CHRISTY PAUL, CNN ANCHOR: Welcome back everyone. As if he needed something else to worry about. A new poll today shows support for California governor Gray Davis is fading. National Correspondent Bob Franken now on duty in Los Angeles has more for us. Hello Bob.
BOB FRANKEN, CNN NATIONAL CORRESPONDENT: Well Christy, it looks like he's in a lot of trouble. Fifty eight percent of those surveyed by the fielding poll -- a well respected poll -- say that 58 percent would want Gray Davis recalled. Only 22 percent supporting him.

Also very notable was the result involving the lieutenant- governor democrat Cruz Bustamonte, it shows he has pulled slightly ahead of Arnold Schwarzenegger who is being viewed by so many people as almost the heir apparent in case Davis is recalled. We have to point out that even though that is quite notable, this is extremely volatile electorate right here. Forty four percent of those involved in this poll say that they are undecided. It is extremely volatile. And of course, Schwarzenegger is just one of the Republicans which is what the fielding people are quick to point out.

(BEGIN VIDEO CLIP)

MARK DICAMILLO, DIRECTOR THE FIELD POLL: There's been a lot of attention to Schwarzenegger and the entire world has been fascinated by his candidacy, but the actually ballot itself with four prominent Republicans on the ballot and really only one prominent Democrat really does favor the Democrat.

If you look at our poll, you will see the preferences of Republicans are divided.

(END VIDEO CLIP)

FRANKEN: And, of course, the field poll person points out that in fact this is split among the Republicans, but if you combine the Republicans, and there is quite a bit of pressure for some of them to drop out, then they are well ahead of the Democrat. This has a long way to go in the field poll and this is just part of the story. One of the things that might have hurt Schwarzenegger is the fact that the person he brought on to help him with financial advice, Warren Buffet, is raising some hackles in California.

He has said that he considers the property tax for personal property, meaning homes, far too low in California. Well, you are talking about the holy grail here. Prosition 13 was passed many years ago, it keeps property taxes down. So a lot of people raising concerns. Certainly many of Schwarzenegger's opponents.

There is also something else to remember, the fact that this is going to be held, an election is going to be hel, on October 7 is not an absolute certainty. There are some court cases there, which raise questions about that. There was a decision by a federal judge yesterday to hold a hearing two weeks from now to decide whether he is going to delay the election because of the fact that officials may not have fully complied with regulations that they deal with the federal government on how they might change things.

There also there's a hearing on Monday for American Civil Liberties Union, a motion to delay the election, because, in fact they are using some discredited punch card ballot machines in California -- Christy.

PAUL: Ok, Bob Franken, live in Los Angeles, we appreciate it Bob, thank you.
