Motion to Move Malvo Case to Juvenile Court Denied

DARYN KAGAN, CNN ANCHOR: Hearing today in Virginia looking at sniper suspect John Lee Malvo on his status, at least in some aspects. as a juvenile. Our Kathleen Koch was in the courtroom as that hearing took place, and she's with us now to tell us what was decided.
Kathleen, hello.

KATHLEEN KOCH, CNN CORRESPONDENT: Well, Daryn, basically, what we heard was these same arguments that were presented here in juvenile court one week ago were rehashed, where Todd Pettit (ph), who has been appointed as Malvo's guardian in the absence of any parent, and he made the argument that Malvo should be held in a juvenile facility, and said just the simple fact that Malvo presents a risk of harm, that that is not enough. He said while he's been in custody, he's shown no real evidence he would harm anyone in a juvenile facility.

But Fairfax prosecuting attorney Robert Horan vigorously argued that indeed Malvo was a flight risk, that he had tried to escape while in Maryland, and that should be held in the adult detention center, which is a much more security facility, and the judge in the case agreed with him.

Now as we're speaking right now, John Allen Muhammad's attorney is in the courtroom right now, that is Peter Greenspun, and he's arguing basically for a gag order to be applied in this case to anyone and everyone who is involved. He filed this motion yesterday in court, and it calls for the -- it targets the Fairfax County prosecuting attorney, the Fairfax police, the FBI, the U.S. attorney, mandating that all of them not speak anymore to the press. Basically in this filing, he called the behavior reprehensible, extreme and outrageous in the leakage of some of the questioning that went on apparently last week of John Lee Malvo -- Daryn.
