KYRA PHILLIPS, CNN ANCHOR: Gagging Gloria? Well the defense lawyer for Scott Peterson is filing a new notion to gag noted attorney Gloria Allred and cite her for contempt of court. Peterson is charged with murder in the death of his wife, Laci, and their unborn son.
CNN's Rusty Dornin live in Modesto, California, with the details on the latest development. Hi, Rusty.
RUSTY DORNIN, CNN CORRESPONDENT: Well, Kyra, over the weekend, attorney Mark Geragos filed a motion. He wants the whole gag order revoked anyway. But he also sites Gloria Allred, who is the attorney for Amber Frey, the woman who did have an affair with Scott Peterson, he says she should be cited with contempt of court because he claims five hours after the gag order was instituted, that Allred was on a cable TV show talking about the case. Now he says that he was talking -- she was talking outside of the court expressing an opinion, and Geragos himself can't respond because of the gag order.
Now, I did speak to Gloria Allred just a couple of hours ago. She says this is purely an attempt to silence her. That it was absolutely no merit. That she never said that Scott Peterson was guilty. She does not feel that she is covered by this gag order in any way.
And she's always said it's been up for the jury to decide. Now, Geragos would like to see both of these issues addressed on June 26, which is the next time both sides will be back in court. We are understand, also, that Allred will be filing some other papers in relation to her response to the court sometime today.
In some other papers that were filed, it looks like there was another search warrant conducted a couple of weeks ago on the Mobil cell company. Now, those communications now are also under seal, at least conditional. Another judge -- a third judge in this case, has put that search warrant under seal as well. So it looks like we're not going to be able to be seeing any of these arguments in court until June 26. Kyra?
PHILLIPS: All right. Rusty Dornin. We'll be following it. Thank you.
