No Cameras in Malvo Trial

MILES O'BRIEN, CNN ANCHOR: Sniper suspect Lee Boyd Malvo smiles as he sits beside his alleged coconspirator. Today, the teen is in a more serious setting as his lawyers fight to get him a fair trial.
A judge in Virginia is considering a number of defense motions today. We're watching it with the help of CNN's Patty Davis, joining us live from the courthouse, Fairfax County, Virginia -- hello, Patty.

PATTY DAVIS, CNN CORRESPONDENT: Hi, Miles. Lee Boyd Malvo in his green prison jumpsuit in the courtroom, listening intently as lawyers for both sides spar over more than a dozen motions. Now, so far what the judge has decided is no cameras, television or still cameras, will be allowed in his trial, which is set for November 10.

Also, the judge has ruled that prosecutors must turn over any problems that they ran into with their forensic evidence. Fingerprinting problems, things like that. Also, any credible leads that police stopped pursuing after the arrests were made have to be turned over so that the defense can follow up on that.

There will be a limited number of uniformed officers allowed in the court, probably right around six, as they are now. The defense had argued in a motion that the jury could be tainted by that, perhaps thinking if there were too many police officers, an excessive number around Malvo, that indeed, that he was a danger to them, and the defense did not want that.

Malvo's defense team will be allowed to hire three investigators to help them. They had originally asked for five, but the judge allowing them to hire three.

Now, Malvo has been charged in the murder of 47-year-old Linda Franklin. She was gunned down as she came out of a Home Depot. She was gunned down as she was loading her car, along with her husband, on October 14 of last year. He's charged in her murder, and that is the focus of all of the proceedings here to date -- Miles.
