Police Seize Additional Evidence From Peterson Home

KYRA PHILLIPS, CNN ANCHOR: We're going to bring our Jeffrey Toobin back in. Now you're looking at pictures via KGO in San Francisco. This is the home of Scott and Laci Peterson. This mystery continues 56 days after Laci Peterson vanished, the pregnant woman married to Scott Peterson. Police are back here where they started, right here, in the home of the Petersons where Laci and Scott both lived. Investigators say they're making headway in this case. They don't want to comment on the second search of the Petersons' home.
Now we have live pictures, I'm told -- you were looking at tape, now live pictures. You can see the detectives with their gloves on, once again, searching the home of Scott Peterson where he and his wife, Laci, lived. You've got detectives going through the pool area, also the garage area. We are told detectives also inside the home. We're also told Scott Peterson is not there. Earlier we had reported he was taken downtown for questioning, that is not the case.

According to our reporter on the scene, she said that Scott Peterson had left the house voluntarily on his own. It was just a few hours ago we got word that police were able to get a search warrant, come back to this home for a second search.

Jeffrey Toobin, our legal analyst with us, following these live pictures, following this story. And once again, Jeffrey, we want to make the point Scott Peterson not being named a suspect here.

JEFFREY TOOBIN, CNN LEGAL ANALYST: Right. The police are very careful to say he is not a suspect but they also say he's not ruled out. It's interesting, Kyra, sort of in recent years, police have become very sensitive about this term suspect, as if it has some real legal significance, which in fact it doesn't.

You recall in the Gary Condit case the police were always saying Gary Condit was not a suspect in the disappearance of Chandra Levy but they hadn't ruled him out either. This is sort of meaningless word play. In fact, obviously, both Scott Peterson and Gary Condit were in an everyday sense of the word "suspects," but it also means that there is no real proof that they did anything wrong and it's worth keeping that in mind.
