Yee Spends Holidays With Family

CAROL LIN, CNN ANCHOR: The U.S. Army chaplain accused of mishandling classified documents at Guantanamo Bay isn't due back in court until January. A hearing to determine if he will be court marshaled is on hold until then. So he is doing what most US soldiers would do if they could, spending the holiday with his family. Our Rusty Dornin has more on his homecoming from Washington State.

RUSTY DORNIN, CNN CORRESPONDENT (voice-over): He is a man who has been accused by the US government of espionage. But for family, friends and other supporters back home here in Seattle Captain Yousef Yee, a former army chaplain at Guantanamo Bay Is a man unjustly accused.
CHAPLAIN YOUSEF YEE: And I know there are many who have supported me right from the beginning. Right from the beginning when I became three months ago the center of this harrowing ordeal that I find myself in the midst of today.
DORNIN: Yee, a West Point graduate was arrested in September and jailed. Weeks later, the government charged him with illegally transporting classified material but not espionage. He spent 76 days in solitary confinement, finally released in November, he was then also charged with adultery and storing pornographic images on a government computer. Earlier this month at a hearing attended by his wife and family, the government focused on the sex charges.
EUGENE FIDELL, YEE'S ATTORNEY: As for as the adultery is concerned, that is real preposterous in this era to see the criminal process being used for that.
DORNIN: And what about the classified material Yee was supposedly carrying with him, the government wasn't ready to talk about it.
FIDELL: They still hadn't done the required security review to determine for sure that there is anything classified in this case.
DORNIN: The military has refused to discuss the case. Granted leave, he is back home for the holidays in Washington state with his wife and daughter. Yee will be back in military court to continue his hearing January 19. Rusty Dornin, CNN, Seattle, Washington.
