Aired February 09, 2015 - 20:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

NANCY GRACE, HOST: Breaking news tonight. We go live. American songbird superstar Whitney Houston`s look-alike daughter in a coma, found

unconscious, face down in her bathtub, doctors telling family prepare for the worst, Whitney Houston`s family telling us tonight they`re holding out

for a miracle.

While doctors say the situation is, quote, "bleak," this is what we know at this hour. Just two days to the three-year mark of her mother,

Whitney Houston`s, death, also found submerged in a bathtub, history repeats itself.

Bombshell tonight. At this hour, we learn investigators say Bobbi Kristina has serious injuries, and they demand an explanation. According

to sources, there is an active criminal investigation under way. Is the target Bobbi Kristina`s boyfriend?

And tonight, we learn secret surveillance video at the high-end condo community may have captured someone fleeing the scene at the same time

Bobbi Kristina pulled, dragged from that tub of water. This as one of the witnesses on the scene has a brand-new fleet of criminal defense lawyers.

Why? And as we go to air tonight, TMZ obtains police video on the scene when fiance Nick Gordon arrested blaring Whitney Houston tunes.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Cissy Houston, a mother to Whitney Houston, grandmother to Bobbi Kristina, leaves Emory University Hospital.

UNIDENTIFIED FEMALE: They`re having a fight in the bar here. We have a group that`s fighting in the bar.

UNIDENTIFIED MALE: ... not regained consciousness and remains in a coma.

UNIDENTIFIED MALE: There are still so many unknowns. Was it an accident, or something worse?

(END VIDEO CLIP)

GRACE: And live Malibu, Olympic decathlon icon and reality TV star from "Keeping up With the Kardashians" Bruce Jenner in a fatal freeway

crash. At this hour, police obtaining a search warrant for Jenner`s cell phone. Was he texting?

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: A tragic traffic collision that involves a celebrity.

UNIDENTIFIED MALE: One person is dead.

UNIDENTIFIED FEMALE: Four-car chain reaction crash. Bruce Jenner`s SUV rear-ended that white Lexus, shoving it into oncoming traffic, where it

was hit by a Hummer.

(END VIDEO CLIP)

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us.

Bombshell Tonight. We learn investigators say Bobbi Kristina sustained serious injuries that need an explanation! And according to

sources, there`s an active criminal investigation under way. Is the target her boyfriend, Nick Gordon? And tonight, we learn secret surveillance

video at the high-end condo community where Bobbi Kristina lives may have captured someone fleeing the scene at the same time Bobbi Kristina`s

dragged out of that tub of water.

This as one of the witnesses on the scene has a brand-new fleet of criminal defense lawyers. Why? And tonight, TMZ obtains police video on

the scene when fiance Nick Gordon arrested blaring Whitney Houston tunes.

But first, we are standing by at the hospital, trying to find out the very latest on Bobbi Kristina`s condition. To Martin Savidge, CNN

correspondent. Martin, what do we know tonight?

MARTIN SAVIDGE, CNN CORRESPONDENT: Well, there have been conflicting reports as to the health of Bobbi Kristina, but what we officially have

heard is that she is still in a very bad way. And the fact that her family continues to gather here in Atlanta would only seem to back up that medical

opinion. She is still in that narrow (ph) intensive care unit at Emory University. You couldn`t ask for better care, but it also suggests that

she in an extremely bad way, Nancy.

GRACE: When you say there`s conflicting reports -- we heard reports that she had fluttered her eyes again and that she had had some sort of a

seizure. Have those reports circulated? Do you know about that?

SAVIDGE: They have. You know, those are ones that came out a couple of days ago that suggested that maybe there was some brain activity here.

But the doctors had put her into a medically induced coma, and they really could not measure brain activity until they begin to reduce the sedatives.

There`s been no word as to whether they`ve actually carried that out. Of course, people continue to hope and pray for the best.

GRACE: You`re seeing shots of baby Bobbi Kristina with Mom and Dad, Whitney Houston and Bobby Brown. At this hour, Bobby Brown still standing

by her bedside in a bedside vigil. Tonight, a vigil for the public goes down.

Also with me, national correspondent from Radaronline.com Alan Duke. Alan, also, we are learning that she sustained other injuries, as well --

other injuries -- and that police are demanding an explanation. What do you know?

ALAN DUKE, RADARONLINE.COM: Well, they are trying to figure out what happened and what injuries there were. You know, this is different than a

death investigation because, usually, we`re waiting for the coroner to tell us what they find in the autopsy. But she`s still a patient in a hospital,

so doctors are still able to look at her as she`s living now. And of course, any injuries will be healing. So I really don`t know what they`re

doing at the hospital. But I can tell you they are also talking or have been -- no longer talking...

GRACE: What who is doing at the hospital?

DUKE: ... to Max Lomas...

GRACE: What -- you can`t tell me what...

(CROSSTALK)

DUKE: ... got doctors there. Of course, they give her -- the only examinations she`s getting are from doctors on a patient at the hospital.

This is not a criminal examination at this point, unlike if she were at the coroner`s office.

GRACE: OK, everyone, with me, national correspondent, Radaronline.com, Alan Duke. Well, Alan, what we are learning is that

police say she -- Bobbi Kristina -- sustained other injuries. These are not injuries, apparently, from being face down in the water.

Also with me at this hour, Daphne Barak, who has kept in close contact with Bobbi Kristina -- everyone, you`re seeing Whitney Houston with Bobbi

Kristina as a toddler during an interview with "Dateline NBC." We have all watched this little girl grow up, and now hopes and prayers going up as she

remains in a coma, reports that recently, she has fluttered her eyelids. What, if anything, does that mean?

To Daphne, who has kept in very close touch with Bobbi Kristina. Thank you for being with us. Daphne, what do you know about possible

injuries on Bobbi Kristina`s body?

DAPHNE BARAK, IN CONTACT WITH BOBBI KRISTINA (via telephone): I actually kept in close contact with both her and Nick for (INAUDIBLE) the

last 14, 15 months, working on a film, which we had the footage of the wedding of her mother, and she wanted to narrate it.

What I know about the injuries, I know from day one. I was overseas, but I spoke to Nick and his family. I understand it`s not new. It`s maybe

new in the media. Immediately from the beginning, they asked him about injuries in the chest, and he told them that it`s when he was doing the CPR

on her and...

GRACE: I`m sorry, I couldn`t hear you, Daphne. Who asked Nick Gordon about injuries to Bobbi Kristina`s body? Who asked him?

BARAK: I understood from Nick and his family -- and by the way, he`s coming from a very good family -- that they asked him from day one, from

the time that he -- the police arrived and they called 911 -- about some, I don`t know if injuries, but bruises around her chest. And he explain it`s

probably because of the CPR he was doing on her, so that`s nothing...

GRACE: OK, wait. Let me understand something, Ms. Barak. Are you saying she has bruising on her chest and police asked Nick Gordon about it?

BARAK: I understood from him and his family, that it`s -- they asked him from the beginning. And he explained it was -- don`t forget, if you

knew Bobbi Kristina, she was very tiny, you know? So anything -- you know, and he was very frustrated to save her. So it made sense to me when -- I

heard about it first time Sunday morning eight days ago, just a day after it happened. So it wasn`t new to me.

GRACE: You mean the bruises on her body?

BARAK: Not on her body. I heard about some bruises. I heard about it from his family, bruises around her chest, that he was asked by the

police. They -- it made sense to me, and that they ask him not to leave town. And it didn`t make any -- it made sense to me.

GRACE: Were there -- to your understanding, after speaking to Nick Gordon, the fiance of Bobbi Kristina Brown, were there bruises anywhere

other than on her chest?

BARAK: I don`t know. The one thing I know, I had very ongoing contact with them for the last 14, 15 months. And whether you and I like

it and you and I can have many opinions, these two young people -- he was everything for her. She was everything for him. I have so many text

messages from her about that. But they really, really were everything to each other. And it`s up to us to determine -- you know, love can come in

different sizes and shapes.

GRACE: Well, I agree with you opinion, and I don`t think it`s our place to judge her relationship or her love with anyone.

Everyone, you`re seeing Lifetime`s "The Houstons on Their Own."

And we don`t know what was going on in their relationship. But what I am interested in right now is possible bruises on her body. And according

to CNN, there are bruises that investigators, police investigators, are searching for answers about.

Martin Savidge, CNN correspondent joining us, what do you know about the unexplained injuries on Bobbi Kristina`s body? Are police actually

investigating that?

SAVIDGE: They are. I mean, this is part of what is a very large investigation to figure out how she ended up in the bathtub as she did.

But as you`ve just pointed out, any marks on her body like that, anything that might suggest that there was an altercation, any force that had been

used in any way -- or does it point out that there could have been some violence in the relationship between her or whomever? These are all

serious question marks here, and the police would have to take something like that...

GRACE: Well, you know, Marty...

SAVIDGE: ... as a real...

GRACE: ... I want to follow up on what you just said. With me, Martin Savidge, Alan Duke and Daphne Barak, who has been in very close

touch with Bobbi Kristina fiance and Nick Gordon.

You know, isn`t it true, Clark Goldband, that police were called to the same address, but when they got there, nobody was there?

CLARK GOLDBAND, NANCY GRACE PRODUCER (via telephone): Yes, Nancy, and that happened, according to authorities, just a few days before this

drowning incident. Authorities there in Alpharetta, Georgia, responded. They arrived on scene. When they got to the door, Nancy, nobody was home.

And that was the end of that. No charges filed.

GRACE: I don`t know if that equals, you know, a domestic call because by the time they got there, nobody was home. So I find that very unusual,

but I don`t know how to interpret it, Martin and Alan.

Back to Daphne Barak, who has been in very close contact with Bobbi Kristina up until this incident, and Nick Gordon, who she just spoke with

in the last 24 hours. Daphne, what did Nick tell you about Bobbi Kristina`s medical condition? What did he speak to you about yesterday?

BARAK: I`m glad you`re asking because I want to correct it. And by the way, I liked Bobbi -- I like Bobbi Kristina a lot, and she`s much more

intelligent and lovable than people could imagine. And I`m really praying for her, my last conversation with her was just before I went overseas at

the beginning of the year. And I was concerned.

But just -- I`m glad you`re asking because he -- it`s not that he`s not going to visit her, that he dumped her or anything. He has a

restraining order, and he cannot go close. He`s dying to go close. But he`s a person who is allowed to visit and calling him back and forth

because he likes both of them and they know how close they are. And again, you and I can have our own thoughts about this relationship, but they are

very close.

And I understand from information I got really an hour ago that what he saw, that she -- her situation is improving, and I`m just putting all my

prayers that it`s true.

GRACE: Everyone, we are speaking with Daphne Barak, who has spoken with fiance Nick Gordon, who claims that Bobbi Kristina is actually

improving.

Everyone, you are hearing Bobbi Kristina herself on her Twitter account.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Her father issued this statement. "We`re currently investigating the events that led to the hospitalization of Bobbi

Kristina."

UNIDENTIFIED FEMALE: He has said that he has no plans to take her off of life support.

911 OPERATOR: How many people are fighting?

UNIDENTIFIED MALE: (INAUDIBLE) got to be, like, eight or ten people. And they`re in the bar.

UNIDENTIFIED MALE: Right in front of the condo where Bobbi Kristina was reportedly found...

911 OPERATOR: Anybody have any weapons?

UNIDENTIFIED FEMALE: No weapons.

911 OPERATOR: OK, they`re fighting now?

UNIDENTIFIED FEMALE: They used one of the glasses at our bar as a weapon (INAUDIBLE) hit somebody and cut in the face.

(END VIDEO CLIP)

GRACE: At this hour, we are hearing conflicting reports about Bobbi Kristina`s condition. According to Nick Gordon in the last 24 hours --

that`s the fiance -- she seems to be getting better, with some eye fluttering. But according to Martin Savidge, she remains in the same

condition.

We went to the exclusive condo enclave where Bobbi Kristina lives. This is what we see. This is the entrance. Of course, there is security

stop checkpoints. But look at this. When we go out there, we find surveillance cameras that should have caught anyone coming or going from

the scene.

This while we also learn that police have been canvassing the area of all of the stores, even residences, to find out if anyone saw or observed

someone jumping the fence that surrounds this condo community at the time Bobbi Kristina was pulled from the tub. Was there another person in the

condo?

You`re seeing shots right now of Bobbi Kristina growing up with Whitney Houston and Bobby Brown, Bobby Brown at her bedside, 24 hour round-

the-clock vigil by his daughter, claiming, according to sources -- is this true Martin Savidge? -- that he is not going to pull the plug? He believes

there`s going to be a miracle, and says -- this is a quote -- he wants to give her all the time she needs for that miracle to occur.

SAVIDGE: Right. I`ve heard exactly the same thing, Nancy. And I can`t say that I`ve spoken directly with him, but I certainly know that the

family does believe that with enough prayer, with enough vigilance, that she can pull through. At least, that`s what they`re hoping, and of course,

everyone hopes that along with them.

GRACE: And you know, I`m curious. To Dr. Tim Gallagher, forensic pathologist. Can you come out of a coma? I mean, there have been

examples where people did come out of a coma. Is it possible?

DR. TIM GALLAGHER, FORENSIC PATHOLOGIST (via telephone): Yes, Nancy, there are many examples of people coming out of a coma, they do often

suffer residual neurological damage because of the coma. We`ve even had people who came out of the morgue alive. So I`m not surprised that they`re

waiting for her to come out of her coma.

GRACE: Everyone, you just saw grandmother Cissy Houston -- that`s Whitney`s mom -- coming to the hospital, everyone gathering at this hour.

Tonight, we find out TMZ obtains the video of Nick Gordon, the fiance`s, arrest, blaring Whitney Houston`s song. Take a look at the TMZ video, Nick

Gordon during his arrest.

(VIDEO CLIP)

GRACE: OK, what I know about that -- he is not convicted on that. You`re seeing a shot from TMZ of Nick Gordon at his arrest, no conviction

on that.

(BEGIN AUDIO CLIP)

UNIDENTIFIED MALE: (INAUDIBLE) response, possible cardiac arrest, 21- year-old female in the bathtub, face down. PD`s en route. (INAUDIBLE) CPR in progress. We`re getting (INAUDIBLE) third party that`s not on scene,

but supposed to be (INAUDIBLE) (INAUDIBLE) she is gurgling at this time.

(END AUDIO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Whitney Houston`s daughter has injuries that need explaining.

UNIDENTIFIED FEMALE: A source also says that investigators are focusing on her boyfriend.

UNIDENTIFIED MALE: Investigators are trying to determine what happened to Bobbi Kristina inside her Atlanta home.

UNIDENTIFIED MALE: And we`ve also heard reports that police are looking into surveillance video from local businesses.

911 OPERATOR: OK, they`re fighting now?

UNIDENTIFIED MALE: (INAUDIBLE) used one of the glasses at our bar as a weapon where they hit somebody, cut them in the face. Got to be, like, 8

or 10 people.

911 OPERATOR: In the bar?

UNIDENTIFIED MALE: Yes.

(END VIDEO CLIP)

GRACE: Bombshell tonight. We learn police investigating injuries sustained to Bobbi Kristina`s body, demanding answers. And according to a

friend of Bobbi Kristina`s who spoke with the fiance in the last 24 hours, according to Nick Gordon, the fiance, he says she sustained bruising on her

chest because of resuscitation attempts. However, police saying they still want answers as to those injuries on her body. What injuries? What does

it mean?

You`re seeing video from Bravo, the reality show, "Being Bobby Brown."

Also, we learn that the friend in the home, Max Lomas, has hired a whole new fleet of lawyers. He no longer has his former lawyer. It`s my

understanding that Lomas has hired J. Tom Morgan (ph), a former elected district attorney out of DeKalb County, and Petrie (ph), another criminal

defense lawyer, both of them criminal defense attorneys. Why?

Unleash the lawyers, Kirby Clements and David Benowitz, Kirby out of Atlanta, Benowitz out of D.C. Kirby, so the one lawyer, J. Tom Morgan, was

a prosecutor and then an elected district attorney for many, many years in the adjacent country of DeKalb. So why would he lose the other lawyer and

hire a fleet of criminal defense lawyers, Kirby?

KIRBY CLEMENTS, DEFENSE ATTORNEY: Well, two things. First of all, John Petrie and J. Tom Morgan all worked together in the DA`s office, John

Petrie being the chief assistant.

GRACE: Yes, yes, yes. Question -- why? Why?

CLEMENTS: But the reason why is because when you`re being -- when you`re being interrogated by the police and you have someone who could

potentially could die and there could be some criminal ramifications, you want a lawyer who`s skilled with the law, in criminal law, to help guide

you through. You don`t know what the police are doing, what theories they`re coming up with, whether they`re valid or invalid theories that

could still affect you. And you want a lawyer there...

GRACE: OK, Benowitz...

CLEMENTS: ... to protect your rights.

GRACE: ... agree or disagree?

DAVID BENOWITZ, DEFENSE ATTORNEY: I absolutely agree. You have to have a criminal defense lawyer there to protect your rights, whether you`ve

done anything or not.

GRACE: Well, I got to tell you this much. I mean, we just showed you the video of when the fiance, Nick Gordon, was arrested. There has not

been a conviction on that yet. That was obtained by TMZ.

But when the lawyers tell you, Don`t leave town, all right, OK, you better be worried about where the cops are headed on that. Now, that as it

relates to Nick Gordon. Lomas is the one that`s hired the team of defense lawyers.

You`re seeing video from TMZ during Gordon`s arrest on a reckless driving charge.

To Daphne Barak, who`s been in very close contact with Bobbi Kristina and Nick Gordon. Daphne, again, thank you for being with us. I understand

that Nick Gordon says cops told him, Don`t leave team?

BARAK: But that was from day one, you know ? I think -- I came back to America from my overseas filming I guess maybe couple of days before it

happened, and I think Sunday, I talked to them, and his grandmother told me on Monday he was told not to leave town. But they voluntarily told me

about the bruises and explained it was because of the CPR. I didn`t ask because I didn`t know (INAUDIBLE) and it was not reported, as you know.

GRACE: Here`s Bobbi Kristina from her Twitter.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: That`s all.

UNIDENTIFIED MALE: That`s good.

UNIDENTIFIED FEMALE: Yes.

UNIDENTIFIED MALE: Yes.

UNIDENTIFIED FEMALE: That`s all.

UNIDENTIFIED MALE: I love that song.

UNIDENTIFIED FEMALE: Yes. That was -- yes, that was...

(VIDEO CLIP)

GRACE: That`s from Lifetime, "Houstons on Our Own."

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Right in front of the condo where Bobbi Kristina reportedly was found Saturday, I want to show you just how close other

businesses in the area are.

As you can see, literally feet away, there`s this Suntrust Bank, and now authorities have reportedly been asking employees if they saw or heard

anything. What we discovered is that it was open that morning, and something might have been found, and I also want you to see the other

businesses that are in the area, literally right across the street. As you can see, there`s a CVS pharmacy, next to that there is a bar and grill, and

just beyond those, there are a number of other businesses in the shopping complex. The chance that someone saw something or that surveillance video

picked up something are pretty high. What did people see that day?

(END VIDEO CLIP)

(COMMERCIAL BREAK)

UNIDENTIFIED MALE: Sissy Houston, mother to Whitney Houston, grandmother to Bobbi Kristina, leaves Emory University Hospital.

UNIDENTIFIED MALE: They`re having a fight in the bar here. We have a group that is fighting in the bar.

UNIDENTIFIED MALE: Not regaining conscience and remains in a coma.

UNIDENTIFIED MALE: There are still so many unknowns. Was it an accident or something worse?

(END VIDEO CLIP)

GRACE: Welcome back. At this hour, apparently no change in Bobbi Kristina`s condition. Except according to her fiance, he says she has

signs of improvement and has fluttered her eyes, that`s the report we`re hearing. This while we learn injuries to Bobbi Kristina`s body, police

demanding answers, what kind of injuries, why? According to Nick Gordon, the fiance, he says it`s from resuscitation attempts. Why is that

explanation not satisfying police? Or is it?

Also, there is a hope at this hour that she will recover, her father Bobby Brown insisting there will be a miracle. And it has happened before,

Dr. Tim Gallagher, forensic pathologist. Several high profile patients came out of comas. For instance, Martin Lawrence. He slipped into a coma

for three days after suffering a heat stroke. After Martin Lawrence there`s Stevie Wonder. Stevie Wonder survived four days in a coma after

his accident. Ozzy Osbourne, eight days in a coma after an ATV accident. Evel Knievel, 29 days in a coma after a motorcycle crash. Layla Towsey, a

3-year-old girl with meningitis, woke up singing an Abba song. Gary Busy, a 33-day coma after a brain injury and a motorcycle crash. Terry Wallis,

19 years in a coma, wakes up. Jerry Garcia, five days in a diabetic coma. He wakes up. So Dr. Gallagher, it is possible. Is Bobby Brown that wrong?

GALLAGHER: Well, it is possible, but the reasons for those other comas you mentioned, were as a result of a traumatic injury. Remember,

Bobby Brown was submerged under water, deprived of oxygen for quite a while for her to achieve the state she`s in now.

GRACE: I don`t understand it. Yes, there`s a heat stroke, there is meningitis, there is a diabetic coma. Those are not from trauma. How is

it different, Dr. Gallagher? She`s under water for x number of minutes. She was, as a matter of fact, according to police, not breathing, and no

heartbeat when they get there. So what`s the deference between that, a diabetic coma, a meningitis coma, a heat stroke coma? Like Martin

Lawrence?

GALLAGHER: Well, those type of comas, you`re still able to breathe, you`re not -- your lungs have not gone into arrest for the most part. But

her lungs were not functioning, her body was deprived of all oxygen for a long period of time, making her coma and making the extent of her brain

damage greater than those others that you mentioned.

GRACE: You`re seeing video from Bravo`s reality show "Being Bobby Brown." We witnessed on camera and got that video for you from the Lifetime

reality show, I think it was, where -- there you go, Bobbi Kristina in "The Houstons on our Own," where they take the wine away from Bobbi Kristina.

Here you -- she looks like she`s what, 13, 15 years old? She looks like a little girl in this picture. Now, watch carefully. See that bottle of

wine right there? Oh, no you don`t. And look, I mean, she can barely keep her eyes open.

Wendy Walsh joining me. Psychologist, host of Investigation Discovery`s "Happily Never After." Wendy, thanks for being with us. Do

you believe that there is a genetic preponderance toward addiction if both of your parents had alcohol or drug addictions?

WALSH: Absolutely, it`s very well established that addiction can run in families. It`s a certain -- you know, it`s an illness and it is treated

as an illness, and you can inherit the brain chemistry.

GRACE: And to Dr. Tim Gallagher, what exactly is the ventilator doing right now? If we take Bobbi Kristina off the ventilator, would she keep

breathing or remain in a coma or would she just stop breathing?

GALLAGHER: The ventilator now is actually forcing air in her body, and extracting the carbon dioxide. It`s difficult to tell if she will

continue breathing if the ventilator was removed. The only way to verify that is to turn down the ventilator and see if she`s able to breathe on her

own.

GRACE: Alan Duke, writer, Radaronline.com, have we established, was she dressed or naked when she was pulled out of that tub?

DUKE: I don`t know. She was found in the tub by Max Lomas. I`m sure he`s already talked to police about that.

GRACE: Can I ask you something, where was Nick Gordon? Why did the friend find her and not her fiance?

DUKE: A source close to Lomas tells me that Nick was looking for, Nick was answering the door for the cable guy who was down there, and so

that Max was sent upstairs to look for her, and that`s when he found her.

The other question is, was the bathroom door locked? The thing about all of this, is, Nancy, is that Max is no longer talking to cops. I

understand that tomorrow, he and his lawyers, either tomorrow or Wednesday, will be talking with Fulton County prosecutors about the case.

GRACE: You understand that who was talking to county prosecutors?

DUKE: That J. Tom Morgan (ph) and John Petri (ph) are going down to Fulton County prosecutors either tomorrow or Wednesday with their client to

talk to the prosecutors.

GRACE: Unleash the lawyers. Kirby Clements, David Benowitz. All right. So the lawyers are taking him down to talk to the prosecution. To

talk to the lawyers. What does that mean to you, Kirby Clements?

CLEMENTS: Well, it means one of two things. Either nothing happened and they want to go ahead and have their client get clear and talk to the

prosecutors.

GRACE: Why are there even prosecutors? If this is just an accident and she slipped under the water, then why are we hiring defense lawyers and

going to talk to prosecutors? There`s something missing in this puzzle.

CLEMENTS: The police can`t make any deals, they can`t do anything. They`re investigators. The prosecutors are the ones that can bind the

state. So either you bring them down there to talk to the prosecutor, to say, hey look, my guy did nothing, or hey, my guy knows something, because

something did happen.

GRACE: This is what I`m saying, Benowitz. Why would you even be down there talking to prosecutors if this were just an accident? I don`t know

what happened, I just want the truth.

BENOWITZ: Right, but the investigators don`t know what happened, the prosecutors don`t know what happened. This guy may have some information.

If he has some information, and upon the advice of his counsel, they think it`s to his benefit to go down there and speak to prosecutors, that`s what

they`re going to do.

GRACE: Tonight the family begs for your prayers. #stillprayforbk. Here`s Bobbi Kristina from Twitter.

(MUSIC)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Bruce Jenner`s car, when it struck the Lexus, the Lexus went into oncoming traffic, which struck the southbound H2 Hummer,

and the driver of the white Lexus was pronounced dead at the scene.

UNIDENTIFIED MALE: One person is dead and seven are hospitalized after a multicar collision in Malibu. Police say Olympic athlete and TV

star Bruce Jenner was driving the third car, the Cadillac Escalade SUV. Investigators told affiliate KCAL, the driver of a Toyota Prius stopped

suddenly, then a white Lexus slammed on the brakes. Jenner`s vehicle hit the Lexus.

(END VIDEO CLIP)

GRACE: Live Malibu, Olympic decathlon icon, reality TV star from "Keeping up with the Kardashians," Bruce Jenner in a fatal freeway crash at

this hour. Police obtaining a search warrant for Jenner`s cell phone. Was he texting? I don`t think he was, and I`ll tell you why. But first,

Alexis Tereszcuk, RadarOnline.com, what happened?

TERESZCUK: Bruce Jenner was driving down Pacific Coast Highway in Malibu, and a car two cars ahead of him stopped short. So then the car in

front of him stopped short. He swerved, he hit them, but he swerved to the right to really manage crashing into the car. But this shot the car to the

left, it swung into the other lane, and a Hummer H2, a huge SUV, plowed into it, and the driver of that car was killed.

GRACE: Natalie Trombetta, joining us from dailymail.com, Natalie, I keep hearing it`s a fatal crash, someone died in this crash, and that

Jenner, Bruce Jenner, the Olympic athlete of "Keeping up with the Kardashians," had slammed into somebody`s car. Now, did somebody slam into

him or was he the one that slammed into the cars?

TROMBETTA: His car was the last vehicle to enter the crash. It was a change reaction accident.

GRACE: OK. I got it. So he set off the chain events, nobody slammed into him and caused him to slam into the car in front of him. You`re

seeing "Keeping up with the Kardashians," but I always think of Bruce Jenner as the Olympic icon, the athlete who won the decathlon.

To David Lynch, everybody, my husband, and here`s just an interesting nugget. David, here is a reason I don`t think Jenner was texting. OK, my

husband, no offense, but he`s not a good golfer, because he works all day. So when I was out on "Dancing with the Stars," Jenner -- who is -- Rob

Kardashian was on "Dancing with the Stars" with me. Jenner takes David golfing. David, the whole time you were with him, all the hours you two on

this one day are on the golf course, you have lunch, what was he like?

DAVID LYNCH, SPENT DAY WITH BRUCE JENNER: He was the perfect gentleman. We spent about seven hours together. He barely used his cell

phone. He was a very friendly, cordial, nice individual.

GRACE: You see, what I`m talking about, David, is that we have all encountered people that cannot function without texting, being on the

phone, taking selfies. His whole family does it constantly, specifically Kim Kardashian. But this whole time, I`m talking, seven, eight, nine

hours, during lunch, during golf, when he is just standing there doing nothing, essentially, he is not texting and acting on the phone, is that

correct, David?

LYNCH: That is correct. In addition, Nancy, he`s a licensed pilot of two-engine planes and I believe helicopters, too. Those are very careful

people.

GRACE: That`s indicative of something else. I`m not taking sides here. I`m just saying that people with that habit, either you have got the

habit or you don`t.

To Corporal Duane Parker, former traffic homicide investigator, at DeKalb County sheriff`s office. Corporal, this guy, Bruce Jenner, it`s

being thrown around, caused a fatal car crash. Was he texting. Now, reports are police got a search warrant for his phone. But Jenner said he

hands the phone over voluntarily to show he was not texting. What difference does it make, Corporal?

PARKER: Well, as far as handing the phone over, that just shows that his eagerness to comply with the investigation. And on his behalf, I feel

he believes he had done nothing wrong. And looking at the photographs of the crash scene, it`s very evident to me that Bruce Jenner was not

distracted and that he tried to make an evasive reaction in trying to avoid the car in front of him, which tells me that he has to have time to see

what`s happening, take that evasive course, and then actually hit the car. So by doing that, he saw what was coming, took the evasive action. He

couldn`t have been distracted if he took that action. Being distracted, he would have hit the car dead on in the back. And he didn`t. He swerved to

avoid it.

GRACE: You know, Corporal, I typically take the side of a victim in practically every circumstance. But I don`t want to railroad an innocent

person. And just from what I know of this guy and what you are saying that he had time to see what was happening and take an evasive move, I believe

him. Take a look. Here is Bruce Jenner the way many of us remember him.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Really piling up the points. He sprints through the hurdles for 8.66. He hurls the javelin for 8.62. He has done it.

Bruce Jenner set a new world decathlon record.

JENNER: A spent a good part of my life getting ready for that. I worked out a lot. I ate a lot of Wheaties. Because a complete breakfast

with Wheaties is good tasting and good for you.

UNIDENTIFIED MALE: Take it from Bruce Jenner, Wheaties is the breakfast of champions.

(END VIDEO CLIP)

GRACE: (inaudible) Jenner`s Wheaties commercials. And yes, he has been in the news a lot lately. But I still believe him. I do not think he

was texting.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: There were four cars involved in this traffic accident.

UNIDENTIFIED MALE: The co-star on the reality series "Keeping up with the Kardashians."

UNIDENTIFIED FEMALE: Bruce Jenner involved in the crash. Investigators say after the black Prius stopped or slowed down, Jenner was

the third car in the crash and pushed Howie`s (ph) white Lexus into another lane where she was hit by a Hummer.

(END VIDEO CLIP)

GRACE: That crash was fatal. Tonight, Jenner denying he was texting. And I believe him. With me, Natalie Trombetta, dailymail.com and Alexis

Tereszcuk, radaronline.com. Alexis, what more can you tell us?

TERESZCUK: What I can tell you is that this has been a very troubling time for Bruce Jenner. He is actually going through a sex change now, and

he`s actually --

(CROSSTALK)

GRACE: Wait a minute. Alexis Tereszcuk, I`m really disturbed that you would somehow make a connection between Bruce Jenner`s alleged sex

change and this crash. That has nothing to do with this, unless somehow you are making some kind of a medical connection, which I highly doubt,

Alexis.

TERESZCUK: Not a medical connection. But in fact, he actually told the -- when he went -- he volunteered to take a blood test to prove that he

was not on drugs or alcohol at the time of the accident.

GRACE: If you are suggesting that this was a hot flash or something like that, I think you are totally out of line, Alexis Tereszcuk. I knew

you were going to bring this up. I was ready for you. That has nothing to do with this at all. And as far as I`m concerned, he was not texting until

those phone records show me differently, Alexis Tereszcuk.
