Madelyne Toogood to Be Arraigned Shortly

KYRA PHILLIPS, CNN ANCHOR: Madelyne Toogood has an appointment in court later this hour. She is the mother caught on tape slapping and punching her 4-year-old daughter, and she is to be arraigned on felony child battery charges.
CNN National Correspondent Gary Tuchman now standing by in South Bend, Indiana with more on this case -- Gary.

GARY TUCHMAN, CNN NATIONAL CORRESPONDENT: Kyra, Madelyne Toogood lived a fairly anonymous life until September 13, 2002. That was the day she started beating her little daughter in the backseat of her SUV while a store surveillance camera was taking pictures of her.

Now, the 25-year-old mother is in this building, a courthouse here in northern Indiana, getting ready for her first appearance in court. Thirty minutes from now, she will be arraigned.

She came to the courthouse today with many supporters. She walked down the street with her husband. Also, with her mother, with sisters, and with her two attorneys, her husband is the man on the right, the tall man wearing the Gap shirt.

Who she did not come with, as you might expect, is her 4-year-old daughter, Martha. Martha has been put in foster care for the time being for an indefinite period.

Martha Toogood says she is guilty. She says she did beat her daughter. What she and her attorney are going to hope for is for some mercy for prosecutors and/or the judge.

This morning, she was on CNN's "AMERICAN MORNING." She was asked by Paula Zahn, what led to this.

MADELYNE TOOGOOD, DEFENDANT: ... there is really nothing in my mind that I could say that would lead to this. Martha was just being Martha. She was running, she was getting lost, she was opening up everything in the store. She was jumping from the counter to the stroller. You know, that's just a typical day with Martha. I was probably bickering with my sister, another sister, and my husband that day. But no, nothing that would even have anything to do with Martha.

TUCHMAN: Madelyne Toogood says she is ashamed and very sorry for what has happened. The most important news, her little daughter, Martha, the 4-year-old, who will turn 5 on December 30, is in good medical condition. Madelyne gets the right to visit her once a day under the terms of this foster agreement. She has to have supervision when it happens.

Her first visit since she surrendered on Saturday will be tomorrow.

Once again, her arraignment will start in less than 30 minutes. That is the scheduled time -- Kyra, back to you.
