believe she leaked this herself?

LIPPMAN: We have no idea. Like I said, we just found out this morning.

GRACE: Well, think! There -- I`m (INAUDIBLE) pause. Who else would release it, other than her or her lawyers? She`s in hiding. She`s a recluse. According to her, she`s afraid to step out and put one toe outside of her door. So obviously, she leaked it! I mean, I don`t have to be a brain surgeon to figure this one out.

LIPPMAN: No, it -- I don`t know if it was released to a select group, or if it was released in response to something. All I know is that -- all it does is have people be able to identify what she looks like and possibly where she`s at and cause security concerns for wherever she`s staying, whomever she`s staying with and herself.

So if it was an idea to respond to something or do something proactive, I think all it`s done is create a security risk.

GRACE: Well, Mark Lippman, you know, I hate to put you on the hot seat, but let`s just get practical. I`d like to see Lippman when I`m talking to him, please. Mark, think about it. She says that this was taped back in October. But yet it`s released -- anybody in the TV business knows over Thanksgiving and Christmas holidays, ratings are down. People are busy with their lives. They don`t have time to watch TV. TV business picks back up in January. And when is it released? The first full work week in January! Come on! This was perfectly timed. I mean...

LIPPMAN: I imagine it was released...

GRACE: Come on! Take off those rose-colored glasses!

LIPPMAN: Oh, no, no, no.

GRACE: I know you`re trying to protect your clients, but this is all a big scam by tot mom!

LIPPMAN: You know it could be, but it could also be something done by other people who have different interests.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

CASEY ANTHONY: I guess to start off this one, just a few updates from the last few days. There really hasn`t been all too much going on, except now for this. And you know, I`m extremely excited. I`m extremely excited that I`ll be able to Skype, and obviously, keep a video log, take some pictures, and that I have something that I can finally call mine.

(END VIDEO CLIP)

GRACE: You know, it`s just so disingenuous! For those of you just joining us, tot mom injects herself back into the national media by, obviously, leaking this video journal of herself.

Out to Dr. Bethany Marshall, psychoanalyst and author of "The Dealbreakers." I mean, to suggest that she`s never owned anything before, that nothing`s ever belonged to her -- nothing belongs to you like your own children. I mean, in my world, the only thing that has even ever mattered to me are my two children. It`s the first thing, object, person, thing that has mattered that is mine for me to raise and take care of.

And not only that, if she wanted to own possessions, she could have gotten off the sofa and put down the bag of chips and gone to work!

BETHANY MARSHALL, PSYCHOANALYST: But Nancy, don`t you think that is a jab at her mother, Cindy Anthony? She said, Finally, I have something I own. I have this computer. She wanted to own and possess her own daughter, Caylee, and that`s why she killed her. She`s saying, Mom, you didn`t let me own my own daughter. Well, now at least I own this computer.

And Nancy, I love your use of the word "narcissism" earlier in the show because narcissism is self-aggrandizement and devaluation of others. It`s all self-aggrandizing -- her public, her video diary, her dog, her computer, her everything. But there`s nothing about Cindy, George, Caylee, other people, the big picture.

And finally, people with anti-social personality disorder are always putting together the bits and fragments and tiny pieces of their life. They never see the big picture. So the bits and pieces are her stripper pole, her target (ph), her boyfriend that she wanted to seduce, her computer, her dog. She`s putting together the tiny fragments, but there`s not one big picture reference of what this means to her life, her parents, the public. It`s all about her own microscopic world.

GRACE: Joining me right now, Jon Briley, the first to post this video on YouTube. Jon, what did you think when you first happened upon this?

BRILEY: I couldn`t believe that in all the video that Caylee was never mentioned. And I felt very sorry for that dog that she has now.

(BEGIN VIDEO CLIP)

CASEY ANTHONY: (INAUDIBLE) surreal (ph) how much things have changed and things haven`t changed. Kind of funny to think about, actually. (INAUDIBLE) been such a blessing in so many ways.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: A black and white YouTube video supposedly shows Casey Anthony making a video diary.

UNIDENTIFIED REPORTER: Casey Anthony speaking out for the first time since being acquitted of murdering her daughter.

UNIDENTIFIED FEMALE: NBC News has now confirmed that the video that is now on YouTube is, in fact, the Florida mother.

CASEY ANTHONY, MOTHER OF MURDERED CAYLEE ANTHONY: So this is my first video diary. It is October 13th which is a Thursday, 2011. And I`m just starting to figure out my new computer.

UNIDENTIFIED FEMALE: Casey Anthony is out with a Web diary. It`s posted on YouTube.

ANTHONY: This has just been such a blessing in so many ways. And now I have someone to talk to even when I`m by myself so I`m not bothering the poor dog. I`ve adopted, and I love, and he`s as much my dog as any of the other pets I`ve ever had.

UNIDENTIFIED FEMALE: What does this all mean?

UNIDENTIFIED MALE: It means that -- I think that she`s very lonely.

UNIDENTIFIED MALE: Advice, go climb under the rock from which she came.

ANTHONY: So this is my first video diary. It is October 13th which is a Thursday, 2011. And I`m just starting to figure out my new computer. And I don`t know. I guess I`m liking it so far. It`s, obviously, a different ball game for me because I`ve never used this before. So I guess these will be as tedious as my audio recordings have been. And I guess to start off this one, just a few updates from the last few days. There really hasn`t been all too much going on except now for this. And I`m extremely excited.

(END VIDEO CLIP)

NANCY GRACE, HLN HOST: What about it, Steve Helling? Steve joining us from "People" magazine.

STEVE HELLING, STAFF WRITER, PEOPLE MAGAZINE: Well, yes, she can make money, and that`s obviously something that she`s going to be looking to do. But I`m surprised that this video actually came out. Because why would you pay all this money for an interview with Casey Anthony if she`s talking for free and if she`s promising more videos.

GRACE: Steve Helling -- put him up. Steve Helling, I know --

HELLING: Yes.

GRACE: -- you personally. Come on. It`s what they call a teaser. A sizzle reel. Think about it.

HELLING: I`m not feeling it, Nancy.

GRACE: She does this -- yes, I`m not either. She does this back in October, according to her, and releases it the first full TV week after Christmas when all the viewers are back in their seats and not decorating the Christmas tree and doing Christmas shopping and Hanukkah cooking. They are all back now. That`s when this gets released? You don`t see the coincidence there? The timing?

HELLING: Well, of course, Nancy. But what I`m saying is, perhaps this is going to be a teaser that backfires. You don`t see a four-minute teaser for something, for an interview. You might see a 30-second teaser. This is four minutes of her talking about her life. She promises there`s going to be more. Why would somebody pay her $1 million to talk to her at this point?

GRACE: What about it, Jean Casarez? Jean in touch with the defense team who swears that this was hacked.

JEAN CASAREZ, LEGAL CORRESPONDENT, "IN SESSION": Well, as I keep reading this, I keep thinking about the evidence at trial. She talks about this dog that she adopted. That she loves it as much as the other pets she owned.

Nancy, we heard evidence from the prosecution that they buried all of their pets, that she learned how to bury a pet through her mother, and that`s how Caylee was buried.

GRACE: You know, Jean, I thought the same thing. You and I sitting in that courtroom together hearing that evidence.

Jean Casarez joining us from "In Session."

To those of you just joining us, you are seeing just released, tot mom Casey Anthony injects herself back into the national media by apparently leaking this audio/video journal of herself.

And speaking of the content of this, she says, I`ve adopted. As if she`s adopted a baby. Correct me if I`m wrong, Ellie Jostad, but didn`t she want to give Caylee up for adoption before she murdered the baby?

ELLIE JOSTAD, NANCY GRACE CHIEF EDITORIAL PRODUCER: Yes, she did. That`s according to her friend, Kio Marie Cruz. Kio Marie couldn`t have children of her own and she said that she and Casey had discussed that but that it was actually Cindy Anthony who put the kibosh on any sort of adoption.

GRACE: We are taking your calls. But before I go back to the calls, I want to go out to an expert editor and producer, Phil Rosenbaum, joining us.

Phil, thanks for being with us. Does -- you, like I, have combed over this video diary as she is calling it. Apparently leaked by herself, although her lawyer Cheney Mason denies it, saying, obviously, her laptop was hacked. OK. Whatever.

But, Phil, do you see any evidence of editing?

PHIL ROSENBAUM, NANCY GRACE PRODUCER: I do see evidence of editing, Nancy. To the naked eye, it doesn`t look edited, but looks can be deceiving and they are in this case. In this video diary we hear several instances of the audio being muted. Audio edits like this can wipe out and in this case they do, parts of what tot mom actually says.

And the most significant audio edit comes early in the video when tot mom is talking about the fact that she wouldn`t have a phone without -- and you hear a pause. It goes silent. She seems to almost utter the letter J which raises speculation that someone whose name begins with J may have provided her with a phone. This is what it sounds like, Nancy.

(BEGIN VIDEO CLIP)

ANTHONY: Granted, you know, I wouldn`t have the phone without -- and granted, you know, I wouldn`t have the phone without -- and granted --

(END VIDEO CLIP)

GRACE: There you see exactly what Phil Rosenbaum is describing where it appears that she is saying I wouldn`t have this except for John.

Also I noticed, Phil Rosenbaum, when she talks about her family -- Liz, if you could queue up to that point -- it drops out again when she`s talking about her new dog that she adopted and a family. As if she never had a family, Phil. Did you notice that as well?

ROSENBAUM: Yes, Nancy. She said because I`ve adopted and I love Annie as much as my dog, as my other pets I`ve ever had. Some kind of nonsense like that. And then you hear the audio drop out yet again. That`s one of three times I think I noticed. The other one is when she`s talking about whether she`s going to do more video diaries like this one.

GRACE: Let`s listen to the second apparent editing of her audio journal.

(BEGIN VIDEO CLIP)

ANTHONY: And now I have someone to talk to, even when I`m by myself so I`m not bothering the poor dog. I have adopted. And I love -- and he`s as much my dog as any of the other pets I`ve ever had. You know -- families I`ve ever had if not more so.

(END VIDEO CLIP)

GRACE: Phil, we just played the second drop-out. So what does this say to you, Phil, that there`s apparent editing of her audio journal, yet her lawyers are insisting it wasn`t leaked?

ROSENBAUM: Well, it sounds like this video diary is very premeditated and has a purpose to it. And we`re probably witnessing it right here today. As you know, -- as it`s all over the Web.

MIKE GALANOS, HLN ANCHOR: And the new hair and the tank top and all that stuff. So maybe people will want to hear a little bit more. Because she says nothing of substance, right?

GRACE: Let me ask you something, Galanos.

GALANOS: Go ahead.

GRACE: What do you mean the tank top and all that? Because I`m interested in your opinion of the way she presented herself, which I think -- I believe, speaks volumes. What did you mean by the tank top and all that? What did you mean by that?

GALANOS: She`s playing -- I believe she`s playing the cute card again. You know she flips the new blond hair. There, right there on queue. She has the glasses. She`s coy and she`s reflective. Says nothing of substance because anything -- or any real questions that anybody would ask her, and I know nobody worth their salt right now they`re going to be dealing with. But hat`s where it`s coming from. The cute card is being played.

GRACE: Well, I noticed this. I noticed the camera pulling back and showing her cleavage. I noticed her Norma Desmond, I`m ready for my close- up, widening of the eyes, the flipping of the hair. All of the nonverbal communication she`s giving us. But she did the same thing. I watched her day in, day out in front of a jury doing it. So to me, it`s old hat. But what this is about is making money, and really an extension of herself by injecting herself back into the national media.

GALANOS: And then she says at the end or toward the end, she hates being on camera, but she has to conquer that fear.

GRACE: She hates being on camera? Is that why they are shopping a nearly million-dollar deal for her to be on camera? I mean it`s just so disingenuous. Just like what happened at trial. I mean, the viewers and America agrees with me, although a couple of on-air pundits living in their ivory tower may disagree, but I find this reprehensible.

Instead of using her time to put herself in a low-cut tank top back into the national media, maybe she should be out helping missing and murdered children. Just for starters.

GALANOS: Right.

GRACE: Just for starters.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

ANTHONY: I don`t know whether to look directly at myself or look up or -- oh, man. I don`t know. Just a little surreal how much things have changed since July and how many things haven`t changed. But the good thing is that things are starting to look up, and things are starting to change, in a good way. I just hope they stay. That things stay good and that they only get better.

(END VIDEO CLIP)

GRACE: Tot mom Casey Anthony re-injects herself into the national media by apparently leaking this audio journal as she calls it.

To Ellie Jostad, apparent editing has taken place, so it`s clear that this was not an accidental incident. It had to have been edited by her, unless somebody else on the Internet chose to edit those two portions.

JOSTAD: Well, right, Nancy. And the whole origin of this video is really unclear right now. It`s been reposted by a ton of people on YouTube, on Facebook. Numerous locations. I mean it is curious, though, if it was on a pay-per-view site, why would it be a secret? You`d think if it`s trying to make money, you`d want people to know about it.

GRACE: Well, you know, John Briley could find it. And if he could find it the rest of the public could ultimately find it.

Joining me right now is a writer from "People" magazine, Steve Helling.

Steve, thanks for being with us. Weigh in.

HELLING: Thanks for having me. Well, you know, it is interesting this came out when it came out. And it`s all very interesting to notice that, you know, she gives us some details but she doesn`t give us anything that we probably couldn`t have guessed other than the dog. So, you know, at this point, I don`t know that this pushes the story forward very much, except for the fact that we now see what she looks like.

GRACE: OK. You know what, Steve, I get what you are saying about pushing the story forward. But to me, I learned a lot more. I learned that she`s repositioned herself not only in her mode of communication but her looks as well. There you see it. The low cut shirt. The tight tank top. The blond asymmetrical haircut. The glasses to try to make her look smart. The playing with the hair.

All that -- a lot of that we saw when she was interviewing with detectives when they were suspicious that she had murdered her child. A lot of the same mannerisms. As a matter of fact, hold on, Steve Helling.

With me right now, body language expert Aaron Brehove. Aaron, weigh in.

AARON BREHOVE, BODY LANGUAGE EXPERT: Absolutely. Everything you`ve been saying, Nancy. Right on point. This is all about her. And we hear her talk about herself. In the first two minutes, the first time she shows any emotion is when she talks about mine. What she owns. And then also, a point I want to pull out is, she says she`s almost scared. So she`s not scared but she wants to bring in this point that she`s -- it`s about her and she`s a little bit scared but she`s not actually there. She`s almost telling the truth.

It`s an act. She`s an actress. And this is what she`s doing. It`s a lot more of the same with Casey Anthony here and we`re seeing it again in these videos.

GRACE: Aaron, when you said, you said she was almost scared. Almost scared of what?

BREHOVE: She`s almost scared of being on video. Well, she`s -- if she wants to say she doesn`t have to be on video. She`ll get one.

GRACE: Aaron. Her lawyers are shopping a nearly million-dollar deal to be on camera. So what`s this business about being afraid to be on camera?

BREHOVE: Well, she`s not. She says she`s almost scared. And it`s ridiculous. It`s a ridiculous statement to say I`m almost going to tell the truth. I almost want to say the truth. This is -- it says you`re not telling the truth. She`s not actually scared. So why make any comment. It`s because this is an act. And this is something she`s trying to portray is that she`s scared but it kind of slipped in, the almost. So she`s not scared. It`s a lie. I mean this is kind of how she goes forward with things. She`s deceptive. She`s an actress. This is her -- this is one of Casey`s acts.

GRACE: Aaron, I`d like you to analyze the twisting of the hair, the flipping of the hair, the glasses, because, you know, she went to such great lengths for her vanity. Now we see her in these black glasses. Juxtaposed against a low, tight tank top. New watch, new bracelets, new necklace, new hairdo, new hair color. Obviously, that she doesn`t want to keep a secret. Why? What does this is say?

BREHOVE: Well, she comes forward as she said she`s almost scared. She said she acts like she`s a little bit sad. But it`s really she`s so comfortable in these videos. And everything she`s doing is with a purpose. And we see this. Her look is very casual look. She`s wearing a tank top. A low-cut tank top. It`s a very casual look but it`s very put together. It`s very purposely done. As is a lot of her statements and when she pushes her hair to the side and when she looks off, she looks up and to the right for a few minutes or for maybe 10 seconds.

And when she does this, it`s purposeful. She tries to act casual. She tries to put this foot forward that this is casual, this is who she is behind the scenes. This is not at all who she is behind the scenes. This is what she wants to be for the camera and for the camera only.

GRACE: What does her affect mean? The pauses between sentences? The widening of the eyes? I saw her do that a lot at trial when she would be in stressful situations. I refer to it as the Norma Desmond look when she`s getting ready for her close-up and her eyes widen and she gets closer and closer to the camera. What does that mean?

BREHOVE: So there`s a few things. The parallels that we see when her eyes widen, this really is her emotion. She`s coming -- she`s coming forward that she wants to portray something. She wanted it to come back to her so she would widen her eyes when somebody said something like she was surprised about it, that she already knew about. And there`s no reason for the surprise.

This is a great pick-up that you see this that she widens her eyes. It`s a very contrived move that she`s doing there. And it`s inappropriate as it was in trial. Here it`s just a contrived move. And she`s trying -- she`s putting on a little bit of a show. She really is an actress here. I mean it`s nothing more than a show here.

GRACE: And in addition to John Briley who says he was the first to post this video, claims he wants to make no money off of it whatsoever, and he has not made money off of it. Joining us, the lawyers. Peter Odom, Penny Douglas Furr, Mark Lippman the lawyer joining us out of Orlando, the lawyer for George and Cindy Anthony.

OK, Peter Odom, Penny Douglas Furr -- first to you, Peter. This is reminiscent of leaked sex tapes. You know, all of the Hollywood starlets go, oops, my sex tape was released. Now I`m going to make a whole lot of money and get a deal with Playboy.

PETER ODOM, DEFENSE ATTORNEY: Right.

GRACE: All right. Let`s get real about whether this was hacked or not.

ODOM: No way.

GRACE: Peter Odom?

ODOM: Nancy, if you want to figure out who`s responsible for something, one of the first things you want to do is figure out who benefits from it.

GRACE: Exactly.

ODOM: Who benefits from this? Casey Anthony benefits from this. Secondly, look at the fact that it`s edited. She had to do that editing. And the only reason that she would edit it is if she intended it for consumption by somebody else. She was trying to protect people`s names.

So she also understands that even though many people in America have condemned her morally, that there`s a large percentage of Americans that are thirsty for her image. And hints about her personality. So she benefits greatly from this. And it`s no surprise that she put it out there.

GRACE: Penny, what do you think?

PENNY DOUGLASS FURR, DEFENSE ATTORNEY: I don`t believe she necessarily put it out there. My computer was hacked by somebody in Nigeria. It doesn`t have to be somebody in your house. I could have been modified after it got out there.

GRACE: Penny, Penny, Penny, Penny, Penny.

FURR: And if I`m her attorney --

GRACE: Penny, wait a minute, question.

FURR: OK.

GRACE: Your computer was hacked by someone you believed to be in Nigeria for what purpose?

FURR: Yes.

GRACE: For what purpose?

FURR: They got into my -- they got into my email account, wrote all my contacts, and asked them to send them money.

GRACE: All right. Now, so there you have it. It was hacked for the purpose of making money off of you.

FURR: Yes.

GRACE: So back to what Peter said. You`re saying the same thing. Who would make money off this. The people that you say were -- and I don`t remember when that happened to you, Penny. They were trying to make money.

FURR: Right.

GRACE: It wasn`t you. Here, who would gain from this? Who tends to benefit? Who do we think would gain from this, Penny Douglas Furr.

FURR: But as Casey`s attorney, this is not the video I would want out there. I would want a different kind of video out there. I don`t see this as helping her.

GRACE: Well, that`s you, Penny. You would want a different video out there, but John Briley swears he is not making money off this. What about it, Briley?

JOHN BRILEY, ALLEGED LEAKED THE CASEY ANTHONY WEB VIDEO: Not a cent.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

ANTHONY: You know, in some ways, someone to talk to, so I am by myself not bothering the poor dog, who I adopted and I love. And he`s as much my dog as any of the other pets I`ve ever had. You know, from the families I ever had if not more so. I don`t know.

(END VIDEO CLIP)

GRACE: And an obviously edited and leaked bombshell tonight. Tot mom blasts back into the national scene by clearly leaking this video. Of course, her lawyers claim it was not leaked.

Out to Tammy in Florida. Hi, Tammy, what`s your question.

TAMMY, CALLER FROM FLORIDA: Hi, Nancy. I love you and God bless you.

GRACE: Thank you.

TAMMY: I have two comments.

GRACE: OK.

TAMMY: First of all, I do believe the video is premeditated, and she`s profiting from that, but I also believe she`s using it as proof of interest from the public for a high dollar payout interview. And second, she mentions in the video how -- something that she doesn`t have to give back, when I feel like all she`s done is take, she`s taken from her family, she`s taken from her friends, and ultimately from her own child.

GRACE: You know what, Tammy in Florida, my observations exactly. So I`m wondering where this is headed? Are there going to be weekly leaks and posts? Is this the -- just the beginning and more of her audio and video journals being leaked?

To Tina in Ohio. Hi, Tina. What`s your question, dear?

TINA, CALLER FROM OHIO: Hey, I just want to say quick, thank you for being the voice of the victims that have been silenced like the Caylees of this world.

GRACE: Thank you.

TINA: And your twins are awesome. What I want to say, is there any way, because as far as I know, acquittal does not mean innocence. Is there any way legally to keep her from profiting from her viral narcissism?

GRACE: To Mark Lippman, an expert in Florida law, he is attorney for George and Cindy Anthony.

Mark, I know that the U.S. Supreme Court struck down a national Son of Sam law, but what about in Florida?

MARK LIPPMAN: In Florida there`s no such law. I mean, she was found innocent by a jury of her peers, and she`s able to go about her everyday business, including making any money from any books or shows that she may do.

GRACE: Let`s stop and remember Army Staff Sergeant Joseph Phaneuf, 38, Eastwood, Connecticut. Killed in Afghanistan. On a second tour. Also served in Iraq. Awarded Bronze Star, Purple Heart, a volunteer firefighter, coach basketball in Little League. Loved telling jokes, photography, golf, and the Michigan Wolverines. Leaves behind a wife, Michelle, son Ryan, daughters, Danielle and Jordan.

Joseph Phaneuf, American hero.

Thanks to our guests but especially to you for being with us. See you tomorrow night, 8:00 sharp Eastern. And until then, good night, friend.
