[18:00:00] UNIDENTIFIED FEMALE: -- subscriber to Bril`s content, I will tell you, big fan of Steven Bril. OK. "Crime and Justice with Ashleigh

Banfield," is up right now.

ASHLEIGH BANFIELD, HOST, HLN CRIME AND JUSTICE: Good evening, everyone, I`m Ashleigh Banfield. Welcome to "Crime and Justice." Tonight curious

new details about the people who were connected to the gorgeous Pennsylvania teacher gunned down on her mother`s driveway. Like the young

man police are investigating who might had even younger than we thought, when his relationship began with Ms. DelTondo. Or like the sergeant who

showed up to that bloody driveway off duty and blew past the crime tape, Justin Freiman is covering this very strange web of characters. What do we

know tonight?

JUSTIN FREIMAN, SR. PRODUCER, HLN CNN: We`re now learning that that teen she was wasn`t caught in a car with she actually met him when she was

teaching in his elementary school. That is right. He was an elementary student way back then. That is when they first met each other. We are

also learning that certain people on the police force show up at the crime scene, are told to leave, but they don`t, possibly contaminating it.

BANFIELD: Wow, all right, a lot to get through there. Thank you, Justin. We will check in a moment.

Also tonight, more and more videos surfacing of that dermatologist doing unorthodox things in the O.R. Rapping, dancing, filming her patient`s semi

naked on the operating table. Now she is being sued by patients who claim she botched their surgeries. So what else will turn up on tape?

(BEGIN VIDEO CLIP)

(MUSIC PLAYING)

WINDELL BOUTTE, MEDICAL DIRECTOR, PREMIER DERMATOLOGY AND SURGERY: She is the brick house she is letting it all hang out

(END VIDEO CLIP)

BANFIELD: Plus, the woman whose story went viral after accusing a state trooper of sex assault. But the dash cam video was rolling and the truth

is on the tape. And now she is the one who could be charged. And later, talk about a close shave, a man crashes into a building and then still

makes it to his hair appointment in the hair salon next door. Why he acted like nothing was wrong.

First, though, I want to take you to Aliquippa, Pennsylvania, where a young teacher was shot dead on her mother`s driveway just after being dropped off

from a quick trip with friends for ice cream. But there are mysterious new details tonight about the friends that Rachel DelTondo went with. And more

specifically their family members, which could just lead police to Rachel`s killer.

Police are already investigating the little brother of the young man Rachel was out getting ice cream with that night, the little brother by the name

of Sheldon Jeter. And tonight we`re learning that Sheldon allegedly met Rachel when she was teaching at his elementary school. They were,

reportedly, on and off during his teen years. But Rachel`s mom is now saying he was obsessed with her. And even wanted to marry her, though his

lawyer insists that was not the case.

(BEGIN VIDEO CLIP)

MICHAEL SANTICOLA, SHELDON JETER JR.`S ATTORNEY: All you have to do is look at the phone records. I mean, there was no stalking going on. She

was contacting him as much as he was contacting her, because that is what friends do. You know, that there was absolutely none of that going on,

none.

(END VIDEO CLIP)

BANFIELD: While police execute search warrants on Sheldon Jeter`s house, and telephone, so far we`ve heard very little about an investigation into

one of their own in the police force, the father of the young lady who dropped Rachel off at that driveway where she was shot, right after they

all been out for ice cream. Because according to a police report, Sergeant Kenneth Watkins showed up at that bloody driveway, 20 minutes after the

shooting, even though he was off duty, and he refused to leave, reportedly, contaminating the evidence.

Joining me now, John Paul, founder and reporter of the Beaver Countian, a publication, also Randy Sutton, a retired police lieutenant, and Kenya

Johnson is a defense attorney. John Paul, if I could begin with you, there are a lot of new and unusual details about this. I think perhaps there are

the superficial and the salacious. And there are the factual investigative details which are critical, because we are talking about the murder of this

woman. The police officer who was off duty, and showed up at her murder scene, with his daughter in tow, describe for me what we are learning about

what happened and how other officers reacted to him.

JOHN PAUL, FOUNDER AND REPORTER, THE BEAVER COUNTIAN: OK. So I obtained from sources a copy of a letter that was drafted by Captain Robert Sealock,

who`s in the chain of command with the Aliquippa police department. That he wrote to the chief of the police department, it was a complaint letter

related to Sergeant Watkins, who as your viewers may remember, it was her - - his daughter who was in the vehicle and dropped Rachel DelTondo off the night of her murder. He actually arrived on scene with his daughter, and

rushed towards the tape when he arrived. Officers who were on duty yelled for him not to enter the scene, not to cross the police tape.

[18:05:30] Captain Sealock alleges that Sergeant Watkins did cross that tape on two separate occasions, and specifically Captain Sealock says that

Sergeant Watkins, quote, showed no respect for the crime scene, which the captain says is unacceptable. And the captain finishes that, quote, as

your captain it`s my determination that the scene could have been contaminated and Sergeant Watkins acted in an unprofessional manner,

unquote. I`ve also obtain a copy of an e-mail that the chief wrote in response to that letting City officials know that once the investigation

dies down and a suspect is arrested, that he would like to discuss issues related to Sergeant Watkins with officials in the community.

BANFIELD: And, you know, that scene was frenetic that night. And honestly, John Paul, the parents and the family members of Rachel DelTondo

came out of their home to see the carnage in the driveway. They were prevented from crossing that crime tape. And the officers, it seems to me,

felt as though they were successful in keeping family members out. They were frustrated that they couldn`t keep an off duty member of their own

police force out. Is that a correct characterization?

PAUL: That is exactly how Captain Sealock characterized the scene in his letter, yes.

BANFIELD: So, I guess the reasonable question would be, what was Sergeant Watkins doing there if he was not on duty that night? And why on earth

would he have brought his daughter to a murder scene given the fact that this would be horrendous for a 17-year-old minor?

PAUL: Those are very good questions, and they are both questions that I continue to try to get answers to in my reporting.

BANFIELD: And to be clear, that 17-year-old daughter had been with Rachel DelTondo four minutes before that shooting happened. She had been the

driver who dropped Rachel off on her mother`s driveway, four minutes before she was gunned down in a hail of bullets.

PAUL: And that is according to police in affidavits they filed seeking search warrants, correct.

BANFIELD: All right. Let`s move on to Sheldon Jeter. We are now learning, from an interview that you did with Rachel`s rather -- oh, yes,

Rachel`s mother that, indeed, Sheldon Jeter had a relationship with her daughter. She characterizes it as an obsession, that he had an obsession.

That he wanted to marry her, but what else does she say about the relationship?

PAUL: According to the mother, who I spoke to last week after her daughter`s funeral, along with several of Rachel`s friends I spoke with, it

seems that Rachel first met Sheldon sometime back in 2008, when she was serving as a permanent substitute teacher at the Aliquippa School District,

that Sheldon was attending at the time.

BANFIELD: Stop there for a moment. I`m just going to do some very quick math for our viewers. If it was 2008, that is ten years ago, and young

Sheldon, who`s very young in these pictures, who you have been 10. So she would have first met Sheldon Jeter, with whom his lawyer says they had a

romantic relationship that started at least when he was 16. She would have met him when he was 10.

PAUL: Yes. And it seems like he was somewhere around the third grade. I don`t exactly have pointed down exactly what year he would have been. She

-- also need to clarify that he wasn`t actually one of her students, but he attended the elementary school that she did and apparently she had

interactions with him at the school.

BANFIELD: So then, what does Rachel`s mother say happened, how did we go from he is a 10-year-old, she is a teacher, how did we go from that to his

lawyers saying they were romantically involved for years on and off, even when she was engaged to be married with someone she eventually broke it

off, a millionaire, planning this $10,000 wedding dress, and still, according to Sheldon Jeter`s attorney, having a sexual relationship with

this young man. And being caught in a steamy car with him two years ago when he was just 17.

PAUL: And this is where the two stories diverge. The family very much insists that this was not a sexual relationship, that she was something of

a mentor figure. Before Rachel died I had spoken to her at length, of course, and she related to me that this was not a sexual relationship.

[18:10:06] Certainly Sheldon is now saying, through his attorney, that it very much was. And certainly this had been something that was the focus of

police investigation prior to her death.

BANFIELD: It is all very odd considering the fact that she ultimately ended up dating this young man`s older brother named Rashawn, and the night

she died was out with Rashawn`s younger brother, the middle child, Tyrie and all of them are now part of the of the mix, so to speak. Being

questioned, there are subpoenas for phones, I believe that Sergeant Watkins` daughter`s phone, Sheldon`s phone, Tyrie`s phone have all been

sent to a lab. And there are new search warrants that have been issued for Facebook messaging. So, it was very, very curious.

I want to bring in Randy Sutton here. He is a retired police lieutenant. Randy, I need to read something for you that I think, is very disquieting

in my line of work. And that is, that one of your brethren, a retired Pennsylvania state trooper by the name of Wayne Kress had a lot to say

about what`s going on here with the Aliquippa police and this murder and the mess that seems to be a part of it, the police officer who`s now being

investigated, at least, or questioned, he is on leave, because he blew through the crime tape.

And this is what Wayne Kress had to say, the retired Pennsylvania state trooper. When asked if it was possible that the state police might take

over he`d say I would think they would be able to, especially with the known corruption in this county, and quite frankly, I wish the AG`s office

would come in and straighten things out here. I will say that Wayne Kress is in a political race. He wants to be sheriff. So there is that

potential dog in the fight, at least it could look that way. But what`s your perspective on this? And how do you sort of -- how do you qualify

this, Randy?

RANDY SUTTON, RETIRED LAS VEGAS METROPOLITAN POLICE OFFICER: Well, there is a lot more to this story. And beginning with the leak of the

information to begin with from back in 2016 when the police agency had an interaction where this teacher was found in a steamed up car with this

young man. Apparently there was an incident report that was done. There was no crime that was being investigated in relation to it. But there was

an investigative stop and there was a report made out. Well, apparently that report was leaked. So this is an issue, a major issue.

BANFIELD: One of many. Randy, one of many. In fact, Kenya Johnson, one of the biggest issues that, you know, regards the police might be this

notion that the crime scene may have been tainted by one of their own. Do you see that as a big deal?

KENYA JOHNSON, DEFENSE ATTORNEY: That is a very big deal. In the CSI age, forensics are very important. Every one of your viewers knows that you

cannot contaminate a crime scene, and how it can affect the evidence and the prosecution. So there`s certainly bit questions. And I want to know

if there`s any relationship with this police officer and the connection to the victim.

BANFIELD: Yes, no kidding. I want to know a lot more. I only scratched the surface. I have so many more questions. But I`m out of time. So, I`m

going to have you back. And we have to take a little deeper further on. John Paul, thank you, Randy Sutton, Kenya Johnson, I will ask you to stay

with me if you will.

More videos -- more videos have surfaced and they`re not the kind of videos that you expect to see. A doctor whooping it up during surgery. As the

doctor faces various malpractice suits, what do you think? Might these videos become exhibit a and b, and c, d, e, f, g, h, i, j, I could go on?

There could be a courtroom in her future next. We are going show you exactly what it was she is saying, doing, and why on earth she might have

done this.

[18:15:00] (COMMERCIAL BREAK)

BANFIELD: At first when you hear dancing doctor, kind of sounds fun, right? Especially with the name Dr. Boutte. Add in a little rap and some

singing and scrubs and it`s the kind of stuff that makes for YouTube gold. But cosmetic surgeon Windell Boutte might just have to stop making these

videos, at least the kind that she shoots with semi naked patients facedown and seemingly sedated.

(BEGIN VIDEO CLIP)

(MUSIC PLAYING)

BOUTTE: She is a brick house, she is mighty letting it all hang out she is a brick house --

(END VIDEO CLIP)

BANFIELD: Just so you know all that blurriness, we put that there, not the doctor. She let it all hang out online. The dancing doctor currently has

at least six patients who have sued her for malpractice with reported settlements in the millions. And multiple people saying that she botched

their jobs. And they`re holding her responsible for everything from their burns to brain damage.

[18:20:00] But we keep finding more and more of these bizarre videos. And today we`ve come across perhaps some of the most shocking. Though I have

to admit some of her bedside manner seems more professional outside of the operating room.

(BEGIN VIDEO CLIP)

BOUTTE: You know who I am, Dr. Booty boo, how do I get a consult with Dr. Boutte.

Well, it is very simple guys, email. If you come in for a BBL, a Brazilian butt lift by Dr. Boutte, you`re going to get results, you`re going to get

pronunciation, you are going to get annunciation, and you are going to get all kind of creation.

(END VIDEO CLIP)

BANFIELD: Whether or not her patients are happy with those results, they may not stay private, those results. They may just end up being a main

prop in one of Dr. Boutte`s videos.

(BEGIN VIDEO CLIP)

(MUSIC PLAYING)

Cut it, cut it, cut it --

(END VIDEO CLIP)

BANFIELD: OK. That is difficult. But I just need to explain to you, we had to blur it, but, again, when she puts it online, she doesn`t blur it.

It is a large piece of someone`s flesh that obviously seems to have been cut off from a person in the O.R. and it becomes a dancing prop.

Joining me now, Tina Douglas, a freelance investigative reporter, Chloe Dallaire is an attorney for patients of Dr. Boutte, and Rady Rahban, a

board certified plastic surgeon, also still with me defense attorney, Kenya Johnson. Thank you to all of you.

Tina Douglas, I thought when we talked about the story yesterday and we had a couple videos. That would be the end of it. Certainly the YouTube

videos weren`t up anymore, couldn`t find them from anybody other than an attorney for some victims. But now with a little searching, we found a

lot. We found more than we bargained for. It is very uncomfortable stuff. Is there more fallout from this today?

TINA DOUGLAS, FREELANCE INVESTIGATIVE REPORTER: Well, the fallout is these videos keep coming. And I know a lot of people who have been watching your

show are trying to figure out, you know, the purpose of this all. And what we can surmise is that, you know, Dr. Boutte is trying to attract business.

We know that --

BANFIELD: But she is showing people naked. I mean, I want to be clear, again, that blurriness we put on there out of respect for these patients.

The videos that are posted online are completely un-blurred, and their nudity is clear for all to see.

DOUGLAS: Well, it appears as though the doctor is clearly getting a big rush out of all of this. And you wonder if her motivation is monetary.

She is a dermatologist. But in the state of Georgia, as we know, doctors with a physician behind their name or in front of their name can also

perform surgery.

BANFIELD: So Tina, do you know about the consent forms? There`s some talk about some of the patients signing consent forms to appear in videos. Do

we know if those consent forms -- first of all, do we know much about them? If so, if the consent forms say, and is it OK to show you naked?

DOUGLAS: Well, you know, some cosmetic surgeons want to film their work, because it helps to attract other people who want the same type of surgery.

So many of patients do sign consent forms. They`re probably signing them unaware that they will be used in this fashion.

BANFIELD: Right. I get it if you want to show other clients in the privacy of an office here are some of the results and here`s the procedural

aspect of it. But to broadcast it on, you know, flip-o-gram and YouTube with full nudity without any respect for the privacy of that patient`s body

parts, to be dancing with chunks of flesh that, you know, are three feet long in some circumstances is just -- it`s beyond the pale, it would seem

to me. I want to show one of these aspects which might shed some light on the consciousness of the patient and the ability of the patient to know

what`s going on. Or actually maybe not, because in certain parts of the video the patient seems aware and a willing party, and in other parts of

the video, I can`t be so sure. Have a look.

(BEGIN VIDEO CLIP)

BOUTTE: A patient right here you all, she gave me a special request. OK. We did her Brazilian butt lift today. And what`s your requested song?

UNIDENTIFIED FEMALE: Shake what your mama gave you.

BOUTTE: Woot, woot. Shake what you mama -- you wanted to bring back old school?

UNIDENTIFIED FEMALE: One more time.

BOUTTE: All right. She asked me to give her a strip of butt, once more. OK, let us do one more time.

UNIDENTIFIED FEMALE: Yes, ma`am.

BOUTTE: OK, here we go.

UNIDENTIFIED FEMALE: Shake what you mama gave you. Shake what you mama gave you.

(END VIDEO CLIP)

[18:25:00] BANFIELD: Yes, so we, again, altered the patient`s voice. That was a woman. We altered the voice. But on the internet, clear as a bell,

anybody could identify that voice and her nudity was altered by us, not by the doctor who published that on flip-o-gram. The doctor is still

accepting appointments. We called today and still no problem if you want to get in on Wednesday. There`s still no issue there it seems. Chloe

Dallaire, how is that possible with all of these videos out there? I mean, morally to me it doesn`t seem right. Legally, and professionally, can you

still be practicing if you`re doing this kind of thing?

CHLOE DALLAIRE, ATTORNEY FOR PATIENTS OF DR. BOUTTE: Unfortunately, in Georgia, you can, and Ashleigh since this story was broken open by Jim

Strickland, I`ve had a number -- a number is an understatement. I`ve had multiple calls about patients not only concerned about whether they have a

legal suit, but wanting to get out of future surgeries. And unfortunately, the financial policy in Dr. Boutte`s contracts make it virtually impossible

for a client to get a refund or their money back. So I`d be surprised if even under these circumstances Dr. Boutte was giving these folks a refund

even though they should be entitled to one.

BANFIELD: And to be really clear the embarrassing aspects of having naked patient`s buttocks clear as day and their voices clear as day, I have no

idea what level of sedation they were in or if they were in any at that juncture, but I will say this, this Christmas video that I`m about to show

you is deeply troubling, because it is truly a decorated video with Christmas lights and a hunk of flesh as the main prop in the enjoyment of

this surgery team. Have a look.

(BEGIN VIDEO CLIP)

(MUSIC PLAYING)

(END VIDEO CLIP)

BANFIELD: And I need to remind our viewers, the blurring is all ours. Online, clear as day what is going on, that large piece of flesh likely

having been removed from a patient, part of the Christmas video. Dr. Rahban, as board certified plastic surgeon, you reaction to that?

RADY RAHBAN, BOARD CERTIFIED PLASTIC SURGEON: Well, I got to tell you this. This whole things is outrageous. But sadly it is quite common. And

I think, I was --

BANFIELD: Wait, what, common?

RAHBAN: This is very common. Yes. This is very common, I was involved in a similar situation not too long ago. Listen, the world of plastic surgery

is becoming ever, ever more so complicated for patients because the --

BANFIELD: Which part is common, the fact that she says she is a dermatologist and performs all these incredible, you know, very difficult

and intricate procedures, these surgical procedures or the fact that she is dancing on video with a hunk of flesh in the O.R. during an operation? Are

you saying that is common?

RAHBAN: To be honest with you, it`s all common.

BANFIELD: What?

RAHBAN: Number one, the fact that she is not trained, what we would refer to as a crossover doctor is totally normal now. Patients go in thinking

that their doctor is a plastic surgeon, board certified, little do they know they`re a dermatologist, OBGYN.

BANFIELD: Let me get to that in a minute. Because, that is a very fair point. And I definitely want to cover that. But go back to what I just

said, you`re saying this is common?

RAHBAN: Yes.

BANFIELD: Because, I have never seen this before.

RAHBAN: Yes.

BANFIELD: I have never seen a surgeon in an O.R. posing with pieces of flesh, showing the nudity of their patients and singing "Brick house" over

it like it`s some kind of video and then posting it publicly. I have not seen that before. How can you say that is common?

RAHBAN: OK. So, listen, this is obviously a much greater or more egregious version of it. But if you are on Snapchat, today, the whole

world of cosmetic surgery is who`s more sensationalized? Whether, who can create more shock and you know, excitement? So you go to Snapchat, there

are Doctors are snap chatting, people posting to Instagram, there is Facebook live.

Listen, it`s a great tool if patients are being educated, respected, physicians are acting professionally. But as you can see in this video and

many more it`s just a show. And what it does is it attracts sort of -- it`s like sort of barn and bailey`s. What it`s doing is it`s attracting

sort of the -- I don`t know, the vulnerable patients. You and I look at this --

BANFIELD: I can`t imagine how this is marketing. Honestly, if you see this, do you want to be that person?

RAHBAN: She is busy.

BANFIELD: Some people, according to Chloe, you know, want to pull out now that this has been publicized. Actually, that is something I want to ask

you about, Chloe. You have a client who was a patient of Dr. Boutte, and I`m not making up that name. That is how she pronounces her name, Boutte,

but sometimes she says I`m Dr. Booty boo. Your client went in for Smart lipo, and 30 days in the hospital. She got flesh eating bacteria. She

was, according to the facts that you present, she was not told to refrain from eating or drinking after midnight and she vomited on the operating

table. And thinks that may have been part of the reason she got the flesh- eating bacteria. How is that patient doing now?

CHLOE DALLAIRE, ATTORNEY FOR PATIENTS OF DR. BOUTTE: She`s doing okay. Thankfully she recovered fairly well. But she was fighting for her life for

30 days. And whatever the cause of the surgery she went in to look beautiful, and she ended up not only scarred, but fighting for her life.

And unfortunately that`s not the only story we hear.

Susan Witt was on yesterday and had a brain damaged patient. So these ladies are coming in to be beautiful, to feel better about themselves, and

they`re coming out and sometimes fighting for their lives. That`s just not right.

BANFIELD: Well, I`ll tell you what, we`re going to take a quick break. When we come back, Dr. Rahban, I`m going to ask you to look at a video. We

can play it out to break so that we can all sort of digest this over the break.

There is a patient on the table, face down, nudity showing, the buttocks we blurred out, but what was the most disturbing perhaps part of that was that

I could hear labored breathing. Very, very heavy breathing.

So I want you to listen to this as we go out to break. I am going to ask you to analyze what you think might be happening on the other side of the

break.

(BEGIN VIDEO CLIP)

WINDELL BOUTTE, PLASTIC SURGEON: Muscles are not quite toned. OK, so you know it`s almost Christmas, and the built the butt workshop is -- man, we

are doing it, OK? Today --

(END VIDEO CLIP)

[18:35:00] (COMMERCIAL BREAK)

BANFIELD: We are still talking about Dr. Windell Boutte, the singing and dancing surgeon with at least twice as many YouTube videos as malpractice

lawsuits.

The question tonight, however, is whether the shocking content that we have uncovered yesterday and even more today could end up being used against her

in a court of law. And may I just say that we have blurred some of the more sensitive material in these videos. But the doctor sure didn`t.

(BEGIN VIDEO CLIP)

BOUTTE: Butt, butt, butt. This is something awesome. She`s a brick house. She`s a mighty, mighty. She`s letting it all hang out. She had the apple

bottom G`s. She has the whole club looking at her. Boom. Look at you. Jiggly, jiggly, jiggly. Got three big donuts.

I definitely will make them. My patients are bad and boujee. Building up fat in the booty. My patients are snatched with big booties. We got tummy

tucks and BBLs too. Woo, woo, woo! Yeah, yeah, yeah.

(END VIDEO CLIP)

BANFIELD: And by the way, the panel is back with me. Those videos were not leaked. Let`s just be real clear, these were posted as part -- this was a

plan. Dr. Boutte posted these. She introduces herself. These are what she wanted to have out there online, nudity and all, chunks of flesh and all.

I am going to say this about some who have come to her defense. Some patients have praised Dr. Boutte. Some have said in online reviews, she`s

lovely to work with, although we were contacted by someone who claimed to be a former colleague of hers from 10 years ago saying she was

unprofessional and greedy.

Someone else said that Dr. Boutte gave her her life. Another saying, I`m happy with the results. Dr. Boutte has an excellent background. She

graduated from UCLA School of Medicine. She`s been licensed since 1994, a quarter century of work. She says she`s a doctor to the stars. We`re not

exactly sure what stars.

What`s uncomfortable, Dr. Rahban, is that labored breathing. We went out to break showing a patient who seemed to be heavily sedated while there was a

show going on around her, and the breathing was so pronounced. I want to play a little bit more of it and get your reaction to it on the other side.

(BEGIN VIDEO CLIP)

BOUTTE: All right, we`re --

(HEAVY BREATHING)

BOUTTE: -- halfway through with our Boutte built a butt workshop day.

(HEAVY BREATHING)

BOUTTE: And here you can see this side is not done yet.

(HEAVY BREATHING)

BOUTTE: It`s still flaccid.

[18:40:01] Muscles are not quite toned. OK, so you know it`s almost Christmas, and the built the butt workshop is -- man, we are doing it, OK?

Today, we probably done about three booties. I would say a Jessica Rabbit, a Nicki Minaj, and just a corporate contour right here. As you can see --

(HEAVY BREATHING)

BOUTTE: -- baby got back now, OK?

(END VIDEO CLIP)

BANFIELD: Doctor, the breathing really upset me, but I`m not a doctor.

RADY RAHBAN, BOARD-CERTIFIED PLASTIC SURGEON: Right. Well, I mean, everything about this upsets me and I am a doctor. You know, she`s

breathing like that because she`s under conscious sedation. The thing that`s most troubling to someone who operates in a certified accredited

environment is that this is like an office room converted into procedure room.

So because she`s a dermatologist, she`s not doing this in a bonafide accredited surgery center because she won`t get privileges.

So, aside from the labored breathing which means that she`s sedated heavily, you know, you can hear the beeping in the background of the

monitors, but the fact that she`s so distracted, there is no anesthesiologist present, she`s breaking all sterile protocol by moving her

hands behind her back.

None of the things that you`ve presented in terms of the horrific outcome surprises me. You know what I mean? There is nothing about this that

surprise me --

BANFIELD: By the way, that sterile protocol, you just mentioned, she not only puts her hands behind her back, she puts them below her waist, which

is apparently against protocol. She touches her face.

RAHBAN: Everything.

BANFIELD: She uses a surgical instrument as a horn during "Brick House."

RAHBAN: I mean, so none of these things are surprising. If a horse has stripes on it, it`s a zebra. And the fact of the matter is that the singing

and dancing in and of itself is problematic to the layperson. But it`s all the medical stuff that is overlooked during the time that she`s dancing

around.

BANFIELD: You know, one of Chloe`s patients vomited on the table but has no recollection of that. So will these patients all wake up and have no

clue any of this happened with the kind of sedation they`re under?

RAHBAN: It depends. You can tell that it`s not very well monitored. And conscious sedation is a really, really tricky type of anaesthesia. It turns

out that conscious sedation is responsible for a lot of the deaths in the United States. People think general anaesthesia is dangerous.

But if you get general anaesthesia, you have an anesthesiologist, your airway is protected, and you`re under a lot of monitoring. Conscious

sedation is how people like Joan Rivers died and other people because as you can see, you give her some drugs, there`s a nurse there, and there is

no way to protect her airway.

So when she vomited, she aspirated it. So if she`s slightly deep, she`ll feel it. If she`s really deep, she won`t remember it. And no one knows what

they`re doing.

BANFIELD: Let me get Kenya Johnson in here. As a defense attorney, another interesting aspect to this, Kenya, is that she`s got two ORs going at the

same time, that I have heard of before, maybe that`s not necessarily cause for all of the alarm, but there`s got to be a defense for this woman. What

is it?

KENYA JOHNSON, DEFENSE ATTORNEY: It would be that there could have possibly been a consent form. These are promotional videos and certainly a

sign of the times. Lilburn, Georgia is about an hour outside of Atlanta, the new Hollywood of the south. People are wanting to be discovered. These

plastic surgeons are personalities.

Without naming any names, people are looking for these personalities that have been on television. And so I bet to venture that some of the patients

actually were drawn to her because of these videos. They`re looking for doctors that are lighthearted and fun and enjoy their job. And some may

have even asked to be a part of the video.

BANFIELD: I can`t imagine that. I`m just saying I don`t know a lot of women who would like their naked butts being flashed around the screen like

that, nor a chunk of their former butt being dragged through the screen. I have to drop it there, guys. Thank you so much. Tina Douglas (ph), Chloe

Dallaire, Rady Rahban, thank you.

Kenya, I`m going to ask you to stick around for me, because I have a story near and dear to my heart, woman pulled over for an alleged DUI says the

arresting officer raped her. Little did she know the camera was rolling. And wouldn`t you know it? That camera doesn`t lie.

[18:45:00] (COMMERCIAL BREAK)

BANFIELD: It`s easy to see how it went viral with words like groping and threatening and sexual assault in the headline. And the alleged

perpetrator, a Texas state trooper. He pulled a driver over south of Dallas who was suspected of driving drunk.

And that`s where Sherita Dixon-Cole said he assaulted her, even allegedly offered to let her off the hook if he could just have sex with her. Sherita

Dixon-Cole went to the hospital later that night, as so many sex assault victims have done before.

And all this week, the only story we`ve known is her terrifying story. But as it turns out, the whole thing was caught on police cameras. And as that

turns out, there was nothing terrifying at all about it.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE (voice-over): When I activate my emergency lights, you pull over, OK? You don`t keep going for another three, four miles.

[18:50:01] Let me see your driver`s license and insurance. How much alcohol did you consume this evening?

SHERITA DIXON-COLE, ARRESTED AND CHARGED WITH DWI: One drink.

UNIDENTIFIED MALE (voice-over): Just one?

DIXON-COLE: Yes.

UNIDENTIFIED MALE (voice-over): What was it?

DIXON-COLE: Vodka pineapple.

One thousand seven, 1008 --

UNIDENTIFIED MALE (voice-over): You`re being placed under arrest for driving while intoxicated. I need you to face toward -- keep facing towards

my car.

DIXON-COLE (voice-over): What did I do that was wrong?

UNIDENTIFIED MALE (voice-over): Driving while intoxicated.

DIXON-COLE (voice-over): I`m not drunk.

UNIDENTIFIED MALE (voice-over): Based on my observations, both of your driving, your behavior and field sobriety test --

DIXON-COLE (voice-over): I think it was a combination of me being on the phone with someone.

UNIDENTIFIED MALE (voice-over): You can have a seat on one of those chairs. That should be a lot better. All right, deep breath.

UNIDENTIFIED FEMALE (voice-over): Please blow long and steady.

UNIDENTIFIED MALE (voice-over): Keep on going, keep on going, keep on going.

(END VIDEO CLIP)

BANFIELD: And soup to nuts, that`s what happened. Everything in between was pretty much what you just saw. Even her lawyer has apologized, saying

it didn`t happen. And that officer was just cleared of all wrongdoing with his department calling the accusation despicable.

Meanwhile, Sherita Dixon-Cole was officially charged with DUI and there certainly could be a few more charges to come. And I spent a little time

thinking this one over today and I`ve written an open letter to her.

Dear Sherita, you`re not helping. If you hadn`t noticed, the rest of the country is wrenching and turning and churning through a movement that when

resolved may just yield a lot of sunshine and goodwill among men and women who are all just trying to get along.

Your false accusation of rape against that cop, your viral cry wolf just brought a dark cloud to our national therapy session. And your category

five damage is not covered by insurance. While you were busy with your twisted rape lie, this was actually a really rough day for a lot of people.

Harvey Weinstein and his accusers may have to ready themselves for sex crime charges any minute now. And Americans who have loved and trusted

Morgan Freeman were hit with allegations that he, too, may have broken the "Me Too" code.

And when guys like Tom Brokaw and George Bush end up in that mix, it takes the wind out of a lot of people who have loved them deeply for a very long

time. And they`re not sure how to process all this news. And sometimes they`re struggling to choose what side to be on.

We are all trying to figure out this tangled mess together. And scorched earth is not the way to do it. If you cheer the demise of men before you

hear out the actual evidence, you`re not helping. And if you cast aspersions on the accuser, simply because you like the accused, you`re not

helping.

What we need is an honest conversation and a little more understanding about how men and women treat each other in the workplace and everywhere

else and how times and attitudes have changed over the years.

Today`s prism is different than the one the greatest generation looked through. And that has to enter the equation. And to be successful in

bringing us all to the same looking glass, hoisting a burning pitchfork, not helping. Yelling louder than your neighbor, not helping. Crying wolf,

well, that just scatters the flock. And it sends a lot of lambs to the slaughter. We`ll be right back.

[18:55:00] (COMMERCIAL BREAK)

BANFIELD: An Illinois man apparently won`t let anything get between him and a haircut. The 80-year-old man was on his way for a trim and

accidentally crashed into the seafood store next door while trying to park. So this way most of us probably put off the haircut, right, for a while.

Nope, not this guy.

He walked right into the salon next door on time, had the haircut. Police say he`s a diabetic and that might be what caused him to hit the gas

instead of the brake. Luckily, no one hurt. Police say the man won`t be facing charges, but he will be retested for his driver`s license.

[19:00:03] Makes for great picture too. Next hour of "Crime and Justice" starts right now.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE (voice-over): A beautiful, young woman gunned down, right after being dropped off at mom`s.

UNIDENTIFIED MALE: She ended up texting Rachael saying I`m going to come back and pick you up even though she just dropped her off.

BANFIELD: But could the clue to her killer lie in the mysterious cast of characters who knew her.

UNIDENTIFIED MALE: There`s a lot of twists and turns and a lot of rumors.

BANFIELD: What do police know about on again off again lover this teacher met while he was still in elementary school?

UNIDENTIFIED MALE: He is afraid to walk out in his house right now. Just want to put this thing behind him.

BANFIELD: Why did an off duty cop blow past the crime tape? Did he contaminate the murder scene?

The name on her medical license is Dr. Boutte. But in the operating room - -

UNIDENTIFIED FEMALE: You know who I am, Dr. Booty boo --

BANFIELD: She`s all about the booty.

Now dozens of videos we`ve found online could come back to haunt her in court because they feature patients who are naked, seemingly sedated,

facedown, and on cam. And some of her patients say she botched their surgeries.

(END VIDEOTAPE)

BANFIELD: Good evening. I`m Ashleigh Banfield. Welcome to the second hour of CRIME & JUSTICE.

Tonight, the hunt continues for a killer, whoever it was who gunned down Rachael Deltondo, that beautiful young teacher from Pennsylvania, right

after she was dropped off at her mom`s house on mother`s day. And it turns out the people closest to this victim may end up being the people who could

lead to her killer.

Because Rachael had been out getting ice cream with a couple of friends that night, a couple of friends who had family members that police are

currently investigating, like the little brother of the young man Rachael was with that night, the little brother she had been dating on and off

since, well, he was really kind of maybe too little.

Tonight, we are hearing that little brother, Sheldon Jeter, might have been obsessed with Rachael, that he even wanted to marry her. And Sheldon may

be a 20-year-old man today, but Rachael`s mom says he first met Rachael when she was a teacher at his elementary school. And police have had

Sheldon on their radar since he was 16 when a certain sergeant caught him and Rachael in a steamy car one night.

That sergeant, and here`s where it gets complicated, is the father of Rachael`s other ice cream pal, the woman, the young girl, the 17-year-old

who dropped Rachael off after that ice cream night. But she came back to Rachael`s house, 20 minutes after she dropped her off, and with her, her

off duty cop dad. That was just after Rachael had been shot to death. And that`s also when that off duty dad, the sergeant Kenneth Watkins, the same

guy who caught Rachael in the steamy car, reportedly blew past the crime scene tape, possibly contaminating the evidence of that murder, completely

ignoring orders from his fellow officers, the responding officers, which gets extra weird when you learn that a search warrant was just executed on

his wife`s Facebook account.

(BEGIN VIDEO CLIP)

MICHAEL SANTICOLA, SHELDON JETER JR.`S ATTORNEY: This is the wife of the police officer who was on scene, you know, off duty, and we believe

contaminated the scene. That was the officer that was -- that caught Ms. Deltondo and my client in a car when he was a minor and didn`t report it.

And the Watkins obviously daughter was the last person we know that saw her alive, other than the killer. So it`s very interesting that now they are

looking at that Facebook. They must have some reason to believe that there was something posted on Facebook or removed from Facebook by this

individual that sheds light on what happened. I hope it`s not incriminating to her, certainly.

(END VIDEO CLIP)

BANFIELD: Joining me now, John Paul, who is the founder and reporter of "The Beaver Countian" publication. Randy Sutton is a retired police

lieutenant. And Kenya Johnson is a defense attorney.

Got a lot of questions for all of you, but not before I put up a flowchart of who these people are, and how they are connected, particularly to the

victim. And the first one is Rachael and the three brothers. So what`s intriguing about this is that Rachael is connected to the young man on the

right, Sheldon Jeter, because of that steamy car they were caught in when he was 17, a couple years ago. And his lawyer said it isn`t just that one

incident. They had that ongoing relationship, on again and off again, since before he was 17, maybe 16. She met him when he was about 10 at his

elementary school where she was a sub-teacher. But the more intriguing aspect of it might be the name way over on the left, Rashawn Bolton, might

be a different last name. But make no mistake, he and Sheldon are brothers. Rashawn is Sheldon`s big brother. And Rachael was dating him

too. The one in the middle is the middle brother Tyrie. We have not heard one lick about Rachael dating Tyrie, but we do know Tyrie was with him the

night that she died. He was on the ice cream date with the cop`s daughter. The cop`s daughter who is 17. The cop`s daughter who came back to the

murder scene with her dad and made for a very confusing evening.

So if we go to the next flowchart, it connects the other players. Rachael Deltondo, of course, was with Tyrie, the name below her, the middle

brother, but she`s also connected to Sergeant Kenneth Watkins. He was the one who showed up a couple years ago at that steamy car where she was with

the young Mr. Jeter, Sheldon Jeter. Kenneth Watkins has a wife named Stephanie. And her face book records have just been subpoenaed. They have

a daughter, we are not naming her, she`s 17, but she`s the Watkins daughter. Her records have been subpoenaed too. And she was out for ice

cream with Rachael and Tyrie.

So now that we have the players, what about what`s playing out?

At this point, John Paul, it`s very, very complicated. But today, more search warrants, what are they looking for?

[19:06:55] JOHN PAUL, FOUNDER/REPORTER, THE BEAVER COUNTAIN (on the phone): Yes. There is multiple more search warrants it looks like that went out a

couple days ago. They were just getting returned to the (INAUDIBLE) office hear in Beaver County. And it looks like more Facebook records. Looks

like they are looking for Facebook records from -- and other what we call geo-location records from multiple other players involved in this,

including that Tyrie, Sheldon, and also Rachael`s ex-fiance.

BANFIELD: So what I have here, and I don`t even know I assure you this isn`t a complete list. And I sure you it probably isn`t because, you know,

this is an investigation. Sergeant Watkins daughter`s Facebook records have been subpoenaed. Her mom`s Facebook, that daughter`s mom`s Facebook,

Watkins` wife, those accounts, there is a warrant for them. Warrants were out also for the daughter`s cell phone records as well as Sheldon Jeter`s,

that 17-year-old, originally caught in the car, the steamy car, who is now 20, on again, off again relationship, met her when he was 10, his phone

also off to the lab. Tyrie, his older brother, the middle brother, who was out for ice cream, his cell phone off to the lab as well.

John Paul, why is all of this public? Why isn`t this all under seal? There`s a murder.

PAUL: That`s a question that law enforcement has been asking locally from the beginning. As a reporter my job is to try to get as much information

that I can and get it out to the public. And it had been very easy to get this information because the search warrants are being returned to the

magistrate`s office completely unsealed. We were able to get them, along with the affidavits officers were able to substantiate them and we were

able to report those publicly. Within the last day, the now -- the prosecution has asked a judge and supposedly from this point forward all

search warrants issued are going to be under seal. So we will not be getting details of them.

BANFIELD: So it`s going to get trickier and trickier, right?

PAUL: It will be. The other thing I can say, that`s important at this point, related to these last rounds of search warrants, I`m hearing from my

law enforcement sources this is what they are calling tying up loose ends. Some of it, they are using to validate alibis for people that they already

have information that substantiates. It`s a high profile case. And my understanding that the district attorney`s office is being as thorough as

they can be with everyone that is involved or could have appeared to have been involved in this case.

BANFIELD: All right. Well, the district attorney in this case, his name is David Lozier. He has been on the job for a couple years and he had a

couple of things to say about the effort that they are putting in to solving this case. Have a listen to what he said.

(BEGIN VIDEO CLIP)

DAVID LOZIER, BEAVER COUNTY DISTRICT ATTORNEY: We are working with every resource we have with the Pennsylvania state police, the district

attorney`s office, the detective bureau, to investigate this case, to tie up every detail.

We are investigating everyone that was driving around Aliquippa that night that was anywhere near this young lady`s house. We are getting video

cameras, we are downloading information, we are interviewing witnesses, we are doing everything we can.

(END VIDEO CLIP)

[19:10:00] BANFIELD: And maybe doing everything they can, but there is at least one man who thinks that they shouldn`t be the ones doing the work.

In fact, there is a retired Pennsylvania state trooper, lives in this area, his name is Wayne Kress and he is on record as saying this should be a job

for the state police by this point. And he makes some pretty strident accusations as to why.

But here is what he had to say when asked if he thought it might actually happen, if the state police would have to swoop in and take over for the

locals. He said, I would think they would be able to, especially with the known corruption in this county, and quite frankly, I wish the AG`s office

would come in and straighten things out here.

That`s strong language, Randy Sutton, as a retired police lieutenant, I want you to weigh in on our fellow brethren there. He has got a dog in the

fight. He is running for sheriff. So I don`t know if that plays into it. But do you think at this point with what we just heard happened at the

scene, an officer off duty swooping in under the crime tape and having to be shooed by fellow officers several times, an allegation of contamination,

letters going back and forth from the captain on duty that night to the police chief saying, for God`s sake, the murder scene was compromised. And

then this allegation of corruption. Is this the kind of thing where the state police should do what the state trooper is saying, swoop in and take

over?

RANDY SUTTON, RETIRED POLICE LIEUTENANT: To tell you the truth, I think that would be an appropriate thing at this point.

Remember, this is a very small town, very small police department. I think they have 12 police officers. Investigating a homicide, investigating a

murder is very, very complicated. It requires a tremendous amount of skill and expertise. And in reality, you know, small police agencies don`t have

that expertise. They usually assist a larger agency that does have it.

Now, there`s also been issues with search warrants being served on the municipality itself because of financial issues. This issue with the off

duty sergeant, that`s going to play out in a personnel complaint that will be -- that`s clearly been lodged against him. And, of course, he had no

business being in that crime scene. You know, I want to make a prediction here, though, Ashleigh.

BANFIELD: Go for it quickly.

SUTTON: This crime will be solved.

BANFIELD: You think so?

SUTTON: I do. I do.

BANFIELD: It won`t be solved by me. And I will tell you why. Because our office, we have got an amazing staff of dogged producers who have been

calling the Aliquippa police department every day for a week. And you will not believe the response that we have been getting.

Every single day, we get the same response, I`m sorry, the chief is not in the office today, every single day. I`m sorry the chief is not in the

office today. And then it got to a shouting. The response from the person who answered the phone in a shouting tone was that we are not giving any

information to anyone at this time. Whatever information is floating out there is not coming from us. We are not concerned about what people say.

We are only concerned about solving this homicide. You, everyone keeps calling about this, and we are not releasing any information until this

homicide is solved. I am not interested in hearing your questions. Kenya Johnson, I understand when an investigation is ongoing, typically we

hear thank you for your inquiry. We are not at liberty to discuss that. It`s under investigation. But that, doesn`t that surprise you?

KENYA JOHNSON, DEFENSE ATTORNEY: It does surprise me. But I can see why they would be pretty guarded. Criminal investigators and police

departments have to take their victims how they come, for good and for bad. As this investigation progresses, I would have a hunch that more

information is going to come out that the victim herself was involved in a very dangerous mix of lies and murder.

BANFIELD: We`ll have to see, that`s difficult, that`s tough.

JOHNSON: If there`s any wrongdoing on her part, that wreaks havoc on the prosecution.

BANFIELD: I have got to leave it there. Kenya Johnson, thank you. Stay with me.

Randy Sutton, thank you as well John Paul.

More video surfacing of a doctor whooping it up during surgery as a doctor faces malpractice. So it could these become evidence?

(COMMERCIAL BREAK)

[19:18:53] BANFIELD: At first when you hear dancing doctor, kind of sounds fun, right? Especially with the name Dr. Boutte. Add in a little rap and

some singing and scrubs and it`s the kind of stuff that makes for You Tube gold. But cosmetic surgeon Windell Boutte might just have to stop make

these videos, at least the kind she shoots with semi-naked patients faced down and seemingly sedated.

(VIDEO CLIP PLAYING)

BANFIELD: Just so you know all that blurriness, we put that there, not the doctor. She let it all hang out online. The dancing doctor currently has

at least six patients who have sued her for malpractice with reported settlements in the millions. And multiple people saying that she botched

their jobs. And they are holding her responsible for everything from their burns to brain damage.

But we keep finding more and more of these bizarre videos. And today we have come across perhaps some of the most shocking. Though I have to admit

some of her bedside manner seems more professional outside of the operating room.

(BEGIN VIDEO CLIP)

[19:20:28] UNIDENTIFIED FEMALE: You know who I am, Dr. Booty boo, how do I get a consult with Dr. Boutte?

UNIDENTIFIED FEMALE: If you come in for a BBL, a Brazilian butt lift with Dr. Boutte, you are going to get results. You are going to get

pronunciation. You are going to get annunciation. You are going to get all kind of creation.

(END VIDEO CLIP)

BANFIELD: But whether or not her patients are happy with those results, they may not stay private, those results. They may just end up being a

main prop in one of Dr. Boutte`s videos.

(VIDEO CLIP PLAYING)

BANFIELD: OK. That`s difficult. But I just need to explain to you, we had to blur it, but, again, when she puts it online, she doesn`t blur it.

It is a large piece of someone`s flesh that obviously seems to have been cut off from a person in the OR and it becomes a dancing prop.

Joining me now, Tina Douglas, a freelance investigative reporter. Chloe Dallare is an attorney for patients of Dr. Boutte, and Rady Rahben is a

board certified plastic surgeon. Also still with me, defense attorney Kenya Johnson.

Thank you to all of you.

Tina Douglas, I thought when we talked about the story yesterday and we had a couple of videos. That would be the end of it. Certainly the You Tube

videos weren`t up anymore. Couldn`t find them from anybody other than an attorney for some victims. But now with a little searching we found a lot,

more than we bargained for. And it is very uncomfortable stuff. Is there more fallout from this today?

TINA DOUGLAS, FREELANCE INVESTIGATIVE REPORTER: Well, the fallout is that these videos keep coming. And I know a lot of people who have been

watching your show are trying to figure out, you know, the purpose of this all. And what we can surmise is that, you know, Dr. Boutte is trying to

attract business. We know that --

BANFIELD: But she is showing people naked. I want to be clear, again, that blurriness we put on there out of respect for these patients. The

videos that are posted online are completely un-blurred, and their nudity is clear for all to see.

DOUGLAS: Well, it appears as though the doctor is clearly getting a big rush out of all of this. You wonder if her motivation is monetary. She is

a dermatologist. But in the state of Georgia, as we know, doctors with a physician behind their name or in front of their name can also perform

surgery.

BANFIELD: So do you know -- Tina, do you know about the consent forms? I mean, there`s some talk about some of the patients signing consent forms to

appear in videos. Do we know if those consent forms -- first of all, do we know much about them? And if so, if the consent forms say, and is it OK to

show you naked?

DOUGLAS: Well, you know, some cosmetic surgeons want to film their work because it helps to attract other people who want the same type of surgery.

So many of patients do sign consent forms. They are probably signing them unaware that they will be used in this fashion.

BANFIELD: Right. I get it if you want to show other clients in the privacy of an office here are some of the results and here`s the procedural

aspect of it. But to broadcast it on, you know, flip-o-gram and You Tube with full nudity without any respect for the privacy of that patient`s body

parts, to be dancing with chunks of flesh that, you know, are three feet long in some circumstances is just -- it`s beyond the pale, it would seem

to me.

I want to show one of these aspects which might shed some light on the consciousness of the patient and the ability of the patient to know what`s

going on or actually maybe not. Because in certain parts of the video the patient seems aware and a willing party, and in other parts of the video, I

can`t be so sure. Have a look.

(BEGIN VIDEOTAPE)

UNIDENTIFIED FEMALE: A patient right here you all, she gave me a special request. We did her Brazilian butt lift. What`s your requested song?

UNIDENTIFIED MALE: Shake what your mama gave you.

UNIDENTIFIED FEMALE: Bring it back old school?

UNIDENTIFIED MALE: One more time.

UNIDENTIFIED FEMALE: She asked me to give it to her once more. One more time, right?

UNIDENTIFIED MALE: Yes, ma`am.

UNIDENTIFIED FEMALE: OK, here we go. Shake what your mama gave you

(END VIDEOTAPE)

[19:25:05] BANFIELD: Yes, so we, again, altered the patient`s voice. That was a woman. We altered the voice. But on the internet, clear as a bell,

anybody could identify that voice and her nudity was altered by us, not by the doctor who published that on flip-o-gram.

The doctor is still accepting appointments. We called today and still no problem if you want to get in on Wednesday. There`s still no issue there

it seems.

Chloe Dallare, how is that possible with all of these videos out there? I mean, morally, to me it doesn`t seem right. Legally, and professionally,

can you still be practicing if you`re doing this kind of thing?

CHLOE DALLARE, ATTORNEY FOR PATIENTS OF DR. BOUTTE: Unfortunately, in Georgia, you can. And Ashleigh since this story was broken open by Jim

Strickland. I have had a number -- a number is an understatement. I have had multiple calls about patients not only concerned about whether they

have a legal suit, but wanting to get out of future surgeries.

And unfortunately, the financial policy in Dr. Boutte`s contracts make it virtually impossible for a client to get a refund or their money back. So

I would be surprised if even under these circumstances Dr. Boutte was giving these folks a refund even though they should be entitled to one.

BANFIELD: And to be really clear the embarrassing aspects of having naked patients` buttocks clear as day and their voices clear as day. I have no

idea what level of sedation they were in or if they were in any at that juncture. But I will say this. This Christmas video that I`m about to

show you is deeply troubling because it is truly a decorated video with Christmas lights and a hunk of flesh as the main prop in the enjoyment of

this surgery team. Have a look.

(VIDEO CLIP PLAYING)

BANFIELD: And I need to remind our viewers, the blurring is all ours, online, clear as day what`s going on. That large piece of flesh likely

having been removed from a patient part of a Christmas video.

Dr. Rahben, as a board certified plastic surgeon, your reaction to that?

RADY RAHBEN, M.D., BOARD-CERTIFIED PLASTIC SURGEON: I mean, I got to tell you. This whole thing is outrageous, but sadly it`s quite common. And I

think --.

BANFIELD: Wait, what, common?

RAHBEN: This is very common. Yes, this is very common. I was involved in a similar situation not too long ago. Listen, the world of plastic surgery

is becoming ever, ever more so complicated for patients because the --

BANFIELD: Which part is common? Wait. Which one is common? The fact that she says she`s a dermatologist and performs all these very difficult

and intricate procedures, these surgical procedures, or the fact that she`s dancing on video with a hunk of flesh in the OR during an operation? Are

you saying that is common?

RAHBEN: To be honest with you, it`s all common.

BANFIELD: What?

RAHBEN: Number one, the fact that she is not trained, what we would refer to as a crossover doctor is totally normal now. Patients go in thinking

their doctor is a plastic surgeon, board certified, little do they know that they are a dermatologist or OB-GYN.

BANFIELD: Let me get to that in a minute because that`s a very fair point. And I definitely want to cover that. But go back to what I just said, you

are saying that this is common?

RAHBEN: Yes.

BANFIELD: Because I have never seen this before.

RAHBEN: Yes.

BANFIELD: I have never seen a surgeon in an OR posing with pieces of flesh, showing the nudity of their patients and singing "brick house" over

it like it`s some kind of video and then posting it publicly. I have not seen that before. How can you say that`s common?

RAHBEN: OK. So listen, this is obviously a much greater or more egregious version of it. But if you want snapshot, today, the whole world of

cosmetic surgery is who is more sensationalized? Who can create more shock and excitement? So you go to snap chat doctors are snap chatting, people

posting to Instagram, there is Facebook live. Listen. It`s a great tool if patients are being educated, respected, physicians are acting

professionally. But as you can see in this video and many more it`s just a show. And what it does is it attracts sort of -- it`s like sort of Barnum

and Bailey`s. What it`s doing is it`s attracting sort of the -- I don`t know, the vulnerable patients. You and I look at this --

BANFIELD: I can`t imagine how this is marketing, though. Like I honestly, if you see this --

RAHBEN: She is busy.

BANFIELD: Some people, according to Chloe, you know, want to pull out now that this has been publicized. Actually, that is something I want to ask

you about, Chloe. You have a client who was a patient of Dr. Boutte, and I`m not making up that name. That is how she pronounces her name, Boutte,

and I`m not making up that name. That is how she pronounces her name, Boutte. But sometimes she says I`m Dr. Booty Boo.

Your client went in for Smartlipo and spent 30 days in the hospital. She got flesh eating bacteria, she was - according to the facts that you

present, she was not told to refrain from eating or drinking after midnight. And she vomited and thinks that may have been the flesh eating

bacteria. How is that patient doing now?

CHLOE DALLAIRE: She`s doing OK. Thankfully she recovered fairly well. But she was fighting for her life for 30 days and what ever the cause of

the surgery, she went in to look beautiful and she ended up not only scared but fighting for her life. And unfortunately that`s not the only story we

hear. Susan Witt was on yesterday and had a brain damage patient. So these ladies are coming in to be beautiful, to feel better about themselves

and their coming out and sometimes fighting for their lives and that`s just not right.

Well I tell you what we`re going to take a quick break but when we come back Dr. Ravone(ph) I`m going to ask you to look at a video along side -

actually we can play out(ph) break so that we can all sort of digest this over the break. There is a patient on the table, face down, nudity

showing, the buttocks are - we blurred out. But what was the most disturbing perhaps part of that was that I could hear labored breathing.

Very, very heavy breathing. So I want you to listen to this as we go out to break and I`m going to ask you to analyze what you think might be

happening on the other side of the break.

(BEGIN VIDEO CLIP)

(END VIDO CLIP)

(COMMERCIAL BREAK)

BANFIELD: We are still talking about Dr. Windell Boutte singing and dancing surgeon with at least twice as many YouTube videos as now practice

lawsuits. The question tonight however is whether the shocking content that we have uncovered yesterday and even more today could end up being

used against her in a court of law. And may I just say that we have blurred some of the more sensitive material in these videos but the doctor

sure didn`t.

(BEGIN VIDEO CLIP)

(END VIDEO CLIP)

BANFIELD: And by the way, panel back with me. Those videos were not leaked. Let`s just be real clear these were posted as part of - I mean

this was the plan. Dr. Boutte posted these. She introduces herself, these are what she wanted to have out there online, nudity and all. Chunks of

flesh and all. I am going to say this about some who have come to her defense. Some patients have praised Dr. Boutte, some have said that in

online reviews she`s lovely all though we were contacted by some one who claimed to be a former colleague of hers from 10 years ago saying she was

unprofessional and greedy. Someone else said that Dr. Boutte gave her life, another saying I`m happy with the results. Dr. Boutte has an

excellent back ground. She graduated from UCLA School of Medicine.

She`s been licensed since 1994 so that`s a quarter century of work. She says she a doctor to the stars. We`re not exactly sure what stars. What`s

uncomfortable, Dr. Ravone(ph) is that labored breathing. We went out to break showing a patient who seemed to be heavily sedated while there was

show going on around her and the breathing was so pronounced. I want to play a little bit more of it and get to your reaction to it on the other

side.

(BEGIN VIDEO CLIP)

UNIDENTIFIED PARTICPANT: Our bootay build a butt workshop day. And here you can see this side is not done yet, it`s still flaccid, muscles are not

quite toned. OK, so you know its almost Christmas and the build a butt workshop is - man we are doing it, OK. Today we`ve probably done about

three booties, I would say a Jessica Rabbit, a Nicki Manaj, and just a corporate contour right here. And as you can see baby got back now, OK?

(END VIDEO CLIP)

ASHLEIGH BANFIELD, CNN HOST: Doctor, the breathing really upset me but I`m not a doctor.

DR. RAVONE(ph): Right well, I mean everything about this upsets me and I am a doctor. You know she`s breathing like that because she`s under

conscious sedation, the thing that`s most troubling to someone who operates in a certified accredited environment, is that this is like an office room

converted into procedure room.

So because she`s a dermatologist, she`s not doing this in a bonafide accredited surgery center because she won`t get privileges. So, aside for

the labor breathing which means that she`s sedated heavily, she doesn`t - you know you can hear the beeping in the background of the monitors but the

fact that she`s so distracted, there`s no anesthesiologist present, she`s breaking all sterile protocol by moving her hands behind her back.

None of the things you presented in terms of the horrific outcomes surprises me. I mean, you know what I mean? There`s nothing about this

that surprises me.

BANFIELD: But the way that sterile protocol, you just mentioned, she not only puts her hands behind her back, she puts them below her waist, which

is apparently against protocol. She touches her face.

DR. RAVONE(ph): Everything. Everything.

BANFIELD: She uses a surgical instrument as a horn during brick house.

DR. RAVONE(ph): I mean so none of these things are surprising. I mean if a horse has strips on it it`s a zebra, and the fact of the matter is that

the singing and dancing in it of itself, is not - is problematic to the lay person but it`s all the medical stuff that is overlooked during the time

that she`s dancing around.

BANFIELD: One of Tolli`s(ph) patience vomited on the table but has no recollection of that. So, will these patients all wake up and have no clue

any of this happened with the kind of sedation they`re under?

DR. RAVONE(ph): It depends you can tell that it`s not very well monitored and conscious sedation is a really, really tricky type of anesthesia. It

turns out that conscious sedation is responsible for a lot of the deaths in the United States. People think general anesthesia is dangerous but if you

get general anesthesia you have an anesthesiologist, your air way is protected and you`re under a lot of monitoring.

Conscious sedation is how people like Joan Rivers died and other people because you can see you give her some drugs, there`s a nurse there, and

there is no way to protect her airways. So, when she vomited she aspirated it. So if she`s slightly deep she`ll feel it, if she`s really deep she

won`t remember it. And no one knows what they`re doing.

BANFIELD: Let me get Kenya Johnson in here, a defense attorney, another interesting aspect to this Kenya, is that she`s got two OR`s going at the

same time. That I have heard of before, maybe that`s not necessarily cause for all the alarm but there`s got to be a defense for this woman, what is

it?

KENYA JOHNSON, DEFENSE ATTORNEY: It would be that there could have possibly been a consent form. These are promotional video`s and certainly

a sign of the times. Wilbourne, Georgia is about an hour outside of Atlanta, the new Hollywood of the South. People are wanting to be

discovered and these plastic surgeons are personalities without naming any names, people are looking for these personalities that have been on

television and so I beg to venture that some of the patients actually were drawn to her because of these videos and looking for doctors that are light

hearted and fun and enjoy their job and some may have even asked to be a part of the video.

BANFIELD: I can`t imagine that. I`m just saying I don`t know a lot of women who would like their naked butts being flashed around the screen like

that, nor a chunk of their former butt being dragged through the screen. I have to drop it there guys, thank you so much Tina Douglas, Chloe Dallaire,

Randy Ravone, and Tina I`m going to ask you to stick around for me because I have a story near and dear to my heart.

A woman pulled over for an alleged DUI, says the arresting officer raped her. Little did she know the camera was rolling and wouldn`t you know it,

the camera doesn`t lie.

(COMMERCIAL BREAK)

BANFIELD: It`s easy to see how it went viral. With words like groping and threatening and sexual assault in the headline and the alleged perpetrator

a Texas state trooper. He pulled a driver over south of Dallas who was suspected of driving drunk and that`s where Sherta Dixon-Cole said he

assaulted her. Even allegedly offered to let her off the hook if he could just have sex with her. Sherta Dixon-Cole went to the hospital later that

night, as so many sex assault victims have done before and all this week the only story we`ve known is her terrifying story. But as it turns out

the whole thing was caught on police camera`s and as that turns out there was nothing terrifying at all about it.

(BEGIN VIDEO CLIP)

STATE TROOPER: When I activate my emergency lights, you pull over, OK? You don`t keep going for another three, four miles. Let me see your

drivers license and insurance. How much alcohol did you consume this evening?

SHERTA DIXON-COLE: One.

STATE TROOPER: Just one? What was it?

DIXIE-COLE: Vodka and pineapple.

STATE TROOPER: You are being placed under arrest for driving while intoxicated. I need you to face towards . keep facing towards by car. On

the opinion(ph) you`ve lost the normal use of your vehicle.

DIXIE-COLE: What did I do that was wrong?

STATE TROOPER: Driving while intoxicated.

DIXIE-COLE: I`m not drunk .

STATE TROOPER: OK.

DIXIE-TROOPER: And I`m not .

STATE TROOPER: Based on my observations, both of your driving, your behavior, and your field sobriety test .

DIXIE-COLE: I think it was a combination of me being on the phone with someone.

STATE TROOPER: You can have a seat on those loose chairs. That should be a lot better. All right a deep breath.

STATE TROOPER: Please blow long and steady.

STATE TROOPER: Keep on going, keep on going, keep on going.

(END VIDEO CLIP)

BANFIELD: And soup to nuts that`s what happened. Everything in between was pretty much what you just thought. Even her lawyer has apologized

saying it didn`t happen. And that officer was just cleared of all wrong doing with his department calling the accusation despicable. Meanwhile

Sherita Dixon-Cole was officially charged with DUI. And there certainly could be a few more charges to come. And I spent a little time thinking

this one over today.

And I`ve written an open letter to her. Dear Sherita, you`re not helping. If you hadn`t noticed the rest of the country is wrenching and turning and

churning to a movement that when resolved may just yield a lot of sunshine and goodwill among men and women who are all just trying to get along.

Your false accusation of rape against that cop, your viral cry wolf just brought a dark cloud to our national therapy session. And your category

five damage is not covered by insurance. While you were busy with your twisted rape lie, this was actually a really rough day for a lot of people.

Harvey Weinstein and his accusers may have to ready themselves for sex crime charges any minute now and Americans who have loved and trusted

Morgan Freeman were hit with allegations that he too may have broken the me too code. And when guys like Tom Brokaw and George Bush end up in that mix

it takes the wind out of a lot of people who have loved them deeply for very long time. And they`re not sure how to process all this news.

And sometimes they`re struggling to choose what side to be on. We are all trying to figure out this tangled mess together. And scorched earth is not

the way to do it. If you cheer the demise of men before you hear out the actual evidence, you`re not helping. And if you cast a dispersions on the

accuser simply because you like the accused, you`re not helping. What we need is a honest conversation and a little more understanding about how men

and women treat each other in the workplace and everywhere else. And how times and attitudes have changed over the years.

Today`s prison is different then the one the greatest generation looks through. And that has to enter the equation and to be successful in

bringing us all to the same looking glass hoisting a burning pitch fork, not helping. Yelling louder then your neighbor, not helping. Crying wolf,

well that just scatters the flock. And it sends a lot of lambs to the slaughter. We`ll be right back.

(COMMERCIAL BREAK)

BANFIELD: Sometimes a mishap unexpectedly changes the course of your day. An Illinois man wasn`t about to let that happen to him though. The 80 year

old man was on his way for a trim and accidently crashed into the seafood store, next door while trying to park. This is the point where most of us

would put off the haircut maybe, you know settle the other issues. But he did not. He waltzed right into the salon next door on time for the

appointment, got a haircut. Police did say that he`s diabetic and that might have been the reason he hit the gas instead of the break. The good

news is no one was hurt. Police say the man will not face charges but he is going to be retested for his driver`s license. Nice to see you this

week, thank for watching. See you right back here Monday night 6 p.m eastern. You can listen to our show anytime. Just download our podcast on
