John Lee Malvo Could Face Adult Charges

KYRA PHILLIPS, CNN ANCHOR: The wheels of justice turning this hour in the case of the teenage sniper suspect. Although he's just 17, John Lee Malvo could face adult charges sending him to his death. It will depend on a hearing that's scheduled to start in about 30 minutes.
CNN's Patty Davis outside the courtroom in Fairfax, Virginia -- Patty.

PATTY DAVIS, CNN CORRESPONDENT: Kyra, that hearing, as you said beginning about 1:30. John Lee Malvo just arrived here in a black van, heavily guarded by sheriffs' deputies, heading in to the courthouse.

Now, prosecutors are expected today to lay out evidence linking John Lee Malvo to a series of sniper shootings here in the Washington D.C. area about three months ago. They're expected to call as many as 20 witnesses.

Now, prosecutors have got to convince a judge today that they have probable cause that John Lee Malvo committed murder. He is charged here in Fairfax County specifically with the murder of 47- year-old FBI analyst Linda Franklin. She was shot once in the head and died in the parking lot of a Home Depot in Falls Church, Virginia, exactly three months ago today.

Now, the judge will also decide today or tomorrow -- this is a two-day preliminary hearing -- if they are not able to complete their work today, the judge will also decide whether or not John Lee Malvo will be tried as an adult since he's only 17 years old now. If convicted, he does face the death penalty in this case.

Now, if the judge is not convinced that there is probable cause, the prosecutors in Virginia could still go directly to a grand jury and ask for his indictment -- Kyra.

PHILLIPS: What about the other suspect, John Muhammad, Patty?

DAVIS: John Muhammad sitting in a jail in Prince William County, a nearby county here in Virginia. He is charged in a different murder, that of Dean Meyers, who was gunned down at a Sunoco station near Manassas, Virginia. His trial date has been set. That is for October 14th -- Kyra.
