[20:00:01] NANCY GRACE, HLN HOST: Breaking news tonight. She needs to go- - bone-chilling words from a little school girl she texted her 20-year-old boyfriend in the Army, Mommy`s body found covered in stab wounds to the

head, the neck, the torso, her mother dumped in a shallow grave, blood evidence leading back to Mommy`s car. Other reported texts from the little

girl in 8th grade to her adult tattooed boyfriend, quote, ``She`s lying to you about my age`` and, ``Just do it. Kill her.``

Tonight, stunning new evidence.

UNIDENTIFIED FEMALE: ``She needs to go, Caleb, right now.``

UNIDENTIFIED FEMALE: Mother stabbed to death in the driveway of her home.

UNIDENTIFIED FEMALE: ``I want her gone.``

UNIDENTIFIED FEMALE: ``Do whatever necessary.``

UNIDENTIFIED MALE: Blood smeared down the inside of the passenger window.

UNIDENTIFIED FEMALE: Dumped the body and buried it, then left the SUV--

UNIDENTIFIED MALE: Blood spotted across the dash. It was horrifying.

UNIDENTIFIED FEMALE: ``I want her to shut her face.``

GRACE: Did a 24-year-old woman fabricate a story of her own kidnap, even including a detailed composite sketch of the kidnapper, a strange man, as

she describes him, who holds her hostage for two full weeks in a woodshed, her description including that her kidnapper is white, six feet tall, brown

eyes, gray hair, full beard, weighing in at 250 pounds, police even using this sketch to track down nearly 400 leads. But tonight, did she make the

whole thing up?

UNIDENTIFIED FEMALE: Until the day I die, I believe Rachel`s (ph) story.

UNIDENTIFIED MALE: The story she gave us did not occur.

UNIDENTIFIED FEMALE: But still, Rachel claims she was locked in a shed and repeatedly assaulted by this man, who police say does not exist.

GRACE: Tonight, we go live in the desperate search for a 12-year-old little school girl missing out of San Antonio.

Good evening. I`m Nancy Grace. I want to thank you for being with us.

Bombshell tonight. She needs to go-- bone-chilling words from a 14-year- old girl that she texts to her 20-year-old boyfriend in the Army, mommy`s body, her mother, found covered in stab wounds. The mother is stabbed in

the head, the neck, the torso, her body dumped in a shallow grave. Well, blood evidence leads back to the mom`s own car.

Reported texts from the little 8th grade girl to her adult tattooed boyfriend, quote, ``My mom is lying about my age`` and, ``Just do it. Kill

her.``

Tonight, stunning new evidence emerging as the teen killer, the girl killer, is fighting tooth and nail to have her case returned to juvenile

court, where she will walk in just a matter of a few years, this as her tattooed lover, then 20 years old, is facing trial. Trial is kicking off.

I want to go straight out to Chris Spargo joining me, reporter with Dailymail.com. Chris Spargo, what is so disturbing about this is the mom,

the victim in this case, was trying break up the relationship between her little girl and a grown man, a tattooed man in the Army, for Pete`s sake.

And the daughter whined and carried on until, finally one night, the mom agrees, OK, you can go to this concert, but I`m going to drive the two of

you. You are not getting in the car with a 20-year-old man.

She takes her little girl and this man to the concert. She waits outside. Then they want to go out to dinner after at some all-night diner. She sits

in the car in the parking lot while her daughter has dinner.

Then the next thing you know, the neighbors report hearing the mother`s car, Beep, beep, beep, for about 20, 30 minutes. They didn`t realize that

the mother was trying to signal everyone she was being hacked to death by her own daughter and her boyfriend.

Those are the allegations. Are they true? We`ll find out in court. But Chris, I want to hear all the facts from the beginning. What happened?

CHRIS SPARGO, DAILYMAIL.COM: So this couple started dating. They actually met when she was only 13. He`s a 20-year-old, as you mentioned, in the

Army in Maryland. So the day of this incident, the mother says to him she`s found out his age. She`s proven how old her daughter is (INAUDIBLE)

she`s 14. She says this relationship cannot go on. She tells her daughter she can`t go to the concert. Her daughter, as you said, pleads with her

her for hours, Please, please, please.

[20:00:05]The mother finally says, All right, I will drive you both. I am going to stay at the concert outside waiting for you the entire time. I am

going on drive you back. And the second we get back, this relationship is over and this boy returns to Maryland.

Now, after all of this, she waits at the concert. She takes them to the diner. And at that final moment--

GRACE: Oh, wait, wait, wait, wait, wait!

SPARGO: --in their driveway--

GRACE: Chris Spargo, what you just did not see is the boyfriend coming into court, smiling and laughing. Now you`re seeing the girlfriend, the

little girl, and there is the boyfriend, what, over this? I mean, she killed her mother to be with him?

And Chris Spargo, isn`t it true that according to reports, that after she kills the mother with her boyfriend-- this is a 14-year-old little girl--

she takes the boyfriend back to the home, where the father has come home and gone to sleep, and they have sex in the upstairs bedroom. This is

after she murders her mother?

SPARGO: That`s correct. They were found naked in bed by investigators and police when they went to the house.

GRACE: OK. I interrupted you. Start at the concert. What was the concert? What was it?

SPARGO: They went to a concert about an hour away for a local band that was playing, and it was at a hotel. The mother waited in the lobby of that

hotel, really did not let them be alone at all other than inside that concert.

They get out of the concert. The mother gets back in the car with the two of them. She drives them to a diner to have dinner, and that`s when we

find out from video surveillance at the diner that during this meal, the boyfriend can actually be seen pointing to his neck and making what seemed

like stab moves, and the mother was stabbed in the neck less than an hour after this meal.

GRACE: Well, wait. Where did that come from, Chris? Was that in the surveillance video at the all-night diner? The two of them are sitting

there eating a late night dinner, and you can see the boyfriend making motions to his own neck as the two are sitting there, like, pointing out to

the girl where he`s going to stab the mom. And apparently, the boyfriend is in the back seat. The mom is driving, and she is attacked from behind.

What did the girl do, just sit there in the passenger seat and watch?

SPARGO: That`s what she claims at first. Of course, the further investigation shows that she also has markings on her hands. And then

after this killing, the two of them both to go Walmart, buy cleaning supplies together, again as seen on surveillance camera, acting perfectly

normal as they buy this stuff for the car.

GRACE: Well, I`ll tell what you may be the nail in the coffin, and the defense is fighting like mad to suppress this. Listen to these text

messages sent between this 14-year-old little school girl and her grown boyfriend.

UNIDENTIFIED FEMALE: ``Caleb, if she asks about your age, say 16-and-a- half again, and that the reason you said 20 is you are used to lying about it about to fellow soldiers in the Army to avoid harassment. So when

you`re (INAUDIBLE) it just comes out. She needs to go, Caleb, right now. You don`t understand. She threatened to throw me out of the house. I want

her gone. I just need you to be able to come over so we can do whatever necessary, honestly.``

``I`m going to go to the bathroom while you do it, OK? I`ll come right out as soon as you`re done. Why don`t we wait until we get in the car with

her?``

UNIDENTIFIED MALE: ``Fine.``

UNIDENTIFIED FEMALE: ``That would be easier for you, I would guess. Caleb-- Caleb, leave the age thing alone. Just do it. Caleb? Caleb?

Seriously, what are you doing? Caleb, I`m serious. She`s lying. Please do it. I`m going to throw up. I can`t stand her lying to you like this.

Caleb, respond to me.``

UNIDENTIFIED MALE: ``We`ll talk later.``

UNIDENTIFIED FEMALE: What the actual-- she`s lying about my age. Just do it. Caleb, I`m about to cry. What is going on? Please don`t leave.``

UNIDENTIFIED MALE: ``She`s out here with me.``

UNIDENTIFIED FEMALE: ``Do something, please. Caleb, I`m trusting you.``

UNIDENTIFIED MALE: ``There`s no way she could fake a passport.``

UNIDENTIFIED FEMALE: ``Caleb!``

UNIDENTIFIED MALE: ``Baby, I love you.``

UNIDENTIFIED FEMALE: ``Where are you? Come in the basement. I need to talk to you.``

GRACE: Did you hear what-- she texts to her older boyfriend, I just want her gone so you can come over whenever and we can do whatever needs to be

done-- translation, have sex. Honestly, this is a 14-- just turned 14- year-old little girl.

Now, let me understand something. To you, Michael Christian. When the little girl is texting the boyfriend, the adult boyfriend, they`re both in

the home. And it is at that moment the mother is showing the boyfriend the girl`s passport to say she just turned 14.

MICHAEL CHRISTIAN, NANCY GRACE PRODUCER (via telephone): That`s right, Nancy. There is some evidence to suggest that when they first met, he

actually thought that she was 17, that she had told him that she was 17. So when the mother is telling him that, No, she`s 14, look, here`s her

passport, this girl is very vehemently denying that. She`s insisting to Caleb that the mother is lying and she`s really 17.

GRACE: Now, we also have learned that the boyfriend, the adult tattooed boyfriend in the Army, goes on line just before the mother is murdered and

orders a fake birth certificate. And in that fake birth certificate, he`s planning to use it to convince the mother, his girlfriend`s mother, he`s

actually younger than he is. Well, it all ends in murder.

[20:10:22]To Dr. Michelle DuPre, forensic pathologist joining us tonight out of Columbia. Dr. Dupre, have you seen the number of stab wounds on the

mother, as the girl is sitting in the car with her mother, stabbing her dead along with her boyfriend? Could you describe what we know?

DR. MICHELLE DUPRE, FORENSIC PATHOLOGIST: Nancy, this is horrendous. This is absolutely unbelievable. The stab wounds indicate violent rage. I have

very rarely seen anything quite this bad.

GRACE: Look, it`s ruled a homicide, multiplule stab wounds to the neck, sharp force injuries to head, neck, torso, extremities, which are probably

defensive wounds on her arms and her hand, maybe even her neck, her knees and legs as she balls up trying to protect herself, contusions and

abrasions, which are scrapes and bruises.

Unleash the lawyers. Out of Atlanta, defense attorney Mindy Smith. Out of Maryland, veteran trial lawyer Robin Ficker.

OK, Robin Ficker, what`s your best defense? Because in my mind, they`re caught red-handed because of these texts.

ROBIN FICKER, DEFENSE ATTORNEY: There`s the Stockholm syndrome. Patty Hearst, Fay Wray and King Kong. She`s under his complete psychological

control. He is a trained killer. Stockholm defense.

GRACE: OK, let me ask you how this Stockholm defense-- which very rarely works, OK? It was used in the Patty Hearst defense when she robbed a bank

with a machine gun and blamed the Symbionese Liberation Army. Remember that caught on video? That didn`t work.

Stockholm defense, Stockholm syndrome defense is when your captors have brainwashed you. But did you just hear those texts, where the boyfriend is

saying, Look, your mom couldn`t fake a passport. You lied to me about your age. It`s the girl who is the puppeteer and the man is the puppet, based

on those texts, Robin Ficker.

FICKER: He entrapped her when she was just 13. She`s only 14. She is not psychologically developed. She`s immature. He`s the mature one. He`s

trained to kill. He wanted to get what he had to get, which was her, and the mother stood in the way. She was psychologically under his control,

and therefore adversely against the mother.

GRACE: Well, maybe she can mature, Robin Ficker, behind bars.

UNIDENTIFIED FEMALE: ``We can do this.``

UNIDENTIFIED FEMALE: Police say Jamie Silvonek helped her boyfriend murder her mother.

UNIDENTIFIED FEMALE: ``Please do it. I`m going to throw up.``

UNIDENTIFIED FEMALE: Police say Barnes stabbed the girl`s mother.

UNIDENTIFIED FEMALE: ``I`m trusting you.``

UNIDENTIFIED FEMALE: The mother was found dead in a shallow grave.

GRACE: Bottom line, her much older boyfriend, who is an adult to her-- he`s meeting her when she`s just 13 years old, and the result of that union

is that her mother was stabbed to death brutally.

Can you imagine what Ms. Silvonek went through? She takes her daughter and her boyfriend to a concert, then sits in the parking lot while they have

dinner inside at an all-night diner. And the boyfriend can be seen gesturing to his neck during dinner on the surveillance at that diner.

They get home, when the mom is attacked from behind by the boyfriend, says the state. She is covered in lethal wounds to her neck, her face, her

head. She bleeds out, her body dumped in a shallow grave. The lovebirds then to go Walmart for cleaning supplies and then go back home to Mommy and

Daddy`s home to have sex after the murder of her mother.

Now, what we think is going to happen, Chris Spargo, reporter with Dailymail.com-- again, thank you for being with us, Chris-- is that the

girl is going to testify against the boyfriend. Do you believe that`s going to happen, Chris Spargo?

SPARGO: That is going to happen. She took a plea deal in her case. And a part of that plea is that she is going to have to cooperate, and then most

likely testify against her boyfriend.

GRACE: But the reality of that is-- to Ficker and Smith, Mindy Smith-- she wants out of that. She wants out of her plea deal, and she wants the case

transferred back to juvenile court. That`s not going to happen, Mindy.

MINDY SMITH, DEFENSE ATTORNEY: Yes, it is. And this plea deal, this conviction, is going to be overturned so fast it`s going to make your head

spin.

GRACE: Really? Why?

SMITH: The judge failed to consider a 20-year-old having sex with a 13 and 14-year-old, failed to consider that.

GRACE: I`m pretty sure the judge knew the scenario. In fact, at the plea, the state laid out all the facts, and the girl had to agree as to what her

testimony is going to be. So the judge was very well aware of the facts and the connniving the school girl joined in on to kill her own mother.

Can you give me, Mindy, any argument based in reality, in the facts or in the law, as to why her plea deal, where she puts her hand on the bible and

swears, I`m telling the truth, I plead guilty and this is why-- why should that be reversed and sent back to juvenile court?

(CROSSTALK)

SMITH: Here`s why.

GRACE: OK, you already said that, but go ahead.

SMITH: In the pre-trial conference-- in the pre-trial conference, the judge already says that she`s mature enough to-- mature enough to know what

she was doing, et cetera, et cetera. This was in the pre-trial conference. This was before the plea trial was even on the books.

(CROSSTALK)

[20:20:06]GRACE: Mindy, did you know that there had been psychological evaluations of her--

SMITH: Yes.

GRACE: --that the judge was privy to and had read? That`s why he`s making this decision. You know what? Let`s talk about the law.

(CROSSTALK)

GRACE: Let`s just--

SMITH: It was before the hearing.

GRACE: OK, I think you`re trying to articulate is that, what, you want a full-blown trial for a guilty plea? She`s the one who wanted to plead

guilty. Nobody made her.

SMITH: (INAUDIBLE) the pre-trial conference before the plea was on the record, before the evidence came out. The judge did not have all of the

evidence.

GRACE: Can I ask you a question, Mindy? Have you ever tried any juvenile cases?

SMITH: Absolutely. Yes, I have. And I can tell you--

(CROSSTALK)

GRACE: Then you are familiar, are you not, with the designated felonies, right?

SMITH: Yes, i am.

GRACE: (INAUDIBLE) these designated felonies, which are, if I can remember them off the top of my head, murder, aggravated assault, armed robbery,

rape, sodomy, arson and-- oh, what could it be? Kidnapping!

(CROSSTALK)

GRACE: --seven deadlies--

(CROSSTALK)

SMITH: --to be tried as an adult. The court can conider, but the court has to consider the totality of the circumstances. And the judge--

(CROSSTALK)

GRACE: Isn`t it true, Robin Ficker, that the judge that bound this over to adult court was not this judge? It was a juvenile court judge and then it

landed with this judge. Now, can I steer the bus back into the middle of the road just for a moment?

FICKER: I think she had in-conference counsel.

GRACE: You know the law-- oh, OK. So that`s your argument.

(CROSSTALK)

[20:40:00] FICKER: ... abuse. Drugs missing at her...

(CROSSTALK)

FICKER: There were drugs missing at her place of work. She may have gone there, taken these drugs, and that was the reason why she was incapacitated

and unable to report where she was.

(CROSSTALK)

GRACE: That was the first time I`ve ever heard one crime being used as a defense to another crime. What do you know about the prescription drugs,

Michael Christian?

MICHAEL CHRISTIAN, NANCY GRACE PRODUCER: Nancy, we know that there has been an investigation into some prescription drugs missing. The investigation is

ongoing. She has not been charged with anything at this point.

However, police say that the day before she went missing, she knew she was going to be questioned by police about it.

GRACE: We are talking about a young woman who gives a detailed account of how she was kidnapped at her family`s vacation spot, a cabin in a rustic

area. The police found her vehicle. It had been still running with her cell phone, her purse, her keys, and obviously no sight nor sound of her. No

trace of her at all.

She is finally returned by her kidnapper to within a few blocks of her mother`s home. Now, that`s curb service for a violent kidnapper. She said

she was held and tied up in a wood shed for over two weeks and assaulted repeatedly during that time.

Tonight, police are saying she faked the whole thing. Her mother insists she is telling the truth. Now, here is my question. Michael Christian, how

did country superstar Shania Twain get dragged into this?

CHRISTIAN: Friends say that Rachael Mattice`s favorite music star is Shania Twain. So, when she was originally missing, they contacted Shania Twain to

see if she could help.

And she actually sent out a tweet saying quote, I`ve heard the story of Rachael Mattice and urged anyone with information to come forward to the

police and help her return to her family. So, here`s a big star trying to help a fan.

GRACE: Now, we really get mad because Shania Twain was duped, according to the police.

Okay, Paul Vandenburgh, why don`t police believe her? How did they know this is all a big fake? And how will they ever going to get this money back

that they spent on searching for her?

PAUL VANDENBURGH, SHOW HOST, TALK 1300 RADIO: Well, they`re not gonna get the money back. You know, we`ve got around these games enough. You know,

it`s -- it`s like the convictions, the two murderers breaking out in Northern New York. We`ll never get that back either.

But the case -- you made a great point earlier here. When -- when you pointed out that she was dropped off a couple blocks from the house. Who

does that? You know, I`ll tell you another thing...

GRACE: Nobody! Nobody does it.

VANDENBURGH: That`s kind of bizarre, too. If you look at some of the websites back here, there was a picture of her that first was posted, where

a young girl, a big smile on her face, very cute picture. Everybody felt sorry for her back here.

Then they put the mugshot of -- of her, with the mug shot with this scowl face, angry young woman, and people are writing on the websites of the

local newspaper back here that they felt better about looking for her when they saw the first picture than they did with the mugshot. I mean, I it has

turned into a bit of a circus back here.

[20:50:00] GRACE: So Lillian Glass, psychologist and -- oh, ouch. Okay. I think Rachael in a mugshot you`re talking about. Dr. Lillian Glass,

question, did you hear our discussion earlier about how she was going to be questioned the next day about stealing prescription drugs? And instead of

being questioned about that, she suddenly vanishes.

LILLIAN GLASS, PSYCHOLOGIST: Yes. And that could play a big part of that. There could be some drug involvement. There`s definitely some mental

breakdown there, especially the fact that her mother is so vehement and saying, you know, this did not happen, you know this did happen, I believe

my daughter.

So, it`s kind of out of character for her daughter. So, the daughter may have been involved...

GRACE: You know, Lillian, I really disagree with you, but I don`t think she had a mental breakdown. I -- I believe she thought she was getting in

trouble with the law and she went on the run. When she got ready to come home, her kidnapper dropped her off on the doorstep. C.O.D.

[20:55:00] GRACE: Tonight we go live in the desperate search for a 12-year- old school girl missing out of San Antonio.

UNIDENTIFIED MALE: A beautiful young school girl goes outside to listen to some music and is never seen again. 12-year-old Wilma Dame lives with her

grandfather in San Antonio, Texas.

She went to sit by his truck and listen to music. When her grandfather went to check on her, she was gone. Vanished without a trace.

GRACE: Joining me right now is the little girl, Wilma Dame`s grandfather. Thank you for being with us, sir. I appreciate it so much. When was the

last time you saw Wilma?

ANTHONY CINTRON, GRANDFATHER OF WILMA DANE: That was on June 20th, around 3:30.

GRACE: And where was she, Mr. Cintron?

CINTRON: She was in the driveway under the carport cover where I have my truck parked.

GRACE: So, she goes outside. I believe she wanted to listen to some music. Is that right?

CINTRON: She loves to listen to music. She went out there to listen. So she could put her music as loud as she can.

GRACE: Joining me in addition to Wilma`s grandfather, everybody, you see this 12-year-old little girl missing out of San Antonio, and tonight we

want to bring her home.

With us is the chief communications officer. Joining us out of San Antonio, Texas, with police, with the Sheriff`s Department, James Keith. Sir, thank

you for being with us. What can you tell me about the search for Wilma?

JAMES KEITH, CHIEF COMMUNICATIONS OFFICER, BEXAR CO., SHERIFF`S OFFICE: First off, thank you for highlighting this case for us. We`re going on a

month now where this little girl has not been seen.

We`re investigating a report that she may have contacted a relative over the weekend, but that`s something we`ve been unable to confirm. There is no

evidence of her whereabouts right now and that`s something that we`re concerned about.

GRACE: James Keith, what can you tell me about a mystery text that was sent to the grandfather? Apparently from the little girl saying that she has

been beaten and wants to come home.

KEITH: We are still investigating that text and -- and where it originated from. The family tells us that they`re not certain where this may have come

from. The problem that we have...

(CROSSTALK)

GRACE: Wouldn`t it be a matter of getting the cell phone and looking up the number?

KEITH: Oh, absolutely. The problem that we have is this may be a situation where this child does not want to be found. She has run away in the past.

We have to determine. Is this a case where...

GRACE: Hold on just a moment though. Let me address that. Dave Mack, joining me, Syndicated Talk Show host. Let`s follow up on what James Keith

is saying.

Regardless of how she first went missing, she is still missing. She is a 12-year-old. What is that? Fifth grade? What is that, Dave Mack?

DAVE MACK, SYNDICATED TALK SHOW HOST: Actually, she is in seventh grade. She is an A-B student. She`s sweet. Here`s the deal, he`s right. She is 12

years old. She went missing in a 20-minute segment of time. And the text, pictures, they all say she wants to come home. So, we got to hold on to

that. A 12-year-old girl is missing. She wants and needs to be home.
