[18:00:00] ASHLEY BANFIELD, HOST, CNN: It is 6 o`clock Eastern. These are your headlines.

Rumors are swirling about Omarosa Manigault-Newman, the former "Apprentice" star turned White House staffer who left her position yesterday. Well, the

Daily Beast is reporting that she tried to access the Trump White House resident when she learned that she was being fired. While others say

Omarosa simply resigned.

For her part, Omarosa denied all of the reports of a dramatic exit. Insisting on Good Morning America Today that the real story is yet to come

to light but that it will in due time.

Kentucky State Representative Dan Johnson was found dead of a probable suicide last night. Just a day after he denied allegations that he kissed

and fondled a 17-year-old girl back in 2013.

According to local reports, he shot himself in his car after posting a message on social media saying, quote, "Only God knows the truth."

Today marks five years since a deeply troubled young man in Newton, Connecticut walked into Sandy Hook Elementary School and massacred 26

people gunning down 20 children and six adults. At the time it was the second deadliest mass shooting in modern U.S. history. Now, five years

later, it is the fourth.

Today, the FCC voted three to two to repeal the net neutrality rules that regulate internet providers. And what does that mean to you? A lot. It

means your internet provider is going to have the right now to slow down your service, or maybe even block certain web sites from you if those sites

don`t jive necessarily with their business model among other things.

And thanks to bullet proof vests, two police officers in the St. Louis area recovering from just bruises today after a suspect turned his gun on them

and fire right into their chest.

Christopher (Ph) barricading himself in his home this morning. And guess what? The police are still trying to get him to surrender.

But we`re going to begin tonight in depth in Seattle, Washington with a dramatic armed robbery. It could have gone two ways. But the bad guy

getting away before cops ever got beat on him or the bad guy hitting the ground retiled with bullets because he thought he was one step ahead of the

cops and figure he didn`t have to listen to a word that they said.

This story is going to start right after an armed robbery at a Forever 21 store at a local mall. The suspect 24-year-old Kyle Gray and his female pal

decided after the 21 store to make their way to a nearby apartment complex and that`s where the video starts rolling.

Fight over a parking spot got heated when police stay. A worker in that building took them to task for the parking and the f bombs started to fly

along with the m-bombs. The m-bombs and the f-bombs. F-bombs galore too much beeping even to let you know how it really sounded.

But it was not long before that robber pulled a gun out and started to fire, fire around right into the ground before making a getaway. The police

arrested the woman on a nearby road, but the chase was on for the armed robber.

The cameras also rolling in the cruiser, and this was chase that would wind through quiet residential streets in North Seattle and it wouldn`t be the

last time that Kyle Gray would squeeze off a few rounds.

BANFIELD: Gray led them to a popular park nearby. The kind of place people go during the day to swim in the lake and play sports, but this night, this

is where he would take his last breath.

UNIDENTIFIED MALE: There he is.

UNIDENTIFIED MALE: I got him. I got him.

UNIDENTIFIED MALE: Got him.

UNIDENTIFIED MALE: Let me see your hands.

BANFIELD: And that is reality TV. That is what happens when you don`t follow the commands of the officers who are chasing you. That is what

happens when you fire at other people and then you reach for your waistband.

With me is Steve Miletich, he`s a criminal justice reporter for the Seattle Times. What more do we know about this whole series of very violent events,

Steve?

STEVE MILETICH, CRIMINAL JUSTICE REPORTER, THE SEATTLE TIMES: Well, we know that the person who was shot by the police was wanted on an arrest warrant

issued into and for failure to report to his duty supervision officer with the State Department of Corrections.

[18:05:08] He had failed to report and the warrant was issued. He had been released from prison in December of 2014 after serving time for bail

jumping and possession of a controlled substance. He had begun his prison sentence in May of 2014.

BANFIELD: So the video that we`re looking at right now, Steve, is from Seattle Police Department and it obscured the faces of the players

involved.

My feeling now though, is that that may change, I believe at this point since the suspect himself is dead and the female companion was been picked

up, there may be further charges for her. You`ll have to get me straight on this because it is still kind of breaking as we speak and we may know who

she is, and she might be able to shed more light on this whole series of events.

MILETICH: I would expect more information to come out on her case. Her name hasn`t been release. She is still in the court system. She has not been

formally charged at this point. But I would expect there would be some additional information on her.

As far as the identity of the -- of Mr. Gray and any photograph of him, the State Department of Corrections has released a photograph of him that was

taken when he was in the prison system.

BANFIELD: Let me ask you this, if I can, at the Forever 21 store before all of this ugliness began to play out on video, we don`t have video of that

yet. There may very well be surveillance video in that local mall of what happened in the Forever 21 store, but it was the first moment where a gun

ever entered into this narrative.

Help me understand what happened that set off this whole chain of events that ultimately lead to his death.

MILETICH: Yes, you`re correct. The report of an armed robbery at the Forever 21 turned this into a high priority police call whenever there is a

weapon involved. We don`t know all of the details of whether that happened in the store yet. There`s been some versions. The man`s mother says it

began with shoplifting that evolved into a gun being displayed and that her son and this woman left the store and went to the apartment parking lot

to...

(CROSSTALK)

BANFIELD: Let me interrupt you for a minute. The gun that was displayed, I have heard this as though, it was flashed. The gun was flashed at the

worker. We got a picture on our screen right now I believe it will be the actual gun that was recovered in this -- yes. This was -- this was the gun

that was recovered near the suspect`s body. Do we know if that`s the same gun that was flashed...

(CROSSTALK)

MILETICH: Ashleigh, I don`t know if -- I don`t know if it was near the body, it was found at the scene. The man`s mother is claiming it was found

in his car.

BANFIELD: OK, so a couple of varied reports. I`m sure the investigators will try to sort that out.

In the meantime, do we know if that`s the same gun that some poor unsuspecting worker at the mall was menaced by? And if it was the same gun

that that worker at the nearby apartment complex who tried to take them to task for parking in the wrong spot, apparently was threatened with and a

shot was fired actually into the ground. Is that all the same weapon, do they know that yet?

MILETICH: They don`t know that yet. I think there`s probably an assumption that it was the same weapon based on the chain of events, but there`s been

no independent confirmation of that about at this point. I`m sure that some ballistics investigation is taking place along those lines.

BANFIELD: What about the last civilian who came into contact with Kyle Gray, the subject of this chase that we`re seeing, the subject of a police

shooting which is now thrown the whole department into turmoil. They`ve got an internal investigation obviously. Every time an officer even fires his

weapon there`s an investigation, let alone fires a weapon into a human being, drops him to the ground and killed him.

What do we know about the last known witness to have looked into the eyes of Kyle Gray and exchanged all those words with him. Is that person

helpful, has that person been integrally involved in trying to sort of set the time line?

MILETICH: His statement hasn`t been released, but he was obviously interviewed by the police. And what you -- from what you see on the video,

there was a loud argument laced with a lot of profanity between him and the couple of people over a parking space and his demands that they move a car

was led to the shot being fired into the ground by the suspect.

BANFIELD: All right. So, I want to actually play that now, the cell phone video that that apartment complex worker when he got into it with Kyle Gray

and the female companion. He started rolling tape. It is not easy to edit because of the unbelievable profanity, but here`s what transpired.

UNIDENTIFIED FEMALE: My -- my dog.

UNIDENTIFIED MALE: I`m going to move it for you.

[18:10:00] UNIDENTIFIED FEMALE: (muted) My dog was running out of the car so I parked it really (muted) fast.

UNIDENTIFIED MALE: Do I get a ticket?

UNIDENTIFIED MALE: You already got one.

UNIDENTIFIED FEMALE: You`re dead.

UNIDENTIFIED MALE: You lost your job, (muted).

UNIDENTIFIED MALE: OK. Go take care of that one. Go take care of that.

UNIDENTIFIED FEMALE: (muted) you, bitch.

UNIDENTIFIED MALE: Go take care of that.

UNIDENTIFIED FEMALE: You don`t (muted) give a (muted) about any of this.

UNIDENTIFIED MALE: Go take of that.

UNIDENTIFIED MALE: Go take care of what bitch?

UNIDENTIFIED FEMALE: You are a sociopath.

UNIDENTIFIED MALE: Take care of what bitch?

UNIDENTIFIED MALE: You`re asking for it. You`re asking for it, mister.

UNIDENTIFIED MALE: I already got your license plate, you`re not very (muted) smart.

BANFIELD: So, there are so many levels of don`t do that in that piece of tape.

I want to bring Ken Williams out. He is a use of force expert, he is on the phone now with me. Ken, I mean it`s great that we have the evidence of this

couple prior to the police chase which I`m going to show you in its entirety in a moment.

I can`t believe after that gun was fired the video continued. The worker at the apartment complex continued to film. And continued to get into it with

them. Look, I`m glad he is alive he is with us, but this is -- this has got to be the wrong thing to do when you encounter people like this. This guy

was armed and not afraid to use it.

KEN WILLIAMS, USE OF FORCE AND POLICE REFORM EXPERT: Correct, I mean police there had to respond to control people`s misconduct. In this particular

case we had a person armed with a firearm, that was armed and dangerous and had the very intention on trying to harm other people.

So, police responded to the scene and that person had taken off with the girlfriend. At some point in time police did encounter this person who

still did not want to give up, resisted arrest, and police had to act accordingly.

BANFIELD: I want to just continue the tape if I can. Once they left this parking lot they got into a car. Ultimately, the woman in the picture was

picked up before the police chase that you`re about to see, but the dash cam was rolling as they continue chased after Kyle Gray. Have a look.

UNIDENTIFIED MALE: Northbound on 80.

BANFIELD: All right, so the next piece of tape you`re going to see is when he pulled into that park and they pursued him on foot. Have a look.

UNIDENTIFIED MALE: He would have had to go this way.

UNIDENTIFIED MALE: I can`t hear it.

UNIDENTIFIED MALE: Can you hear it?

UNIDENTIFIED MALE: Let`s go.

UNIDENTIFIED MALE: Yes.

UNIDENTIFIED MALE: I got him, I got him. I got him.

UNIDENTIFIED MALE: Hands up! Hands! Show your hands. Get him up, get him up.

BANFIELD: Ken, by your best judgment of the tape you`re seeing, is this -- was this by the book?

WILLIAMS: By all means, yes. The police were left with no alternative, and it was based on their perception at the time, what they knew before

engaging him, at the time of engaging him, and his inability to cooperate.

[18:14:56] BANFIELD: I want to bring in the former prosecutor on this. Bob Schalk is sitting with me. You know what happens now. The Seattle P.D. is

now in a full internal investigation. It`s going to cause the taxpayers a whole bunch of money. At the same time, my guess, I don`t know for sure,

someone is going to file a civil suit off at this P.D. How will that go?

ROBERT SCHALK, FORMER PROSECUTOR: They can file it, they`re not going to win. Thank God for body cams. I`m a huge proponent of body cams. And every

police officer they save lives, they ensure tactical response. So at this point in time they`re both going to win. That video exonerates those cops.

BANFIELD: You think so?

SCHALK: Yes.

BANFIELD: But not before a whole bunch of money is spent on a guy like this, on Kyle Gray with a big old set of priors, leading everybody on this

for hours, menacing people all over town, not to mention frightening people in that high speed chase all to that quite neighborhood.

SCHALK: He was told 14 times to put his hands up and didn`t do it.

BANFIELD: Fourteen.

SCHALK: Fourteen times, I count it.

BANFIELD: Fourteen. All right. I got to leave it there. But there you go, guys. If there is one chasing cautionary tale, do what the cops say and do

it right away. All right. My thanks to Steve Miletich, Ken Williams, and Bob Schalk. I`m going to ask you to stay around.

I got new information that were just getting in. That that missing teenager in Ohio, who ran off with the dangerous felon, a.k.a. her cousin, new

credible tips have come in now.

A new confirmed sighting where they were spotted just hours after disappearing. And let`s not forget, that 14-year-old girl, pregnant.

BANFIELD: Tonight, U.S. Marshals are working around the clock to hunt down a dangerous felon on the run and bring the teenager that he may still have

with him to safety and they need your help too to track down 33-year-old Louis Jakab. He is criminal wanted on multiple charges with a rap sheet

that includes manslaughter.

And he is believed to be traveling with Annalys Clay, a 14-year-old girl, described as amazing and outgoing but also vulnerable. And she`d be in

danger in the hands of this man but here is the strange thing about Annalys. Annalys is his cousin. Annalys is also pregnant, and it is

believed that Annalys is pregnant with his child.

So her cousin may just be the dad. Until tonight, there had been no signs that either of them anywhere but now police have something to go on.

For any information breaking tonight that Louis and Annalys were spotted at a department store, apparently 70 miles away from where they were first

reported missing on Monday. And the tip has them at that department store just 12 hours after they drove off.

What made this particularly tough for the police is that they were thrown off of the scent and thrown off the trail by a false lead. That false lead

came from Annalys` own mother. She told police that her daughter had attacked her in her car and that she ran off when she pulled over. And

surprise, surprise, got into the car with her cousin Louis who just happened to be driving right next to them in that moment. And guess what?

Not true.

And it took mom four full days to fess up and admit the story was a lie. And that she was actually with Annalys and her cousin at the gas station

when he two of them drove off together.

UNIDENTIFIED MALE: Very troublesome. So picture this. If she would have walk into that Sheetz gas station and told the clerk of what happened and

then called 911 you would have had immediate response from patrol officers in that area looking for that very distinctive vehicle.

Instead, some two, or two and a half hours later she walks into a police station 35 miles away put this concocted story that her daughter ran away.

BANFIELD: Well now mom has been arrested. It`s official and the word is she is being much more helpful in the effort to find her pregnant teenager

daughter.

With me now, senior inspector Bill Boldin, he`s a sex offender investigations coordinator for the U.S. Marshals Service, he`s also been

working around the clock trying to find Annalys and of course Louis Jakab.

Thank you so much, inspector, for joining us tonight. Has this tip that`s brand new that is brand new and breaking tonight, this tip that led to a

sighting in a department store 12 hours after the pair vanished, has it helped in the effort to find them?

BILL BOLDIN, DEPUTY U.S. MARSHAL, UNITED STATES MARSHALS SERVICE: It has helped in the effort for -- well, it has helped for a number of reasons.

The first and most important thing is, it`s an actual sighting of her after this incident occurred which we`re still a week and a half behind them, but

at least we know that after this supposed incident occurred that she was at least alive and well and seen on a video camera. So that makes feel a lot

better.

(CROSSTALK)

BANFIELD: And -- you know, he`s got a rap sheet that includes manslaughter. So her not just the fact that there may be assaults going on along the way

given the fact that the reports are she is pregnant with his child and she is only 14, but that her life could actually be in danger.

So some of the tips that have come in as I understand it, people have told you that they know of others along the way who have been helping them, is

that true?

BOLDIN: That is true. We have received a number of tips since the show aired last night that we are trying to follow up on. The one most important

thing that we discovered, again, was that in the afternoon hours, the day after she was reported on that Monday that they were seen together at a

department store in the Youngstown, Ohio area.

And we have been able to confirm that was true and we`ve also been able to confirm that once they left that store that they left the area were mostly

heading east and south.

BANFIELD: You think going east and south, is that where the search is being concentrated now?

BOLDIN: It`s really hard to say that there is a search being concentrated in any one area because we really have no idea. You`re talking 10 days now.

So regardless of what direction they were heading when they left Youngstown, they could literally be anywhere in the country at this point.

(CROSSTALK)

BANFIELD: And when we talk about this, inspector...

[18:24:59] BOLDIN: But at least -- at least the evidence that we need to know that they were together.

BANFIELD: That they were together and in a black 2017 Audi A3, apparently not Louis` car. I`m guessing it`s stolen and that the plates that were on

it were also stolen plates, but has the car been recovered?

BOLDIN: That car has not been recovered and we have every reason to believe that that care is still in play and still viable to this investigation. We

have no idea where that car came from, but we do know that the license plate that was on it that we observed at the gas station was a stolen

license plate.

BANFIELD: There you go, HED 3844, HED 3844. If you have seen that plate, that car, the tip line is on your screen as well. We`re going to continue

And you just heard the inspector say tips came in throughout the show, so this is helpful, folks. You can be of assistance. Keep your eyes peeled for

this young girl Annalys Clay. But detective, it`s important here to note that -- or inspector, it`s important to not while she is pregnant, it`s not

as though, she appears pregnant. Is that what you`re learning?

BOLDIN: That is correct. It is our understanding that she is not that for a long, possibly eight to nine weeks. So she`s not that far along and she`s

not showing, so it would not be obvious to anybody who saw her.

BANFIELD: So that mom, Helena Clay, I don`t know if I`m pronouncing it right. Haleana, Halena, apparently now being a little more helpful and

she`s been brought in. She had to -- she had to actually once the warrants for her arrest were executed for you know, telling those stories, she was

brought in and process, and how much has she been able to tell you?

BOLDIN: Well, I will tell you that, you know once we confronted her originally when we started our investigation last week, at that time she

started to become much more helpful and providing us with a lot of the information that we needed to focus our investigation in the right

direction.

So she has been providing what information she can. However, at this point, you know, once her daughter left, she`s had no contact with her and really

has no idea where she is.

BANFIELD: So we`ve done a little digging and some Facebook information has popped up from Louis apparently. Louis Jakab has a Facebook page and I

think it`s very telling. The post that he started sending December 3rd. Remember, She went missing on December 4th, so, the day before,

effectively.

And then, inspector, I`m going to ask you something about this last post, but I`m going to go through them chronologically. On December 3rd, he

posted "LMFAO. Laughing my, you know what off. Today is the day." On December 3rd, as well, he posted a screen grab of an author, an unknown

author, reading, "I want a best friend I can sleep with, make love to, travel with, shop with, dream with, and live with. I want a life partner

someone that I can laugh with, and build with, someone that I can trust with my heart, my money, and my life. Somebody I`m not afraid to lose

because they`ll always be there, a relationship with love and loyalty. I`ll take that."

On December 2nd, so this would be the day before, he posted, "Missing the only thing that matters in my life." And a day before that, on December

1st, he posted, "Best ice cream in town. I`m taking my daughter tomorrow when they open because I know if I make it through tomorrow night I won`t

be seeing light for a while." Once again, LMFAO.

He continues to say, "but at least I was able to protect other people." What is that supposed to mean, inspector? At least I`m able to protect

other people while I won`t see my own daughter? What do you take that as?

BOLDIN: I have a hard time understanding that he is going to be trying to protect other people when, in fact, the public, Annalys, and everyone else

needs to be protected from him. He is the person society needs to protect from, so I really don`t understand what he means by that.

BANFIELD: What`s the story on this daughter? He actually has a daughter already?

BOLDIN: Yes.

BANFIELD: And where is she?

BOLDIN: She is in the Greater Cleveland area with family. And I understand...

(CROSSTALK)

BANFIELD: Someone else is looking after her?

BOLDIN: ... she really and she`d -- yes, somebody else is looking after her and that really doesn`t factor into our part of the investigation in trying

to locate him, but we do know that she is in the Greater Cleveland area with the family.

BANFIELD: Does he ever have a role in her life other than saying he`s going to take her for ice cream before he never sees her again?

BOLDIN: I don`t know, and I don`t know how much of a role he could have had considering he has spent most of his adult life in prison.

[18:29:59] So, again, that`s an area that we`re really focusing on at this point. Our efforts are all on everything occurring after December 4th, and

really trying to find her and get her back into a safe environment.

BANFIELD: Give me this one favor, inspector, I know you have been able to ask a lot of people about Louis Jakab, apart from the rap sheet, what have

you been able to find out about his character from other people who know him?

BOLDIN (via telephone): In the course of our investigation, we have talked to a lot of people, and we haven`t filed and found a person yet that has

actually had one nice thing to say about him.

Even, I would say, you know, his criminal associates who were involved in these minor thefts and crimes and other minor-type issues, he stolen from

them and conned them.

So, he is somebody that will con anybody and steal from anybody and do anything to satisfy his own needs.

BANFIELD: She is 14 years old. She is pregnant with his child. She is his cousin. And she is missing. Somewhere out there, someone is going to have

eyes on Annalys Clay. Someone is going to see this girl.

She may think she is with the love of her life. She is in danger. She is vulnerable. And a huge whopping load of laws are being broken right now. If

you know anything, if you have seen the two of them, if you have seen one of them, 866-4-Wanted. If you need the numbers, 4926833. If you can`t

remember any of that, call 911.

Inspector, I really hope that this is helpful. I hope that someone out there who is watching may be able to call in with another tip to get eyes

on the two of them. As we approach the holidays, I sure hope you can bring Annalys Clay home safely. Thanks for being here tonight.

A man is accused of kidnapping his own stepdaughter and then marrying her in a van, and holding her captive for nearly 20 years. And tonight, he is

facing a big new load of charges that could put him behind bars for the rest of his life. And it`s that stepdaughter`s story of courage that could

play a massive role in his prosecution.

ROSALYNN MCGINNIS, KIDNAPPED AND RAPED BY HENRI PIETTE: I can`t remember exactly what age I was, but it was between 11 and 12. He said that because

he had already touched me that he needed to marry me.

BANFIELD: Just because you say you`re married doesn`t always make it so. Just because you say you`re in love doesn`t mean the other person is too.

Especially when that other person is just 11 years old. And that`s probably what a grand jury thought when they indicted this man, Henri Piette of

Wagoner, Oklahoma.

And there is a good chance that Henri may never again see the light of day if he is convicted of the boat load of charges that are now coming at him

from every direction. The state has already locked him up on accusations that he married his young stepdaughter in the back of a van and then stole

off to Mexico with her, reportedly bearing nine children with her.

While that sinks in, know this. The feds have piled on now with charges that could see him put away for life. So you would think that that would

sink in for him, that Mr. Piette would know that he is in a boat load of trouble for things that the rest of us just don`t do.

UNIDENTIFIED FEMALE: Mr. Piette, do you have anything to say about the allegations against you?

PIETTE: They`ve been manipulated and they`re lying.

PIETTE: I never raped any children. I made love to my wife. We were married.

BANFIELD: Remember what I said just a little bit ago? Just because you say you`re married doesn`t make it so, especially if that wife is a child. And

that woman that he is talking about because now she is a woman, she has plenty to say about that and about him, too.

BANFIELD: Great reporting by people.com. And with me is PEOPLE staff writer, Elaine Aradillas. Elaine, thanks for being here. So, he says, it`s

all lies, they`re all lying. But what he may not have known when he said that was that they swabbed him and they have his DNA.

And they`re now going to compare it to the nine children that this poor Rosalynn McGinnis was forced to bear over the time that she spent with him

for roughly two decades. And if they matched that up, at least two of them, mean that they were born before she was anywhere close to being at legal

age.

ELAINE ARADILLAS, STAFF WRITER, PEOPLE: Yes, and she had two children with him. She has nine with him. And there was even a miscarriage early on that

they haven`t brought up in those charges or maybe there is more to come.

BANFIELD: So he -- something else we were learning from the indictment. And again, I am going to mention this photograph, because it is just so -- it

is revolting to look at it. This is the photograph of the squalor they were living in in Mexico. We blurred the children`s faces.

But the photograph here, it looks like it is a wedding picture. It is actually a quinceanera. Is that the right pronunciation?

ARADILLAS: Quinceanera.

BANFIELD: Quinceanera. Quinceanera would be a celebration of a 15-year- old`s birthday. He apparently threw this for her. But in that picture, she is only 13. So, if the math is correct at this picture, she would have

already been his wife for about two years.

ARADILLAS: He was determined to marry her. They first met when she was 10 years old. He came into her family home.

[18:40:00] BANFIELD: His girlfriend was her mom.

ARADILLAS: Right.

BANFIELD: Yes. And apparently this disgusting sort of back of the van marriage ceremony that he had his son performed, 16-year-old boy from

another relationship, preceded the marriage that he actually had to this poor victim, this young girl`s mom. I mean, it is just sort of a whole

revolting series of events.

So that everybody knows how he pulled a lot of this stuff, I want to go over all the aliases that he has reported to abuse, as he spirited this

poor girl all around the country and then over the border to Mexico.

He went by Henri Billy, Dan Reed, Billy Ira Sloop Jr., Michael Wayne Mansfield, Christopher Allen McAnear. We don`t know all the different names

that he made her adapt, but apparently he changed her appearance. He changed her name. And then took off over the border. She is doing pretty

well, though, given the life that she has had to live.

ARADILLAS: Given the life that she was forced to live and living inside a tent with no food, being forced to beg in the streets, that`s pretty much

how she survived for all of these years in Mexico. She is reunited with her children. The school that they`re going to --

BANFIELD: They`re not living like this anymore, right?

ARADILLAS: No, they`re not.

BANFIELD: So just so that, you know, the evidence is clear against him, because I think anybody watching this right now would hope to hell that

they`re ironclad in the case not just at the state level but at the federal level, because feds, you know, the kidnapping charge alone could be life in

prison for him.

But he is not just facing kidnapping. He is also facing travel with intent to engage in a sexual act or in sexual acts with a juvenile. He is facing

first-degree rape with molestation of a child. Child abuse by injury. Those at the state level.

So that everyone is clear on the evidence and you will have to help me sort of wade through this because we all have been, you know, going through the

federal indictment. He had children by another woman prior to meeting poor Rosalynn at the age of 10. They were young children and one of them was a

child of about the age of four or five, a young girl.

That girl, that daughter, has told the police that she saw her father rape and molest and beat Rosalynn regularly in their home. She also reports that

she was forced into his bed at age four or five years old and forced to perform oral sex. All I can ask, Elaine, is how can we not assume that the

nine children he forced Rosalynn to bear were not all sexually molested?

ARADILLAS: Those are areas that she didn`t want to get into with he. I mean, just telling her own story was so difficult.

BANFIELD: And these are her babies.

ARADILLAS: And these are her babies.

BANFIELD: Regardless of how she was impregnated, they were her children.

ARADILLAS: And she did everything to protect them, which is why she escaped. You know, she did not want to leave her children with him any

longer.

BANFIELD: Real quickly. I want to play a quick soundbite from Rosalynn. Her voice is very scratchy. It is hard to understand her and there is a good

reason for it. She said he choked her and abused her and damaged her vocal cords.

She needed surgery, in fact, and she is left speaking like this. This is a moment where she describes the beatings and how much worse they got on a

regular basis. Take a look.

MCGINNIS: The beatings got worse. The rape got worse. He had stabbed me. He had choked me unconscious. He would beat me with baseball bats. He shot me.

And I still have a bullet in my ankle, and in my back, and in my head.

The bullet had to be removed out of my head because it got infected. It didn`t go really deep but it went into the side and it was lunged into my

skull. It was the worst nightmare you could ever think of.

BANFIELD: Bob Schalk, you`re a former prosecutor. I want to say, is it open and shut? I know I shouldn`t, but I really need to know how good this case

is.

ROBERT SCHALK, FORMER PROSECUTOR: As you pointed out, the DNA is going to be what buries him. He admitted on television that he had sex with her, and

you have her cooperating as a witness. It should be everything that the government needs.

BANFIELD: And other children, too. A disgusting case. You did a great job, Elaine, reporting this story for people. Thank you so much.

ARADILLAS: Thank you for having me.

BANFIELD: Keep us posted, too, will you?

ARADILLAS: I will.

BANFIELD: Appreciate it. Imaging heading for home for the holidays and then you get stuck in an airport tarmac for hours. It is a travel nightmare.

Tonight, one man says he lived through that bad dream and now he is suing Delta Airlines claiming that he was kicked off of his flight because he was

desperate to go to the bathroom.

came to sit down. I absolutely couldn`t. and I`m being kicked off the plane.

BANFIELD: When you got to go, you got to go. But are you always free to go when you have to go? I know that is confusing, but I want to take you back

to a story that we first gave you. You might remember this guy, a Delta passenger flying from Atlanta to Milwaukee. He says he was thrown off of

this flight and he was questioned too by the FBI because he had to go to the bathroom before takeoff.

Apparently that is a big no, no to the airline. His name is Kima Hamilton. He said he urgently, urgently had to go, despite the all too familiar

announcement telling passengers, please remain in your seats.

Worried that he might not make it, literally might not make it, he tried to just race to the restroom. And he was turned back by a flight attendant and

he sat pack down. But more time passed before takeoff and Hamilton had to go even more than ever, so he got up again, and this time

[18:50:00] he did use the restroom, told the flight attend it was an emergency, and when he was done, he said an attendant told him the plane

lost its place in line for takeoff. Next thing that happens, the pilot comes over and announces that the plane is going to be returning to the

gate so that a passenger could be removed.

UNIDENTIFIED MALE: So I`m going to kindly ask you please, come with me.

UNIDENTIFIED MALE: I need, I`m not really clear on why I`m being asked to leave this plane. I purchased this ticket. I had an emergency. I had to

pee. I went on a tour. I had to pee. I tried to hold it the first time. I came to sit down. I absolutely couldn`t. And I`m being kicked off the

plane.

BANFIELD: So, after getting kicked off the plane, Kima Hamilton is fighting back. He has decided to sue Delta, saying that he was a victim of racial

discrimination. Delta says it takes any claims of discrimination seriously, but also said that it could not comment pending further litigation.

Hamilton had a few words to say back when this first happened, though. Have a look.

KIMA HAMILTON, SUING DELTA AFTER REMOVAL FROM FLIGHT: First question, am I angry? I`ll say that I have -- I worked through -- I am working through the

emotions that come with having this experience. You know, it was outrageous. So, you know, it has created those types of feelings. I can

only speak from the perspective that I was in, in this scenario.

And I think they old the act of runway language implies that we were actively taking off and that -- you know, we weren`t in the process of

taking off. So I -- you know, that part, I think, depending on the version of the events that you are processing might, you know, determine how you

would look at that act of going to the restroom, you know, and during, you know, during a plane headed up in the air, that`s a different conversation.

BANFIELD: Mr. Hamilton is suing for an unspecified amount of money. That was him talking to us on this program, waiting to see how things transpire.

But Bob Schalk, you`re a lawyer. Do you think he has a case? We have all been in that boat, desperate to go to the bathroom, wondering if we could

dash and make a run for it. And I`ve seen people do it.

SCHALK: There`s nothing more uncomfortable --

BANFIELD: They get away, right?

SCHALK: Right. But the problem we run into in today`s climate, the post- 9/11 safety climate is that the employees of the airline are there to enforce the FAA rules and regulations with regards to safety. The safety of

the entire plane trumps the safety of one individual or one individual`s uncomfortable feeling.

But, we`ve talked about this. What is he supposed to do? I would have done the same exact thing. And if I got thrown off, I would ask for bazillion

miles.

SCHALK: You`re a white guy. Would you have gotten thrown off, where Kima is a black man and says that might have been --

SCHALK: I hope so. I hope the rules apply for all. I don`t know whether or not he is going to be able to prove racial discrimination. Do they have

statements of other witnesses? The problem, I think, for him is that this was all recorded by the woman on the Facebook and this thing went viral.

And he handled himself appropriately.

BANFIELD: He did.

SCHALK: But Delta did too. So I think that is going to offset one another. I think, you know, Delta is not going to want bad PR here. Obviously,

people file lawsuits in hopes that a big company like Delta doesn`t want TV shows and lawyers like me talking about it with you.

BANFIELD: Right.

SCHALK: Maybe they`ll give him some hush money or a million miles.

BANFIELD: A million miles coming his way. Bob, thank you for that. One more thing, too often, we tell you about a bad guy getting caught on camera

inside a store, but tonight, no, we`ve got two secret Santas instead surprising some Walmart shoppers, and holy moly, were they ever happy. Such

a great story.

It is a lesson that bears repeating because it`s the difference between life and death. Do what police tell you to do or risk everything.

Unfortunately, this is the lesson that a man in Seattle needed to hear or should have known Monday night after flashing his handgun at the Forever 21

Store his female friend had apparently just been shoplifting from.

Then driving on with that female friend to an apartment complex where a building worker filmed a confrontation that started a chase that would end

his life.

BANFIELD: Leaving a car in the wrong parking spot. That`s what this was all about. They could have gotten away with the armed robbery at the mall,

it might have been, but that apartment worker called the police.

And they then caught up with that couple on the road and arrested the woman. We don`t know her name yet, but then they had to chase 24-year-old

Kyle Gray and they had to chase him through a bunch of very quiet streets in North Seattle.

BANFIELD: Did you hear that? "Shots fired." Unfortunately, they were not the last shots fired in this chase and in this case because Kyle Gray drove

to a park and then decided fatefully to get out of his car and run.

And then hide in the bushes, where police would hunt him down and give him some very important commands, which he ignored.

UNIDENTIFIED MALE: He`d have had to have go this way.

UNIDENTIFIED MALE: Can`t hear it.

BANFIELD: And that is how Kyle Gray`s life came to an end because he didn`t put his hands up and he did reach.

With me Steve Miletich. He`s the criminal justice reporter for "The Seattle Times".

My guess, Steve, is that this is making really big headlines in your city. Do we know anything more than everything we just laid out, that actually

came through on videotape?

STEVE MILETICH, CRIMINAL JUSTICE REPORTER, "THE SEATTLE TIMES": We know that Mr. Gray was wanted on an arrest warrant that had been issued in June

for his failure to report to his community corrections officer in a nearby county.

He had been released from prison in December of 2014 for bail jumping and possession of a controlled substance and released in May of that year. And

then went on community supervision, which is our equivalent of parole in Washington State.

And when he failed in June to report to his community corrections officer, this warrant was issued and was in effect the night this incident occurred.

BANFIELD: So, he`s got quite a background. Or at least, I should say, he had quite a background. The woman that we`re seeing on this tape - and

yes, both of their faces are obscured. That`s the way the Seattle Police Department sent the video. That may change now that he is dead.

And I believe she is either wanted or is under arrest. What`s the story about her?

MILETICH: She`s in custody. I think prosecutors are reviewing the case, determine whether to file charges. Her identity has not been revealed at

this point.

The video was obscured as far as their faces, because at that time, the medical examiner had not identified Mr. Gray. No one had been charged

with anything.

But since then, he has been identified and his photograph has been released by the State Department of Corrections from the time it was taken when he

was in state prison custody.

[19:10:05] BANFIELD: So, there was a chain of violent acts that preceded him being shot. It started with him flashing a gun at a poor, unsuspecting

Forever 21 employee while a shoplifting was going on, and that`s what they`re accusing the female partner of doing.

Then, at the apartment complex, apparently, that same gun may have been what was brought out in the argument with the apartment complex worker.

Shots fired at the ground, while the worker was actually filming that. And then, of course, smashing through a gate at 80 miles an hour after this

high-speed chase and running into the park.

If I can, I just want to air that little piece of material from the actual shooting because this is what`s going to be under close scrutiny. The

moment that Kyle Gray lost his life. I want you to watch again and think about all the things that the police officers know leading up to what ends

up happening. Have a look.

BANFIELD: Steve, what is the status of the officers who fired those fatal shots with this internal investigation? What`s happening with them?

MILETICH: Under standard policy for the Seattle Police Department, they`ve been placed on paid leave while this is investigated. That is no judgment

on their actions, but it`s a routine procedure in the aftermath of a police shooting.

The Seattle Police Department has begun a very elaborate process, we have here, for investigating officer-involved shootings. It will be

investigated by the Force Investigation Team, which is specifically tasked with handling these kinds of situations.

And, ultimately, will be reviewed by a Force Review Board to determine if the shooting was reasonable and conformed with department policy.

BANFIELD: So that brings me to Brandon Tatum, who is a former police officer, also a spokesperson for "ConservativeTribune.com". Brandon, good

to have you back again this evening.

I want to ask your assessment of the video you saw and the officers who fired those fatal shots. How do you think this internal investigation is

going to go?

BRANDON TATUM, SPOKESPERSON FOR "CONSERVATIVETRIBUNE.COM": Well, I think it`s going to go in the favor of the officers.

I was very impressed and actually shocked at how much composure that they show during the pursuit, the composure that they showed during the

confrontation that they had with the gentlemen in the woods.

It was very shocking that they handled it the way that they did because I think that it would be reasonable for them to use deadly force against that

gentlemen earlier. But they showed complete restraint and they did a wonderful job.

And I think that if you can draw it up to be a perfect situation, I think that they handled it. And at the very last minute, they had no choice but

to use deadly force against him.

BANFIELD: So, let me ask you this, clearly, they had a lot more information that many of the other cases that we cover. That information

being all of the dangerous and violent things that had preceded the shooting. And I`m guessing that really informs the police officer in how

they make those last-minute decisions as to whether someone`s going for their waistband.

The number of shots that were fired. Brandon, is that an issue?

TATUM: It`s not really an issue. I think it looks bad when people watch it from the outside looking in, but you`ve got to think that there`s

multiple people possibly shooting one or two shots at a time.

In a perfect world, we would say one person would shoot, the other person wouldn`t. But at that point, this person became a lethal threat and they

had to all shoot. And, unfortunately, there was multiple people shooting at one time, and therefore, it became a lot of rounds.

But at the end of the day, it`s really hard to control that. I think the best way to control that is to actually comply with police and that will

never happen.

BANFIELD: Yes. I want to bring in former prosecutor, Bob Schalk, who`s with me now. Obviously, what happens so frequently after an incident like

this is family members or some representatives bring a civil suit against the police department. How do you think the Seattle Police Department are

going to fare if that happens?

ROBERT SCHALK, FORMER PROSECUTOR: They can file it. They`re not going to win. As Brandon just outlined, this is the textbook proper use of force.

You have an individual who`s firing gunshots from a car speeding away from officers. They chase him down, identify themselves, tell him to put his

hands up 14 different times. One person even yells, "you`re going to get shot." He reaches for his waistband, he gets shot.

We`re lucky that this is on body cam and this is why police officers should all wear body cameras because this will exonerate these officers. They

acted in the right here.

BANFIELD: Cautionary tale, do as police say. This may - I say may - not happen. Bob, thank you. My thanks to Steve Miletich too and Brandon

Tatum.

We have some new information that we`re just getting in. That missing teenager, remember the one in Ohio who ran off with a dangerous felon, now

there are some new credible tips coming in, new confirmed sighting where they were spotted, just hours after they disappeared.

(COMMERCIAL BREAK)

BANFIELD: Tonight, US Marshals are working around the clock to hunt down a dangerous felon on the run and bring the teenager that he may still have

with him to safety.

And they need your help, too, to track down 33-year-old Louis Jakab. He is a criminal wanted on multiple charges with a rap sheet that includes

manslaughter. And he`s believed to be traveling with Annalys Clay, a 14- year-old girl described as amazing and outgoing, but also vulnerable.

And she`d be in danger in the hands of this man, but here is the strange thing about Annalys. Annalys is his cousin. Annalys is also pregnant.

And it is believed that Annalys is pregnant with his child. So, her cousin may just be the dad.

Until tonight, there have been no signs of either of them anywhere, but now police have something to go on. Brand-new information breaking tonight

that Louis and Annalys were spotted at a department store, apparently 70 miles away from where they were first reported missing on Monday. And the

tip has them at that department store just 12 hours after they drove off.

What has made this particularly tough for the police is that they were thrown off the scent and thrown off the trail by a false lead. That false

lead came from Annalys` own mother.

She told police that her daughter had attacked her in her car and that she ran off when she pulled over and, surprise, surprise, got into the car with

her cousin, Louis, who happened to be driving right next to them at that moment.

And guess what? Not True. And it took mom four full days to fess up and admit the story was a lie and that she was actually with Annalys and her

cousin at the gas station when the two of them drove off together.

BILL BOLDIN, DEPUTY US MARSHAL, US MARSHALS SERVICE: Very troublesome. So, picture this, if she would have walked into that Sheets Gas Station and

told the clerk what happened, then called 911, you would have had immediate police response from patrol officers in that area looking for that very

distinctive vehicle.

Instead, some over 2, 2.5 hours later, she walks into a police station 35 miles away, with this concocted story that her daughter ran away.

BANFIELD: Well, now mom`s been arrested. It`s official. And the word is she is being much more helpful in the effort to find her pregnant teenage

daughter.

With me now is senior inspector Bill Boldin. He`s the sex offender investigations coordinator for the US Marshals Service. He`s also been

working around the clock trying to find Annalys and, of course, bring in Louis Jakab.

Thank you so much, inspector, for joining us tonight. Has this tip that`s brand-new and breaking tonight, this tip that led to a sighting in a

department store, 12 hours after the pair vanished, has it helped in the effort to find them?

BOLDIN: It has helped in the effort, for - well, it`s helped the case for a number of reasons. The first and most important thing is, it`s an actual

sighting of her after this incident occurred, which - we`re still a week and a half behind them, but at least we know that after this supposed

incident occurred, that she was at least alive and well and seen on a video camera.

BANFIELD: And, of course, that`s a fear -

BOLDIN: So, that makes us feel a lot better.

BANFIELD: He`s got a rap sheet that includes manslaughter. So her - not just the fact that there may be assaults going on, along the way, given the

fact that the reports are she`s pregnant with his child and she`s only 14, but that her life could actually be in danger.

So, some of the tips that have come in, as I understand it, people have told you that they know of others along the way who have been helping them.

Is that true?

BOLDIN: That is true. We have received a number of tips since the show aired last night that we are trying to follow up on.

The one most important thing that we discovered, again, was that in the afternoon hours, the day after she was reported missing on that Monday that

they were seen together at a department store in the Youngstown, Ohio, area, and we have been able to confirm that was true.

And we`ve also been able to confirm that once they left that store that they left the area, most likely heading east and south.

BANFIELD: You think heading east and south. Is that where the search is being concentrated now?

BOLDIN: It`s really hard to say that there`s a search being concentrated in any one area because we really have no idea. You`re talking ten days

now. So, regardless of what direction they were heading when they left Youngstown, they could literally be anywhere in the country at this point.

BANFIELD: And when we talk about this, inspector -

BOLDIN: It at least gives us the evidence we need to know that they were together.

BANFIELD: That they were together. And in a black 2017 Audi A3, apparently not Louis` car. I`m guessing it`s stolen and that the plates

that were on it were also stolen plates. But has that car been recovered?

BOLDIN: That car has not been recovered and we have every reason to believe that that car is still in play and still viable to this

investigation. We have no idea where that car came from, but we do know that the license plate that was on it, that we observed at the gas station

was a stolen license plate.

BANFIELD: There you go. HED 3844. HED 3844. If you have seen that plate, that car, the tip line is on your screen as well. We`re going to

And you just heard the inspector say tips actually came in throughout the show. So, this is helpful, folks. You can be of assistance. Keep your

eyes peeled for this young girl, Annalys Clay.

But, detective, it`s important here to note that - or inspector, it`s important to note, while she is pregnant, it`s not as though she appears

pregnant, is that what you`re learning?

BOLDIN: That is correct. It is our understanding that she is not that far along, possibly 8 to 9 weeks. So, she`s not that far along and she`s not

showing. So, it wouldn`t be obvious to anybody who saw her.

BANFIELD: So that mom, Helena Clay - I don`t know if I`m pronouncing it right - apparently now being a little bit more helpful and she has been

brought in. You had to actually - once the warrants for her arrest were executed for telling those stories, she was brought in and processed.

And how much has she been able to tell you?

BOLDIN: Well, I will tell you, once we confronted her originally, when we started our investigation last week, at that time, she started becoming

much more helpful and providing us with a lot of the information that we needed to focus our investigation in the right direction. So, she has been

providing what information she can.

However, at this point, once her daughter left, she`s had no contact with her and really has no idea where she is.

BANFIELD: So, we`ve done a little digging and some Facebook information has popped up from Louis, apparently. Louis Jakab has a Facebook page and

I think it`s very telling.

The posts that he started sending December 3rd. Remember, she went missing on December 4th. So, the day before, effectively.

And then, inspector, I`m going to ask you something about this last post, but I`m going to go through them chronologically. On December 3rd, he

posted, "LMFAO" - laughing my you-know-what-off - "today`s the day."

On December 3rd as well, he posted a screen grab of an author, an unknown author, reading, "I want a best friend I can sleep with, make love to,

travel with, shop with, dream with and live with. I want a life partner, someone that I can laugh with and build with, someone that I can trust with

my heart, my money, and my life. Somebody I`m not afraid to lose because I know they`ll always be there, a relationship with love and loyalty. I`ll

take that."

On December 2nd, so this would be the day before, he posted, "Missing the only thing that matters in my life."

And the day before that, on December 1st, he posted, "Best ice cream in town. I`m taking my daughter tomorrow when they open, because I know if I

make it through tomorrow night, I won`t be seeing light for a while." Once again, "LMFAO."

He continues to say, "But at least I was able to protect other people."

What is that supposed to mean, inspector? "At least I`m able to protect other people," while I won`t be able to see my own daughter. What do you

take that as?

BOLDIN: I have a hard time understanding that he is going to be trying to protect other people when, in fact, the public, Annalys, and everyone else

needs protected from him. He`s the person society needs protected from. So, I really don`t understand what he means by that.

BANFIELD: What`s the story on this daughter? He actually has a daughter already?

BOLDIN: Yes.

BANFIELD: And where is she?

BOLDIN: She`s in the Greater Cleveland area, with family.

BANFIELD: Is someone else looking after her?

BOLDIN: Yes. Somebody else is looking after her. And that really doesn`t factor into our part of the investigation in trying to locate him. But we

do know that she is in the Greater Cleveland area with family.

BANFIELD: Does he ever have a role in her life, other than saying he`s going to take her for ice cream before he never sees her again?

BOLDIN: I don`t know. And I don`t know how much of a role he could have had, considering he has spent most of his adult life in prison. So, again,

that`s not an area that we`re really focusing on at this point.

Our efforts are all on everything occurring after December 4th, really trying to find her and get her back into a safe environment.

BANFIELD: Do me this one favor, inspector. I know you`ve been able to ask a lot of people about Louis Jakab, apart from the rap sheet. What have you

been able to find out about his character from other people who know him?

BOLDIN: In the course of our investigation, we have talked to a lot of people, and we haven`t - I haven`t found a person yet that has actually had

one nice thing to say about him. The - even his, I would say, you know, his criminal associates that were involved in these minor thefts and crimes

and other minor-type issues, he`s stolen from them and conned them. So he is somebody that will con anybody and steal from anybody and do anything to

satisfy his own needs.

ASHLEIGH BANFIELD, HLN HOST: She is 14 years old. She is pregnant with his child. She is his cousin, and she is missing. Somewhere out there,

someone`s going to have eyes on Annalys Clay. Someone is going to see this girl. She may think she`s with the love of her life. She is in danger.

She is vulnerable. And a huge, whopping load of laws are being broken right now. If you know anything, if you`ve seen the two of them, if you`ve

A man is accused of kidnapping his own stepdaughter and then marrying her in a van and holding her captive for nearly 20 years. And tonight, he`s

facing a big new load of charges that could put him behind bars for the rest of his life. And it`s that stepdaughter`s story of courage that could

play a massive role in his prosecution.

ROSALYNN MCGINNIS, VICTIM: I can`t remember exactly what age I was but it was in between 11 and 12. He said that because he had already touched me

that he needed to marry me.

BANFIELD: Just because you say you`re married doesn`t always make it say so. And just because you say you`re in love, doesn`t mean the other person

is, too. Especially when that other person is just 11 years old. And that`s probably what that grand jury thought when they indicted this man,

Henri Piette, Wagoner, Oklahoma. And there is a good chance that Henri may never again see the light of day if he is convicted of the boatload of

charges that are now coming at him from every direction. The state has already locked him up on accusations that he married his young stepdaughter

in the back of a van and then stole off to Mexico with her, reportedly bearing nine children with her. While that sinks in, know this. The feds

have piled on now with charges that could see him put away for life. So you would think that that would sink in for him, that Mr. Piette would know

that he`s in a boatload of trouble for things that the rest of us just don`t do.

UNIDENTIFIED FEMALE: Mr. Piette, do you have anything to say about the allegations against you?

HENRI PIETTE, DEFENDANT: Most of it are lies. 99 percent are lies. I`m telling the truth.

UNIDENTIFIED FEMALE: What do you have to say about the children who say that you abused them violently and heinously for years and decades?

PIETTE: They`ve been manipulated and they`re lying.

UNIDENTIFIED FEMALE: They`re lying about what you did to them? You`d never raped any children?

PIETTE: I never raped any children. I made love to my wife. We were married.

BANFIELD: Remember what I said, just a little bit ago? Just because you say you`re married doesn`t make it so, especially if that wife is a child.

And that woman, that he`s talking about, because now she`s a woman, she has plenty to say about that and about him, too.

MCGINNIS: I want the world to know. I want him to be stopped. And I want justice to be served.

BANFIELD: Great reported by PEOPLE.com. And with me is PEOPLE staff writer, Elaine Aradillas. Elaine, thanks for being here. So he says, it`s

all lies, they`re all lying. But what he may not have known when he said that was that they`ve swabbed him and they have his DNA and they`re now

going to compare it to the nine children that this poor Rosalynn McGinnis was forced to bear over the time that she spent with him, roughly two

decades. And if they match that up, at least two of them, meaning that -- they were born before she was anywhere close to being of legal age.

ELAINE ARADILLAS, PEOPLE.COM STAFF WRITER: Yes, and she had two children with him, she has nine with him, and there was even a miscarriage early on

that they haven`t brought up in those charges, or maybe there`s more to come.

BANFIELD: So, he -- something else we were learning from the indictment. And again, I just got to mention this photograph, because it`s just so --

it`s revolting to look at it. This is a photograph of the squalor they were living in, in Mexico. We`ve blurred the children`s faces. But the

photograph here, what -- it looks like it`s a wedding picture. It`s actually a quinceanera, is that the right --

(CROSSTALK)

ARADILLAS: Quinceanera.

BANFIELD: Quinceanera. A quinceanera would be a celebration of a 15-year- old`s birthday. He apparently threw this for her. But in that picture, she`s only 13. So if the math is correct, at this picture, she would have

already been his wife for about two years.

ARADILLAS: He was determined to marry her, you know, he -- they first met when she was 10 years old. He came into her family home --

BANFIELD: Girlfriend was her mom.

ARADILLAS: Right. Yes.

BANFIELD: And apparently, this disgusting sort of back of the van marriage ceremony that he had his son perform, a 16-year-old boy from another

relationship, preceded the marriage that he actually had to this poor victim`s -- this young girl`s mom. I mean, it`s just sort of a whole

revolting series of events. So that everybody knows how he pulled a lot of this off, I want to go over all the aliases that he`s reported to have

used, as he spirited this poor girl all around the country and then over the border to Mexico. He went by Henri Billy, Dan Reed, Billy Ira Sloop

Jr., Michael Wayne Mansfield, Christopher Allen McAnear, we don`t know all the different names that he made her adopt. But apparently, he changed her

appearance, he changed her names, and then took off, you know, over the border. She`s doing pretty well, though, given the life that she`s had to

lead.

ARADILLAS: Given the life that she was forced to live and living inside a tent, no food, being forced to beg in the streets. That`s pretty much how

she survived for all of those years in Mexico. She is -- she -- she`s reunited with her children, the school that they`re going to --

BANFIELD: They`re not living like this anymore, right?

ARADILLAS: No, they`re not.

BANFIELD: So just so that, you know, the evidence is clear against him, because I think anybody watching this right now would hope to hell that

they are ironclad in the case, not just at the state level, but at the federal level. Because feds, you know, the kidnapping charge alone could

be life in prison for him. But he`s not just facing kidnapping. He`s also facing travel with intent to engage in a sexual act or in sexual acts with

a juvenile. He`s facing first-degree rape, lewd molestation of a child, child abuse by injury. Those at the state level. So that everyone`s clear

on the evidence, and you`ll have to help me sort of wade through this, because we`ve all been, you know, going through the federal indictment, he

had children by another woman, prior to meeting, you know, poor Rosalynn at the age of 10.

They were young children and one of them was a child of about the age of 4 or 5, a young girl. That girl, that daughter has told the police that she

saw her father rape and molest and beat Rosalynn regularly in their home. She also reports that she was forced into his bed at age 4 or 5 years old

and forced to perform oral sex. All I can ask, Elaine, is how can we not assume that the nine children he forced Rosalynn to bear weren`t all

sexually molested?

ARADILLAS: I know. I mean, those are areas that she didn`t want to get into with me, because, I mean, just telling her own story was so difficult.

BANFIELD: And these are her babies.

ARADILLAS: And these are her babies. And she did --

BANFIELD: Regardless of how she was impregnated, they`re her children.

ARADILLAS: And she did everything to protect them, which is why she escaped. You know, she did not want to leave her children with him any

longer.

BANFIELD: Real quickly, I want to play a quick sound bite from Rosalynn. Her voice is very scratchy. It`s hard to understand her. And there`s a

good reason for it. She says he choked her and abused her and damaged her vocal chords. She needed surgery, in fact, and she`s left speaking like

this. But this is a moment where she describes the beatings and how much worse they got on a regular basis. Take a look.

MCGINNIS: The beatings got worse. The rape got worse. He`d stab me. He`d choke me unconscious. Would beat me with baseball bats. He shot me.

And I still have a bullet in my ankle, and in my back, and in my head. The bullet had to be removed out of my head because it got me infected. And it

didn`t go really deep but it went into the side, and it was lunged into my skull. It was the worst nightmare you could ever think of.

BANFIELD: Bob Schalk, you`re a former prosecutor, I want to say, is it open and shut? I know I shouldn`t but I really need to know how good this

case is.

ROBERT SCHALK, CNN LEGAL ANALYST AND FORMER PROSECUTOR: As you`ve astutely pointed out the DNA is going to be what buries him. He admitted on

television that he had sex with her and you have her cooperating as a witness. It should be everything the government needs.

BANFIELD: And other children, too.

SCHALK: Yes.

BANFIELD: It`s a disgusting case. You did a great job, Elaine, reporting this story for people. Thank you so much.

ARADILLAS: Thank you for having me.

BANFIELD: Keep us posted, too, will you?

ARADILLAS: I will.

BANFIELD: Appreciate it.

Imagine heading for home for the holidays and then you get stuck on an airport tarmac for hours. It is, you know, quintessential travel

nightmare. Tonight, one man says he lived through that bad dream. And now he is suing delta airlines, claiming that he was kicked off his flight,

because he was desperate to go to the bathroom.

(BEGIN VIDEO CLIP)

KIMA HAMILTON, PASSENGER: I purchased this ticket. I`ve -- I had an emergency. I had to pee. I went on a tour, I had to pee. I tried to hold

it the first time. I absolutely couldn`t.

UNIDENTIFIED MALE: And I understand that.

HAMILTON: And now I`m being kicked off the plane.

(COMMERCIAL BREAK)

BANFIELD: When you got to go, you got to go. But are you always free to go when you have to go? I know that`s confusing, but, I want to take you

back to a story that we first gave you, you might remember this guy. A Delta passenger flying from Atlanta to Milwaukee says he was thrown off of

this flight and he was questioned, too, by the FBI, because he had to go to the bathroom before take-off. Apparently, that is a big no-no to the

airline. His name is Kima Hamilton, he said he urgently had to go despite the all-too-familiar announcements telling passengers please remain in your

seats. Worried that he might not make it, literally, might not make it, he tried to just race to the rest room, and he was turned back by a flight

attendant and he sat back down.

But more time passed before take-off and Hamilton had to go even more than ever, so he got up again, and this time he did use the rest room, told the

flight attendant it was an emergency, and when he was done, he says an attendant told him the plane lost its place in line for take-off. Next

thing that happened is the pilot comes over and announces that the plane is going to be returning to the gate so that a passenger could be removed.

HAMILTON: I`ve purchased a ticket. Can you help me understand why?

UNIDENTIFIED MALE: We`re going to discuss this outside. Not here, outside. Follow me, please. Follow me.

HAMILTON: I need more information, sir. I haven`t done anything. I`ve paid for this ticket, and I actually have, I have to be home.

UNIDENTIFIED MALE: So I`m going to kindly ask you, please come with me.

HAMILTON: I need, I`m not really clear on why I`m being asked to leave this plane. I purchased a ticket. I`ve -- I had an emergency. I had to

pee. I went on a tour, I had to pee. I tried to hold it the first time came to sit down. I absolutely couldn`t.

UNIDENTIFIED MALE: I understand that.

HAMILTON: And now I`m being kicked off the plane.

BANFIELD: So after getting kicked off the plane, Kima Hamilton is fighting back. He`s decided to sue Delta saying that he was the victim of racial

discrimination. Delta says it takes any claims of discrimination seriously, but also said that it could not comment pending further

litigation. Hamilton had a few words to say back when this first happened, though. Have a look.

HAMILTON: You see, am I -- first question, am I angry? I`ll say that I have -- I`ve worked through -- I am working through the emotion that come

with having this experience. You know, it was outrageous. So, you know, it has created those types of feelings. I can only speak from the

perspective that I -- that I was in in this scenario. I think they hold the act of runway language implies that we were -- we were actively taking

off (INAUDIBLE). You know, we weren`t -- we weren`t in the process of taking off. So, you know, that part, I think, is depending on the version

of the events that you are processing, might, you know, determine how you would look at that act of going to the rest room, you know, and during, you

know, during a plane headed up in the air. That`s a different conversation.

BANFIELD: Mr. Hamilton is suing for an unspecified amount of money. That was him talking to us on this program. Waiting to see how things

transpire, but Bob Schalk, you`re a lawyer, do you think he has a case? We have all been in that boat, desperate to go to the bathroom, wondering if

we could dash and make a run for it, and I`ve seen people do it.

SCHALK: There`s nothing more uncomfortable --

(CROSSTALK)

BANFIELD: They get away, right? They get sway.

SCHALK: Right. But the problem that we run in to in today`s climate, the post-9/11 safety climate is that the employees of the airline are there to

enforce the FAA rules and regulations with regards to safety. The safety of the entire plane trumps the safety of one individual or one individual`s

uncomfortable feeling. But we`ve talked about this, what is he supposed to do?

(CROSSTALK)

SCHALK: I would have done the same exact thing. And if I got thrown off I`d asked for a bazillion mile --

(CROSSTALK)

BANFIELD: So, you`re a white guy. Would you have gotten thrown off? Where Kima is a black man and says that might have been the reason.

SCHALK: I hope so. I hope the rules apply for all. I don`t know whether or not he`s going to be able to prove racial discrimination. Do they have

statements of other witnesses? The problem I think for him is that this was all recorded by the woman on Facebook and this thing went viral. And

he handled himself appropriately but Delta did, too.

BANFIELD: He did. (INAUDIBLE) They both did.

SCHALK: So I think that`s going to offset one another. I think, you know, Delta is not going to want bad P.R. here. Obviously, people file lawsuits

in hopes that a big company like Delta doesn`t want T.V. shows and lawyers that are going to be talking about it with you.

BANFIELD: Right. So maybe they`re --

(CROSSTALK)

SCHALK: Maybe they going to give him some hush money. Maybe they going to give him a million miles.

instead surprising some Wal-Mart shoppers. And holy moly were they ever happy. Such a great story.

This time of year it`s all about giving back, but the 11th annual "CNN HEROES ALL-STAR TRIBUTE" salutes ten people who really put others first all

year long. It is a star-studded gala. It airs live this Sunday, 8:00 P.M. Eastern time. And I want to give you a little preview.

could not deliver the gifts themselves because of the NBA schedule, but they sent their elves led by their mom (INAUDIBLE) to the store near where

they grew up in Philadelphia.
