KYRA PHILLIPS, CNN ANCHOR: An ex-Marine accused of child abduction faces a German court. Toby Studabaker told the judge he will not fight extradition to England, where he faces charges in the abduction of 12-year-old Shevaun Pennington.
Our Stephanie Halasz is in Frankfurt, joins me now live with the latest -- Stephanie.

STEPHANIE HALASZ, CNN CORRESPONDENT: Hi, Kyra.

Well, that's correct, Toby Studabaker saw the investigative magistrate for about 10 minutes today, and he told the judge that he did not have sexual relations with 12-year-old girl Shevaun Pennington. He also told the judge that he did not know the girl's age. He believed her to be 18, not 12.

This is basically what he said happened, he flew from Michigan to Manchester last week. He met up there with the 12-year-old girl that he thought was 18, a girl with whom he had had an intense e-mail relationship with over the last year. They then flew to Paris together, and went from there to Straussberg (ph), a French town on the French/German border. There, over the last couple of days, Studabaker read in a newspaper that he was being looked for, as well as the girl, and that Shevaun was indeed only 12 years old. He then called the FBI in the United States and asked them for advice on what he should do, and the FBI advised him to travel to Frankfurt here where we are and hand himself over to authorities.

Studabaker took the girl to Stuttgart (ph), a German town on the way. He put her on a plane back to Manchester, and traveled on to Frankfurt, where he was arrested yesterday, early afternoon, near the U.S. consulate here -- Kyra.
