Martha Stewart Trial: the Date is Set

KATE SNOW, CNN ANCHOR: Mark your to-do calendars. Martha Stewart's trial date has been set. The domestic diva's court appearance today offered a taste of the media hoopla and legal wrangling to come.
CNN's Allan Chernoff is in New York -- Allan.

ALLAN CHERNOFF, CNNfn CORRESPONDENT: Well, January 12 is the date for Martha Stewart's trial. Judge Mariam Cedarbaum (ph) setting that date this morning at a scheduling hearing. And the two sides will submit motions prior to then, they'll have an opportunity for oral arguments on November 18. But the big date is set for January 12.

Legal analysts say it's not terribly unusual to have to wait six to seven months. And as you see there, Martha Stewart departing court. She even waved to a few supporters and photographers as she did leave court today.

Now, the bulk of the argument inside of the courtroom dealt with the extent of the evidence that the defense has had an opportunity to have a look at. Martha Stewart's main attorney, Robert Morevilleo (ph), says he believes he's only seen 5 percent of the government's evidence against Martha Stewart. He said there are as many as 30 boxes of evidence that he has yet to examine. The attorney for Martha Stewart's co-defendant, Peter Baconvic, the former broker from Merrill Lynch, they -- his attorney says that he believes there's as many as 40 boxes plus 15 computers that need to be examined.

So the attorneys for the defense essentially saying, "We need time to review the evidence," and therefore the judge setting January 12 as a trial date.
